LAKE ELMO CITY COUNCIL MINUTES
APRIL 2, 1991
Mayor Johnson called the City Council meeting to order at 7:04 p.m. in
the City Council chambers. Present: Mayor Johnson, Hunt, Dick
Johnson, Mottaz, Williams, City Engineer Tom Prew, City Planner Mike
Black, City Attorney Jerry Filla and Administrator Kueffner.
MAYOR JOHNSON MADE THE FOLLOWING PROCLAMATION:
WHEREAS: THE BASIC PURPOSE OF THE ANNUAL SALE OF BUDDY POPPIES BY THE
VETERANS OF FOREIGN WARS IS ELOQUENTLY REFLECTED IN THE DESIRE TO
"HONOR THE DEAD BY HELPING THE LIVING" THEREFORE, I DAVID JOHNSON,
MAYOR OF THE CITY OF LAKE ELMO DO HEREBY URGE THE CITIZENS OF THIS
COMMUNITY TO RECOGNIZE THE MERITS OF THIS CAUSE BY CONTRIBUTING
GENEROUSLY TO ITS SUPPORT THROUGH THE PURCHASE OF BUDDY POPPIES ON THE
DAY SET ASIDE FOR THE DISTRIBUTION OF THESE SYMBOLS OF APPRECIATION OF
THE SACRIFICES OF OUR HONORED DEAD.

5. REAPP REPORT
ReAPP member, Tedi Carlson reported that Washington County has written -------
a letter of support for the recharge bill and drafted a resolution
which they will adopt at their next Board meeting. The Inventory Sites
Bill will be discussed further by the Board before a resolution is
passed.
The Met Council passed a resolution to eliminate regional parks and
Dayton (Mississippi critical river area) from the inventory for
landfill sites.
On March 26 a presentation was given to the Washington County .Board..
Mary Kueffner gave the introduction, Pat Forciea gave a legislative

update, the landfill video was Played, and Chris Naylor presented them
a press kit.
Pat Forciea will update the Council on his activities at the April
16th Council meeting.
6. PLANNING/LAND USE & ZONING:
A. PUBLIC HEARING: Gregory Lohmer, 8199 Hill Trail N.
Variance to side yard setback and variance to OHWM
Mayor Johnson opened up the public hearing at 7:16 in the City Council
chambers. The Public Hearing notice was published in the St. Croix
Valley Press on March 20, 1991 and adjoining property owners were
notified.
Gregory Lohmer, 8199 Hill Trail N., is requesting a variance from the
sideyard setback requirements to construct a deck on the north side of
his house. The deck would come to within 6" of the north property
line. He is also requesting a shoreland permit with variance to
reconstruct a deck and add a lattice shade structure at the OHWM along
with extensive landscaping on the lake side.
Darrel Paulsrud, 8195 Hill Trail No. noted he did not dive nermission
to build up to the property line, but would be in agreement if Lohmer_
kept the deck within code of 10 feet from the property line.
Mayor Johnson closed the public hearing at 7:20 p.m.
The Council received a letter from molly Shodeen, DNR, dated March 28,
1991, indicating it is their recommendation that if the deck is to be
rebuilt that it be removed from the bed of the lake and constructed
out of the flood plain. Once our shoreland ordinance is revised, the
city will determine whether they wish to allow these type of
structures or if they wish to be more restrictive.
The Council received a letter from Karen Chandler, Barr Engineering,
dated March 25, 1991, indicating their concern that the proposed
landscaping may result in the placement of fill within the floodplain
of Olson Lake. On Olson Lake, you are limited to placing no more than
1.7 cubic yards of fill per foot of shoreline in the floodplain. It
appears that Mr. Lohmer has 144 feet of shoreline; therefore, he would
be allowed to place 245 cubic yards of fill. The floodplain of Olson
Lake currently extends up to Elevation 931.5 feet, but the DNR is
considering changing that elevation.
The Council agreed that the existing deck should be allowed to be
rebuilt, but did not believe it should be rebuilt in the flood plain.
Mr. Lohmer was willing to postpone consideration of the lake deck
variance request until such time he decides to come back to the City
for action. Therefore, he would not have to pay another fee, the
application is still active, the DNR will have come to a decision on
the flood elevation. The following motion was made:

M/S/P Williams/Dick Johnson - to postpone consideration of Gregory
Lohmer's request for construction of a lakeside deck variance request
until such time as the applicant comes back to the City for action for
6 months. After 6 months, the existing request will be terminated.
(Motion carried 5-0).
M/S/P Mottaz/Hunt - to deny the request for the sideyard setback
variance based on the (1) lack of a hardship and (2) the request of a
variance for 6" where 10' is required is too close to the neighbor's
property line. (Motion carried 5-0).
B. Shoreland Permit: Gary Lee, 9344 Hidden Bay Trail
Gary Lee, 8344 Hidden Bay Trail, is requesting a shoreland permit to
construct a 20' x 20', two level deck to the house on the lake side.'
There will be a 3' wood stairway with periodic landscaping leading
from the deck to a natural trail toward the back (as shown in the site
plan submitted to the City). Since the deck and stairway are not in
the OHWM, no variances are required.
M/S/P Williams/Dick Johnson - to grant Gary Lee, 8344 Hidden Bay
Trail, a shoreland permit for the purpose of constructing a two level
deck and stairway based on no variances are required and all
structures will be more than 75' from the OHWM. (Motion carried 5-0).
Cl. Arabian Hills: Rezoning
At their March 25th meeting, the Planning Commission recommended
approval for the rezoning of the property to be known as "Arabian
Hills" from Rural Residential to Residential Estates.
M/S/P Hunt/Williams - to adopt Ordinance 8041 rezoning the property
described in said ordinance from Rural Residential to Residential
Estates based on the fact that the land conforms to the 1990
Comprehensive Plan's Future Land Use Map and on the recommendation of
the Planning Commission at its March 25, 1991 meeting, and it is the
intent of the Council to have the minutes of the meeting and motion
serve as Findings of Fact. (Motion carried 5-0).
2. Arabian Hills Preliminary Plat
At its March 25, 1991 meeting, the Planning Commission on a 6-0-1 vote
recommended that the Council grant preliminary plat approval to
Arabian Hills; subject to the resolution of the park land dedication
and to the plat meeting all the recommendations listed (1-7) of City
Planner Black's report dated March, 8, 1991.
M/S/P Mottaz/Williams - to postpone action on this item until after
Agenda Item 6F. is discussed. (Motion carried 5-0).
M/S/P Williams/Mottaz - to amend the Council agenda to consider Item
6F at this time. (Motion carried 5-0).

F. Recommendation of Park Land Dedication Requirements
The Council reviewed draft Ordinance No. 8042 prepared by Mike Black
and approved by the Parks Commission. The Council made the following
changes:
401.400 Park Land. Dedication Requirements
A. Land Dedication
Mayor Johnson suggested raising the figure of 2.5% of the
total land in a proposed commercial subdivison to a higher percentage.
Councilman Dick Johnson suggested rounding the figure off to 3% as a
compromise.
B. Contribution in Lieu of Land:
Councilman Williams suggested added wording as stated in
our code Section 401.400A: The form of contribution (Cash or land., or
any combination thereof) shall be decided by the City Council.
E. Cash Contributions:
Councilman Johnson asked the following sentence to be added
after the sentence,..... from a licensed real estate appraiser. "The
reasonable portion shall be 7% of the total land in a proposed
residential subdivision and 3% of the total land in a proposed
commercial subdivision.
M/S/P Dick Johnson/Hunt - to direct the City Attorney to prepare a
formal ordinance for Council adoption based upon this proposed
ordinance and the amendments discussed. (Motion carried 5-0).
Mike Black pointed out there was a Resolution establishing- park -
dedication fees for residential subdivisions of three or less parcels.
The Parks Commission did review this resolution. This resolution will
be brought back at the same time the final draft of the ordinance is
reviewed.
M/S/P Hunt/Williams - to bring back for Council consideration the
Arabian Hills Preliminary Plat Approval. (Motion carried 5-0).
Issues of discussion: park land versus the cash dedication, Lot 10
grading and drainage, landscaping on the proposed subdivision;
particularly along 53rd Street, and landscaping (screening) from
traffic on the impacted neighboring Keith Raleigh property
Larry Lisles, the developer of Fox Fire Manor, noted. that his company
has entered into an agreement with the developer of Rolling Hills
(Roger Kolstad) that upon preliminary plat approval of Rolling Hlls,
Lisles' company will (based on certain conditions) buy the property.
Lisles stated that there is no land available in Fox Fire Manor to
dedicate for parkland, however, there is approximately four acres in
the proposed Rolling Hills plat which abuts the Korhel property to the
south that could be dedicated for parkland and combined. with Mr.
Kohrel's parkland dedication when his land is developed. It has also
been proposed all along that the Kohrel property would have access to
the street through Rolling Hills.

M/S/P Mottaz/Dave Johnson - to accept the new park dedication
ordinance and request cash in lieu of park land for Arabian Hills
plat. (Motion carried 4-1: Hunt: He would prefer receiving feedback
from the Park Commission.)
M/S/P Williams/Mottaz - to approve the Preliminary Plat of Arabian
Hills with the conditions that prior to submittal of Final Plat
approval, the developer shall: (Motion carried 5-0).
1. Submit landscaping plan (screening and berming plan)
agreeable to the Council for the purposes of mitigating
the impact on the Raleigh property;
2. Show on the grading and landscaping plan appropriate
changes to reflect the additional screening required
on the west side of Keats Avenue;
3. Obtain from the VBWD an acceptable plan and permit for
grading and driveway placement on Lot 10, Block 2;
and this plan shall also be approved by our City
Engineer;
4. The cash dedication be calculatd at the time of.
the Final Plat approval.
3. Ordinance Protecting Existing Farming Operations
At their. March 25th meeting, the Planning Commission recommended that
the City adopt the language and intent of the State Statute protecting
existing farming operations.
In regard to State Statute 561.19 (c) Family Farm, Councilman Williams
voiced his concern about land that is owned by one person and rented
to someone totally unrelated and are we allowed to include this as an
additional situation which would be covered by the proposed ordinance.
The Council asked the City Attorney to consider Councilman Williams'
suggestion as an addition and report back to the next Council meeting.
D. Comprehensive Plan Amendment: Future Land Use Map
(Clifford Adkins property)
Attorney Paul Wolff, repesenting Ciff Adkins, explained Mr. Adkin's is
opposed to any amendment to the Future Land Use map and requests the
City leave this property in the SRD zoning district. The parcel is
approx. 12 acres and is surrounded by three sides of SRD, all of which
is currently in Rl zoning. The RED Zoning district requires a minimum
of 20 acres for an RE development, but this is only 1.2 acres and does
not qualify for RED zoning. Wolff indicated this is the only property
in the City within the SRD district which is not already zoned R1.
Mayor Johnson and Councilman Mottaz supported the Planning
Commission's recommendation of March 11, 1991 that Mr. Adkins' land
stay SRD as designated on the Future Land Use Map.

M/S/F Dick Johnson/Mottaz - that the Adkins' property, at 2227 Lake
Elmo Avenue and surrounding property owned by Mr. Adkins, continue to
be shown as SRD on the Future Land Use Map and amend the text of the
Comprehensive Plan to allow this one last area remain SRD and as
future zoning be allowed as SRD; further, it remain city policy that,
there be no additional R1 development in the City. (Motion failed
3-2: Hunt: He sees a conflict between the map and the text and is
looking at the Attorney for the best way to resolve it., Williams:
Without doing a thorough study, this type of .problem (person does not
own enough land to make an RE development) will come up in the future.
The landowner has the option of developing at the current zoning or
acquire additional land from his neighboring property owners to
provide 20 acres.)
In order to amend the text of the Comp Plan, it requires 4/5th
majority vote of the Council.
M/ Williams - to postpone consideration of this matter until the next
meeting at which time we will expect to receive from the City Attorney
a clarification of the procedures.
The Mayor did not recognize Councilman Williams and the above motion.
Councilman Williams appealed from the action of the Chair/No second to
the appeal.
Mayor Johnson stated we do not have to change the text of the Comp
Plan. We can simply leave the map "as is" and when a request comes in
for rezoning, allow that R1 zoning. He noted this is the last piece of
SRD property we have in the City.
M/No second Mottaz/No Second - to accept the Future Land Use Map with
the SRD land designation for Mr. Adkins' property.
Mayor Johnson noted there needs to be a motion to amend the Comp Plan
to change the SRD to RED Zoning.
M/No Second Williams/No Second - to amend. the Comp Plan to reflect the
12 acres owned by Clifford Adkins as RED instead of SRD Zoning.
When asked if this item could be postponed for two weeks, Mr. Adkins
indicated he had no urgent plans for development.__
M/S/P Williams/Dick Johnson - to postpone consideration of this item
until the next Council meeting at which time we can expect from the
City Attorney clarification of the procedure to be used. (Motion
carried 5-0).

E. Site & Plan Review: Maintenance Building at Lake Elmo
Park Reserve
Washington County is proposing construction of a 7,000 sq.ft. concrete
panel random rib maintenance building in the Lake Elmo Park Reserve
near Highway 5. The building will be the headquarters for Washington
County Parks Maintenance and will include an adjacent 25 car pared
parking lot and a 44,000 sq.ft. storage yard.
At their March 25th meeting, the Planning Commission recommended
approval of this site and plan for the Lake Elmo Park Reserve
Maintenance Building with the understanding the Planning Commission
does not wish this building to set the architectural standard. for the
rest of Lake Elmo.
M/S/P Dick Johnson/Hunt - to approve the site and building plan for
the Lake Elmo Park Reserve Maintenance Building based on the finding
this building is a unique use in a unique setting and, therfore, shall
not be deemed as setting an architectural standard for the rest of the
City. (Motion carried 5-0).
F. Recommendation of Park Land Dedication Requirements
This item was addressed under Arabian Hills Preliminary Plat.
G. Update from City Engineer on Steve Ziniel property
Tom Prew reported the problem appears to be a localized low spot along_
the edge of the road. Although the Kraft Circle pavement is in good
condition, Prew felt if the low spot is not drained the pavement in
that area will eventually need patching. Prew recommend.ed that a
shallow catch basin be constructed at the low point. An outlet pipe
would be extended west across Kraft Circle. A shallow ditch along the
north property line of the Rolf property and through the City property
would be necessary to direct the water to an existing culvert at the
corner of 33rd Street Lane and 33rd Street. Because of the small size
of this project, the City Maintenance Dept could perform the
construction. It was estimated that materials will cost $1,200 and
labor will cost $1,500. A drainage easement will be needed from the
Rude's for the shallow ditch on their property.
M/S/P Hunt/Williams - to direct the City Staff to approach .the Rudes
with this plan to see what their interest would be granting an
official easement before a Council decision is made. (Motion carried.
5-0).
Since the City did not create this problem, Councilman Johnson asked
Mr. Ziniel if he would be willing to pay material costs. Mr. Ziniel
responded he could replace his driveway for less than what the
materials would cost. Then the problem will go to the neighbor's
driveway.
H. Review variance request of Philip Zimmer, 4850 Jasper Avenue
The City Administrator pointed out that under Section 301.040-83 of
LAKE ELMO CITY COUNCIL MINUTES APRIL 2, 1991 PAGE 8
our code, a front lot line is defined "In the case of a corner lot, it
shall be the shortest dimension of a public street". The staff erred
when it issued the original building permit for this house by not
recognizing this and providing wrong setback information to the
builder. The Administrator explained that we essentially allowed, by
issuing this permit, a structure that does not conform to our
rear -yard setback requirement of 40 feet. Even if the house would
have been closer to Jasper than it was placed, a non-conformancy still
exists.
M/S/P Hunt/Dick Johnson - to reconsider the variance request of Philip
Zimmer, 4850 Jasper Avenue, which was denied by the Council at the
April 3rd meeting. (Motion carried 5-0).
M/S/P Dick Johnson/Hunt - to rescind the April 3rd motion to deny the
variance from the side yard setback request by Philip Zimmer, 4850
Jasper Avenue, because a request for a variance was inappropriate in
that a variance was not required. (Motion carried 5-0).
M/S/P Hunt/Dick Johnson - to grant a variance to Philip Zimmer, 4850
Jasper Avenue N. for a rear yard setback on the existing structure
based on the fact that staff created the non-comformity through an
error of issuing a building permit, a variance should have been
granted, therefore, the hardship was not self-created. (Motion
carried_5-0).
I. Request by Robert Ziertman
Robert Ziertman requested correction of an error in a legal
description from a two 10-acre subdivision that were granted in 1990.
This error gives one of the property owners 4.135 acres more than they
should have. In order for this to be recorded, staff will have to
draft a resolution for Council adoption.
M/S/P Hunt/Williams - to direct staff to prepare a resolution for the
reconveyance of land as legally described in the quit Claim Deed
provided with the understanding that no lot less than 10 acres wil:L be
created. (Motion carried 5-0).

A. Continuation of request from APAC
B. Update on legal matters
City Attorney, Jerry Filla, reported:
-- Derrick Land has decided that they will proceed with the testing
procedures to see if these lots can be built upon.
-- The Jamie Olson lawsuit was heard. The attorney suggested going
over why we are in litigation to begin with and some of the
ramifications of procedures that were or were not followed.

-- In regard to the Cimarron ordinance request, he has spoken to
Glen Schumaker, a representative from the association of manufacturing
housing owners in the state of. Florida where they have similar
legislation and similar problems, member of the Attorney General's
staff in the state of Massachusetts who have similar types of
regulations. The purpose of these conversations is to "zero in" on
the potential taking issue that could result from the adoption of this
type of legislation. At the next Council meeting Jerry will present a
draft of an ordinance for Council review.
Research was presented by Glen Schumaker and Floyd Olson on the three
factors why they are asking for compensation in addition to relocation
funds. The three factors are: (1) Many of these homes are too old, and
they cannot be relocated. (2) Many of these homes that could be moved.
physically cannot be relocated to other parks because of the vacancy
rates. (3) Many of the parks that do have openings have age
restrictions.
9. CITY ADMINISTRATOR'S REPORT:
A. Street Sweeping
The City received three quotes for street sweeping:
Foss Sweeping: $49.50 per hour - Eligen Pelican Sweepers
Allied Blacktop: $45.00 per hour for one-way broom
$59.00 Eligen Pelican Sweeper
Clean -Sweep: $55.90 Eligen Power Sweeper.
The staff recommended the bid
Sweeping Service.
M/S/P Hunt/Williams - to award the 1991 street sweeping to the low
bidder, Foss Sweeping Service, $49.50 per hour, based on the
references have been checked and found acceptable. (Motion carried
5-0).
B. League of Cities Conference
League of Minnesota Cities Annual Conference, June 11-14, 1991 in
Rochester, MN
The following people will attend the Annual Conference: Mayor Johnson
and spouse, Dick Johnson and spouse, Jess Mottaz and Spouse,
Administrator Kueffner and Finance Director Banister.

C. Request from Maintenance Foreman for a 30-day leave of absence
Maintenance Foreman, Dan Olinger, has requested a thirty -day personal
leave of absence, beginning April 8, 1991 and ending on May 5, 1991.
The City Administrator recommended that the City grant the requested
leave and it appoint Mike Bouthilet as Acting Maintenance Foreman from
April 8 to May 5, 1991. In the past when someone has filled a vacancy
on an interim basis, compensation has equalled the difference in wages
for the time of the interim performance. The Administrator
recommended that the Council approve this compensation procedure.
M/S/P Williams/Mottaz - to grant the request for personal 30-day
leave of absence to the Maintenance Foreman, Dan Olinger, and that
Mike Bouthilet be appointed as Acting Maintenance Foreman from April 8
to May 5, 1991 with compensation adjusted accordingly based on the
City Administrator's recommendation. (Motion carried 5-0).
D. Parks Department
At the March 5th meeting, the Administrator was instructed to
establish a separate Parks & Recreation Department. The Administrator
asked for a motion for designation of the Old City Hall for the
purpose of housing the Parks Department.
M/S/P Dick Johnson/Hunt - to designate the Old City Hall be used to
house the Parks Department and the position of Parks Department
Supervisor be posted internally. (Motion carried 4-1: Williams: This
conversion of the Old City Hall to a parks building is going to cost
the City. Until we get a handle on cost, he was not in favor of taking
on more expense than the City has to.)

Activities Undertaken Durinq the Reportinq Period
During the reporting period (January 26 - February 25, 1991) DPRA reviewed
existing research literature to determine "typical" municipal landfill
leachate constituent concentrations for use in landfill release and ground-
water modelling. Technical assistance was provided to Holly Glovatsky of
Colle & McVoy Public Relations in the development of the Lake Elmo landfill
siting video. Site maps and photographs were provided and discussions held
regarding the significant environmental conditions at Site G. In addition, a
meeting with Kelton Barr of Geraghty & Miller was conducted on February 25 to
discuss their progress on the groundwater modelling task, review preliminary
results, and coordinate modelling activities. Subcontractor labor and expen-
ses for December are included on this invoice. During that time period,
Geraghty and Miller continued their groundwater modelling analysis of hydro -
geologic conditions at Site G.
Activities Anticipated Next Month
Fletcher Driscoll of Geraghty & Miller will provide expert testimony on Site
G hydrogeologic conditions during an on -camera interview for a video being
produced on the landfill siting process. A final list of leachate consti-
tuent concentrations will be compiled and incorporated in DPRA's source term
model to assess constituent release rates and concentration profiles for
input to Geraghty and Miller's groundwater transport model. Initial source
term model results are anticipated during the latter half of the month.

Activities Undertaken During the Reporting Period
During the reporting period (November 26 to January 25) DPRA reviewed the
"Engineering Design Concept Technical Memorandum", November 1990, to obtain
values for the input parameters to DPRA's Municipal Landfill Failure and
Release Model. DPRA also began reviewing the literature to determine
"typical" municipal landfill leachate constituents for use in landfill
release and groundwater modelling. Subcontractor labor and expenses for
September, October and November are included on this invoice. During that
period, Geraghty and Miller staff continued their modelling analysis of Site
G, initially using a single layer analytic element model.
Activities- Anticipated Next Month
During the next reporting period, DPRA will identify "typical" organic and
inorganic leachate constituents, their concentrations, and how those con-
centrations change over time. This will be incorporated in our source term
model to assess constituent release rates and concentration profiles for input
in Geraghty and Miller's groundwater model. Fletcher Driscoll will provide
expert testimony on Site G hydrogeologic conditions through a video being
produced on the Lake Elmo landfill siting process.
Changes in Personnel and Schedule
No changes in personnel are anticipated. A project meeting with Kelton Barr
of Geraghty & Miller is scheduled for Monday, February 25, 1991 to discuss
progress on the groundwater modelling task.

Time spent by Chris, Ann and Holly researching
organizing, interviewing, writing and editing
video, press kit, Clean Water Action summaries

Time spent by Chris and Holly coordinating the
production of the education video. Including
arranging a photographer, choosing a narrator
and music, conducting interviews, creating

States has been officially recognized and endorsed by governmental leaders since 1922; and
WHEREAS: V F W Buddy Poppies are assembled by disabled veterans, and the proceeds of
this worthy fund-raising campaign are used exclusively for the benefit of disabled and needy veterans,
and the widows and orphans of deceasaveterans, and

In response to the request of the Planning and Zoning -Commission
of the City of Lake Elmo, Northern Lakes Diversified, Inc. or any
of its designated representatives or agents will disclole to any
potential. Arabian Bills customer that there are people within the
direct vicinity who do rely on agricultural occupations for their
livilihood and that these agricultural operations may from time
to time create normal agricultural odors and other processes
naturally associated with farming, i.e., particles of stalks,
leaves in the air during harvesting, eta. These odors and
processes are to be taken as part of the neighborhood and should
be taken into account when deciding on purchase of a lot in the
Arabian Hills residential development.

Dear Mayor and Council:
As instructed by the City Council, I visited the referenced problem area on March 27, 1991,
Water was ponded on the east side of the road between the south side of Ziniel's driveway and
the north side of Wichelman's driveway.
According to Mrs. Wichehman, ponding has occurred at this location throughout the 10 years she
has lived there.
Ptoble
The problem appears to be a localized low spot along the edge of the road. Although the Kraft
Circle pavement is in good condition, I feel that if the low spot is not drained, the pavement in
that area will eventually need patching. I believe that this, in addition to the nuisance the water
moos, warrants the City's attention to the problem.
Solution
It Is recommended that a shallow catch basin be constructed at the low point. An outlet pipe
would be extended west across Kraft Circle. A shallow ditch along the north property line of the
Rolf property and through the City of Lake Elmo property would be necessary to direct the water
to an existing culvert at the corner of 33rd Street lane and 33rd Street (See Fig= 1),
— Because of the small size of this project, the City Maintenance Department could perform the
construction. It is estimated that materials will cost $1,200, and labor will cost $1,500,
A drainage easement will be needed from the `WS for the shallow ditch on their property.
Coungg Action
It is recommended that the outlet be constructed as proposed.
