Absent: Councilman Hunt. M/S/P 11OTTAZ/DAVE JOHNSON - to instruct the Planning Commission to hold a public hearing at their earliest possible date, to be determined by staff when all the work is done to hold such a hearing, for the purpose of considering changing the comprehensive plan by extending the DIUSA to a maximum of a 1/2 mile East of County Road 19 and a 1/2 mile North of the Freeway with the cost of the study for expansion of the MUSA Line to be taken out of the $17,000 Sewer Reserve, but not to exceed $10,000. ORIGINATING - DEPARTMENT. BY: APPROVED FOR AGENDA BY: The City has received an inquiry from Northland Investment, the owner of approximately 180 acres which borders County Road 13 and I-94. ' In an very preliminary. way, this property is under consideration for a 300,000 to 350,000 sq.ft. building, strictly for office use. Not unlike what West Publishing had in mind,'this company (which has yet to be made public) is looking for a minimum of 50 acres so its development would have a campus -type setting. ( To accommodate a development of this nature, the City would have to petition for an expansion of the MUSA. This would require a major amendment to our Comprehensive Plan. Before the landowner will proceed with pursuing this with the company:that is looking for a site; he would Pike a favorable commitment from the Council that it would indeed favor a MUSA expansion. Mayor Johnson has invited a representative from the League of Minnesota Cities to talk to the Council about different financing options that are available. Any council member who wishes to attend should let me know.at this special meeting so I can make the necessary reservations. �j City to Study for MUSA Extension In response to a request from a property owner on I-94, the City Council directed the staff to study an area bound by County Road 13 on the West, 1/2 mile East of County Road 19 on the West and North 1/2 mile,for a possible extension of the Municipal Urban Service Area (MUSA). Upon completion of the study, the Council has directed that a- public hearing be held, and that formal application be made to the Metropolitan Council for a MUSA extension. If this request is approved by the Met. Council and the plan is accepted by the City Council, it would enable the City to accommodate a higher density. of commercial development on 1-94. Councilmember Hunt was not present. A motion to instruct the Planning Commission to hold a public hearing at their earliest possible date, determined by staff when all the work is done to hold such a hearing, for the purpose of considering changing the Comprehensive Plan by extending the MUSA to a maximum of a half -mile east of County Road 19 and a half -mile north of I-94. This direction given to staff by the City Council will require a major amendment to the City's Comprehensive Plan and review by the Metropolitan Council pursuant to Minnesota Statues 473.854 (1982). A major amendment is defined as a change in the Metropolitan Urban Service Area (MUSA Line) involving 40 acres or more. The amendment is subject to a maximum 90 day review by the Metropolitan Council. The primary focus of their review is to determine the amendment's impact on the regional systems - sewers, parks, airports and transportation and its consistency with other chapters of the Metropolitan Development Guide. The Metropolitan Council will require the City of Lake Elmo to modify the proposed Comprehensive Plan Amendment if it is found to have a substantial impact on the Metropolitan system plans. The amendment to the City's Comprehensive Plan must be submitted by Lake Elmo to the Metropolitan Council following action by the Planning Commission and the City Council whose action must be conditional upon completion of the Metropolitan Council review and the Metropolitan Council's determination of regional systems impact. The City Council's direction to study and consider an expansion of the MUSA Line in Lake Elmo is in direct conflict with the following public sewer goal stated in the Comprehensive Plan: * To prevent the extension of public sewer beyond the current limits of the M.U.S.A. Lake Elmo April 29, 1991 Page 2 A four -fifths vote of the City Council is required to pass an amendment to the City's Comprehensive Plan. Hill, Inc.: * Base map of the study area. * Property ownership map. * Existing land uses. * Existing zoning map. * Natural features - soils, topo, wetlands. * Existing Future Land Use Map. * Proposed Future Land Use Map changes. * Estimated area of "buildable" acreage. TKDA: * Estimated sewer flows based upon Future Land Use changes. * Infrastructure planning showing location and timing of interceptors including possible intercommunity connections to Woodbury and Oakdale. * Estimated cost for infrastructure. Once the above information is complied preliminary discussions will begin with the Cities of Woodbury and Oakdale, the Metropolitan Waste Control Commission and the Metropolitan Council staff.
