Present: Mayor Johnson, Hunt (arrived 7:15 p.m.), Dick Johnson, Mottaz, Williams, City Engineer Tom Prew, Attorney Filla and Administrator Kueffner. 1. AGENDA Move Item 7 to 4A. 1992 Budget, Postpone 9A and 9B until the December 3rd meeting. M/S/P Dick Johnson/Mottaz - to approve the November 19, 1991 City Council agenda as amended. (Motion carried 4-0). 2. MINUTES: November 5, 1991 November 12, 1991 M/S/P Mottaz/Williams - to approve the November 5, 1991 minutes as presented. (Motion carried 4-0). M/S/P Williams/Mottaz - to approve the November 12, 1991 City Council minutes as amended. (Motion carried 3-1-0 Abstain: Dick Johnson). 3, CLAIMS M/S/P Mottaz/Dick Johnson - to approve the November 19, 1991 Claims #95470 thru #95554 as presented. (Motion carried 4-0). 4. OLD BUSINESS: The City Council updated the Old Business items listed in the City Administrator's memo. They designated the following as workshop items: compost site, West Sunfish (landfill Park), Organized Collection, Limited Business, and Surface Water Management Utility. VBWD Representatives: M/S/P Williams/Dick Johnson - to direct the staff to write a strong letter of protest indicating the City of Lake Elmo makes up the majority of the Valley Branch Watershed District; therefore, Lake Elmo should have a representative. (Motion carried 5-0). A. PUBLIC HEARING: 1992 BUDGET Mayor Johnson called the public hearing to order at 7:45 p.m, in the Council chambers. A public hearing notice was published in the November 13th St. Croix Valley Press. LAKE ELMO CITY COUNCIL MINUTES NOVEMBER 19, 1991 2 Finance Director Marilyn Banister explained that the following sums of money be levied for the current year, collectible in 1992, upon the taxable property in the City of Lake Elmo, for the following purposes: General Fund $680,210 Park Bond 65,000 Landfill Referendum 50,000 Equipment Certificate 61,063 TOTAL LEVY $856,273 Councilman Williams pointed out it was his understanding the Council was being asked to approve the gross amount of the tax levy on the budget and not specifically adopting this budget as a series of line items. Banister responded that under the state rules the Council can amend the budget anytime as long as they stay within the gross amount. M/S/P Mottaz/Williams - to adopt Resolution No 91-39, A Resolution Approving the Proposed 1991 Tax Levy, Collectible in 1992. (Motion carried 5-0). Mayor Johnson closed the public hearing at 8:13 p.m. 5. CITY ENGINEER'S REPORT: A. Septic Systems in Old Village At the November 5th meeting, Jim McNamara, Building Official, provided a list of inadequate septic systems in the downtown area of Lake Elmo. McNamara indicated his concern with these properties is the lack of suitable land to accommodate a properly designed septic system. The properties do not have land available to accommodate an updated, legal septic system. City Engineer, Tom Prew, provided a sketch plan of two alternatives for an off -site drain field for the inadequate septic systems in the Old Village. The Council decided that before the City becomes involved any further, the City should get an inquiry out to residents indicating the City has already identified some failing systems and are interested if there are other problems in the City. The Council will address these problems after they receive the responses from the citizens. LAKE ELMO CITY COUNCIL MINUTES NOVEMBER 19, 1991 3 M/S/P Mayor Johnson/Dick Johnson - to direct the City Administrator to draft a letter indicating the city already has identified failing septic systems and are soliciting information from residents, business owners North of the tracks and South of Hwy 5 as to whether there are other septic system problems.After the response is received, the City will address it. (Motion carried 5-0). B. 201 Users Fee, Resolution No 91-37 Tom Prew reported each year we review the 201 System account and recommend adjustments to the User Charge. The User Fee system has been in place four years now. The goal has been to increase the fund balance $360 each year to cover replacement of the pumps and controls for the lift stations. At this time, the City Engineer recommended no increase in the 201 User Fees because our positive balance should cover any unexpected expenses that could occur. M/S/P Williams/Hunt - to adopt Resolution No. 91-37 adopting the 1992 rate structure for 201 systems in the City of Lake Elmo. (Motion carried 5-0). C. Water Rates: Old Village & Lake Jane Set date for Public Hearing Lake Jane Area: City Engineer Tom Prew recommended establishing the water rate for the Lake Jane area at $1.25/1,000 gallons, plus a $5 quarter service charge, and raising the rate in 1994 to $1.50/1,000 gallons. In our agreement with Washington County, they gave the City $25,000 to help pay for operation, maintenance and depreciation of the new system. It was proposed to use the $25,000 to help phase in the water rates to the new users. Both water rates are contingent upon the price of water from Oakdale remaining at $1.00/1,000 gallons. Mike Bouthilet, city maintenance employee, inquired if Oakdale will give us a cost break on metered water that is used to flush the system. When the Old Village system is flushed or when we permit tapping of water, we make them pay basically what it costs to run a pump and do not charge $1.00/1,000 gallons. The City Engineer will check if the flushing of water lines was taken into account and calculated into the $1.53/1,000 gallon of the original contract with the Counties. Old Village Area: Tom Prew reported the water rate in the Old Village are is $1.00/1,000 gallons and this rate is less than the amount necessary to supply the water. Prew recommended the Old Village water rate be set at $1.25/1,000 gallons, plus a $5/quarter service charge, plus a $5/quarter improvement charge. LAKE ELMO CITY COUNCIL MINUTES NOVEMBER 19, 1991 4 Also part of the 33rd and Laverne Street improvement project is replacement of the existing water main and it was proposed at that time to add $5.00/quarter to each user in the Old Village to help finance this replacement. This improvement charge would only be necessary until the replacement water main is paid for. Marilyn Banister explained water is costing the City $1.25/1,000 gallons now, and we should have raised the rates a year ago in order to set aside money for improvements. Councilman Williams added if the correct rate is $1.25 per 1000 gallons we should present it as an independently arrived at figure, not something intentionally set to be the same as the Lake Jane system. For the public hearing, the City Engineer was asked for an estimate of cost per 1,000 gallons in each area setting aside money to pay for future maintenance. The Council also asked for the number of total gallons used a year. M/S/P Dick Johnson/Mottaz - to set the public hearing on water rates for the Old Village and Lake Jane area for December 17, 1991. (Motion carried 5-0). D. 1992 State Aid Maintenance Allotment Tom Prew reported in his letter, dated November 7, 1991, that each year at this time the City must submit to the District State Aid Engineer a resolution requesting 25% of our construction allotment be given directly to the city for maintenance of our State Aid street system. Beginning in 1992, we will no longer need to report where on our State Aid system this money is spent. M/S/P Dick Johnson/Hunt - to adopt Resolution No 91-38 requesting that the State of Minnesota allow the City of Lake Elmo's maintenance allotment for 1992 to be equal to 25% of its total 1992 allotment. (Motion carried 5-0). 6. PLANNING/LAND USE & ZONING: A. 1990 Comprehensive Plan, Resolution No. 91- Councilman Williams explained we have a resolution before us correcting a procedural error regarding the Comp Plan and urged all the Council to vote in favor of this resolution and formally adopt the plan the Council all thought was in effect anyway. MIS/ Williams/Dick Johnson - to adopt Resolution 91-40 adopting the Lake Elmo 1990 Comprehensive Plan Councilman Mottaz pointed out the City has one comp plan which was adopted in 1983 and anything from that point on is an amendment to the comp plan. What we would have is a 1990 amendment to the Comp Plan and not a new comprehensive plan. There are steps that are set out by state statute that must be LAKE ELMO CITY COUNCIL MINUTES NOVEMBER 19, 1991 5 followed in adopting a comp plan. A motion to adopt a comp plan now is out of order until we determine what steps we have missed and deal with these steps in the proper order. If this is just a housekeeping measure to correct the procedure, Councilman Johnson noted he had no problem with adopting this resolution. But if the 1990 amendment of the comp plan is opened to revision, he felt it was inappropriate because a past council has adopted this amendment and in substance is the plan the city is now operating under. The City Attorney concluded if you had 1979 plan and changed the official controls the official controls apply. If after you change the official controls that would amend the comp plan, you now have 9 months to revise the official controls. The question is: "what action was taken at the most recent time? And apply that logic to this, and if you assume the August, 1990 amendment is not effective, the city has still taken action in the way of adopting RE regulations". RE regulations, or rezonings of property effecting changes to a zoning map, are official controls and will take precedence over the 1979/1983 version of the comp plan or the 1990 version of the comp plan because those actions occurred most recently. If they are in conflict, then the official controls apply. Councilman Hunt noted the Council has acted under the 1990 Comp Plan all year. He has voted on items and on applying for a MUSA extension based on this plan. Therefore, he would not support any MUSA extension under the 1983 comp plan. Mayor Johnson provided his explanation as to the procedure of the initial adoption of the 1983 Comp Plan. M/S/P Williams/Dick Johnson - to amend the resolution as follows: (Motion carried 4-1: Mottaz). Add Defining Paragraph: For the purpose of this Resolution "the 1990 Lake Elmo Comprehensive Plan" amends and supersedes a Comprehensive Plan adopted in 1983 and amended since then, including the wording approved by Met Council of February 14, 1991. Add: BE IT FURTHER RESOLVED, that City Council actions with regard to any residential rezonings and subdivisions since February 14, 1991 are hereby ratified. M/S/F Williams/Hunt - to adopt Resolution 91-40 as amended. (Motion failed 3-2: Mayor Johnson, Mottaz). Councilman Hunt: my previous vote was made upon a comp plan which covered the entire city. Based upon what that plan stated (it called for residential dev. and commercial dev.) I felt at that point the extension of the MUSA was justified and appropriate into that area. I do not feel, with my knowledge of the 1983 LAKE ELMO CITY COUNCIL MINUTES NOVEMBER 19, 1991 6 plan, that I could support the extension of the MUSA because there are a number of things missing that are not there today such as residential development in the area of the southern part of the City and residential estates is not directly called out in the 1983 version. M/S/P Williams/Hunt - to rescind the application for a MUSA extension to the Metropolitan Council. (Motion carried 3-2: Mayor Johnson: I see this as an attempt on the part of one Councilman to renege on his stated belief that high quality commercial development along I-94 is essential to our tax base, therefore, the only way this is going to come is thru extension of MUSA, Mottaz). The City Administrator will write a letter to the Metropolitan Council indicating the action taken by the Council and to request return of all documents. B. PUBLIC HEARING: Variance to frontage on a public street: Carmelite Monastery, 8251 DeMontreville Trail Mayor Johnson called the public hearing to order at 10:35 p.m. in the Council chambers. The public hearing notice was published in the November 6, 1991 St. Croix Valley Press and adjoining property owners were notified. Dick Sachs, Fire Chief, submitted a letter indicating the road was designed to safely carry emergency vehicles. D. Meier stated she appreciated their neighbors, the quiet nature of the setting, and the roads out to Hidden Bay Trail are well plowed. She would feel badly about another access because it would destroy the quality of this area. Mayor Johnson closed the public hearing at 10:50 p.m. Rev. Burns stated he had contacted Mr. Skalbeck who was not happy about the idea of putting in another road. Rev. Burns submitted a copy of deed showing Carmelite acquired their property together with the easement over the Jesuit property. Council voiced their concern on approving this variance starting a troublesome precedent for the City. The City Attorney advised the Council they could develop findings of fact (such as; property is served by a private easement, Fire Chief has indicated no problem accessing the property from a public street, the property has on -site shelters, low density of this use with a population of 14) to support approval this particular variance. M/S/P Dick Johnson/Mottaz - to postpone action of this item until December 3rd Council meeting and direct the City Administrator to prepare a resolution incorporating the attorney's comments to protect the city. Park Plan M/S/P Mottaz/Williams - to accept the proposed Comprehensive Park Plan and to direct the Staff to set up a joint public hearing on this Plan between the Parks and Planning Commission. (Motion carried 5-0). D. Other 7. PUBLIC HEARING: 1992 Budget (Moved to 4A) 8. CITY ATTORNEY'S REPORT: City Attorney Filla reported a Motion was made by the attorney for Trailhead Dev. Judge Quinn will address the issue, whether or not the City should be found in contempt for failing to comply with his order regarding the rezoning of Stonegate, on Monday, November 25th, 8:45 a.m. 9. CITY ADMINISTRATOR'S REPORT: A. Liquor Ordinance - Item postponed B. Request by the Fire Department for software: Jim Sachs - Item postponed C. Annual Christmas Party The Annual Christmas Party will be held at 6:30 p.m. on Friday, December 20, 1991. 10. CITY COUNCIL REPORTS: Mayor Johnson Councilman Hunt Councilman Johnson Councilman Mottaz submitted his letter to be mailed to the public on the septic ordinance to the City Administrator. This letter will be copied to the City Council. Councilman Williams noted the City Engineer was a fine engineer; however, as a city consultant he has to have some stage presence and ability to deal with the City Council and the public at City Council meetings. Other Council members shared this same concern and this will be discussed with the Engineer and his supervisor. 11.
