LAKE ELMO CITY COUNCIL MEETING
(Continuation of November 5th Council meeting)
NOVEMBER 12, 1991
Mayor Johnson called the council meeting to order at 7:05
p.m. in the Council chambers. Present: Mayor Johnson,
Mottaz, Williams, Administrator Kueffner. Absent:
Councilmen Johnson and Hunt.
1. OLD BUSINESS:
A. Resolution No. 91-34 Opposing Detachment/Annexation
to Oakdale, Out Lot A -Lake Elmo Heights, 2nd Addition
M/S/P Williams/Mottaz - to adopt Resolution 91-34, as
amended, Opposing the Detachment of 93 acres known as Out
Lot A Lake Elmo Heights 2nd Addition from Lake Elmo and Its
Concurrent Annexation to the City of Oakdale. (Motion
` carried 3-0).
B. Signing of Letter to MAC re: Airport Commission
Expansion
The Council signed the letter to Hugh K. Schilling
indicating the city's concern about the commission staff
recommendation to retain a 3,900 ft. ultimate primary runway
length in the master plan for the Lake Elmo Airport.
2. CITY COUNCIL REPORTS:
Councilman Mottaz:
Councilman Mottaz reported research has been done on the
septic tank man hole extension and found out the following:
Washington County allows 6" earth cover over the manhole,
Burnsville has an ordinance almost identical to Lake Elmo's
regarding clean -out through the manhole, etc, and they also
allow a 6" earthen cover; the University of MN experts
recommend a 6" cover; and Chandler Concrete Fabricators
recommend a 6" cover.
The City staff has received approx. 100 telephone calls
regarding this item and most of the people were offended by
having to bring their manholes completely up to the ground
surface. They would have preferred if it was simply stated
they had to pump thru a manhole. Another option for Council
consideration: pumping thru the manhole at the discretion of
the property owner whether they want to dig it up every two
years or bring it up to the surface.
Councilman Mottaz has prepared a draft letter which details
the need for cleaning out thru a manhole, but before it is
sent out, he would like to give the Council an opportunity
to discuss whether we want to maintain the surface exposure
of the cover or allow a 6" earth cover. This draft letter
will be included for the next Council meeting.
Wyn John, Chairman of the Planning Commission:
At their November 11th Workshop on the MUSA Business
Ordinance, the Planning requested that their Chairman
present the following motion: M/S/P Rita Conlin/Steve DeLapp
- After reading the Mayor's submission to the District Court
of October 31st, I move that the Planning Commission table
all work on the MUSA Business District Ordinance until such
time that, by resolution of the Council, the 1990
Comprehensive Plan is acknowledged and approved and that Wyn
John will represent the Planning Commission at the November
12th Council meeting to request this resolution. (Motion
passed 6-2).
Wyn John indicated the Pz is saying, "we are working on this
MUSA ordinance and it is an amendment to the 1990 comp plan
which apparently has no status so what is the point of
holding work sessions if this comp plan is in question
here"
In addition, Chairman John provided a 1990 Lake Elmo
Comprehensive Plan Reaffirmation Petition signed by eight
members of the Planning Commission.
The Council accepted the petition and motion offered by the
Planning Commission.
3. CITY ADMINISTRATOR'S REPORT:
A. Request from Solid Waste Advisory Committee Battery
Collection
Margaret Carlson, Solid Waste Advisory Committee, requested
that the City implement a button battery recycling program.
The Committee provided information on such a program.
M/S/P Mottaz/Williams - to direct the staff to fill out the
MPCA application to implement a Battery Collection Program.
(Motion carried 3-0).
M/S/P Mottaz/Williams - to adjourn the City Council meeting
at 7:50 p.m. (Motion carried 3-0).

NOVEMBER 5, 1991
Mayor Johnson called the city council meeting to order at 7:03
p.m. in the City Council chambers. Present: Mayor Johnson, Dick
Johnson, Mottaz, Williams, City Engineer Prew, City Attorney
Filla and Administrator Kueffner. Absent: Councilman Hunt.
1. AGENDA

3. CLAIMS

4. PUBLIC INQUIRIES:
Steve DeLapp inquired about two items: the proposed Stonegate
development which was recommended for approval by the PZ, are now
in court with the developer, and a private agreement being made
for cluster development. Currently the developer who had a
cluster development along the Oakdale border who has 93 acres
outstanding apparently has been negotiating privately with the
members of the City Council, or certainly the Mayor, about
getting a higher density which was stated in today's St. Paul
Pioneer Press. Bishop apparently is getting feedback from members
of the Council that he should go into a sewered development on a
deal with Oakdale we work out or he just go into Oakdale and do
it.
These two things going on in the backroom along with the
development that Dave Morgan, who was our former Mayor and on the
Board of Directors of the St. Croix Animal Shelter, told him
(Steve) that he was unable to consummate a deal for land that Joe
Rogers owns on Hwy 5 because the Mayor said "I can get a higher
price for you for industrial work". DeLapp indicated it was time
to start doing things in accordance with the city ordinances and
comp plan. The City Council should stand up and be alerted of
these things and let the people in Lake Elmo know what is going
on. We cannot have these backroom deals going on all the time.

Mayor Johnson responded he has not talked to Don Bishop so it
{ would have been difficult to work a deal with him. We have on
record a cluster development that was agreed to by Mr. Bishop and
we will hold him to this cluster development. As far as the
Animal Shelter, I have no idea what Mr. Morgan is involved in and
have not had any dealings in negotiations with Joe Rogers.
5. OLD BUSINESS:
A. Cimarron Park Evacuation Plan
The staff met with the Mayor, Fire Chief, both of our contract
deputies, Civil Defense Director Fran Pott, Cimarron Management
and one homeowner to discuss the evacuation plan for the park. A
draft plan was presented to the Council.
Discussion followed on the following concerns: routes of travel
not being very accessible, kinds of roads, ages of people who
reside in the park, and a less then reasonable distance from the
shelter to the park.
The Council made it very clear that this plan is only good for a
year and the shelters are going to be up in a year.
Attorney representing Cimarron responded he was in agreement with
the resolution as presented, except for the requirement of
shelters. He indicated it was his feeling that this is going
beyond what was anticipated tonight, and he did not have a full
opportunity to discuss this thoroughly with his client so he is
going on record objecting to this. He added this issue might be
suited for another meeting.
M/S/P Dick Johnson/Williams - to approve an interim Cimarron Park
Severe Weather Emergency Procedure, as amended (Changes: Page 2:
Add as Item 4. WARNING PROCEDURE: Washington County be directed
to tone out the Lake Elmo Fire Department at the same time it
sounds the severe weather warning siren; Page 3, Item 5, 6th
line, change "may" to "shall", Paragraph 5 last sentence: to the
satisfaction of the City Attorney regarding liability by the
City.); contingent upon approval by School District 834. The
City Council determines that this plan is for an interim use only
and the Council determines that this plan does not offer adequate
protection for the Cimarron residents for the long term due to
the distance to the school. Park owners shall be required to have
shelters constructed within one year; the City shall assist in
applying for grants to contribute to the shelter construction.
(Motion carried 4-0).
B. Recodification Bids
M/S/P Williams/Dick Johnson - to award the bid to Sterling
Codifiers in the amount of $5500, plus shipping charges;
contingent upon the City Attorney approving the final contract.
(Motion carried 4-0).

C. Comp Plan (MUSA) Amendment Update
The Council received a memo from Mary Anderson, Chair of the
Metropolitan Council, regarding the Comp Plan (MUSA) Amendment
which the City sent them on October 11, 1991.
Mike Black and Tom Prew met with the Met Council staff to
determine what additional information was needed in order to
initiate the regional agency review period for our Comp Plan
Amendment to extend the MUSA Line. Mike presented a letter he
received from the Metropolitan staff indicating that the
information they have is complete. The Met Council still has
asked that we provide them information on traffic update and
nonpoint source runoff.
When asked what costs would the city incur for providing this
information, Mike Black responded he would do a letter (approx 2
page) which would take 1 to 2 hours of his time. The Council
had set a limit as to the monies to be spent on this application
and requested an update by the next Council meeting on monies
spent to date on the MUSA amendment.
D. Heritage Preservation Ordinance
The consensus of the Council was to pass the Heritage
Preservation Ordinance outlined in staff memo dated November 5,
1991. City Attorney Fills. explained this Ordinance should be
summarized for publication and this summary will be brought
before the City Council for their approval. Applicants for
Commission will be solicited in the Newsletter, Cable TV and as a
Press Release. Appointments to this commission will be made at a
January, 1992 Council meeting.
E. Letter to re:Airport Commission Expansion
At the last meeting, the Council directed the City Administrator
to prepare a letter for their approval to the Metropolitan
Airports Commission regarding the proposed airport expansion and
MAC's apparent disregard for the comments made by the people
attending the public hearing.
M/S/P Williams/Dick Johnson - to direct the City Administrator to
send the letter, as presented, after being signed by each council
member at the November 12th meeting. (Motion carried 4-0).

6. PLANNING/LAND USE & ZONING•
A. Shoreland Permit: Dan & Jean Olinger,
9057 Lake Jane Trail
Dan and Jean Olinger, 9057 Lake Jane Trail, has applied for a
shoreland permit for demolition of existing home and construction
of new home within the Shoreland District.
Building Official, Jim McNamara, reported no variances are
required and Molly Shodeen, DNR, had no problem with this
application. The septic system will have to be updated to meet
city code.
The Olingers have made arrangements with our Fire Department to
have the existing house burned down in a "training session".
M/S/P Williams/Mottaz - to grant a shoreland permit to Dan & Jean
Olinger, 9057 Lake Jane Trail, for demolition of existing home
and construction of new home based on a favorable recommendation
from the DNR, Planner, and Building Official and based on the
determination that no variances were required. (Motion carried
4-0).
Councilman Johnson indicated his concern on the number of items
stored on this property and asked that a list of stored items be
provided to the City. The Council designated this as an OLD
BUSINESS item.
B. Petition for Detachment/Annexation to Oakdale,
Out Lot A -Lake Elmo Heights 2nd Addition
Resolution No. 91-34
The City received notice that the Municipal Board has received a
petition by the property owner for detachment of 93 acres located
in Lake Elmo Heights 2nd Addition, from the City of Lake Elmo and
concurrent annexation of the same property to the city of
Oakdale.
The Municipal Board will be scheduling a hearing on the matter
unless both cities pass concurrent resolutions requesting the
same detachment/annexation and forward to the Municipal Board by
November 18. 1991.
The City Administrator is preparing a resolution which includes a
chronology of events that led to Out Lot A's existence. This
resolution opposing detachment/annexation of Out Lot A will be
presented for Council approval at the November 12th meeting.

The following Lake Elmo Heights residents, Paul Bernardy, Denny
Seigler, Larry Mann, Peter Buckles, Jean Sluss, advised the
Council they purchased their property with the understanding that
Out Lot A would continue to be used for Agricultural and/or Open
Space purposes consistent with the City's cluster development
regulations. Paul Bernardy indicated they were not in favor of
this annexation and asked what they as residents could do.
Councilman Williams suggested that these residents go back thru
their records from Mr. Bishop or any of his representatives
describing what the situation was supposed to be and supply those
documents to our City staff. Williams explained there are two
bills that relate to annexation procedures which will be
introduced in the state legislature this year, Senate File 1013
and companion bill House File 1496. He asked the residents to
write or call their legislators and inform them what a travesty
the existing regulations are causing on development policies of
our city. The City will have copies of these bills.
C. Petition for Speed Study on CSAH 35
The City received a letter from the Tri-Lakes Association
requesting we take whatever action is necessary to lower the
speed limit on CSAH 35.
The Council asked the Administrator to write a letter to the Tri-
Lakes Association indicating the entire city is being surveyed
and the County has already asked MnDOT, by resolution, to do a
speed study independent of the other.
D. No agenda Item
E. Park Plan - Set date & time for public hearing
The Council received a copy of the Lake Elmo Park Plan for their
review and comments. The Parks Commission voted (7-0) to accept
this Plan at their meeting on October 21, 1991. Mike Black
indicated in his memo, dated October 31, 1991, that as an
amendment to the City's Comp Plan, this Plan should be referred
to the Planing Commission for a public hearing. It would then
come back to City Council for consideration before submission to
the Metropolitan Council and then back to the City Council for
final approval.
The Council postponed action on the proposed park plan until the
November 19th Council meeting.

F. Requests from PZ
At their October 28th meeting, the Planning Commission
unanimously recommended that an ordinance be drafted that will
allow for "lot line adjustments": Exceptions to Platting: The
City may allow a transfer of property by resolution of the City
Council provided that: 1. Property owner provide survey of the
property to be conveyed; 2. Transfer of property will not result
in either piece of property becoming non -conforming, 3. Property
conveyed must be combined with the parcel to which it is to be
attached with the result being one legal description for entire
parcel.
M/S/P Williams/Dick Johnson - to direct the staff to prepare an
ordinance dealing with "lot line adjustments" as recommended by
the Planning Commission. (Motion carried 4-0).
The Planning Commission has asked that the proposed MUSA Business
Park/Office Parks Ordinance be reviewed by our City Attorney.
M/S/P Williams/Mayor Johnson - to direct the City Attorney to
review and comment on the proposed MUSA Business Park/Office Park
Ordinance as recommended by the Planning Commission. (Motion
carried 4-0).
The Planning Commission asked that the council authorize the City
Engineer to draft a "Fill Ordinance" and "Holding Pond Standards
Ordinance"
The City Administrator indicated she would submit background
information as to why this was an agenda item before the City
Engineer can draft ordinances.
G. Trail System: Mike Bouthilet, Parks & Rec. Supervisor
Mike Bouthilet reported the Parks Commission would like to access
Munger Trail, which is located up in the northwest corner of the
City, through the DeMontreville Park wildlife area. Mike has met
with the DNR and they are interested in making the access.
The Council asked to postpone this item until they received some
information regarding motorized vehicles using the Munger Trail,
M/S/P Mayor Johnson/Mottaz - to postpone this item until the
Parks Commission receives a DNR update. (Motion carried 4-0),
7. CITY ENGINEER'S REPORT:
A. Septic Systems in Old Village
Jim McNamara provided a list of inadequate septic systems in the
downtown area of Lake Elmo and noted these property owners lack
suitable land to accommodate a properly designed septic system.

This item will be postponed until the next Council meeting and
will be addressed as the first item under the City Engineer's
Report.
B. SW-1 Watermain
(1) Partial Payment #1, Keyes Well Drilling
M/S/P Dick Johnson/Williams - to approve Partial Payment No. 1 in
the amount of $3,709.75 for Keys Well Drilling; contingent upon
payment not being made until the funds are received from
Washington County. (Motion carried 4-0).
(2) Partial Payment #4, Kenko
M/S/P Dick Johnson/Williams - to approve Partial Payment No. 4 in
the amount of $38,483.59 for Kenko, Inc.; contingent upon payment
not being made until the funds are received from Washington
County. (Motion carried 4-0).
C. Final Payment to Tower Asphalt for Hytrail Overlay,
DeMontreville Park
Tom Prew reported work is complete on the Hytrail Overlay and
Demontreville Park Parking Lot. Added to this project was an
overlay on the west end of Lake Jane Trail which was scheduled to
be done in 1990. However, this was put on hold due to the
watermain project. Since Tower Asphalt was both our contractor
on the overlay project and the paving subcontractor on the
watermain project, doing the overlay now proved to be quite cost
effective. Payment for the Lake Jane Trail overlay comes out of
the patch and overlay portion of the budget.
M/S/P Williams/Mottaz - to approve Change Order No. 1 in the
amount of $2315.97 for the Lake Jane Overlay. (Motion carried 4-
0).
M/S/P Williams/Dick Johnson - to approve Compensating Order in
the amount of (deduct) $175.64. (Motion carried 4-0).
M/S/P Williams/Dick Johnson - to approve final payment to Tower
Asphalt in the amount of $16,968.08. (Motion carried 4-0).
8. CITY ATTORNEY'S REPORT:
A. Federal Land Update
The City Attorney reported that on February, 1991 the District
Court entered a decision in this case which concluded the
plaintiff was not entitled to a judgement declaring the present
zoning and classification of the City was unreasonable and
further they are not entitled to a judgement from the court
enjoining the city from interfering with their development of
their land.

The property owner then requested that some of those findings
be amended. In July of 1991 the court amended two of the findings
by deleting them and added "The present zoning is not consistent
with the 1979 comp plan which was in effect in 1987 when this
application was being reviewed and the City failed to state any
reasons for not following the 1979 plan".
The City Attorney noted this particular case was handled by then
City Attorney Carlson and he (Fills) had not reviewed the
transcript of the trial. Filla added there was no chance of
appeal because of the lapse of time, but believes the process
will start all over with an application by this property owner in
the future, but not until they find out what is going to happen
with the current proposal to amend the comp plan.
B. Liquor Ordinance Amendment
The City Attorney was asked to review the city's liquor
regulations because they were somewhat outdated and there was a
request from Guardian Angels Church to sell intoxicating liquor
on a temporary event basis. Under the city's current
regulations, this is not possible because we do not allow for
temporary intoxicating liquor licenses. The State allows us to
do this, but our current regulations are more restrictive.
Filla's comments, suggestions and remarks are offered in his
letter dated November 5, 1991.
The Council directed the city staff to take comments from the
City Attorney's letter dated November 5, 1991 and bring our
liquor ordinance more in line with the state law.
9. CITY COUNCIL REPORTS:
This item was postponed to the November 12th Council meeting.
10. CITY ADMINISTRATOR'S REPORT•
A. Charitable Gambling at VFW, Resolution No. 91-36
M/S/P Dick Johnson/Mayor Johnson - to adopt Resolution No. 91-36
approving the Premises Permit Application for Charitable Gambling
located at the Lake Elmo Post 5725 VFW. (Motion carried 3-1:
Mottaz: He's not in favor of expanding any gambling operations in
the State of Minnesota).
Councilman Williams explained he was generally not in favor of
expanding gambling in the City, but voted in favor of this motion
because he feels the VFW is a very worthwhile organization for
the City and they depend to a great extent on this operation for
their survival.
