LAKE. ELMO CITY COUNCIL MINUTES
NOVEMBER 2.0, 1990
Acting Mayor Williams called the City Council meeting to order at 7:02
p.m. in the City Council chambers. Present: Williams, Hunt,
Armstrong, Graves (arrived 7:10 p.m.), City Engineer Bohrer and
Administrator. Kueffner. Absent: Dunn.
1. AGENDA

11F. Letter from Oakdale on recently detached property

4. REAPP REPORT
As the result of the Wednesday workshop, Todd Williams reported the
Request for Proposal for Public Relations Firm has been completed and
is ready for distribution.
5. Discussion with Washington County Sheriff, James Trudeau,
regarding Sheriff Department's policy on traffic laws in
Lake Elmo.
Sheriff Trudeau indicated he received a letter from Mr. Acr.ee
regarding his concern on traffic safety and noted he would be willing
to take any input they can get to make this City a better and safe
place to live. Trudeau stated. "we don't see an alarming speed problem
out there." Based on the two speed surveys taken on Lake Elmo Avenue
near 30th Street, he pointed out on both of these days the average
speed limit was 31.56 mph using unmarked vehicles. By the time you
come around the corner, whether the car is marked or unmarked, you are
already picked up by the radar. Trudeau said he thinks the state
results will match those of his own department.
Trudeau added, "I do believe a police officer should have discretion
whether to write a ticket. I think they need that discretion to do
ther job. I've let people go at 15 miles over the speed limit because
they were going to the hospital. Al]. these things have to be taken
into account". If they were to write tickets for 2 to 3 miles over
the speed limit, this chamber would not be large enough to hold all
the people complaining.

The Sheriff stated he would abide by whatever the state recommended.
Trudeau stated., "It's not their desire to have more traffic accidents.
We don't like to see those things. If it takes lowering the speed
limits, we will live with that."
Richard Acree, 2986 Lake Elmo Avenue N., thanked Sheriff Trudeau for
coming. Acree stated that one of his concerns was that the sheriff's
dept. did not stop speeders until they were violating the speed limit
by ten miles per hour or more. He would like to see this gap brought
down closer to the posted speed limit with the intent being to create
a. reputation for strictness in the Old Village because it is a
residential. area. Specifically where he lives, Acree noted there are
a number of people who use that road for walking, jogging, riding
bikes and asked if something could be done to make it safer for
pedestrians. Mr. Acree asked to be informed when the study results
are in and to be involved in any work group.
Constance Northrup, 1.11097 32nd St.N., submitted a petition to the
Council with signatures of people that were not aware of Mr. Acree's
ideas for solutions. The people she talked to agreed there was a
problem, but very few people were aware that lie had recommended speed
bumps, stop signs, turning lanes, and sidewalks along Lake Elmo
Avenue. Northrup noted, "the solution isn't so much lowering the
speed limit as much as enforcing it or possibly rerouting traffic
headed for I-94. Lake Elmo Avenue is a thouroughfare. It's County
Road 17. To expect people to stop at stop signs for side streets is
not realistic."
Jess Mottaz, 8770 DeMontreville Trail, stated.in support of the
Sheriff's Dept., it appears we are making this a Sheriff.'s Dept
problem. If you went anywhere in Lake Elmo, you will find speeders
regardless of stop signs, speed limits, and police protection. You
can't have Deputy Sheriff's on every road all the time watching
speeders. The problem is not with the Sheriff's Dept., the problem is
ours-- everyone that drives a car in Lake Elmo.
Dick Acree stated he made a statement the night the petition was
submitted to the Council and made it clear he was not the spokesman
for the signers of his petition. The recommendations that were
included in his August 9th letter are strictly his alone. The
petition is a separate document and stands alone. If you look at the
petition, there is only one of the six items that has to do with
speed. Mr. Acree noted they are not putting the burden on the
Sheriff's Dept.
Williams related that he had spoken with one of the deputies
conducting the speed survey. Tha deputy confirmed that they were not
issuing ticketsfor speeds under 10 mph over the posted limit. Sheriff
Trudeau reiterated his philosophy of allowing his deputies to use
their discretion in that regard.
The Council. acknowledged, receiving the letter from Donald Wisniewski,
Director of Public Works, regarding an update of actions they have
taken to answer concerns raised in the Richard Acree petition.

Administrator Kueffner referred to the Don Wisniewski letter, where he
states sidewalks or pedestrian/bikeways are permitted, but at city
cost. The City Engineer has informed her since Cty Road 17 is a county
state aid highway, the City can use municipal state aid funds on this
type of a project. A preliminary feasibility report consisting of
field study and, cost estimate for a.sidewalk between south of the
railroad tracks to Pierre's Pier would cost approx. $1000. While we
are dealing with the speed problem, Kueffner pointed out, we have the
option of providing an area for people to walk that is separate from
the driving lane. This was something she could not respond to until
she received this report.
M/No Second/ Graves/No Second - to direct the City Engineer to make a
field study and cost estimate for installation of sidewalks between
the railroad tracks to Pierre's Pier and the funds be taken out of the
Planning portion of the 1990 Budget.
The Council received a mixed reaction to the option of sidewalks.
Councilman Hunt suggested they wait until they receive the results of
the speed study and issues addressed between himself and Dick Acree in
the next several weeks and try to come up with a comprehensive plan
for this area. Councilman Hunt will come back with a recommendation
to the Council.
Acting Mayor Williams thanked Sheriff Trudeau, Deputy Jesse Kurtz and
Sergeant Swanson for attending the Council meeting. Williams
explained the City is looking forward to receiving the results of the
state's traffic survey. Councilman Hunt has agreed to work with Mr.
Acree to try to write down issues he feels should be dealt with and
what the City can or cannot do. Williams noted no one is trying to
ignore the fact that there is a speeding problem on Lake Elmo Avenue.

The Old Village area is a densely populated area and perhaps has a
special problem, but is receiving special attention.
M/S/P Graves/Hunt - to adopt Resolution 90-35 requesting a speed
survey on 30th Street from CSAH 17 to CSAH 15. (Motion carried 4-0).
6. PUBLIC HEARING: 1991 Budget
Resolution adopting 1991 Budget
Acting Mayor Williams opened up the public hearing at 8:06 p.m. in the
City Council chambers. The public hearing notice was published in the
November 14, 1990 St. Croix Valley Press.
Finance Director, Marilyn Banister, presented the 1991 Budget and
reported the increase this year is $26,826 or 3.260 over last years
budget and taxes, basically due to increase in cost of living.
Special levies for 1991 will include $70,000 for a park bond, $50,000
for the landfill referendum and a $50,000 equipment certificate.
Bill Boylan, 10711 N. 50th St., stated he was not happy about the
money the landfill referendum would cost him. He stated, "I know
there is a lot of emotion in this area about the landfill, but I'm not
paying taxes to fight another agency of government."

Mark Rivard, 5290 Hilltop, asked if the negative population growth
affected the City. Banister responded the population has no bearing on
taxes, but the number of households does make a difference.
Gloria Knoblauch, 9181 31st St. N., asked if $40,000 was enough for
legal fees in 1991 and to appeal Section 32. Acting Mayor Williams
responded the costs involved in appealing Section 32 will be rather
minor compared to the original hearing cost.
When asked how the detachment would affect the City, Banister stated
the recent loss of 500 acres to Oakdale will not affect tax collection
in Lake Elmo in 1990. The owners of the detached property would still
pay their taxes to Lake Elmo this year.
Acting Mayor Williams closed the public hearing at 8:18 p.m.
M/S/P Graves/Hunt - to adopt Resolution 90-34, A Resolution Approving
1990 Tax Levy, $849,756, collectible in 1991. (Motion carried 4-0).
7. PLANNING/LAND USE & ZONING:
A. Petition for Comprehensive Plan Revision
Steve Korhel, 5540 Keats Avenue N., submitted to the Council a
petition requesting an amendment to the Lake Elmo Comprehensive Plan.
The petitioners are requesting that the "DIP" area be removed from the
"RED" zoned section that borders the south side of Highway 36 and be
put back into an "RAD" zoning classification.
M/S/P Armstrong/Graves - to remand this petition to the Planning
Commission for their consideration. (Motion carried 4-0).
B. Limited Business District Ordinance
Tood Williams gave an update on the meeting held Saturday to work on
the Limited Business District Ordinance along I-94. Planner, Mike
Black, will incorporate their discussion into a list of allowed uses
for review by the Planning Commission.

A. Proposed 1991 Street Improvements
City Engineer Larry Bohrer proposed the following street improvements
for 1991:

1. 1990 MSA Laverne Avenue & Upper 33rd Street
This Old Village street reconstruction project has been identified as
the next MSA project in the City's 5-year plan. it is also necessary
as a vital part of the Old Village drainage improvements. Public
hearings were held with only slight objections to the proposed
assessments. The most difficult part of the project will be the
easement acquisition across the Schiltgen property and getting VBWD
approval.
The Council requested William Rohrer, Lake Elmo's Rep. on the VBWD, to
attend a Council meeting with an update. The Council postponed
consideration of this project until after an update from the VBWD.
2. Legion Avenue within Eden Park Addition
This street is 14 years old and was extensively patched in 1989. It
needs a full overlay to preserve the rest of the street and is
proposed to be 100% assessed. Public hearings were held in 1990 and
persons spoke that this project should be postponed until the
construction was completed in Packard Park. Packard Park is now
complete.
M/S/P Graves/Hunt - to call a public hearing for an overlay project
for Legion Avenue within Eden Park Addition. (Motion carried 4-0).
3. Hytrail Avenue - Highlands Trail. to 59th Street
This street was paved in the mid-1970's. Upon inspection, the Public
Works Foreman and City Engineer felt that an overlay over the entire
surface was needed. This project would be similar to other overlay
projects that the City has performed over the last few years is
proposed to be 100% assessed.

M/S/P Graves/Hunt - to direct the City Engineer to prepare a
feasibility report for an overlay project on Hytrail Avenue -
Highlands Trail to 59th Street. (Motion carried 4-0).
4. MSA Maintenance Project
5. Annual Patch & Overlay Maintenance Project
No Council action was required on these items at this time.
B. Final Payment for 39th Street
City Engineer, Larry Bohrer, reported work on the 39th Street project
with Brookman 2.nd and 3rd Additions is complete and ready for final
acceptance and issuance of final payment. (See Final Estimate and
Certificate No. 5 in the amount of $8,637.59.) Also, Compensating
Change Order No. 1 shows that the final contract amount is $7,022.00
more than the original bid. This cost overrun is due to the fact that
MnDOT required a turn lane to be constructed after the contracts had
been awarded.
Bohrer recommended the City accept the work, approve Compensating
Change Order No. 1 and authorize final payment in the amount of
$8,637.59 to be passed through to the developer.
M/S/P Armstrong/Hunt - to accept the work done by C.W. Houle, Inc. in
its construction of. 39th Street and to approve Compensating Change
Order No. 1 in the amount of $7,022.00. (Motion carried 3-0).
M/S/P Armstrong/Hunt - to authorize final payment No. 5 to C.W. Houle,
in the amount of $8,637.59 and to instruct the staff to pass through
this amount to the developer in accordance with the developer's
agreement. (Motion carried 3-0).
C. Light at 39th St. & Hwy 5
The City received a letter from the Lake Elmo Bank requesting a street
light be placed at the intersection of 39th Street and Highway 5.

A. Letter of Resignation from City Attorney
The City received a letter from Fritz Knaak, Rauenhorst, Carlson
Knaak, Ardnt & Ojile, indicating they do not intend to seek a renewal
of their contract with the City for the coming year.
M/S/P Graves/Hunt - to accept the letter of Fritz Knaak indicating
they will not be renewing their contract with the City for 1991.
(Motion carried 4-0).
M/S/P Graves/Hunt - to appoint Jerry Filla of Peterson, Frank and
Reech, as the interim City Attorney for Lake Elmo beginning January 1,
1991 until May 31, 1991. (Motion carried 4-0).
M/S/P Graves/Armstrong - to direct the City Admininstrator to work
with Jerry Filla and Fritz Knaak to begin the transition in the
attorney's responsibilities for the City and facilitate this
transformation any way possible. (Motion carried 4-0).
B. Proposed Uniform Parking Fine Schedule
The City received a memo from Washington County requesting that we
approve and adopt its proposed fine for violation of parking
regulations to $25.00. Currently, we charge $10.00 for parking
violations. ($100.00 for handicapped violation will remain the same).
M/S/P Armstrong/Graves - to adopt Resolution 90-36, A Resolution
directing Washington County to include Lake Elmo in its standardized
fine program of $25.00 for all parking violations, excluding violation
of handicapped parking which shall remain at $100.00. (Motion carried
4-0).
C. Maintenance Department's Request for Transfer of Funds
Dan Olinger has requested that we transfer approximately $5,000 from
the patch and overlay budget, which has a balance of. approx. $17,000
to the Equipment and Repair Budget. Dan reported the plow frame on
the 1986 dump truck is fractured and weakened. The plow frame and
hitch will cost approx. $1,300 from Little Falls Machine. (See
Request for Council Action for other Maintenance requests).
M/S/P Armstrong/Graves - to direct the Finance Director to transfer
approximately $5,000 from the patch and overlay budget to the
Equipment and Repair budget and authorize funds to repair snowplow.
(Motion carried 4-0).
D. 1.990 Christmas Party
M/S/P Armstrong/Graves - to direct the staff to send out invitations,
order the "City Mug", and find someone to cater the Christmas Party
for Friday, December 14th, at a time to be determined. (Motion
carried 4-0).

E. First Meeting in January
The first meeting in January falls on January 1, 1991. Staff
suggested that the meeting be rescheduled for Wednesday, January 2,
1.991.

meeting to Wednesday, January 2, 1.991. (Motion carried 4-0).
F. Letter from Oakdale Regarding Municipal Services
The City received a letter. from Oakdale's City Administrator., Sharon
Klumpp regarding providing municipal services to the area recently
detached from Lake Elmo and attached to Oakdale. The Council made it
very clear Lake Elmo has been and is capable of providing municipal
services to those areas and will continue to provide services to these
parcels not included in the Municipal Board's latest decision.
M/S/P Graves/Hunt - to direct the City Administrator to write a letter
to the City of Oakdale and the residents in Section 32/33 who are
still officially part of Lake Elmo indicating that the City of Lake
Elmo will continue to provide municipal services to those areas.

Lake Elmo Avenue North (County State Aid Highway 17 - CSAH 17)
Dear Mary:
This letter is intended to give you an update of actions we have taken to
answer concerns raised in the Richard A. Acree petition.
A. Vehicles traveling too fast on Lake Elmo Avenue North.

In August, the Washington County Board of Commissioners passed a
resolution requesting a speed zone study from the Minnesota
Department of Transportation (see attached resolution). Usually,
it takes approximately 4 - 6 months to accomplish the study. We
will advise you of the results of this study.
It is my understanding that the speed enforcement issues will be
addressed to the County Sheriff.
Sidewalks or pedestrian/bikeways are permitted; however, these
improvements are local cost participation items. The county would
require review and approval of plans, but the cost to design and
construct would have to be borne by the City of Lake Elmo.
We are conducting a stop sign warrant study for Lake Elmo Avenue
North and 30th Street North. Preliminary reviews of accidents and
traffic volumes do not demonstrate that stop signs should be
installed. We will contact you as soon as the study is finalized.
We discourage placement of edgelines in urban areas. The many
varied traffic movements in and out of residences and parking
maneuvers require unrestricted movements. Passing on the right is
prohibited, and this is a traffic enforcement issue.
The City of Lake Elmo may request a speed zone study of 30th
Street North from the Commissioner of Transportation. At the same
time, you could request further review of signing and sign

placement from W/DOT. Since 30th Street North is a roadway unde
city jurisdiction, the city should correspond directly with
MN/DOT.
C. S-Curve on Lake Elmo Avenue North near 2986 Lake Elmo Avenue
North.
Same comments as noted above. There is no plan to reconstruct
CSAH 17 within the next five years. Changes in the highway
alignment are unlikely for the foreseeable future.
D. Hill and curve near 2119 Lake Elmo Avenue North.
No improvements to CSAH 17 are planned. We are studying stop sig
warrants at 20th Street North. Again, preliminary reviews of
traffic and accident data do not demonstrate an all -stop
intersection.
E. Traffic signal at CSAH 17 and Trunk Highway 5 (TH 5).
Right turnlane on TH 5 at Klondike Avenue.
MTC bus stop on TH 6.
As you are aware, both Washington County and the city have been
monitoring the CSAH 17/TH 5 intersection, and we have discussed
the need for traffic signals with MN/DQT. Warrants for traffic
signals are not met, and MN/DOT is committed to reviewing all
intersections with TH 5 through Lake Elmo for possible safety
improvements.
It is my understanding that Mr. Acres has contacted MN/DOT. You
may want to correspond further with Mary LaPlante, bIN/DOT Distric
Traffic Engineer to determine the status of the safety improvemen-
study.
I appreciate the time and attention you have given this letter. We will keep
you advised of our findings for the speed zone and stop signs along CSAH 17.

A RESOLUTION REQUESTING A SPEED SURVEY ON 30TH STREET
BE IT RESOLVED, that the Lake Elmo City Council hereby
requests the Commissioner of the Minnesota Department of
Transportation to conduct a traffic survey to determine the reasonable
and safe speed on the following City street:
30th Street from CSAH 17 to CSAH 15
BE IT FURTHER RESOLVED, that upon determination of a
reasonable and safe speed on the above street, the City of Lake Elmo
be authorized by the Commissioner of the Minnesota Department of
Transportation to post such speed limit.

The projects are individually described as follows:
1. 1990 MSA. - Laverne Avenue and Upper 33rd Street
This Old Village street reconstniction project has been identified as the next MSA project in
the City's 5-year plan, It is also necessary as a vital part of the Old Village drainage
improvements, The project will most likely include street reconstruction with concrete curb
and gutter, storm sewer, right-of-way acquisition along 33rd Street, and maybe watennain
replacement, This main has had four or five breaks in the past. This project would be
funded with MSA Construction Funds and assessments.
Public hearings were held with only slight objections to the proposed assessments. The most
difficult pan of the project will be the easement acquisition across the Schiltgen property
and getting VBWD approval.

2. Legion Avenue within Eden Park Addition
This street 1s 14 years old and was extensively patched in 1989, It needs a full overlay to
preserve the rest of the street. It is proposed to be 100% assessed.
Public hearings were held in 1990 and many persons spoke that this project should be
postponed until the construction was completed in Packard Park. Packard Park Is now
complete.
3, Hytrail Avenue - Highlands "frail to 39th Street
This street was paved in the mid-1970s. Upon Inspection this year for Its annual spot patch
and overlay, the Public Works Foreman and I felt that an overlay over the entire surface was
needed, This project would be similar to other overlay projects that the City has performed
over the last few years and is proposed to be 100% assessed.
4. MSA Maintenance Project
For the past few years, the City has been requesting its maximum maintenance allotment.
Many MSA roads have been overlaid with this money and it has helped to reduce the City's
unexpended MSA Construction Fund in order to avoid penalties. The maximum /
maintenance allotment for 1991 Is expected to be around $40,000. If 33rd and Laverne is to
be done in 1991, It was anticipated to use all of the funds on that project. If that project will
not be done, bituminous shouldering on 20th Street between Lake Elmo Avenue and
Manning Trail had been suggested.
S. Annual Patch and Overlay Maintenance Project
The City budgets about $25,000 annually for small patches and overlays which are
contracted out. These repairs are not large enough to be considered projects like those
described previously but yet are too large for the City crew to handle. This progratn is
usually determined by the Maintenance foreman and the Engineer in the spring when the
roads are fully visible.
Action Requested
The Council should decide if they want to proceed with 33rd and Laverne as the 1991 MSA
Project. The next step would be to approach the VBWD. If the Council does not want to
proceed with 33rd and Laverne, another MSA project should be chosen for 1991 to avoid a
penalty because of high fund balance.
A feasibility report has previously been prepared for Legion Avenue but would have to be
updated for 1991. The Council should direct the Engineer to update the feasibility report.

RE: Proposed uniform parking fine schedule.
Within Washington County there is a wide variety of fine amounts
used for parking violations. We cannot include this much
information on the fine schedule we print on the back of our
uniform citations. Each of the 32 townships and municipalities
would need to be listed separately to show the various parking
fines. Lack of this information results in numerous calls to my
office merely to inquire as to the fine amount. It would be much
more efficient for us, and more convenient for anyone receiving
parking violations if we could standardize the fines and include
that information on the violator's citation.
With that in mind, I ask that each of you consider changing your
fines for all parking violations to $25.00 I have enclosed a
sample resolution for your convenience. The Washington County
Judges have approved and recommend adoption of the standard $25.00
fine for all parking violations.
If any of you have need for further information or would like me to
meet with you, 1 will be very pleased to hear from you. If not,
would you please put the issue on your next meeting agenda for
approval and endorsement.. After the resolution has been adopted,
please send me a copy.
The new citation form will be printed mid November. I would
appreciate receiving this resolution by November 1st. Thank you
for your help.

Following action by the Minnesota Municipal Board on October 31,
1990, property petitioned for concurrent detachment/annexation
will become a part of Oakdale on November 7, 1990. As of 12:01
a.m. on Wednesday, November 7, 1990, Oakdale will be providing
municipal services within the generalized area bounded by loth
Street on the north, County Road 13 on the east, I-94 on the
south and I-694 on the west. The only exception for municipal
service will be Guardian Angels Church, which was not a signator
to the petition and which therefore, will continue to receive
services provided by the City of Lake Elmo.
The border creates some islands of Lake Elmo within the newly
annexed area of Oakdale. In the interest of the safety, health
and welfare of residents in this area, the City will provide the
full range of municipal services, again, excluding only the
Guardian Angels property. Chief Sullivan will be making the
necessary arrangements with Washington County to ensure that the
County will dispatch calls for service accordingly.
