LAKE ELMO CITY COUNCIL MINUTES
NOVEMBER 8, 1.990
6:30 EXECUTIVE SESSION
Acting Mayor Williams called. the City Council meeting to order at 7:15
p.m. in the City Council chambers. Present: Williams, Hunt, Graves,
Armstrong, City Engineer Bohrer, City Attorney Carlson and
Administrator Kueffner. Absent: Mayor Dunn was attending an SPSE
Meeting.
ACTING MAYOR WILLIAMS ACKNOWLEDGED THE ATTENDANCE OF THE NEWLY ELECTED
MAYOR ELECT, DAVE JOHNSON, AND NEWLY ELECTED COUNCILMEN, JESS MOTTAI
AND DICK JOHNSON.
1. AGENDA
Add: 7A. Ja.nochoski letter regarding the Lake Jane Water Supply,
10E. Update on traffic and speed issues within the Old Village and
including Dick Acree's letter.
M/S/P Graves/Hunt - to approve the November 8, 1.990 City Council
agenda as amended. (Motion carried 4-0).
2. MINUTES: October 16, 1990
M/S/P Hunt/Graves - to approve the October 16, 1.990 City Council
minutes as amended. (Motion carried 3-0-1 Abstain: Graves).
3. CLAIMS
M/S/P Armstrong/Graves - to approve the November 8, 1990 Claims #93946
thru #94036 as presented. (Motion carried 4-0).
4. PUBLIC INQUIRIES
Rhonda Smothers stated she lives one-half mile east on Hwy 36 next to
Sun Country. She has been unable to sell her property as residential,
but had many business inquiries. Smothers asked for Council direction
to rezone her five acres from Residential to Commercial.
The Council informed her the City recently passed a Comp Plan which
shows this area remaining Residential. Council directed her to City
Hall. to apply for an application for rezoning.
5. REAPP REPORT
Rita Conlin, REAPP Member, explained REAPP formulated a plan to build
a public information campaign. This concept proposal was included in
their Council packet. REAPP asked the Council and Council -elect to
call a workshop with REAPP to work together on initiating the
county -wide public information effort. (See public awareness concept
plan along with a Phase I Plan).

M/S/P Hunt/Armstrong - to hold a workshop with REAPP on Wednesday,
November 14th, at 7 p.m. in City Hall. (Motion carried 4-0).
6. PLANNING/LAND USE AND ZONING:
A. PUBLIC HEARING: David Schwarz, 10961 32nd St.
Variance to setback requirement, sideyard and street
right-of-way and Shoreland Permit for construction
of garage.
Acting Mayor Williams opened up the public,hearing at 7:30 p.m. in the
City Council chambers. The public hearing notice was published in the
October 24, 1.990 St. Croix Valley Press and adjoining property owners
were notified.
There was no one to speak for or against the variance request. A
letter was received from Evelyn Kramer, 10949 32nd St., indicating she
has no objections for replacement of the garage where the old building
exists.
City Engineer, Larry Bohrer, reported David Schwarz has applied for a
shoreland permit to construct a new detached garage at 10961 32nd
Street North. This property is on the north shore of Lake Elmo and
Shoreland Regulations apply. Mr. Schwarz had previously applied for a
similar permit in 1988. At that time the applicant was requesting a
larger garage and a sideyard setback of only 1.5 feet. Action was
postponed until a more detailed drawing was furnished showing
drainfield, waterline and reduced garage size.
Mr. Schwarz has now revised his application to request a side yard
setback of 5 feet where 10 feet is required and a 23' x 32' garage.
Bohrer furnished a revised drawing which accurately reflected the
application.
Two variances are requested:
1. A 20' setback from the street to the garage where 50' is required.
2. A side yard setback of 5' where 10' is required.
Bohrer pointed out the first variance was not much of a. concern in
1988 since the new garage would tend to line up with other existing
garages along the street. The steep sloping terrain toward the lake
is the hardship on the land that would allow this variance. The
reduced depth of the garage removed the concern for interference with
the existing drainfield which was a concern in 1988 when the larger
garage was proposed. The smaller garage also ].eaves more room for
possible drainfield expansion.
Bohrer also pointed out that the existing drainfield goes over the
waterline. The drainfield was constructed new in 1986 and the water
line was extended about the same time. The setback of a waterline to
a drainfield is 10 feet and asked. Bohrer asked Mr. Schwarz for his
comments.

Mr. Schwarz responded he had talked to the septic installer. According
to his input, Schwarz provided a drawing showing the existing water
line 10' from the septic system. Schwarz gave as the hardship for his
variance the cutting down of a large tree and the narrow size of his
lot.
Also Bohrer indicated Mr. Schwarz mentioned a possible addition to the
house. Bohrer stated adding bedrooms, etc. would not be looked upon
favorably because of the limit of the size of yard left for
drainfield. (Drainfields are sized according to the number of
bedrooms). Schwarz responded, he would rather have a garage than an
addition to the house.
Acting Mayor Williams closed the public hearing at 7:43 p.m.
M/S/P Armstrong/Graves - to approve a shorela.nd permit and two
variance requests: (1) a 20' setback from the street to the garage
where 50' is required and (2) a side yard setback of 5' where 10' is
required, by David Schwarz, 10961 32nd Street North, for construction
of a 23' x 32' garage based on the hardship being the narrow lot,
removal of a large tree, the area for the drainfield will not be
affected by this application, the garage size and location is
consistent with character of neighborhood, and a letter received from
neighbor in favor of the request. (Motion carried 4-0).
B. Residential Estates Zoning Ordinance
The Council received a draft copy of the Residential Estates Zoning
Ordinance (Section 301.070D.).
Councilman Williams referred to C(1) Lot Size and commented there is
nothing stated, that prevents a large portion of the 2 1/2 acres from
being in a lake. He felt it should explicity state that 2. 1/2 acres
should be free of any easements or flood plain. His intent is the lot
has to be above the lake, but could have some seasonal water on the
lot as long as you have 1 acre or 1 1/4 acres of land free of any
water.
The Council. discussed this concern. There was Council consensus on
(4) Areas of Building Site: A minimum of 1.25 acre of land above the
flood plain and free of any drainage easements.
Discussion followed on (9) Septic Drainfield Regulation. Councilman
Williams provided a draft which would allow the splitting of the
20,000 sq.f.t. based on the reasoning the County's ordinance is minimum
10,000 sq.ft. Therefore, if Lake Elmo allows the 20,000 sq.f.t. to be
split up into a maximum of two parcels, neither of which can be less
than 10,000 sq.f.t., this should be adequate, but as a requirement each
of those areas has to be contiguous to the building site or part of
it.
There was Council consensus on (9) Septic Drainfield Regulation:
(a) All newly subdivided lots shall have a minimum of 20,000 sq.f.t. of
land to be dedicated for septic system use and suitable for that use.
This land may comprise up to two separate areas each of which is

contiguous to the 1.25 acre building site or contained within it and
each of which contains at least 10,000 contiguous sq.ft.
M/S/P Hunt/Graves - to proudly adopt Ordinance 8039, amending the 1979
Lake Elmo Municipal Code by incorporating Section 301.070D.
Residential Estates as amended. (Motion carried 4-0).
Residential Estates Supporting Ordinances
Street Standards:
The Planning Commission made a motion at their October 22, 1990
meeting to require a minimum distance of fifteen feet (15') from the
edge of a property line to the nearest- edge of the driveway in the
Residential Estates Zoning District.
The Council considered a 10' requirement to be reasonable between
driveways in a residential area.
M/S/P Graves/Hunt - to direct the City staff to prepare an ordinance
amending Section 1.602.070(1) to allow the exception that a driveway
must be 10' from any lot line in the Residential Estates Zoning
District.
The majority of the Council favored a 28' wide blacktop road with
bituminous curbs. Councilwoman Armstrong preferred 24' wide roads,
but as long as we will not be adding a shoulder on either side, she
would approve 2B' wide bituminous road with the alternative of asphalt
or concrete rollover curbs.
M/S/P Graves/Hunt - to direct the city staff to prepare to modify the
appropriate ordinance to specify 28' wide asphalt roads with either
asphalt or concrete rollover curbs in the Residential Estates Zoning
District. (Motion carried 4-0).
C. Comprehensive Plan Revisions
Michael Black reported on Thursday, October 25th, a meeting was held
at the office of the Met Council to receive comment on the City's
Comprehensive Plan update. The purpose of the meeting was to address
Chairman Keefe's letter dated October 5, 1990 and to determine what
information had to be added to the plan update in order to start the
Metropolitan Council review period. (See Mike Black's memo dated
October 26, 1990).
Mike Black asked for Council direction to proceed with updating the
Chapter on Sanitary Sewer. Larry Bohrer will prepare a map and exhibit
that identifies and locates the cluster systems which goes along with
the text. Black will update the thoroughfare plan map and send this
information back to the Met Council.
M/S/P Williams/Hunt - to direct the City Staff to proceed with the
requested direction. (Motion carried 4-0).

7. CITY ENGINEER'S REPORT:
A. Janochoski letter regarding the Lake Jane Water Supply.
The Council acknowleged receipt of a letter from Thomas Janochoski,
8510 Lake Jane Trail. N, putting forth an argument that with reduced
restoration costs routing the water system pipe from Oakdale to the
well advisory area by Lake Jane along Ideal and Trunk Hwy 5 might be a
wash in cost with the route currently proposed.
Bohrer commented the longer route would be the more expensive route.
The $80,000 that is estimated for restoration applies to the entire
project and not just that length of road on Lake Jane Trail. In the
design, they will be more sensitive to the trees, slope and all the
items sited in the closing of Mr. Janochoski's letter. Bohrer did not
see any reason to change the route at this time.
The Council indicated they would continue with the plan proposed by
the City Engineer and asked the City Administrator to write a letter
to Mr. Janochoski indicating the Council has reviewed his letter with
the City Engineer, and they feel. confident he will be sensitive to the
topography, trees, etc. and will have a workable, yet less expensive
system with the current design.

A. Canvass Election Returns
The City Administrator explained the Council must meet as a canvassing
board within two days after the City General Election and declare the
results of the election as they appear upon the face of the election
returns.
The Council read aloud the results of the election and declared the
winners:
M/S/P Graves/Hunt - "For the two-year term of Mayor, Susan Dunn
received 1166 votes and David Johnson received 1341 votes. Now,
therefore, be it resolved that we the City Council of Lake Elmo
declare David Johnson elected as Mayor by a majority vote by the
registered voters of the City of Lake Elmo." (Motion carried 4-0).
M/S/P Graves/Armstrong - "For the two - four year terms for
Councilmembers, David Bucheck received 1078 votes, Arlyn Christ
received 359 votes, Richard Hughes received 1063 votes, Richard
Johnson received 1094 votes and Jess Mottaz received 1097 votes. Now,
therefore, be it resolved that we the City Council of. Lake Elmo
declare Jess Mottaz and Dick Johnson elected as Councilmembers by a
majority vote by the registered voters of the City of Lake Elmo."
(Motion carried 4-0).

B. Recommendation from Lake Elmo Solid Waste Advisory
Committee
TMT Recycling's contract with the City expires December 31, 1990. It
is the recommendation of the LESWAC to renew this contract wth TMT
Recycling at the cost of $90.00 per ton which will include the
addition of certain plastics. The proposed increase reflects a $5.00
per ton increase.
M/S/P Hunt/Armstrong - to support the extention of TMT's Recycling
Contract with the City of Lake Elmo at the cost of $90.00 per ton
which will include the addition of certain plastic until December 31,
1991. (Motion carried 4-0).
C. Telephone and Computers
The staff provided a bid on a new AT&T telephone system and a bid from
Team Electronics for three new computers for the office staff.
M/S/P Williams/Hunt - to direct the staff to proceed with purchasing
the proposed telephone package from AT&T for the City Office. (Motion
carried 4-0).
M/S/P Graves/Hunt - to postpone consideration on computer package
until further review by the City Staff and CIP Committee. (Motion
carried 4-0).
D. Animal Control, Officer's Request for Increase
Michael Smith, Animal Control Officer, has requested an increase of 6%
percent (from $360.00 to $380.00) in the monthly contract fee. Mike
is also asking to double his call -out fee from $15.00 to $30.00.
The City Administrator pointed out the city adopted a $50.00 impound
fee for unlicensed dogs and $25.00 for licensed dogs. We budgeted
$5500 for Animal Control and $3000 for impounding. If we increase the
animal control to $6,000 and decrease the impound to $2,500 we should.
stay within budget.
M/S/P Armstrong/Graves - to approve the 6% percent increase request by
Michael Smith, Animal Control Officer, from $360.00 to $380.00 in the
monthly contract fee and the call -out fee from $15.00 to $30.00
effective January 1, 1.991. (Motion carried 4-0).
E. Update on traffic and speed issues within the Old Village
and including Dick Acree's letter.
The City Administrator reported. two letters were sent to Washington
County. The County passed a resolution requesting MNDOT to do a speed
study from Pierre's Pier -•-South to 20th Street, to see if it is a
reasonable request to reduce the speed from 45 mph to 30 mph.
Subsequent to this, the County is looking at stop signs along Lake
Elmo Avenue and a stop light at Hwy 5 and Cty Road 17. Other items
such as sidewalks will have to be addressed by the City.

Councilman Bunt volunteered to meet with Mr. Acree to develop a list
of exactly what Mr.. Acree wants the City to do and what the City has
or is doing in response to his concerns.
Councilwoman Armstrong stated she felt Mr. Acree has overstepped in
saying the City hasn't responded adequately and noted he was a bit
vicious in his letter and his accusations are unfounded. This is
government and things happen slowly in government. Mr. Acree has to
learn patience.

hall for the volunteer group to use. Since volunteers will be
using; the telephones, space and phones will be needed as their
schedules permit which may be during the day as well as in the
evening. It is requested that one telephone and office space
be made available any time of the day in city hall and that up

Dear Lase Elmo Mayor, Council Members and City Administrator,
On Sept. lath., the Council decided against a end landfill
referendum that would extend the current levy an additional
,years in order- to fund a county wide public information effort.
In lieu of this funding mechanism, the Council indicated a
willingness to consider the use of current referendum dollars to
fund this effort and requested that Re.H.P- . specifically define
the elements, and their costs, that would be contained in an
overall public information effort. Consistent with this Council
request., the +allowing proposal is presented for consideration by
the Council.
On Oct. 14Lh, a special ReAPP meeting was held to identify all
action items necessary for an effective county -wide ,public
information effort. The following 41 action items represent the
over-all strategy and constitute the basis for the proposal.
Action items were first of all divided into the categories of
"PLANNED EVENTS" and "ON -GOING ISSUES". The category of "ON-
GOING ISSUES" was further divided into the components of
"COMMUNICAT! DNS". "LOBBYING "MEMBERSHIP'' and ''FUND RAISING".
The action items in all categories are prioritized.
The column anti tiedT "PEOPLE RESOURCE(S) NEEDED" was constructed
by identifying those people resources that are currently
available and those people resources that, although not currently
available, world be needed to carry out the particular action
item. The question was then asked, "ideally and realistically,
what people resources do we need to put behind a particular
action item in order to make it happen?" In all cases, the 1st
resource identified is viewed as the primary parson(s)
responsible for ensuring that the action item is carried out.

I have been a municipal attorney since i970. During the
past 20 years I have worked with city councils, town boards,
charter commissions, planning commissions and public hospital
boards. I have litigation experience in the areas of municipal
contracts, zoning regulations, condemnations, special assess-
ments, personnel matters, and criminal prosecution.
I am also familiar with the various legal matters
associated with public improvement projects, volunteer fire
departments, and contract police services. I have recodified
and been involved in the recodification of city codes and have
drafted ordinances and legislation.

BACKGROUND
Peterson, Franke & Riach, A Professional Association, was formed in
1986 and represents the merger of the St. Paul, Minnesota firm of
Peterson, Gray and Sheehan, Ltd., and the Roseville, Minnesota firm

Warren E. Peterson:
Warren Peterson is a 1964 graduate of William Mitchell College of
Law. He served as a law clerk for the Minnesota Supreme Court and
as a Special Assistant Attorney General and Assistant Ramsey County
Attorney before entering private practice. He practices in the
areas of general business law, including the purchase and sale of
businesses and estate planning and probate.
Ronald J. Riach:
Ronald Riach is a 1966 graduate of Drake University Law School and
was admitted to the Iowa Bar in 1966 and the Minnesota Bar in 1967.
He practices primarily in the areas of real estate, commercial,
business and family law. In the real estate area, he has been
involved with numerous residential and commercial real estate
developments representing both lenders and developers. He is a
Fellow of the American Academy of Matrimonial Lawyers, and a member

Glenn A. Bergman:
Glenn Bergman is a 1971 cum laude graduate of William Mitchell
College of Law. He practices primarily in the real estate area.
He is a past chairman of the Ramsey County Bar association's Real
Property Section and has been involved in both residential and
commercial real estate developments. He is a licensed title
insurance underwriter and a former Deputy Examiner of Titles in
Ramsey County. He has also represented various real estate title
and closing companies, as well as individual buyers and sellers of
residential and commercial real estate.
Daniel Witt Fram:
Witt Fram is a 1976 cum laude graduate of William Mitchell College
of Law. He serves as General Counsel for the Minnesota Association

RE: Meeting with the Metropolitan Council Staff
On Thursday, October 25, 1990, a meeting was held at the offices of the
Metropolitan Council to receive comment on the City's Comprehensive Plan
update. The purpose of the meeting was to address Chairman Keefe's
letter dated October 5, 1990 (copy attached) and to determine what
information had to be added to the Plan update in order to start the
Metropolitan Council review period.
The Metropolitan Council staff members in attendance were Richard
Thompson, Ann Braden and Jack Frost. Along with myself, Councilmember
Todd Williams, City Administrator Mary Kueffner and City Engineer Larry
Bohrer were there representing the City of Lake Elmo.
We discussed items relative to the Plan completeness and other
additional comments pertaining to issues or information which did not
delay the review period but were "helpful suggestions". Listed below
are the items or concerns raised by the Metro Council staff and my
suggestions for action on each item. I have first listed those items
needed to be done in order to initiate the review process and then
listed the other issues.
REQUIRED NEW DATA / INFORMATION
In the Community Facilities Plan, Section C, Other Services and
Facilities, three items were asked to be added or clarified:
1. The heading in Section III.C.1.f. should include reference to
"and Private Package Systems".
2. A map should be added noting the number and location of the 201
community sewage treatment systems. Other information should also
be included describing the systems, how many homes they serve, and
maintenance responsibilities.
3. Add a policy statement to Section III.C.3.e. (page 49) pertaining
to sewer infiltration and inflow. The suggested wording discussed
was "to require that the design and construction of any public
sanitary sewer eliminate excessive infiltration and inflow and be
in compliance with current acceptable engineering standards and
those set by the Minnesota PCA".

ACTION NEEDED: I will meet with Larry Bohrer next week (October 29 -
November 2) to prepare the required information
The goals and policies for private septic systems (page 49) should be
clarified to read that private package treatment systems for new
development will not be allowed and only where existing systems have
failed will the City allow properly designed private treatment system
for multiple properties.
ACTION NEEDED: I believe the City Council agrees with this position
and the policy should be reworded.
The Metro Staff questioned why the City's population projections were
higher than their projects. Metro Council projects the year 2000 popu-
lation as 6,600 and our plan (page 8 and 35) projects a 2000 population
of 7,200. Also, they question the projected population shown by TAZ
zones (page 35).
ACTION NEEDED: This may be an issues that we agree to disagree on.
On page 8 we state that part of the reason for a low projection by the
Metro Council is that they predict a decrease in family size and an
overall decrease in the growth rate of the entire Metropolitan area.
They did not consider our RED land use designation and anticipated de-
velopment in new areas of the City. The City does not wish to disagree
or argue with the Metropolitan Council on this point. If development
does not occur, that's fine. However, we believe our projections are
more realistic based upon past building permit records and new land use
designations. The projected population by TAZ zones reflect the new RED
land use and anticipated growth.
The following issues were raised relative to Map 12 (page 30A):
1. Street names are not legible.
2. Highway 36 should be labeled as a Principal Arterial.
3. County Road 10 and Inwood Avenue should both be labeled as
Minor Arterials.
4. The map does not acknowledge or show the I-94 bridge crossing
from Bielenberg Drive in Woodbury.

ACTION NEEDED: The map will be corrected to include legible street
names. Highway 36 will also be changed to a principal arterial. The
City needs to discuss if we agree with the minor arterial classification
as opposed to collector classification for County Road 10 and Inwood.
Also, the text (page 31) pertains to Keats Avenue as a collector;
however, it was not labeled so on Map 12.
The Metro staff requested that the Plan include a statement that
"special transportation for the elderly and disabled person is provided
by Metro Mobility with additional transportation service provided by
Transporter of Washington County".
ACTIONNEEDED: Upon City Council direction, this wording can be added
to pages 32 and 33.
The Metro Council staff acknowledged an "in-house" policy disagreement
between the Parks Department and Solid Waste Department over the siting
of the landfill in the Lake Elmo Regional Park. The issue would not
delay the review period of the Plan, but was something the Metro Council
will have to "wrestle" with.
ACTION NEEDED: We reaffirmed the City's opposion to siting a landfill
in the regional park. And, we reaffirmed our continued efforts to stop
any further consideration of the landfill in the Park.
The Metro staff stated that they "reserved" making additional comments
regarding housing; however, they would not delay the start of the review
period.

Oakdale's Comprehensive Sanitary Sewer Plan Update states that
Oakdale Sewer District 13 is planned to be served by the WONE
Interceptor through Lake Elmo. Part of the District 13 is
temporarily connected to the Oakdale sewer system by means of lift
stations. The permanent gravity connection to the Lake Elmo
system is anticipated before the year 2000. In this regard,
Oakdale has requested that this connection be considered in Lake
Elmo's Comprehensive Sewer Plan. The sewer system layout is shown
on Map 24. The MWCC has made a preliminary determination that the
WONE Interceptor can accommodate this additional flow from Oakdale
at the Lake Elmo connection point and points downstream. If Lake
Elmo agrees to provide this service, an inter -community agreement
will be executed before construction would begin.
Present flow from Lake Elmo into the WONE Interceptor is estimated
by the MWCC at 1.0 MG per year (.0027 MGD). The following chart
projects straight line growth from 1987 to 2010.

f. Indivldual On -Site and Cluster Septic Systems and
Packaged Treatment Plant
The City has just concluded participation in the nationwide
Project 201, implemented to correct deficient private septic
systems. Over 200 residences and businesses received new
individual systems or were connected to new cluster systems (see
,Map _ for location of cluster systems and pertinent design date).
� J These systems were consructed with cost sharing by the residents
J�f and State and Federal Governments. This effort was an important
1�1 part of the City's involvement in the process of eliminating the
small percentage of systems which did not meet City standards.

Those residents determined in the future to have faulty septic
systems will be required to upgrade their systems at their own
expense. Under the current program the existing ordinances have
been upgraded to require regular septic tank pumping and detection
of faulty systems. New systems are carefully regulated and most
include provision for the installation of back-up facilities.
Chapter 701 of the City Code Book relates to the regulation of
individual sewage treatment systems. The ordinance requires a
site evaluation by the zoning administrator prior to the issuance
of a building permit. Also required are soil test and percolation

The standards in Chapter 701 of the City Code exceed
the requirements of Minnesota Rules Chapter 7080, Individual
Sewage Treatment Standards,
Section 707.050 of the City Code states the following maintenance
requirements for cluster septic systems:
The City shall be responsible for operating, maintaining and
replacing the collection and final treatment and disposal
system. The City shall arrange for all repairs and
maintenance on sewers, lift stations, controls and
drainfields. The property owner shall be responsible for all
repairs and maintenance to septic tanks, including septic
tank pumping, and to all individual pump stations and sewer
pipes up to the collector sewer or final treatment and
disposal system. Unless otherwise prescribed, City ownership
and the City's responsibility for conducting Operation,
Maintenance and Replacement shall begin at the property line.
Cimarron, a mobile home park development in Section 36, contains a
privately owned and operated sewer collection system and packaged
wastewater treatment plant. This treatment system has a design
capacity of .25 mgd and now serves the residents of the mobile
home park.
2. Analysis
a. Public Safety
The City works with the Sheriff's Department and the Volunteer
Fire Department to determine the needs of the City in terms of
Public Safety. The City Council works with the Administrator to
develop plans to keep equipment up to date, and to keep informed
as to the needs of police protection.
The police and fire systems are balanced with the needs of the
City. other than to plan for replacement of equipment and funds
to compensate the firemen through insurance and pension funds, no
other expenditures are planned. Based on population forecasts,
the current system should be adequate at least through the year
2000. it is not anticipated that Lake Elmo will have its own
police department.
b. Public Water System
* Rural Center
The current system is over 25 years old. The Lake Elmo Water
System Advisory Committee was formed to review the present
operation including the financial structure, maintenance programs,

and future requirements. Originally, there was an expectation of
a rapid increase in the number of customers. Rut this has not
occurred. The committee in its report says this lack of growth is
the cause for a number of incomplete loops in the system. Loops
are desirable for redundancy in the event of a leak. The current
interest of the Advisory Committee is to study how to achieve a
cost effective way of maintaining and increasing the capacity of
the system on a self-financing basis.
At the present time, water from private wells supply the
residences, businesses, and a church complex within the Municipal
Urban Services Area. The City anticipates that the scheduling of
and costs associated with provision of public water in this area
will be borne by future building developers, as current supplies
are sufficient for current uses.
c. Waste Management
The City is satisfied with the current system of having individual
households contract for weekly trash pick-up. However, with
increasing state and metropolitan regulations concerning waste
reduction and recycling, Lake Elmo will consider contracting for
the organized collection of both recyclable$ and solid waste in
the future. While the City is free to determine the type and
level of participation in solid waste collection programs, it must
work within the guidelines of the Metropolitan Council
d. Public Sewer
The Sewer Feasibility Study and Plan prepared in 1985 are
sufficient to allow potential developers within the MUSA to plan
the location of utility easements for development, There are no
plans to extend public sewer beyond the current MUSA line.
With appropriate regulation and enforcement by State agencies, the
Cimarron sewer plant is expected to operate satisfactorily
throughout the planning period.
e. on -site septic systems
The upgrading of individual septic systems through the 201 program
has provided a major improvement for participants, many with
houses on less than code sized lots. The new systems have for the
most part provided the necessary relief from constant pumping and
failing systems. They have corrected ground and surface water
pollution problems. The program was based on a major policy deci-
sion that a central sanitary sewer will not be necessary and would
destroy the rural character of the City. The City Council and the
Planning Commission believe that the majority of the residents
l want to preserve and continue the land use pattern of large -lot
(low -density) development, served by on -site septic systems.

f. Public and Private Facilities

The City will always have a need for public and private facilities
such as parks, fire stations, a library, schools, churches, and
recreational areas. The location of each type of facility will be
dependent on its need, such as the location of governmental
buildings in the Central Business District and the spacing of fire
stations and parks.

* Continue to provide cost effective police and fire
protection.
* To keep theft, fire, personal injury, and automobile
accidents at or below existing levels.
(2) Policies:
* Keep overhead to a minimum and rely on volunteers where
possible.

* Emphasize preventative measures to avoid the occurrence of
problems.
b. Public Water System
(1) Goals:
* To distribute public water in a manner that reinforces the
City's development policies.
* To maintain the Old Village water system on a self-financing
basis.
* To prevent.the extension of public water into rural areas of
the City.
(2) Policies:
* Prohibit urban density developments in areas which,'due to
soils, water tables, or geological features, are likely to
lead to high costs in providing public water.
* Revise the rate structure of the Old Village water system to
provide for future maintenance and equipment placement.

The Parks Commission met last night and worked on its 5 year CIP.
That will be sent to the council later this week so you can review
it prior to the November pre -budget hearing meeting.
So that Marilyn can finish the CIP's and get them out to you, I
would like to bring up the Capital items that we would like here
in the office.
First is an upgrade of our telephone system. We got a bid from
AT&T for a "Merlin Plus" communication system. I have enclosed
brochures from AT&T that outline the systems capabilities.
We budgeted $3,000 for telephone expenses in 1991. We lease our
present phones at $66.95 per month for a total yearly cost of
$804.00. Three lines of service is $2,196 yearly for a total of
$3,000.
For four lines of telephone service (which we are proposing rather
than the 2 regular <rollover>, and one private line that we now
have) will cost approximately $2,928.00 per year.
If we purchase this new phone system outright our costs would be:

AT&T also has a lease program and the cost for that will be
$188.50 per month. Over a 5 year period that would total
$11,310.00. Therefore, the savings of purchasing outright versus
leasing would save the City $3,161.00 over the next five years.
I have attached a copy of the "Fund Balances", that will be part
of your final budget.
Please note under "Other Fund Balances" that the proceeds from our
bond sale amounted to $263,413. Of that amount, $17,066 was spent
on administrative CIP purchases, $184,639 was spent on Fire
Deptartments CIP purchases and $38,126 was spent on maintenance
department CIP purchases. There remains a balance of $28,833 in
that fund, and administration could use to pay for the telephone
system and the computers.
