LAKE ELMO CITY COUNCIL MINUTES
OCTOBER 2, 1990
Mayor Dunn called the City Council meeting to order at 7:04 p.m. in
the City Council chambers. Present: Dunn, Williams, Graves,
Armstrong, City Engineer Larry Bohrer, City Attorney Steve Carlson and
City Administrator Kuef.fner. Absent: Councilman Hunt.

2. MINUTES: September 18, 1990
M/S/P Graves/Williams - to approve the September 18, 1990 City Council
minutes as amended. (Motion carried 3-0-1 Abstain: Armstrong).

5. REAPP REPORT
Todd Williams reported REAPP has not had a meeting since the last
Council meeting.
6. CITY ENGINEER'S REPORT:
A. Assessment Hearings:
1. Lampert Avenue (32nd Street to 33rd Street)
Mayor Dunn opened up the public hearing at 7:37 p.m. in the City
Council chambers. The public hearing notice was published in the St.
Croix Valley Press and all affected property owners were notified.
Larry Bohrer, City Engineer, provided assessment tabulations for the
patch and overlay projects for Lampert Avenue and for 31.st Street.

Bohrer reported Wilmer and Harriett Arndt, 3315 Lampert Avenue, were
inadvertently missed for the individual mailed notices for the Lampert
Avenue hearing, and they cannot be assessed without proper
notification. Bohrer suggested holding a separate hearing on October
16 to levy the Arndt's assessment.
Mayor Dunn closed the public hearing at 7:42 p.m.
M/S/P Graves/Williams - to adopt Resolution No. 90-31 Adopting
Assessment for the Improvement of Lampert Avenue from 32nd Street to
33rd Street and passing the assessment of $694.56 per lot to each
benefitting property owner. (Motion carried 4-0).
M/S/P Williams/Graves - to call an Assessment Hearing on Lampert
Avenue Street Improvements for Wilmer and Harriett Arndt, 3315 Lampert
Avenue, at 7:30 p.m. on October 16, 1990. (Motion carried 4-0).
2. 31st Street (Stillwater. Boulevard to TH5)
Mayor Dunn opened up the public hearing at 7:45_p.m. in the City
Council chambers. The public hearing notice was published in the St.
Croix Valley Press and all affected property owners were notified.
Larry Bohrer submitted the final assessment tabulations for 31st
Street (Stillwater Boulevard to TH5) Bituminous Patching and Overlay.
Construction Cost $22,946.44
Engineering 3,710.00
Administration 690.00
Total Cost $27,346.44
Less 1990 MSA Mtnc Funds-$22,946.44

Bill Hughes, 9038 31st St., asked if the grass seed should be
compacted. Bohrer responded the shoulder was too narrow to mulch;
therefore, loose seeding seems to work.
Gloria Knoblauch voiced her appreciation on the new overlay, but noted
some of the residents on her street felt the state funds should be
spent on TH 5.

Mayor Dunn closed the public hearing at 7:54 p.m.
M/S/P Williams/Graves - to adopt Resolution 90-32 Adopting Assessment
for the Improvement of 31st Street from Stillwater Boulevard to TH5
and passing on the assessment of $200.00 per lot to each benefitting
property owner. (Motion carried 4-0).
B. Partial Payment No. 2 to T.A.. Schifsky & Sons for MSA Work
on 15th Street - $69,400.1.6
Larry Bohrer reported the bituminous surfacing and shoulder surfacing
is now complete on 15th Street. The work remaining includes final
ditch grading, seeding and mulching. Bohrer recommended payment of
Estimate and Certificate No. 2 to T.A. Schifsky and Sons in the amount
of $69,400.3.6.
M/S/P Williams/Graves - to approve Partial Payment No. 2, for MSA Work
on 15th Street to T.A. Schifsky & Sons in the amount of $69,400.16
based on the recommendation of the City Engineer. (Motion carried
3-0-1: Abstain: Armstrong).
C. Fire Protection Update
Larry Bohrer reported, at the last Council meeting, direction was
given to contact Oakdale regarding an amendment that would allow for
the Lake Jane landfill area fire protection, if the City chooses, to
be added to the water system. A proposed amendment was provided and
was passed by the Oakdale City Council. Oakdale agrees to furnish and
deliver to Lake Elmo from the water supply system of: Oakdale the fire
flow of up to 1000 gpm for fire suppression emergencies. Bohrer
recommended holding a. new public hearing on October 16th for fire
protection outside of the well. advisory area.
M/S/P Graves/Williams - to direct the City staff to call a public
hearing for 7:35 p.m. during the October 16th City Council meeting to
discuss expanding the capacity of the Lake Jane Well Advisory Area
water system for fire protection only according to the revised plans
of extending the distance between fire hydrants and enlarging the area
outside of the well advisory area that would benefit from the upgraded
system. The estimated cost per lot is $41.5. (Motion carried 4-0).
Former Fire Chief Fran Pott suggested that the Council further reduce
the cost for fire protection by eliminating $30,000 for. shut -off -
valves. The valves, according to Bohrer, would allow maintenance and
repair work on portions of the system without shutting down the entire
utility.

D. Request for Street Light Study on 39th Street and Cty Rd 17
The Council received a letter from Roger Knutson, Lake Elmo Bank,
indicating their concern on a potential safety hazard at the point
where 39th Street North joins County Road 17 (Lake Elmo Avenue). They
are requesting the City place a street light at this intersection
because they feel it is difficult for drivers turning out of 39th
Street onto County Road 17 or onto 39th Street from County Road 17
after dark.
Larry Bohrer will review this street light request for 39th Street and
County Road 17 and report back to the Council at the next meeting.
7. CITY ATTORNEY'S REPORT:
Attorney Carlson referred to the monthly litigation report and pointed
out the trial with Federal Land will be held on Friday, October S,
1990. The appeal brief on Section 32 (first petition) is due October
24th.
8. CITY COUNCIL REPORTS:
Mayor Dunn announced the Lake Elmo Volunteer Fire Dept. will hold an
open house on October 13th from 10 a.m. to 2 p.m. Also the Lake Elmo
Fire Auxiliary will hold a bake sale and ga.rage/craft sale at the Fire
Hall on Sat. Oct. 13th.
Mayor Dunn thanked all who participated in the joint Woodbury/Lake
Elmo Hazardous Waste pick up.
9. CITY ADMINISTRATOR'S REPORT:
A. First City Council Meeting in November
The first City Council meeting falls on November 6th which is General
Election Day. State Law prohibits us from holding a council meeting
until the polls close at 8:00 p.m. The Council has the choice of
either meeting at 8:00 or having our regular meeting on November 8th
since we have to meet on this day anyway to canvass the election
returns.
M/S/P Williams/Armstrong - to reschedule the first City Council
meeting from November 6th, which is General Election Day, to Thursday,
November 8th at 7:00 p.m. (Motion carried 4-0).

B. Budget
The Council discussed the 1991 Pay Plan which was recommended by the
Personnel Committee. (See Attachment A)
M/S/P Graves/Armstrong - to approve the 1991 pay plan as recommended
by the Personnel Committee. (Motion carried 3-0-1: Williams indicated
he had no argument with the job that the Finance Director has done,
but wanted the 24% pay increase spread over a 2 year period and the
increase of the Clerk -Typist changed to 100.)
The Council asked the Finance Director to summarize the CIP's and
points of discussion from the Budget workshop.
C. Memo from D.N.R.
The Administrator reported that in 1991 the City will be asked to
revise our ordinance to incorporate the new DNR shoreland regulations
at the DNR.'s expense. In the meantime the DNR felt the City can issue
any shoreland permits directly where no variances are required.
D. Letter from Browns Creek Watershed
The Council received a letter from Nile Kriesel, Secretary, BCWMO,
requesting a primary and an alternate representative from the Browns
Creek WMO in Lake Elmo. There is a very small portion of the City in
this Watershed. The Council asked the staff alert the public of the
need for a representative on the BCWMO through the newsletter and
cable TV.
E. Administrator's Performance Evaluation
The Council was asked to submit their comments to Councilmen Graves or
Hunt.
F. Agreement for Auditing/Accounting Services for 1990/91:
Voto, Tautges, Redpath & Co. Ltd.
The Council received a copy of an Agreement for Auditing/Accounting
Services for 1990/1991. This contract is similar to last year's
contract except for rate changes necessitated by general economic
factors. Rates have increased an average of 5%.
Councilman Williams indicated the firm has given satisfactory
performance for years, but suggested we investigate other firms which
could give us the same service for less money. The majority of the
Council indicated they were happy with the services of this firm and
if a new f_irm's bid came in lower, it would take more staff time and
expense to bring the firm up-to-date.

G. Red Ribbon Campaign
I
The Third Annual Red Ribbon Week, October 21-28, 1990, is sponsored
locally by the Community Prevention Project of Human Services, Inc. in
Washington County. Red Ribbon Week is part of a national campaign of
the National Federation of Parents for Drug Free Youth. The Council
supported the goal of Red Ribbon Week which is to present a visible
and unified commitment to reduce and prevent the abuse of alcohol and
other drugs.
H. Request by Elmo View Townhouse Association
The Council received a letter from Charles Kent, President of Elmo
View Townhouse Assoc., requesting a refund of property taxes ($635.44)
on property the city acquired for the 201 Project on September 22,
1986, but the deeds did not get filed until the following year. (See
Letter dated June 18, 1990).
M/S/P Graves/Armstrong - to authorize a reimbursement of property
taxes in the amount of $635.44 to the Elmo View Townhouse Association.
(Motion carried 4-0).
I. Letter from Mayor of Ham Lake on HUD -FHA loans
in Metro Rural Area
At the last meeting, the Council received a letter from Marilyn
Schultz, Mayor of Ham Lake, requesting support for reversal of the
recently imposed exclusion from FHA loan approval in our area for
homes on less than 10 acres. The Administrator offered. a Resolution
for Council approval.
M/S/P Graves/Armstrong - to adopt Resolution No. 90-33, A Resolution
Requesting Relief from the Federal Housing Administration (FHA)
Requirement to Meet the Metropolitan Council General Rural Use Density
Policy; contingent on the City Attorney's approval. (Motion carried
4-0).
M/S/P Williams/Graves - to adjourn the City Council meeting at 9:35
p.m. (Motion carried 4-0).

TO WHOM IT MAY CONCERN:
Notice is hereby given that the Lake Elmo City Council will meet at
7:30 p.m. on Tuesday, October 16, 1990 at the City Hall to pass upon
the proposed assessment for Bituminous Patching and Overlay
Construction on the following streets:
Lampert Avenue from 32nd Street to 33rd Street.
The area proposed to be assessed for the improvements is each parcel
which abuts the streets or is benefitted by the improvements.
The amount to be specially assessed against your particular lot, piece
or parcel of land is $ 694.56 You may at.anytime prior to
certification of the assessment to the county auditor,'pay the entire
assessment on such property, with interest accrued to the date of
( payment, to the City of Lake Elmo. No interest shall be charged if
the entire assessment is paid within 30 days from the adoption of this
assessment. You may at any time thereafter, pay to the City of Lake
Elmo the entire amount of the assessment remaining unpaid, with
interest accrued to December 31 of the year in which such payment is
made. Such payment must be made before November 15 or interest will be
charged though December 31 of the succeeding year. If you decide not
to prepay the assessment before the date given above, the rate of
interest that will apply is 8 percent per year over five years.
The proposed assessment roll is on file for public inspection at the
city clerk's office. The total amount of the proposed assessment is
$10,475.00. Written or oral objections will be considered at the
meeting. No appeal may be taken as to the amount of an assessment
unless a signed, written objection is filed with the clerk prior to
the hearing or presented to the presiding officer at the hearing. The
City Council may upon such notice consider any objection to the amount
of a proposed individual assessment at an adjourned meeting upon such
further notice to the affected property owners as it deems advisable.
An owner may appeal an assessment to district court pursuant to
Minnesota Statutes 429.081 by serving notice of the appeal upon the
Mayor or City Clerk of the city within 30 days after the adoption of
the assessment and filing such notice with the District Court within
ten days after service upon the Mayor or Clerk.

Notice is hereby given that the City Council of Lake Elmo will meet in the Council Chambers of
the City Hall at 7:35 P.M. on Tuesday, October 16, 1990, to consider the addition of fire
protection capabilities to the public water supply system to be installed to the area affected by
Washington County Landfill No. 1. The fire protection improvements would be made pursuant
to Minnesota Statutes, Sections 429.011 to 429.111.
The areas proposed to be assess for fire protection are the areas which abut the following streets:
Ideal Avenue from 40th Street to Lake Jane Trail
Lake Jane Trail from Ideal Avenue to 42nd Street;
Lake Jane Trail from 42nd Street to 1000 feet north;
42nd Street from Lake Jane Trail to Jamaca Avenue;

Ivy Court;
Jamaca Avenue from Lake Jane Trail to TH5;
Jamaca Court;
36th Street from Jamaca Avenue to Irwin Avenue;
37th Street from Jamaca Avenue to Irwin Avenue;
Irish Court;
Irvin Circle;
and that part of the SW 1/4 of Section 15 lying north of TH5.
The estimated cost of fire protection improvements is $66,000.00. The estimated cost per lot is

Dear Mayor and Council:
At the last Council Meeting, the Council received a request from Lake Elmo State Hank to install
a street light at the intersection of. 39th Street North and Lake Elmo Avenue. This matter was
referred to the Engineer, The following is our report.
We have contacted Mark Mattson, Assistant County Engineer, and discussed the need to increase
visibility at that intersection. Based on that conversation, the County will install a standard
cylindrical reflector on the existing stop sign post on 39th Street. The County will also study
whether large (2' x 3') advance street name signs should be installed north and south of the
intersection on Lake Elmo Avenue.
We also contacted Ron Helfman from NSP and asked if there would be an installation charge for
a street light at that location. As of this writing, Mr. Helftnan has not estimated the cost but it
should be available at the meeting.
In conclusion, the safety of the intersection would be enhanced by adding the 360 reflector on
the stop sign and the erection of advance signs and/or it street light. The County will not have an
answer on the advanced signing for a month or so because of the recent heart attack of their
Traffic Engineer, Larry Bousquet. We will be present at the October 16 council meeting to
discuss this In more detail.

plans or controls have not been adopted is annexed to a municipality, the governing
body of the municipality may adopt an interim ordinance applicable to all or part of
its jurisdiction for the purpose of protecting the planning process and the health, safety
and welfare of its citizens. The interim ordinance may regulate, restrict or prohibit any
use, development, or subdivision within the jurisdiction or a portion thereof for a
period not to exceed one year from the date it is effective, and may be extended for such
additional periods as the municipality may deem appropriate, not exceeding a total
additional period of 18 months. No interim ordinance may halt, delay, or impede a
subdivision which has been given preliminary approval prior to the effective date of
the interim ordinance.

462.356 PROCEDURE FOR PLAN EFFECTUATION; GENERALLY.
Subdivision 1. Recommendations for plan execution. Upon the recommendation
by the planning agency of the comprehensive municipal plan or sections thereof, the
planning agency shall study and propose to the governing body reasonable and practica-
ble means for putting the plan or section of the plan into effect. Subject to the
limitations of the following sections, such means include, but are not limited to, zoning
regulations, regulations for the subdivision of land, an official map, a program for
coordination of the normal public improvements and services of the municipality,
urban renewal and a capital improvements program.
Subd. 2. Compliance with plan. After a comprehensive municipal plan or section
thereof has been recommended by the planning agency and a copy filed with the
governing body, no publicly owned interest in real property within the municipality
shall be acquired or disposed of, nor shall any capital improvement be authorized by
the municipality or special district or agency thereof or any other political subdivision
having jurisdiction within the municipality until after the planning agency has reviewed
the proposed acquisition, disposal, or capital improvement and reported in writing to
the governing body or other special district or agency or political subdivision con-
cerned, its findings as to compliance of the proposed -acquisition, disposal or improve-
ment with the comprehensive municipal plan. Failure of the planning agency to report
on the proposal within 45 days after such a reference, or such other period as may be
designated by the governing body shall be deemed to have satisfied the requirements
of this subdivision. The governing body may, by resolution adopted by two-thirds vote
dispense with the requirements of this subdivision when in its judgment it finds that
the proposed acquisition or disposal of real property or capital improvement has no
relationship to the comprehensive municipal plan.

Subdivision 1. Authority for zoning. For the purpose of promoting the public
health, safety, morals and general welfare, a municipality may by ordinance regulate
on the earth's surface, in the air space above the surface, and in subsurface areas, the
location, height, width, bulk, type of foundation, number of stories, size of buildings
and other structures, the percentage of lot which may be occupied, the size of yards and
other open spaces, the density and distribution of population, the uses of buildings and
structures for trade, industry, residence, recreation, public activities, or other purposes,
and the uses of land for trade, industry, residence, recreation, agriculture, forestry, soil
conservation, water supply conservation, conservation of shorelands, as defined in
section 105.485, access to direct sunlight for solar energy systems as defined in section
116J.06, flood control or other purposes, and may establish standards and procedures
regulating such uses. No regulation may prohibit earth sheltered construction as
defined in section 116J.06, subdivision 2, or manufactured homes built in conformance
with sections 327.31 to 327.35 that comply with all other zoning ordinances promul

7:40 p.m. in the Council Chambers. Present: DeLapp, Conlin, Dick
Johnson, Bucheck, John, Thomas, Enes, Arkell, Stevens, Johnston
(arrived 8:00), City Planner Mike Black, Administrator Mary Kueffner.

and drainage plans, landscape plans, and until this Ordinance is
completed Kolstad cannot plan how wide the streets must be or what
kind of sewer system is required.

3B. Bob Mogren: Request to move a Manufactured Home
Bob Mogren, 8738 Lake Jane Trail, of Mogren Bros., is requesting
approval to move a manufactured home into Lake Elmo as a residence for
the person that is the watchman for their sod fields. The location is
just south of Oakland Jr. High school on Manning Avenue. The
manufactured home will be placed on an old house site among existing
out buildings and trees. The watchman has been working for Mogren for
15 years and has kept such vandalism as snowmobiles, three wheelers,
horses, cars and parties from ruining the sod fields. Mogren brought
photographs of the trailor and proposed site to show the Commission.

Chairman DeLapp suggested the Commission look at Ordinance Code
502.070 C. page 502-2 and 302.030 page 302-2 and the zoning of the
property as the only three items to be considered. Commissioner
Johnson directed the Chairman's attention to page 301-74 & 75 of the
code book which contradicts Jim McNamara's written statement that
there are no other dwelling units on the property and no variances are
necessary, and in Commissioner Johnson's interpretation of this code a
variance would be required.
Chairman DeLapp interpreted in a recent phone conversation with Jim
McNamara, City Building Inspector, that there is a state statute that
will override our Ordinance. The Commission suggested that this be
verified and brought to the City Council's attention.
Administrator Kueffner asked that the Commission also consider what
the proposed use is exactly. If it is going to be used as a business
operation, is this allowed in RR zoning district or should this land
be reclassified as Agricultural? The point being that if Mogren
occasionally sells sod at the site to homeowners retail, by code, this
is allowed in the Agricultural Zone and not the Rural Residential Zone
regardless of how many acres owned, but a Conditional'Use permit could
be issued if re -zoned to Ag.
Chairman DeLapp made a list of conditions that this request does not
meet: (1) not part of a Manufactured Park, (2) Need verifcation that
site meets zoning district requirements (zoned RR), (3) does not meet
code 301.030 O.
Commissioner Johnson suggested that the Commission get a legal opinion
on this in order to base a decision. Chairman DeLapp suggested
another alternative would be to state the Commissions findings and
concerns and then pass this onto the City Council without making any
recommendations.
Vice -Chairman John suggested the Commission report to the City Council
the following facts: (1) the property is currently zoned RR, yet the
site plan of the proposed area is only 5 acres, (2) If the land were
to be re -zoned Agricultural the dwelling could be considered a farm
dwelling, but this would require re -zoning, (3) the Ordinances
covering temporary farm dwellings prohibits the proposed use as a
temporary dwelling.
Commissioner Stevens stated the consensus seems to be that the
Commission would like to enable Mr. Mogren to have a watchman on his
property and suggested the Commission request a legal opinion as to
what conditions will enable Mr. Mogren to do this.

storage site without a safeguard, or that any existing safeguard
is inadequate, he.may order the owner of other responsible person
to immediately remove the manure from the storage site and refrain
from further storage or keeping of any manure thereat unless and
u-*-il an adequate safeguard is provided.

4. Hazards and Nuisances. On parcels of less than forty
(40) acres whicn are not part of a larger crop producing commer-
cial agricultural farm, the keeping of horses, cattle, or other
grazing animals on a site with less than two and one-half (2Z)
acres of existing grazable land per animal is hereby declared
to be a n-iisance. No domestic animals, livestock, or kennels
shall be placed on any site of less than ten (10) acres.
5. Grazable acres. Grazable acreage shall be defined
as open, nontreed acreage currently providing enough pasture
or other agricultural crops capable or supporting summer graz-
ing at a density of one (1) cow, or its equivalent, per two and
one-half (2 ) acres. For purposes of these regulations, the
following animal equivalents apply; one slaughter steer, heifer,
or horse - 1.0; one mature dairy cow - 1.4; one swine over 55

A permit shall be required for the excavation, grading or surfacing
for any building, structure, plot or area of ground occupied by a
building or structure, or in preparation for the construction of any
building or structure where such excavation and grading is to be done
with mechanical equipment. (See Section 105 of this Code.)

PRIVATE' ROAD PERMITS
A permit shall be required to construct an asphalt, concrete, or
gravel private road or alley. (See Section 1602 and Section 105
of this Code.)

MOVING BUILDI,IGS INTO- CITY
A. Buildings or structures moved from one location to
another shall comply with the provisions of this code
for new buildings.
B. Where the Building Official is required to inspect a
building outside of the City, any travel expense shall
be paid by the applicant. Building mover must present
a State license for house and building moving to the
Building Official when applying for permit to move a
building.
C. Before any house or other structure is moved onto a lot or
parcel in the City of Lake Elmo, the owner shall apply for
a building permit. The Building Official shall present the
site plan, construction plans, and photos of the structure
from two or more angles to the Planning Commission. The
Planning Commission shall report to the City Council
whether or not the structure will be compatible with
other development in the area; and make such recommendation
to the City Council. If the City Council determines the
structure would depreciate the area into which it is to be
moved, it may withhold the permit for such relocation.
502.080 BUILDING DEMOLITION FEES
All buildings or structures prepared for. demolition t_rithin the City of
Lake Elmo require a demolition permit. -(.See Section 105 of this Code.)

All residential buildings shall have the exterior finished within one
(1) year of the date their permit was issued.

A. Manufactured Home. A Structure, transportable in one or
more sections, which Ln the traveling mode, is eight body feet or
more in width or 40 body feet or more in length, or, when erected
on site, is 320 or more square feet, and which is built on a pe*-a-
anent chassis and designed to be used as a dwelling with or wthout
a permanent foundation when connected to the required utilities,
and includes the -)lumbing, heating, air conditioning, and electrical
systems conuained therein; except that the term includes any
structure which meets all the requirements and with respect to
which the manufacturer voluntarily files a certification required
by the secretary and complies with the standards established under
the Minnesota Statutes Chapter 327.31, Subd. 3. No manufactured
dwelling shall be moved into the City of Lake Elmo that does not
meet the manufactured home building code as defined in Minnesota
Statutes Chapter 327.31, Subd. 3. This does not include recrea-
tional vehicles as regulated iri Section 301.130 Q & R, of this
code.
B. Manufactured Home Park. Any site, lot, field, or tract
of land upon which two or more occupied manufactured homes are
located, either free of charge of for compensation, and includes
any building, structure, tent, vehicle or enclosure used or in-
tended for use as part of the equipment of the manufactured home
park.
C. Manufactured Home Lot. A parcel of land for the placement
of a single manuracture home and the exclusive use of its occupants

This easement was granted to the City on the condition that
grantee (the City) construct and maintain a split rail
fence on both sides and the full length of said easement
and on further condition the City improve the walkway with
gravel on its full length.
Before proceeding with this improvement, the City would like
comments from adjoining property owners on whether or not
they would prefer a bituminous walkway, as opposed to a
gravel walkway that is stipulated in the easement granted to
the City,

Re: DeMontreville Easement
Dear Mary:
I reviewed your facsimile transmition of February 28, 1990 in which you address
the issue of change in the conditions of the walkway easement through Lot 14,
Block 3 DeMontreville Highlands 4th Addition. By virtue of the original quit
claim deed, this is an express grant of easement in favor of the City. As a
rule of law, when an easement is by express grant, its extent depends entirely
on the construction of the terms of the grant. Only when ambiguities exist, may
the circumstances surrounding the grant be considered by the courts. As the
language of the grant becomes less precise, the circumstances of the grant grow
in importance as an interpretive aid. The law, however, requires that a grant
of an easement is to be strictly construed. It is apparent that there are no
ambiguities in the grant of this particular easement. The easement is specific
as to its extent and its purpose. The easement in question is also specific as
to the type or nature of improvements that are allowed on the easement.
Generally when an easement has once become fixed, there can be no material
alteration except by an agreement by the owners of the dominant and the servient
tenets. In this case the servient tenet is the current landowner of Lot 14,
Block 3 DeMontreville Highlands 4th Addition and the dominant owner is the City
of Lake Elmo. Therefore any "material alteration" of the easement must be bet-
ween the agreement of these two parties. However, the question then arises as
to whether or not the paving of a presumed gravel walkway path is a material
alteration. The 1956 case of Thomas v. Mrkonich 247 MN 481, 78 N.W.2nd 386
(1956) held that the right to make an alteration in easement is dependent on the
extent of the proposed change. If a change is not so substantial as to result
in the creation or Substitution of a new and different servitude, it will not be
held objectionable. It is my opinion that to pave what is intended as a gravel -
topped walkway path would not be a substantial change which would create a new
or different servitude.

However, the City must also consider the cost of the dispute with the landowner

public water being put in for some homes.
We are being asked to pay $415.00 to benefit the people living;
along the water supply route.
We live on Deer Pond Trail and believe the project will benefit
us in only a very minimal way, if at all.
We are still paying off a. water level control assessment which
did not appreciably benefit us since we do not live on a lake
or pond..

Project: EIS Review for Proposed Landfill Site G in Lake Elmo

Activities Undertaken During the Reporting Period
Activities conducted during the current reporting period consisted primarily
of project administration (i.e., reporting on project status and com-
munication with project staff, subcontractor, and ReAPP) and a visit to Site
G on 8/15/90 to review and photograph the placement of helium balloons used
to assess the visual impacts of the proposed landfill final contours.
Although subcontractor labor and expenses for June, July, and August are not
included on this invoice, Geraghty and Miller staff have been gathering
background information, reviewing maps, and setting up input files for the
groundwater flow model as part of the analytical groundwater modeling task.
Activities Anticipated Next Month
During the month of September, Geraghty and Miller will continue their ground-
water modeling analysis of the proposed landfill vicinity. Other activities
will be prioritized following consultation with the City, ReAPP, and their
attorneys based on the County's progress with the health risk memo, landfill
design specifications, and draft EIS report.
Chanqes in Personnel and Schedule
No changes in personnel are anticipated. It is the project team's
understanding that the draft EIS is delayed approximately six months from the
schedule presented in the last Progress Report from the County.

OCTOBER 2, 1990
Mayor Dunn called the City Council meeting to order at 7:04 p.m. in
the City Council chambers. Present: Dunn, Williams, Graves,
Armstrong, City Engineer Larry Bohrer, City Attorney Steve Carlson and
City Administrator Kueffner. Absent: Councilman Hunt.

A. Assessment Hearings:
1. Lampert Avenue (32nd Street to 33rd Street)
Mayor Dunn opened up the public hearing at 7:37 p.m. in the City
Council chambers. The public hearing notice was published in the St.
Croix Valley Press and all affected property owners were notified.
Larry Bohrer, City Engineer, provided assessment tabulations for the
patch and overlay projects for Lampert Avenue and for 31st Street.

Bohrer reported Wilmer and Harriett Arndt, 3315 Lampert Avenue, were
inadvertently missed for the individual mailed notices for the Lampert
Avenue hearing, and they cannot be assessed without proper
notification. Bohrer suggested holding a separate hearing on October
16 to levy the Arndt's assessment.
Mayor Dunn closed the public hearing at 7:42 p.m.
M/S/P Graves/Williams - to adopt Resolution No. 90-31 Adopting
Assessment for the Improvement of Lampert Avenue from 32nd Street to
33rd Street and passing the assessment of $694.56 per lot to each
benefitting property owner. (Motion carried 4-0).
M/S/P Williams/Graves - to call an Assessment Hearing on Lampert
Avenue Street Improvements for Wilmer and Harriett Arndt, 3315 Lampert
Avenue, at 7:30 p.m. on October 16, 1990. (Motion carried 4-0).
2. 31st Street (Stillwater Boulevard to TII5)
Mayor Dunn opened up the public hearing at 7:45 p.m. in the City
Council chambers. The public hearing notice was published in the St.
Croix Valley Press and all affected property owners were notified.
Larry Bohrer submitted the final assessment tabulations for 31st
Street (Stillwater Boulevard to TH5) Bituminous Patching and Overlay.

Bill Hughes, 9038 31st St., asked if the grass seed should be
compacted. Bohrer responded the street was too narrow to mulch;
therefore, loose seeding seems to work.
Gloria Knoblauch voiced her appreciation on the new overlay, but noted
some of the residents on her street felt the state funds should be
spent on TH 5.

property owner. (Motion carried 4-0).
B. Partial Payment No. 2 to T.A. Schifsky & Sons for MSA Work
on 15th Street - $69,400.1.6
Larry Bohrer reported the bituminous surfacing and shoulder surfacing
is now complete on 15th Street. The work remaining includes final
ditch grading, seeding and mulching. Bohrer recommended payment of
Estimate and Certificate No. 2 to T.A. Schifsky and Sons in the amount
of $69,400.16.
M/S/P Williams/Graves - to approve Partial Payment No. 2, for MSA Work
on 15th Street to T.A. Schifsky & Sons in the amount of $69,400.16
based on the recommendation of the City Engineer. (Motion carried
3-0-1: Abstain: Armstrong).
C. Fire Protection Update
Larry Bohrer reported, at the last Council meeting, direction was
given to contact Oakdale regarding an amendment that would allow fire
protection, if the City chosen, to be added to the water system. A
proposed. amendment was provided and was passed by the Oakdale City
Council. Oakdale agrees to furnish and deliver to Lake Elmo from the
water supply system of Oakdale the fire flow of up to 1000 gpm for
fire suppression emergencies. Bohrer recommended holding a new public
hearing on October 16th for fire protection outside of the well
advisory area.
M/S/P Graves/Williams - to direct the City staff to call a. public
hearing for 7:35 p.m. during the October 16th City Council meeting to
discuss revised plans of extending the distance between fire hydrants
and enlarging the area outside of the well advisory area that would
benefit from the upgraded system. The estimated cost per lot is $415.
(Motion carried 4-0).
Former Fire Chief Fran Pott suggested that the Council further reduce
the cost for fire protection by eliminating $30,000 for shut-off
valves. The valves, according to Bohrer, would allow maintenance and
repair work on portions of the system without shutting down the entire
utility.
D. Request for Street Light Study on 39th Street and Cty Rd 17
The Council received a letter from Roger Knutson, Lake Elmo Bank,
indicating their concern on a potential safety hazard at the point
where 39th Street North joins County Road 17 (Lake Elmo Avenue). They
are requesting the City place a street light at this intersection
because they feel it is difficult for drivers turning out of 39th
Street onto County Road 17 or onto 39th Street from County Road 17
after dark.

Larry Bohrer will review this street light request for 39th Street and
County Road 17 and report back to the Council at the next meeting.
7. CITY ATTORNEY'S REPORT:
Attorney Carlson referred to the monthly litigation report and pointed
out the trial with Federal Land will be held on Friday, October 5,
1990. The appeal brief on Section 32 (first petition) is due October
24th.
8. CITY COUNCIL REPORTS:
Mayor Dunn announced the Lake Elmo Volunteer Fire Dept. will hold an
open house on October 13th from 10 a.m. to 2 p.m. Also the Lake Elmo
Fire Auxiliary will hold a bake sale and garage/craft sale at the Fire
Hall on Sat. Oct. 13th.
Mayor Dunn thanked all who participated in the joint Woodbury/Lake
Elmo hazardous Waste pick up.
9. CITY ADMINISTRATOR'S REPORT:
A. First City Council Meeting in November
The first City Council meeting falls on November 6th which is General
Election Day. State Law prohibits us from holding a council meeting
until the polls close at 8:00 p.m. The Council has the choice of
either meeting at 8:00 or having our regular meeting on November Bth
since we have to meet on this day anyway to canvass the election
returns.
M/S/P Williams/Armstrong - to reschedule the first City Council
meeting from November 6th, which is General Election Day, to Thursday,
November 8th at 7:00 p.m. (Motion carried 4-0).
B. Budget
The Council discussed the 1991 Pay Plan which was recommended by the
Personnel Committee. (See Attachment A)
M/S/P Graves/Armstrong - to approve the 1991 pay plan as recommended
by the Personnel Committee. (Motion carried 3-0-1: Williams indicated
he had no argument with the job that the Finance Director has done,
but wanted the 24% pay increase be spread over a 2 year period and the
increase of the Clerk -Typist be changed to 10%.)
The Council asked the Finance Director to summarize the CIP's and
points of discussion from the Budget workshop.

C. Memo from D.N.R.
The Administrator reported that in 1991 the City will be asked to
revise our ordinance to incorporate the new DNR shorel.and regulations
at the DNR's expense. In the meantime the DNR felt the City can issue
any shoreland permits directly where no variances are required.
D. Letter from Browns Creek Watershed
The Council received a letter from Nile Kriesel, Secretary, BCWMO,
requesting a primary and an alternate representative from the Browns
Creek WMO in Lake Elmo. There is a very small portion of the City in
this Watershed. The Council asked the staff alert the public of the
need for a representative on the BCWMO through the newsletter and
cable TV.
E. Administrator's Performance Evaluation
The Council was asked to submit their comments to Councilmen Graves or
Hunt.
F. Agreement for Auditing/Accounting Services for 1990/91:
Voto, Tautges, Redpath & Co. Ltd.
The Council received a copy of an Agreement for Auditing/Accounting
Services for 1990/1991. This contract is similar to last year's
contract except for rate changes necessitated by general economic
factors. Rates have increased an average of 5%.
Councilman Williams indicated the firm has given satisfactory
performance for years, but suggested we investigate other firms which
could give us the same service for less money. The majority of the
Council indicated they were happy with the services of this firm and
if a new firm's bid came in lower, it would take more staff time and
expense to bring the firm up-to-date.

Auditing/Accounting Services for 1990/1991 to Voto, Tautges, Redpath &
Co., Ltd. (Motion carried 4-0).
G. Red Ribbon Campaign
The Third Annual Red Ribbon Week, October 21-28, 1990, is sponsored
locally by the Community Prevention Project of Human Services, Inc. in
Washington County. Red Ribbon Week is part of a national campaign of
the National Federation of Parents for Drug Free Youth. The Council
supported the goal of Red Ribbon Week which is to present a visible
and unified commitment to reduce and prevent the abuse of alcohol and
other drugs.

H. Request by Elmo View Townhouse Association
The Council received a letter from Charles Kent, President of Elmo
View Townhouse Assoc., requesting a refund of property taxes ($635.44)
on property the city acquired for the 201 Project on September 22,
1986, but the deeds did not get filed until the following year. (See
Letter dated June 18, 1990).
M/S/P Graves/Armstrong - to authorize a reimbursement of property
taxes in the amount of $635.44 to the Elmo View Townhouse Association.
(Motion carried 4-0).
I. Letter from Mayor of Ham Lake on HUD -FHA loans
in Metro Rural Area
At the last meeting, the Council received a letter from Marilyn
Schultz, Mayor of Ham Lake, requesting support for reversal of the
recently imposed exclusion from FHA loan approval in our area for
homes on less than 10 acres. The Administrator offered a Resolution
for Council approval.
M/S/P Graves/Armstrong - to adopt Resolution No. 90-33, A Resolution
Requesting Relief from the Federal Housing Administration (FHA)
Requirement to Meet the Metropolitan Council General Rural Use Density
Policy; contingent on the City Attorney's approval. (Motion carried
4-0).
M/S/P Williams/Graves - to adjourn the City Council meeting at 9:35
p.m. (Motion carried 4-0).
