Comp Plan Amendment: Elimination of "dip" in Section 3 THe Planning Commission held a public hearing on 12/17/90 on the petition submitted requesting an amendment to the Comp Plan. On a vote of 6-3 the motion was passed to recommend that the City Council deny the petitioners' request to amend the 1990 Lake Elmo Comprehensive Plan, specifically their request to change the Future Land Use Map designation of that portion in the southeast quarter of Section 3 that is presently shown as RED to RAD based on the following Findings of Fact. LAKE ELMO CITY COUNCIL MINUTES DECEMBER 18, 1.990 PAGE 2 t. 1. The Lake Elmo City Council has granted the request of the property owner, Cletus Tauer, to show his property as RED on the Future Land Use Map. 2. The extension of 53rd Street which is currently an illegal cul-de-sac, but allowed as a "temporary" cul-de-sac has been viewed by the Council as an improvement to the health, safety, and welfare of the City. 3. That RED Zoning is not "spot zoning" in this area because it is contiguous to the Fox Fire development to the west. 4. That the designation of RED for Future Land Use of this area is indeed consistent with proper planning of the City. 5. Proper notification was provided for the Public Hearing on the Comprehensive Plan. The Council supported the PZ's recommendation based on their Findings of Fact, but asked the developers to be conscientious of the petitioner's concerns. M/S/P Hunt/Armstrong - to deny the petition to eliminate the "dip" based on the Planning Commission's Findings of Fact. (Motion carried 4-0). B. Conditional Use Permit for advertising sign and variance related to sign: 3M/Nat.i.onal Advertising Company/ Crossroads Collision Center, Inc., 8910 Hudson Boulevard The Planning Commission on an 8-1-1 vote recommended to the City Council the variance not be given for the distance between signs and a variance not be given from the size of the sign and that the City Council deny the Conditional Use Permit based on the fact the applicant showed no hardship due to the land or structures on the property and because economic or financial considerations do not alone constitute a hardship. M/S/P Williams/Hunt - to accept the Planning Commission's recommendation to deny the variances requested by 3M/National Advertising Co./Crossroads Collision Center, Inc. at 8910 Hudson Boulevard, and because the variances have not been granted, the Conditional Use Permit is being denied because the applicant does not comply with the City's regulations. (Motion carried 4-0). D. Limited Business Zoning District LAKE ELMO CITY COUNCIL MINUTES DECEMBER 1.8, 1990 PAGE 3 The Planning Commission voted 5-4 recommending the proposed ordinance for Limited Business Zoning District along I-94 be tabled. The Planning Commission received written and verbal comments on this zoning district. Mayor Dunn and Councilman Hunt thanked the Planning Commission for their efforts to try to finish this Limited Business Ordinance. Even with numerous sub -committee meetings and discussions, they understood why the Planning Commission was not comfortable in passing this ordinance along to the Council. The Council. concurred with Hunt's statement and supported giving the PZ time to develop a good LB Zoning Ordinance. E. Residential Estates Ordinance Review The consensus of the Planning Commission was that the gross density include park land dedication as part of the 20 acre minimum and still have 6 lots .per 20 acres with the 2.5 acre minimum per lot. The PZ indicated our park dedication fee ordinance desperately needs to be looked at. The Council and staff concurred with reviewing our park dedication fee ordinance. Williams asked the status of a request by the PZ for Council direction to resolve the apparent conflict between the R1 areas as shown on the FLUMP, the Comp Plan, and the resolutions referring to no more R1 Zoning in the city. The City Administrator will look into this request and report back to the Council in January. 6. A few days later, the general contractor, C. W. Houle, telephoned me and said he had missed some of the blacktop tickets furnished by T. A. Schifsky when agreeing to final quantities. I told Houle to forward the missing weight tickets to me for verification. The missing tickets totalled about 80 tons of blacktop used to patch the watermain trench through Hagberg's driveways. The work was done by a different paving crew therefore we didn't have the missing tickets either. I have reviewed the tickets and am satisfied"that the tickets represent contract work. Since this is a unit price contract, the contractor should get paid for this work. In that regard, I have revised the Final Estimate and Certificate and the Compensating Change Order to reflect this change. Enclosed for your review and approval are Compensating Change Order No. 1R and Final Estimate and Certificate No. 5R in the amount of $10,159.22. We recormnend that these revised documents be approved and the revised payment amount be forwarded to the developer for payment hi accordance with the Developer Agreement. Sincerely, Lary D. This matter was referred to the City Engineer, I contacted Ron Helfrnan from NSP to investigate the situation and determine if there would be an installation charge. He said there would not be an installation charge. The only charge would be the usual $10 - $13 per month charge for electricity and maintenance. I recommend a street light be installed at that intersection to enhance safety. Sincerely, Larry D. Bohrer, P.E. Jerome Turnquist Deputy Administrator The term of office for David Nordhausen, Woodbury, on the Ramsey/Washington Metro Watershed District, will expire on Febraury 24, 1991. Such a list may be submitted to the County at least 60 days prior to the expiration of the term of office of a manager.
