Present: Mayor Johnson, Dick Johnson, Mottaz, Williams, City Engineers Bohrer and Prew, City Attorney Filla and Administrator Kueffner. �Nboeiit: ITunt. 1. AGENDA. Add: 5C. MINUTES: January 19, 1991 M/S/P Dick Johnson/Williams - to approve the January 19, 1991 minutes as presented. (Motion carried. 4-0). MINUTES: February 5, 1991 M/S/P Williams/Dick Johnson - to approve the February 5, 1991 City Council minutes as amended.. (Motion carried 4-0). 3. CLAIMS M/S/P Dick Johnson/Mottaz - to approve the February 21, 1991 claims #94436 thr.0 #94500 as presented. (Motion carried 4-0). 4. REAPP REPORT A. Contract with Colle & McVoy B. Contract with Pat Forciea M/S/P Williams/Dave Johnson - to direct the City Staff to send a letter to KSTP, to be signed by the Mayor, expressing our appreciation for their donation of the helicopter and pilot time for filming the video tape. (Motion carried 4-0). City Attorney, Jerry Filla, reported that Chris Naylor of Colle & McVoy indicated they would be happy to work with Pat Forciea, and Pat Forciea indicated he would be happy to work as their sub -contractor. Therefore, care would have one agreement with Colle & McVoy and they would. designate, the lobbyist to be Pat Forciea who would work through them and be part (approx. 812,000) of the $57,000. Filla voiced his concern that the Contract was not complete because Exhibit A (Budget for Public Relations Services) was missing from the proposed agreement. Colle & McVoy will have Exhibit A by March 5th. This agreement is retroactive to January 1, 1991. LAKE ELMO CITY COUNCIL MINUTES FEBRUARY 21, 1991 PAGE 2 The Council asked that Colle & McVoy update them at a Council meeting at a time when it would be beneficial or upon Council request. Attorney Filla will send out the draft contract incorporating the Council's changes to Colle & McVoy on Friday, February 22nd. M/S/P Williams/Mottaz - to postpone consideration of contract until March 5th Council meeting or until such time we receive Exhibit A. (Motion carried 4-0). 5. PLANNING/LAND USE AND ZONING: A. Comprehensive Plan Mike Black reported in his memo, dated February 15, 1.991, that on Thursday, February 14, 1991, the Metropolitan Council approved the Lake Elmo 1990-2010 Comprehensive Plan. During the Metro Council review process, the City Council did authorize staff to make certain text and map changes. Those final changes should now be incorporated into final print copies. The staff will request copies of plan that have been distributed in order to update them. M/S/P Dick Johnson/Williams - to direct the staff to print 50 final copies of the 1990-2010 Comprehensive Plan incorporating all final text and map changes. (Motion carried 4-0). B. Proposal to move house into city: Tony Collette Tony Collette, 1125 Roselawn Avenue, Roseville, has applied to move a single family structure into Lake Elmo. The house is currently located at 1075 Hadley Avenue N. in Oakdale and is proposed to be moved to Lot 7, Block .1 of Midland Meadows. Mr. Collette stated there are no covenants on the property according to River Estates and no variances are required. The Building Inspector and Councilman Mottaz have looked at the house and stated it appeared in excellent shape and should transport without major problems. At their February 11, 1991 meeting, the Planning Commission found this structure compatible with other development in the area and recommended the Council approve the moving of this house into the City. M/S/P Dick Johnson/Mottaz - to approve the request of Anthony and Jodi Collette to move the house and garage at 1075 Hadley Avenue in Oakdale to Lot 7 Block 1, Midland Meadows in Lake Elmo providing that the completed building meets all building and zoning codes and that the applicant is held responsible for any damages to city roads or other property caused. by the move. (Motion carried 4-0). C. Request by DNR Joint Meeting with CC and PZ to discuss Shoreland regulations. Councilman Johnson, Mike Black, Wyn John, Jim McNamara and. Administrator Kueffner will attend a seminar on new state shoreland management laws, March 1st at the Days Inn. Obi Sieum, DNR, requested LAKE ELMO CITY COUNCIL MINUTES FEBRUARY 21, 1991 PAGE 3 an hour of the Council's and Planninq Commission's meeting time to go over the process for updating the shoreland regulations. M/S/P Williams/Dave Johnson - to call a special joint meeting at 7:30 p.m. between the City Council and Planning Commission for Monday, March 11, 1991 to discuss updating DNR shoreland regulations. (Motion carried 4-0). 6. CITY ENGINEER'S REPORT: A. Old Village Drainage City Engineer, Tom Prew, reported that at the February 5th Council meeting there was discussion on the possibility of constructing a detention pond on the VFW Ballfield. site. The Engineer was asked at that time to prepare a cost estimate for that option. The Council received preliminary assessment rolls for all four storm sewer options including the preliminary street assessments. B. Diversion of Water to Sunfish Lake Tom Prew explained the city discussed investigating the feasibility of diverting runoff from Schiltgen's Farm fields north of TH5 and west of CSAH 17. Instead of the drainage from these fields flowing through the Old Village, the City would like to divert the water into Sunfish Lake. (see Tom Prew's letter to Karen Chandler, VBWD Enq. 2/12/91). Prew reported he talked to Karen Chandler who stated she would bring this proposal to the VBWD Board, but could not recommend it for the following reasons: the project would double the size of the drainage area going to Sunfish Lake, concern on water quality, cost of acquiring easements, and Sunfish Lake has no outlet. Karen Chandler will be sending a letter incorporating these reasons. The Council indicated the desire to pursue the diversion of water to Sunfish Lake. Therefore, the following motion was made: M/S/P Mottaz/Williams to send letters to all propertyowners on Sunfish Lake explaining the proposal and asking them if they have any objections or if they would like to approach the Council to discuss this proposal. (Motion carried 4-0). Mike Ziniel, 3265 Kraft Cirlcle N., submitted a picture showing water ponding (approx. 10" deep) on his driveway and causing damage to the driveway. This is his fourth winter at this residence and the water problem has increased since he moved in. City Engineer reported this is the first time he became aware of a drainage problem in that area and noted the City has not done any improvements to the street. M/S/P Williams/Dick Johnson - to direct the Building Official and Maintenance Foreman to inspect this problem and report back to the City Council. (Motion carried 4-0). LAKE ELMO CITY COUNCIL MINUTES FEBRUARY 21, 1991 PAGE 4 C. Easement Appraisals - SW1 Watermains Larry Bohrer reported we are now in the easement acquisition phase of the SW-1 Watermain project. There are two utility easements which need to be acquired and. appraisals are necessary before an offer for the easements can be made. Bill Schwab, Pennfield, Inc. has estimated appraisal fees at $500.00 per easement. Both the appraisal fee and. the easement cost will be reimbursed by Washington County. M/S/P Williams/Dick Johnson - to hire Bill Schwab, Pennfield, Inc. to appraise the two utility easements that are required for installation of the SW1 Watermain, with said appraisal fee not to exceed $1,000 and that these costs be reimbursed by Washington and Ramsey Counties in accordance with our agreement for this project. (Motion carried 3-1: Mottaz:There is no such thing as the County paying for this --we are paying for it, anyway. I think Mr. Schwab is overcharging the City.) 7. Appointment of Planning Commission Members Each City Council member recommended candidates for two Planning Commission appointments, First Alternate and Second Alternate. Because Ray Salus and Karin Schubert were the only candidates recommended by all the City Council members, Councilman Williams made the following motion: M/No Second. Williams/No Second - to appoint Ray Salus as First Alternate and Karin Schubert as Second Alternate to the Lake Elmo Planning Commission. In the spirit of co-operation, the following motion was made: M/S/P Mottaz/Dick Johnson - to appoint Jim Mcleod, 2.543 Lake Elmo Avenue N., as First Alternate and to appoint Karin Schubert, 5222 Keats Avenue N., as Second Alternate to the Lake Elmo Planning Commission. (Motion carried 4-0). Parks Commission Appointment: M/S/P Dick Johnson/Williams - to bring back the motion of February 5th to the table. (Motion carried 4-0). Councilman Johnson noted he has interviewed both applicants and would be in favor of appointing Randy Thoreson who is a Planner for Short, Elliot and Henderson and has prior experience with Parks. In the spirit of cooperation, the following motion was made: M/S/P Williams/Hunt - to appoint Randy Thoreson, 4141 Irish Court P.T., as Second Alternate to the Lake Elmo Parks Commission. (Motion carried 4-0). 8. CITY COUNCIL REPORTS: A. Compost Update - Councilman Johnson LAKE ELMO CITY COUNCIL MINUTES FEBRUARY 21, 1991 PAGE 5 The County is proposing to end County funding of the yard waste composting sites after 1991. The 1991 funding for the seven County yard waste composting sites will remain the same as in 1990 with the exception of additional funds provided for site maintenance. The County will continue to provide technical assistance on yard waste composting to cities. The County will assist in notifying the public of the changes in yard waste management planned for 1992. The following options were given cities in 1992: --The cities may continue to operate the compost sites without County funds. -- The Cities may lease or sell the compost sites to private companies which will operate them. --The Cities may close the site and encourage the private sector to establish sites. --The Cities may close the sites and encourage waste haulers to collect yard waste. Councilman Johnson explained this was discussed at the Solid Waste Advisory Committee and the majority of members favored the city continuing to operate the compost site with a gate charge. The Solid. Waste Advisory Committee also reviewed the draft form of the Request for Proposal for Organized Collection within the City. An agreed upon version will be submitted to the City Administrator for typing and then proceed. to the City Council at a later date. Councilman Williams indicated he was in favor of keeping the compost site and operating it on a fee basis, perhaps graduated fee, where Lake Elmo residents pay less than non -Lake Elmo residents as long as the city recovers the operating costs. Williams asked, that the Solid Waste Advisory Committee come back with a proposal. The consensus of the Council was to continue to operate the site and develop a gate charge. Administrator Kueffner indicated the proposed RFP for organized collection deals with collection of all solid waste, and she suggested the Council wait until the proposals are received.. B. Roberts Rules of Order - Councilman Williams Councilman Williams asked this item be postponed until the next Council meeting. M/S/P Williams/Mottaz - to postpone consideration until the March 5th Council meeting. (Motion carried 4-0). C. 1. Creation of Parks Department - Councilman Johnson Councilman Johnson indicated he felt it was time for .placing more LAKE ELMO CITY COUNCIL MINUTES FEBRUARY 21, 1991 PAGE 6 importance on the Parks and Recreation for the City. The Parks Commission, unanimously, recommended a separate Parks and Recreation Dept. be instituted for the City. M/No Second Dick Johnson/No Second - to direct the City Administrator to establish a separate Parks & Recreation Dept. with a supervisor that will report directly to the City Administrator. In order for them to make a decision, the Council asked for the following information: --to direct the City Administrator to contact interested renters and ask them if the City uses the garage, would they still be interested in renting the remainder of the building. --to direct staff (Maintenance Dept., City Admin., Parks Commission) to look at the current way they are doing things and see if some administrative shuffling of time could devote more staff resources to the park without creating a formal department. --to obtain an idea of what this would cost the city to set up this Dept. in terms of replacing Mike, if he gets the job, salary expected for admin. position. Assuming we set up this dept. in 1992, what figure would have to be put in budget. --to consider the option of Parks Dept. being a division within the Public Works. M/S/P Mottaz/Williams - to postpone consideration until these action items can be discussed. (Motion carried 4-0). 2. Rental Property Update The City Administrator reported the former tenant has vacated the building at the city's request and has also made arrangements for a payment schedule. To -date, half of the past due rent has been paid, and we should have the remainder by the end of April. D. Budget - Mayor Johnson In light of the recent proposal by the Governor, Mayor Johnson explained $17,OOO will be cut in state remittance to the City in July, 1991. There will be cuts from LGA, tax equalization aid and HACA. Johnson added the message we are getting is not to rely on state aid, but to rely on our taxing capacity. Johnson felt the City should tell residents in the Newsletter that we are facing a serious deficit problem that may require some tax increases. Mayor Johnson indicated we should look seriously at commercial development along the I-94 frontage to the very maximum extent it can be developed. This may mean requesting the extention of the MUSA to County Road 19 and perhaps a 1/2 mile beyond and to do mirror zoning with Woodbury. Oakdale has told him that they would actively support extention of the MUSA along I-94. LAKE ELMO CITY COUNCIL MINUTES FEBRUARY 21, 1991 PAGE 7 Along the line of cost reduction, Councilman Johnson suggested the City should continue to encourage volunteer activity in the City. The residents have a great history of volunteer work for the City. Johnson referred to a proposal he made at an earlier meeting to establish a Maintenance Advisory Committee with the function of looking for cost reduction within the maintenance dept. and to advise the Council of major purchases. At the next meeting, Councilman Johnson will bring a recommendation on the function of the Maintenance Advisory Committee. The CIP committee will look into options for a Fire Dept. such as looking at a county -wide fire dept. E. "Coffee Break" - Mayor Johnson The Stillwater Area Chamber of Commerce and Lake Elmo City Council will hold a "Coffee Break" on Tuesday, February 26th, 8:00-9:00 a.m. at City Hall. 9. CITY ADMINISTRATOR'S REPORT: A. Furnace for Maintenance Bldg. (Cont.) The Maintenance Dept. received three bids for a 90% efficient gas furnace. The bids received. are: Apollo Heating - $2895.00 Hoffman Heating - $3050.00 Schwantes Heating - $2807.00 M/S/P Williams/Dave Johnson - to award. the bid to the low bidder, Schwantes Heating in the amount of $2807.00 to be taken out of the 1991 Equipment, Parts & Repairs Budget as recommended by the Finance Director, for a 90% efficient gas furnance for the Maintenance Building. (Motion carried 3-0-1 Abstain: Mottaz). B. Word Processor for Maintenance Dept. The Maintenance Dept. has requested permission to purchase a Brother WP-75 (approx. $500) word processor. The Maintenance Dept. feels they could keep better records of its inventory, the 201 maintenance, water records, equipment repair and maintenance. M/No Second Mottaz/No Second - to authorize the Maintenance Dept. to purchase the Brother WP-75 word processor up to the amount of $500. Councilman Williams asked that this request be remanded to the CIP Committee to investigate if a word processor over the long term would be the right purchase or would a personal computer be a better investment. M/S/P Dick Johnson/Williams - to remand this request for study to the CIP Committee as they are in the process of considering computer purchase for City office. LAKE ELMO CITY COUNCIL MINUTES FEBRUARY 21, 1991 PAGE 8 The City Administrator will set up a meeting to discuss this request with the CIP Committee, the City Admin. and Maintenance Foreman (or designee) as soon as possible. C. West Sunfish (Landfill Park) Update The City Administrator and City Attorney have met with Washington County staff regarding a request by the City that the County buy back the 100 acres that the City purchased for park land after the closing of the Sanitary Landfill No. 1. The County is willing to buy back the 100 acres at the price we paid ($75,000) less whatever the city wants to keep; i.e., public works site, fire station #2, compost site and the existing park trails. Councilman Mottaz requested more information on this item before any Council decision is made. Mottaz felt this landfill situation has to be cleaned up. At some time this is going to be an ideal piece of property and he would rather it be an ideal piece of Lake Elmo property rather than owned by Washington County. Mottaz added that both Ramsey and Washington County have walked all over Lake Elmo from the very beginning. Now, they are giving us a gift by offering $680 an acre. The Counties should have come in and put in the entire water system, and it should have been Lake Elmo's rather than now we have our development in that area controlled by Oakdale. Councilman Johnson noted he shared Councilman Mottaz's feelings, but asked what legal advantage does the City have to hold onto this portion of the site that has the buried waste. He does see these funds as helning with our budget constraints or applied to a new narks dept. Councilman Williams explained the MCPA tells the County whether or not they have to clean up the landfill (that is physically dig up the trash). The PCA has said they are not going to do that as long as the air stripping operation and barrier wells contain the plume. Williams suggested. we get our money back with interest because the residents have paid interest on that money thru their park bonding. Williams asked that the City tell the County, "we want all our money back plus interest, plus we want the land for our maintenance building as compensation for the amount of heartache and hardship the residents of this City have gone through. Williams did not see any advantage to our keeping the land under which is leaking waste. Williams stated "no one in this room will live to see the day the landfill is cleaned up". T1/S/P Mottaz/Dick Johnson - to postpone discussion until the Parch 5th meeting for the purpose of evaluating the economic or legal rationale for holding onto this property. (Motion carried 4-0). The Council acknowledged the amount of work and recognized the efffort the City Administrator has done to get to this point in negotiating with the county in this matter. D. Resolution No. 91-8, A Resolution prohibiting the transfer of real estate within the city of Lake Elmo without City approval LAKE ELMO CITY COUNCIL MINUTES FEBRUAR.Y 21, 1991 PAGE 9 The City received a letter from Washington County relating to subdivisons. In 1983, the City had requested in letter form that the County not accept for recording any subdivisions that did, not have city approval. Without a formally adopted and record.ed resolution, the county would accept such a record. In 1987 the City adopted such a resolution for Lanes DeMontreville; therefore, we no longer have a problem with illegal subdivisions occuring. M/S/P Williams/Dick Johnson - to adopt Resolution No. 91-e prohibiting the subdivision of Real Estate within the City of Lake Elmo without approval, by resolution, of the Lake Elmo City Council. Further, that the staff is directed to record resolution 91-8 with the County recorder. (Motion carried 4-0). E. Request to cut trees down on city property: Jess Mottaz Councilman Mottaz has requested permission from the City to remove two dead oak trees from the city -owned, unimproved 60 foot road easement. M/S/ Dave Johnson/Dick Johnson - to grant the authority to Jess Mottaz to cut down two oak trees on city -owned property; contingent on Mr. Mottaz providing to the City a waiver of liability. M/No Second -Williams/No Second - to amend the motion to include approval is contingent on an agreement of the location and condition of trees between Mr. Mottaz and the city code enforcement officer. M/S/P Dave Johnson/Dick Johnson - to grant authority to Jess Mottaz to cut down two oak trees on city -owned property; contingent on Mr. Mottaz providing to the City a waiver of liability. (Motion carried. 2-1-1: Abstain: Mottaz, Williams: He was not opposed to the removal of the trees by Mr. Mottaz, but felt this should be subject to an agreement by the city code enforcement officer of the location and condition of the trees.) Councilman Mottaz indicated he would inform the code enforcement officer of the location and condition of the trees. F. Clerks Conference The Administrator and Deputy Clerk requested. Council approval to attend the Municipal Clerks and Finance Officers Annual Conference held on March 19-22, 1991 at the Sunwood Inn in St. Cloud at a cost, which has been budgeted, of $396. M/S/P Mottaz/Williams - to authorize Mary Kueffner and Sharon Lumby to attend the Municipal Clerks Conference, March 19-22, 1991, at the Sunwood. Inn in St. Cloud, MN in the amount of $396. Comprehensive Plan: Attached is a letter from Mary Anderson, Chair of the Met. Council indicating approval of our Comp. Plan. As indicated by Mike Black at the last meeting, and as stated in the letter, this approval excludes our policy opposing the proposed landfill in the park. 3. Highway 5 Discharge Outlet: Attached is the most recent report submitted by Wenck Associates, Inc. to Washington County. Please note that because the sample results exceeded the NPDES prevention level, testing will be done once a week rather than once a month. I feel that we must closely watch the levels of contaminents that -are leaving the site, and I will keep you posted as the information becomes available. 4. MSA Funds Attached is a memo from MN/DOT regarding MSA Fund Balances. This memo reinforces our City Engineer's past comments that if the City does not proceed with some sort of MSA project, it will indeed loose the funding. Kisumu, Kenya PROGRESS REPORT Project: EIS Review for Proposed Landfill Site G in Lake Elmo Project #: 5175.001 Date: February 21, 1991 Reporting Period: 11/26/90 - 1/25/91 Activities Undertaken During the Reporting Period During the reporting period (November 26 to January 25) DPRA reviewed the "Engineering Design Concept Technical Memorandum", November 1990, to obtain values for the input parameters to DPRA's Municipal Landfill Failure and Release Model. DPRA also began reviewing the literature to determine "typical" municipal landfill leachate constituents for use in landfill release and groundwater modelling. Subcontractor labor and expenses for September, October and November are included on this invoice. During that period, Geraghty and Miller staff continued their modelling analysis of Site G, initially using a single layer analytic element model. Activities Anticipated Next Month During the next reporting period, DPRA will identify "typical" organic and inorganic leachate constituents, their concentrations, and how those con- centrations change over time. This will be incorporated in our source term model to assess constituent release rates and concentration profiles for input in Geraghty and Miller's groundwater model. Fletcher Driscoll will provide expert testimony on Site G hydrogeologic conditions through a video being produced on the Lake Elmo landfill siting process. Changes in Personnel and Schedule No changes in personnel are anticipated. The planning effort concentrated on two objectives: 1) To reflect accurately the city of Lake Elmo's current policies regarding planning, land use, zoning and development; and 2) To provide a basis for guiding Lake Elmo into the 1990's and beyond. AUTHORITY TO REVIEW The Metropolitan Land Use Planning Act of 1976 requires that amendments to local comprehensive plans be prepared, submitted to the Metropolitan Council for review and adopted in the same manner as the original plans (Minn. Stat. 473.864, subd. 2, 1978). Guidelines adopted pursuant to Minn. Stat. 473.864 for reviewing proposed amendments provide a 90-day review period for amendments potentially affecting one or more of the metropolitan systems, and a 60- day review period for amendments that do not have a potential impact on metropolitan systems. The city of Lake Elmo initially submitted its proposed comprehensive plan amendment on September 28, 1990. That initial amendment was deemed incomplete whereupon the city submitted additional information on November 21, 1990. On December 5, 1990, the Chair determined that the amendment presented a potential impact on the metropolitan sewer system. Therefore, the 90-day review period applies and will conclude on February 25, 1991. Documents submitted in support of this plan amendment included: 1. Lake Elmo Comprehensive Plan, 1990--2010. 2. Revised pages 45-50 of the plan (Changes requested at meeting of October 25, 1990) ANALYSIS METROPOLITAN DEVELOPMENT AND INVESTMENT FRAMEWORK The plan contains a discussion of future population, households and employment for the city of Lake Elmo. The Metropolitan Council forecasts a population of 6,200 in 1990 (final census counts for Lake Elmo in 1990 are 5,903 people) and a population of 6,600 in 2000. The plan states, however, that "if the number of new residents per year remains stable, the population will be close to 7,500 by the year 2000." The city's plan forecasts a population of 8,210 in 2010. The Metropolitan Council forecasts 2,100 households for the city of Lake Elmo in 1990. (The preliminary 1990 census indicates there were 1,967 households in Lake Elmo in 1990). The city's plan indicates 2,095 households in 1990 and 2,551 households in 2000. The Metropolitan Council forecasts fewer households (2,300) in 2000. The city's plan forecasts 2,800 households in 2010. The plan records 1990 employment of 970 in Lake Elmo, while the Metropolitan Council forecasts 1,400. Both the Council and the plan forecast 1,500 employment in 2000, while the plan forecasts employment of 1,800 in 2010. The plan states (p. 22) that "People move to Lake Elmo because the community offers an alternative to standardized suburban communities. Lake Elmo offers a wide variety of lifestyles...." The plan indicates that "further development at one house or business per 1.5 acres is inconsistent with regional planning policies and is inconsistent with Lake Elmo's desire to maintain an attractive, uncrowed atmosphere." It also states that "the Metro Council's recommendation of one house per 10 acres seems overly restrictive, especially in light of existing development densities of nearby communities." The plan goes on to settle on a compromise density of 3 units per 10 acres with a minimum lot size of 2.5 acres. This is inconsistent with the Metropolitan Council's rural area policy of 1/10 on a 40 acre basis. NATURAL RESOURCES (Frost) Sanitary sewer is available only in two small portions of Lake Elmo. Approximately one square mile located in the southwest comer of Lake Elmo is inside the Metropolitan Urban Service Area (MUSA) and is served by the Metropolitan Waste Control Commission WONE Interceptor. (A substantial portion of this land has been annexed to Oakdale). The other system is a privately owned and operated collection system and treatment plant serving Cimarron, a mobile home park. The remaining residences and businesses rely on private on -site septic systems, some with joint drainfields designed under the 201 program. After the initial submission, the natural resources staff had concerns about several areas that were not addressed in the plan. The plan needed additional information on private wastewater systems, group on -site systems, and policies on infiltration and inflow. Subsequent to the initial review, the staff met with representatives of the city and outlined specific needs. Following the meeting the city submitted specific information which analyzed individual on -site and cluster septic systems and packaged treatment plants and goals and policies for individual on -site and cluster septic systems and packaged treatment plants. The city also submitted maps showing the Tri-lakes Area Off -site and Cluster Septic Systems as well as the Old Village Area Off -site and Cluster Septic Systems. In reference to the individual on -site and cluster septic systems and packaged treatment plants, the plan states that the city participated in the 201 program to correct private septic systems. It states: "Over 100 residences and businesses received new individual systems or were connected to new cluster systems." The plan further states that "A dedicated area of 20,000 square feet of land suitable for an on -site trench system is required for each new residential lot in the city." The plan also quotes city codes (Section 707.050) which lay out requirements for cluster septic systems. In the Goals and Policies section of the plan, the plan states the policy "to require that the design and construction of any public sanitary sewer eliminate excessive infiltration and inflow and be in compliance with current acceptable engneering standards and those set by the Minnesota PCA." The goal in regard to "Individual On -site and Cluster Septic Systems and Packaged Treatment Plants" is "to allow properly designed cluster treatment systems for multiple properties only where existing individual systems have failed." and "to prohibit private package treatment systems for new development." Under the policies section, the plan states: "To assure proper functioning of on - site individual systems by requiring proper site location, system design, installation, inspection, and maintainence of each system." The staff of the Natural Resources Division is satisfied with the changes as proposed by the city. There will be no regional impact from flows as projected in the plan since there is adequate capacity in the WONE Interceptor to serve the wastewater flows as shown, provided the approved flows from the city of Oakdale are not increased. TRANSPORTATION (Braden) The city's transportation goals and policies are consistent with those of the Council. However, Lake Elmo's population/household forecasts are higher than those of the Council. Distribution of population/households/employment by TAZ is different than that of the Council, in part because the city uses higher numbers but also because the proportionate distribution is different. The Council has no information indicating that the city responded to the Council's request to review TAZ distributions. The functional classification of the city does not match that adopted by the Transportation Advisory Board. Specifically, the city shows several roads identified as collectors that are designated minor arterials on the TAB map. If the city wishes to change the designation of some of these roads, it should submit a- request to the Transportation Advisory Board to make any other necessary changes to classification of specific roadways. The city of Lake Elmo should be aware that the city of Woodbury is proposing an extension of Bielenberg Drive as a minor arterial (connection to Helmo Avenue) into Lake Elmo. The plan describes existing transit service, but it does not elaborate on potential needs such as services for the elderly/disabled. The city should add information to its public transit discussion. Additional comments regarding transit from the Metropolitan Transit Board are contained in Attachment A. AIRPORTS (Case) The Lake Elmo amendment appears to cover the main points dealing with land use compatibility between the community and the Lake Elmo airport. This is accomplished through control of future land uses in the airport runway approaches by recognizing the land use safety zones of MnDOT Aeronautics, and density controls on development outside the MUSA. However, the Aviation text on page 34 of the Plan does not indicate if the runway safety zoning and airspace hazard zoning over the entire community is covered under a joint MAC/Community zoning board. If the joint board is operative, it should be referenced in the system text, goals and policies, and implementation section. These matters were likely addressed in the original comprehensive plan, but should be repeated in the revised plan to ensure the control of airspace obstructions, public airport investments and safety of both aircraft operations and persons on the ground. In the event that a joint zoning board has not been established or an airport zoning ordinance implemented, all effort on the part of the Community and the MAC should be undertaken to put both into effect. This is especially important in 1991 since the Lake Elmo airport comprehensive plan is being prepared by MAC and any changes taken into account. PARKS (Stefferud) The Lake Ehno Comprehensive Plan properly identifies the regional park reserve. The plan, however, states on page 39: "Washington County has proposed to the Metropolitan Council that a landfill occupy 300 acres on the western border within the park [Lake Elmo Regional Park Reserve]. The city of Lake Elmo continues to oppose this landfill." While the Council does not suggest that any part of the regional park reserve be automatically converted to any other use, the city should be aware that state law regarding the siting of solid waste facilities precludes exempting any land from the search areas for sites for solid waste facilities. The Council also has responsibilities for siting or providing for a number of regional services. For these reasons, the Parks and Open Space Plan contains a policy allowing for park land conversion when a higher public interest is served. The Council would take into consideration Lake Elmo's views and views of any other interested parties before making a determination about whether to convert some parkland to another use; however, the final determination is to be made by the Council. Policy 21: The conversion of regional recreation open space areas to other uses shall be allowed only when it is in the public interest and no alternative exists. Such a conversion shall be allowed only upon joint agreement under terms developed jointly by the implementing agency and the Metropolitan Council. Application of policy 21 directs the Council to consider whether there is an alternative site for the landfill outside Lake Elmo Regional Park Reserve. If no such alternative exists, then the Council and Washington County (the park implementing agency in this case) would have to jointly develop and agree on terms for converting part of the park reserve to a landfill. Such terms would need to address protecting the rest of the park reserve and its visitors from any potential negative impacts of the landfill. Once those terms were developed and agreed upon, the Council would then have the basis for removing the restrictive covenant on that portion of the park reserve hosting the landfill SOLID WASTE (Smith) The comprehensive plan states on page 41 the city's policy of "continuing to resist the construction of a landfill in the Lake Elmo Regional Park Reserve." This policy is preceded by text on pages 38-40 that describes the city's efforts to oppose the candidate site. . This policy is inconsistent with the Landfill Development Schedule in the Solid Waste Mannement Development Guide/Policy Plan that directs Washington County to develop 2,494 acre-feet of landfill capacity by 1993. Moreover, Guide criterion 4a states: Solid waste facilities should be compatible, to the extent possible, with Council land use policies. The Council will consider county and local comprehensive land use plans. Lack of compatibility with land use policies and plans shall not preclude Council approval of a waste facility, if waste management policy considerations must take precedence. The text of the Guide states: Waste facilities rarely meet local land use planning requirements. Override of local vetoes may be necessary in some circumstances. The Waste Management Act gives counties the authority to override local vetoes to establish waste processing and land disposal facilities (Minn. Stat., sec 473.811, subd. 4a and sec. 473.823, subd. 5) The Council must approve the override. The city should revise its plan to delete its policy opposing the landfill. HOUSING (Dougherty) The plan amendment provides a thorough summary and analysis of the current housing stock in Lake Elmo. It notes that 71 percent of the current housing stock of 2,037 units are single family, 25 percent are manufactured housing units and 4 percent are a combination of multifamily and townhouse units. Ninety one percent of the homes in Lake Elmo are owner -occupied. The plan identifies the existing mix of residential land uses and the potential land available for housing, as well as the density proposed for each. The official controls in Lake Elmo permit the construction of a range of housing sizes and types. Because the city wants to maintain its rural character, lot sizes have been established based on the need to keep further development at a low rural density and avoid the need for extension of urban services. The community feels lot sizes of at least 2-1/2 acres are desirable in order to achieve these environmental goals. The plan notes that Cimmaron manufactured housing park is an exception to the zoning ordinance, as it was permitted prior to the current zoning ordinance. The park provides the city with low and modest cost housing and makes up nearly 25 percent of the housing units in the city. The park occupies nearly 200 acres and has about 500 occupied manufactured housing units, and its own water and sewer system. The city's Rural Residential category permits housing on land with at least 10 acres and allows cluster development of up to four housing per 40 acres on lots of 5-7 acres each, a policy consistent with Council policies established for the rural area. Another classification is being proposed that would allow three units per 10 acres. This density is not consistent with current Council policies for the rural area. Goals and policies identified in the plan state the importance of restricting residential development to densities that will avoid the extension of services outside the presently defined MUSA boundary. In support of this, the city proposes that there be no more R-1 zoning (1.5 acres per house) allowed in the city. However, establishing a new zoning category for residential development with a minimum lot size of 2.5 acres per unit and maximum density of 3 units per 10 acres is contrary to Council policies. Additional housing policies indicate that urban residential development at medium to high density will be permitted only in areas within the MUSA and served with central sewer and other necessary public services and utilities. As the plan notes that nearly 60 percent of the city's housing units were built between 1960 and 1980, they may soon be reaching an age where they need some maintenance. The city may want to identify goals and policies that would address property and code enforcement to encourage this. FINDINGS 1. The policy of the Lake Elmo Comprehensive Plan of allowing a density of three units per 10 acres with a minimum lot size of 2.5 acres per unit is not consistent with the Council's rural area policies. 2. The Parks Commission discussed this at its February 11 meeting, and its 'recommendation is, attached. From the staff's point of view, I never looked at this in terms of creating a new department, but rather splitting a larger existing department. With the number of parks that we have, and the pride the City has taken in maintaining these parks, along with t! the fact that.we now have the opportunity to use a city -owned building for city -related purposes, I thought it the onn.ortune time to look at this option. Just as. important is the fact that we have about 50 miles of city streets, with more to come with the passing of our Comprehensive Plan and RE zoning district. Street maintenance, such as Patching is a summertime job which keeps our maintenance forman busy. The majority of parks maintenance is also done in the summer (except for the maintenance of skating . rinks) so we have two very time-consuming projects, both demanding an equal amount of time. In the winter time, the number one priority of both'of these departments should be to keep our roads cleared and sanded. For those of you that have not been over to the building, I would suggest that you do check it out. There is a pretty good sized bay area that could hold most, if not all, of the parks equipment. There is a very nice "meeting room" area that could be used by not only the Parks Department, but possibly ReAPP (we still have the old copy machine that could be moved over there), and also by the VBWD (they could use our council chambers if they ever need more room for such things as public hearings etc.) as could ReAPP. (OVER) File cabinets that are stored here at the city office for both ReAPP and VBWD could also be moved over there, as there is a room that would be ideal for storage. On the downside, the City would lose potential income from rental property, but keep in mind, if we do rent to the private sector, we lose tax exempt status on the property. Therefore, we would be taxed at a commercial rate (Twill have an estimate on that figure at the meeting). As noted in the Parks Commission's recommendation, the only capital outlay would be a small truck for hauling parks equipment (cost was estimated between $5,000 and $10,000), furniture, telephone and tools at an esimate of $1,000. PARKS & RECREATION DEPARTMENT The Parks Commission recommends that a separate Park Department be instituted for the City of Lake Elmo. Further that the job of Tree Inspector be added to the new parks department and further that the parks department be physically located in the city owned vacant building at 11194 Upper 33rd Street. The Parks Commission members have offered to help locate furnishings for the new department: desk, table, chairs. The City needs to purchase: one vehicle to pull equipment, $1,000 for small tools, install a telephone. The Parks Commission will hold their meetigs in the new facility. The City Hall kitchen is really not adequate for meetings which fall on the same night as a council or planning commission meeting. Our proposal would be to intercept the culverts crossing TH 5 and divert the water via ditches and culverts along the south side of TH 5. The water would discharge to a low area west of Klondike Avenue, between the railroad tracks and TH 5. An overflow from the low area to Sunfish Lake would be constructed. (See Sketch Plan) We, of course, realize that this proposal conflicts with some of the Watershed Rules; however, we feel that for reasons listed below, the proposal should be seriously considered by the Watershed District. Diversion of the runoff from these fields will significantly reduce flooding problems in the Old Village area. 2. This project would reduce the amount of water flowing to Downs Lake. 3. This project would create additional pond'ung and wetland area in the City. 4. Additional runoff to Sunfish Lake would help to maintain the lake level; thus reducing the potential for winter kill of fish. 5. We feel the available storage in Sunfish Lake (760 Ac. Ft.) is sufficient to contain the proposed total 100-year runoff event (350 Ac. Ft.). EY: FURNACE FOR MAINTENANCE BUILDING QCENCA EY: In December, 1989, it was determined by Oakland Heating that repairing the electric furnace in the lunchroom and bathroom at the maintenance building was just not feasible. Since that time, these two areas have been heated with 2 plug-in electric.heaters. The maintenance department got.three bids for a 90% efficient gas furnance. This has extra capacity to cover any future expansion at the site. (There are plans on file that show expansion to•include an office and lunchroom at some point in time). Regardless of whether we ever expand the site, I feel we should provide a cost-effective means of providing heat to the areas.
