LAKE ELMO CITY COUNCIL MINUTES
DECEMBER 17, 1991
Mayor Johnson called the city council meeting to order at 7:10
p.m. in the City Council chambers. Present: Mayor Johnson, Dick
Johnson, Mottaz, Williams, City Engineer Prew, City Attorney
Filla and Administrator Kueffner. Absent: Councilman Hunt.
1. AGENDA
Add: 9D. Lot Consolidation Ordinance-Ziertman Request

1991 City Council agenda as amended. (Motion carried 4-0).
2. MINUTES: December 3, 1991
M/S/P Williams/Dick Johnson - to approve the December 3, 1991
City Council minutes as amended. (Motion carried 4-0).
MINUTES: December 6, 1991
Councilman Williams indicated he felt the December 6th meeting
was not a properly called meeting because our ordinance clearly
states a special meeting requires 24 hours written notice. This
notice was not given; therefore, all business transactions are
null and void.
Mayor Johnson explained that for an emergency meeting the state
statute requires that a best effort be given in notifying the
Press and everyone involved.
Councilman Williams went on record objecting to the
characterization of the December 6th meeting as being an
"emergency meeting".
M/S/P Mottaz/Mayor Johnson - to approve the December 6, 1991 City
Council minutes. (Motion carried 2-0-2 Abstain: Williams, Dick
Johnson).
3. CLAIMS
M/S/P Mottaz/Williams - to approve the December 17, 1991 Claims
995603 thru #95668 as presented. (Motion carried 4-0).
4. OLD BUSINESS:
A. Stonegate
M/S/P Mayor Johnson/Dick Johnson - to adopt Ordinance No. 8059
rezoning the Stonegate property from Rural Residential to
Residential Estates. (Motion carried 4-0).

Councilman Mottaz explained his vote was not a willing vote, it
was a voted rendered under duress from three sources: 1. the
court, where the judge has threatened to increase the fine and to
possibly levy it personally on me; 2. the City Council, where
three members of the Council instructed the city attorney to ask
the court to have me pay the fine, 3. Attorney Niles, who stated
that he and Mr. Peterson were discussing legal action to force me
to pay for Mr. Peterson's losses.
Mayor Johnson noted he felt the same as Councilman Mottaz.
M/S/P Williams/Dick Johnson - to direct the City Attorney to
draft the appropriate motion to request cancellation of fines.
(Motion carried 4-0).
B. Cimarron
Mayor Johnson stated Fran Pott had informed him that the City did
receive a letter from the Health Dept. indicating, based on the
results of the tests, they had no major concerns on the Cimarron
water system.
Dora Lee, Cimarron resident, stated the people living near the
water tower have noted they are having low pressure problems
again which could lead to a bacteria problem. The Cimarron
management is aware of this and the Health Dept, has been
notified.
The Council discussed sending city personnel, with the full
knowledge of the Park, to check out the lines.
M/S/P Mottaz/Mayor Johnson - to direct the City Administrator to
send a letter to the State Health Dept. indicating the City
recognizes there is a problem with Cimarron's water system and
request the state investigate this system and find out why they
are having these problems. (Motion carried 4-0).
5. PLANNING/LAND USE & ZONING:
A. Shoreland Permit with Variance, Dorothy Hanson,
7978 Hill Trail N., (Continued from 12/3/91)
M/S/P Dick Johnson/Mottaz - to approve a shoreland permit and
variance requested by Dorothy Hanson, 7978 Hill Trail N., for the
purpose of constructing a 3-seasons porch where they now have an
existing deck based on: there is sufficient screening from the
lake by mature trees, the house and addition is in conformance
with the neighboring houses, there was no objection to the
variance at the public hearing, and the screened porch does not
encroach on the lake any further than the existing deck does
now. (Motion carried 3-1: Williams: A hardship has not been
demonstrated and there are other alternative locations for the
porch.)

B. Linder Greenhouse - EAW
The Council previously determined that an EAW was required for
the proposed Linder Greenhouse Conditional Use Permit amendment.
The Council received comment from three reviewing agencies and a
memo from Mike Black, December 10, 1991 stating his reasons for
recommending that an EIS was not necessary.
M/S/P Williams/Mottaz - that the city council made a
determination that an EIS is not required for this project based
on the results of public comment from the reviewing agencies.
(Motion carried 4-0).
C. Rolling Hills Preliminary Plat
At the October 1, 1991 meeting, the council postponed
consideration of the Rolling Hills Preliminary Plat because the
applicant had not received approval from the VBWD. The Council
received a letter from the VBWD, dated December 13, 1991,
indicating their approval of the plat subject to the conditions
shown on the permit.
M/S/P Mottaz/Dick Johnson - to approve the Rolling Hills
Preliminary Plat as shown on December 17th and accepting the
Parks and Planning Commission's recommendation of the applicant
paying a park dedication fee in lieu of land of 7% of the fair
market value; subject to receiving a permit from the Army Core of
Engineers and approval of the final design by the City Engineer.
(Motion carried 3-1: Williams: would prefer accepting Lot 3,
Block 3, (3.2 acres) for park land).
D. Recommendation from Planning Commission on CSAH 10
The Council directed the Planning Commission to review the CSAH
10 construction plans and bring back a recommendation on the
proposed plan. At their December 9th meeting, the Pz met with the
representatives of the Washington County Highway Department.
The City Council accepted the Planning Commission's
recommendation that CSAH 10 be a divided highway as recommended
by Washington County, but to span the pond with a bridge instead
of fill.

E. Recommendation from Planning Commission on Hidden
Valley (Oakdale Dev.)
The City Council accepted the PZ's comments regarding the Hidden
Valley housing development proposal in Oakdale as follows: There
is not a "park" in the plan, the units appear to be too dense,
the design goes over wetlands, poor road design, homes are
planned to be built over gas lines, the entrance onto Highway 36
is too dangerous, there is a concern of run off into Olson Lake,
what will the impact be on the school districts and will there be
an EAW requested.
M/S/P Williams/Mottaz - to direct the city staff to write a
letter to the Oakdale City Council and the Metropolitan Council
conveying our concerns about this development as presented in the
PZ's discussion of December 9, 1991. (Motion carried 4-0).
F. MUSA Extension Update
The Met Council has scheduled a meeting for January 3rd, 9:00
a.m., with Oakdale, Woodbury and Lake Elmo to discuss interim
options for treatment of waste from these three communities.
M/S/P Mottaz/Mayor Johnson - to grant a 30-day extension of the
MUSA consideration by the Met Council, and join with the Met
Council, Woodbury, and Oakdale at the January 3rd meeting and to
schedule a meeting for January 4th, after the Hammes walk-thru,
to prioritize and work on Old Business items, with rezoning the
city according to our FLUMap as top priority. (Motion carried 4-
0).
Councilman Williams explained he voted in favor of this motion;
however, he did not intend to vote for the comp plan amendment
until the rezoning of the City according to our FLUMap has been
dealt with to his satisfaction.
6. CITY ENGINEER'S REPORT:
A. SW-1 Watermain, Partial Payment #2,
Keys Well Drilling (Continued from 12/3/91)
City Engineer, Tom Prew, recommended that the Council authorize
partial payment #2 to Keys Well Drilling for work completed to -
date on the SW-1 watermain.
M/S/P Williams/Dick Johnson - to authorize Partial Payment #2 to
Keys Well Drilling in the amount of $3,044.00; contingent upon
the receipt of funds from Washington County to cover this
payment. (Motion carried 4-0).

B. Arabian Hills, Letter of Credit Reduction
The developer for Arabian Hills has requested a reduction in
their letter of credit. Tom Prew reported the grading, paving
and storm sewer work is complete, but some seeding and cleanup
work remain.
The Council asked the City Engineer to check on the landscape
plan regarding trees being planted along Keats Avenue.
M/S/P Williams/Mottaz - to reduce the Irrevocable Letter of
Credit #156 held by the First State Bank of Spring Lake Park from
$137,000.00 to $15,000; contingent upon submittal of lien waivers
from all contractors. (Motion carried 4-0).
C. Old Village Water Tank Inspection & Paint
The City Engineer indicated no proposal has been submitted.
D. Discussion of water rates for "Old Village" and
Lake Jane water supply
M/S/P Williams/Mottaz - to direct the City Administrator to call
a Public Hearing for January 21st to set water rates for the Old
Village area at $1.25/1,000 gallons, plus a $5.00 per quarter
service charge and a $6.00 quarter per customer water main
replacement fee in accordance with the City Engineer's report,
dated December 4, 1991. (Motion carried 4-0).
M/S/P Williams/Mottaz - to direct the City Administrator to call
a Public Hearing for January 21st to set the water rates for the
Lake Jane area at $1.15/1,000 gallons, plus a $5.00 per quarter
service charge. (Motion carried 4-0).
E. OTHER
The Council suggested that Dave Gustafson, Univ. of Minnesota,
present his slide show on septic systems on January 7th, at 6:00-
7:00 p.m., before the city council meeting.
7. CITY ATTORNEY'S REPORT:
No report was given.
8. CITY COUNCIL REPORTS:
Councilman Johnson explained there was a vacancy on the
Maintenance Advisory Committee due to the resignation of Kelly
Brockman.
M/S/P Dick Johnson/Williams - to advertise the position on the
Maintenance Advisory Committee in the next city newsletter.
(Motion carried 4-0)'.

1 Councilman Mottaz proposed the city staff receive a 3% pay
increase for 1992 and this money ($8,900) be taken out of the
$17,000 that is in the landfill fund based on the fact this would
be a justifiable use of this money because the entire city staff
contributes a great deal to the landfill fight. Mottaz will make
such a motion at the January 7th council meeting.
Councilman Williams asked the City Attorney to look at the
restrictions on the use of landfill funds.
9. CITY ADMINISTRATOR'S REPORT:
A. Ordinance No. 8061, Liquor Ordinance Amendment &
Summary of Ordinance
M/S/P Williams/Dick Johnson - to adopt Ordinance 8061, as
amended, an Ordinance relating to Section 1201 regulations of
Liquor within the City of Lake Elmo. (Motion carried 4-0).
M/S/P Williams/Mayor Johnson - to adopt and publish the Summary
of Ordinance 8061, as amended, relating to liquor within the City
of Lake Elmo. (Motion carried 4-0).
B. Request from Guardian Angels Church for a one -day
non -intoxicating
Guardian Angels Church has applied for a non -intoxicating malt
liquor license for one day, December 31, 1991. The Church has
provided the required insurance certificate and the Sheriff's
Department has signed off with their approval.
M/S/P Dick Johnson/Williams - to grant a one -day on -sale non -
intoxicating malt liquor license to Guardian Angels Church for
Tuesday, December 31, 1991. (Motion carried 4-0).
C. Ordinance No. 8029, Solid Waste, (Continued from 12-3-91)
On April 17, 1990, the City adopted a solid waste ordinance, but
it was never published. A summary of the ordinance outlined the
changes that were made to the existing ordinance.
M/S/P Williams/Mottaz - to adopt and publish the Summary of
Ordinance 8029 relating to solid waste and solid waste disposal.
(Motion carried 4-0).
D. Ordinance No. 8060, Lot Consolidation
M/S/P Dick Johnson/Williams - to adopt Ordinance No. 8060, as
amended, adding Section 401.040 II and Section 401.045, the
contents of said ordinance made part of this motion by reference,
to the Lake Elmo Municipal Code. (Motion carried 4-0).

Request by Robert Ziertman
Robert Ziertman had previously requested selling 4.135 acres to
his neighbor. With the approval of Ordinance No. 8060, the
parcel containing 4.135 acres will be combined by the purchaser
of said property so that the new parcel will consist of
approximately 9.135 acres.
M/S/P Dick Johnson/Williams - to approve Resolution No. 91-42, A
lot consolidation granted to Robert and Dorothy Ziertman
effective the following day after publication of Ordinance 8060.
(Motion carried 4-0).
E. Ordinance No. 8062, Heritage Preservation Commission
M/S/P Williams/Mottaz - to adopt Ordinance 8062, adding Section
212, A Heritage Preservation Commission to the 1979 Municipal
Code of Lake Elmo. (Motion carried 4-0).
M/S/P Williams/Mayor Johnson - to,approve and publish the summary
of Ordinance 8062 Heritage Preservation Commission. (Motion
carried 4-0)•
F. Contract with Washington County for Police Service for
1991
M/S/P Williams/Mottaz - to approve the 1991 contract with
Washington County in the amount of $92,129.87 for police service
for the City of Lake Elmo. (Motion carried 4-0).
G. Contract with Washington County for Ski Trail Grooming
M/S/P Williams/Mottaz - to approve the 1992 contract with
Washington County for Ski Trail Grooming for the City of Lake
Elmo. (Motion carried 4-0).
H. Board of Review
Lake Elmo's Board of Review is scheduled for April 16 from 3 to 6
p.m. with the follow-up meeting scheduled for May 5th. The
Council was asked to try to arrange their schedule so that all
council members could be there for the entire three hours.
I. Letter from Oakdale regarding excess right-of-way
in annexed area.
The City received a copy of a letter from, Larry Whitaker,
Oakdale Administrator, to Mn Dept. of Transportation indicating
the City of Oakdale is interested in annexing this property to
provide the most efficient levels of service to the area while
establishing logical boundaries for the two communities. The
MnDOt property as it now exists in Lake Elmo cannot be left as an
island in Oakdale.

M/S/P Williams/Mottaz - to direct the City Administrator to write
1 a letter to MnDOT, with a copy sent to the City of Oakdale,
opposing any further annexation until we have exhausted the
appeal process. (Motion carried 4-0).
J. Washington County C.I.P. - Informational
K. Computer Update
M/S/P Mottaz/Dick Johnson - to approve a fund accounting program
with training thru the State of MN for $600, to proceed with
conversion for water billing for appox. $600, and to purchase D-
Base from Todd Williams for $300, not to exceed $1,500 maximum.
(Motion carried 3-0-1 Abstain: Williams: This means a sale for
him.)

12:05. (Motion carried 4-0).

At their December 12, 1991 meeting, the Managers of Valley Branch
Watershed District approved the Rolling Bills of Lake Elmo permit, subject to
the fallowing conditions, to be shown on'the permit:
1. All disturbed areas shall be seeded and mulched or sodded within
two weeks following completion of construction, seasonal weather
conditions permitting.
2. The placement of erosion controls shall PRECEDE all other
construction work and be maintained throughout the construction
period until turf is established.
3. The vBWD engineer shall be notified at least three days prior to
commencement of work to schedule an inspection of the project's
erosion controls. The erasion controls mast be in place and
properly installed before grading may commence.
4. Wetland mitigation shall be completed and approved by the District
prior to alteration of the existing wetlands on the site. If this
is not feasible, the applicant shall post a performance bond
equivalent to at least 150% of the estimated construction cost of
the replacement wetlands, as reviewed by the District.

6. Drainage easements shall be granted to the City of Lake Elmo which
cover land adjacent to all ponding areas up to the 100-year flood
elevation. The City of Lake Elmo shall be responsible for all
maintenance within drainage easements.
7. Erosion controls shall be installed to prevent sediment from
entering wetlands and public roads. The erosion controls shall be
installed according to private covenants to be approved by the
Managers and filed with the District. It is understood that these
covenants will he file of record with the office of the Washington
County Recorder at the time the Rolling Hills of Lake Elmo Plat is
recorded. Erosion controls must remain in place throughout the
construction period until turf is established.

DISCUSSION ON IMPROVEMENTS ON COUNTY ROAD 10:
Don Wisnewski: Based on input from Lake Elmo, we have moved the
alignment about 221to 25' north so that would skirt the wetland
area. The Lake Elmo Planning Commission suggested a bridge. We
have a cost estimate of 3 million dollars for the bridge itself.
We are estimating this entire project to be about a million
dollars. We do not feel this is a feasible alternative.
Dick Herold: We moved the alignment to the north so we don't
lose any wetland on the southside of the road. We have contacted
the county landscape architect regarding kinds of trees and
shrubs and would come before the council with a planting schedule
for your approval. There would be bigger trees on the north side
with shrubs on the southside. We do not have anything firmed up
on replacement of wetlands. Permanent loss of acreage is about
3.3 acres. With the no net loss passed by the legislature, this
would mean 6.6 acres of replacement wetlands and would be worked
out with the DNR and Core of Engineers.
Todd Williams: Are you planning on transporting water by a pipe
under the road? Herold: Definitely, but decision hasn't been
made if the pipe would be 30" or 36". We will do a study and look
at the storage and do an engineering design when we size the
pipe.
Wisnewski: We are preparing an EAW and the County would be the
RGU. We finished preliminary design from discussions of the two
councils.
Oakdale: Let's lower the speed limit and make a decent looking
parkway and don't see any reasons why we can't put trees in the
median. As far as putting trees and shrubs along this is a waste
of money. There were individuals here that were not in favor of
a 4-lane, but compromised, favor of a four lane if we could have
a parkway type design. Let's be different and use our
imagination.
Dick Johnson: I don't see any imagination here at all from the
standpoint of a parkway, but just plant a few trees to passify
the councils.

Todd Williams: I agree with everything that has been said about
the landscaping. I have not seen the justification for this
expansion. To the east of Helmo Ave, the figures we have seen
from the traffic counts are no way near the numbers the County
has claimed are needed to justify a 4-lane divided highway at
County Road 13. There's no basis for the projections. Why does
every agency from the State to the County overestimate traffic
counts and growth. Until you can show that you are not doing that
again, and those facts and figures for justification come about,
I cannot support going with a 4-lane divided highway all the way
across.
Wisnewski: This is an important minor arterial route on the
county highway system. It is also a very important route for the
two cities. We are building this for the future, possibly 50
years. We are close enough now to the threshold that it would
not be prudent for us to come with a 2-lane roadway, anticipating
there will be continuing growth.
Williams: Frankly, putting that stretch as you have proposed 4-
lane divided into Lake Elmo is one more step toward extending
that as 4-lane divided across Lake Elmo and I don't want to have
anything to do with that. You have had it in your plans for 20
years to have that 4-lane divided all across Lake Elmo. What is
the traffic count on Highway 5 at County Road 17 and on Manning
Avenue.
Wisnewski: As we started going east 9800 vehicles per day at 17
and 8400 vehicles per day at Manning Avenue on Highway 5,
Williams: Why aren't you proposing upgrading that highway to 4-
lane divided. There is a lot more traffic there than we have
here. Wisnewski: The state of MN looks at this as a very low
priority highway. What they would probably like to see is
Washington County take that over.
Dick Johnson: What would it cost if we only did a portion now 2-
lane and then when required develop it into a 4-lane at some
later date. Herold: A normal 2-lane roadway, rural type
construction, would be $160,000 to $400,000. A 4-lane would be
$900,000.
Mottaz: I want to see a divided 4-lane, a parkway, something
attractive with landscaping, but concern with cutting this body
of water in half. How much extra does it cost to put in a bridge
in as opposed to buying land and expanding the wetlands, plus
what it would cost to construct a road across this lake. Herold:
You are talking about somewhere in the neighborhood of $300,000
versus a bridge for 3 million.

Dick Herold: I have talked to the DNR, Core of Engineers and if
you follow their rules you can get a permit. I have talked to
Armstrongs about it. They said they had to see it, but didn't
say they were opposed to it. I talked to Mr. Kirvida about the
concept, but didn't talk to him about wetland replacements.
Wisnewski: We hear you in terms of the parkway concept. We can
work on the 45 mph and see what we can do there. It may take
special legislation. In terms of the parkway itself we have to
look at the design in terms of median. We may have to take
additional right-of-way width to accommodate those tree clumps.
It may end up being something that separates for a short
distance, wider and then come back together. If we do that, this
means additional right-of-way.
Herold: Would like to see a depressed median as opposed to a
raised median.
Mottaz: If we can have a low speed treeway as a parkway going
thru downtown St. Paul and So. of St. Paul, I can't see why we
have an insurmountable problem here in trying to put in a few
trees and making something attractive going thru Washington
County.
Wisnewski: We will go back and look into what we can do to
provide that separation between the two lanes and come back to
you right after the first of the year. We want to make it a 1992
project.
Mottaz: I would like to see a four lane. We can have it so that
it is a parkway type design. Something attractive like Hilton
Trail, County Rd 36, with more plantings in it.
Dick Johnson: I am in favor of the parkway design and would like
to see lower speeds. In concept. I reserve judgement. If you
come back with something with green dots on it and say that you
have been to the County landscape designers, this is unreasonable
to me.
Oakdale: I think we can support those things with the mitigation
being as close to Armstrong Lake as we can possibly be, either
north or south. If you would consider some other type of program
for the divided strip with or without the extensive landscape, I
think there are certain plants that would be better than others
and would be attractive.
Wisnewski: We will try our darndest. It is an important roadway
to us and we know it is important to you.
Mayor Johnson: I think we have a consensus here on the two
councils to go ahead and go forward with this thing with the
stipulation that definitely we have a boulevard or parkway type
of appearance to it and 45 mph speed limit.

Oakdale: Bill and I have been looking at some of these numbers.
It seems to me we are spending a million dollars and I don't know
if you got a good handle on the actual traffic volume here. I
personally don't think so. If it is possible between now and
then, should get a better feel of actual traffic. From the
standpoint of Oakdale, especially with Walmart south of 10th
street, those numbers are going to jump drastically from whatever
you will count today. In five years from now, we are going to
wish we had another lane down there if we don't do it.
Herold: I have sat out there one evening rush hour and one
morning rush hour to monitor the traffic in the fall of the year.
The numbers were somewhat similar to what we had in 1990--5142.
Observed 75% of the traffic that is coming down 10th St.. are
going straight thru the intersection and not turning.
Mayor Johnson: You are talking about coming back to us the
second week in January. Would it be possible for you to come
back with a design upon which we can go ahead and make some final
determinations.
Wisnewski: We won't have the final design, which is the final
plan. We will have a parkway concept defined to a point where I
think you will be able to see that it is not just splotches of
green on a map. You will be able to get somewhat of a 3-
dimensional view of what we are talking about. We will involve
our landscape architect.
Williams: It would be helpful if that could be given to us prior
to the meeting. Herold: We will try to do that.

The requested Special Meeting shall be at 7:00 PM on Thursday, December
12, 1.991, at the Lake Elmo City Council Chambers.
The topics to be discussed at the meeting include:
1. Response from the City Attorney, in accord with the direction given at
the Council meeting on December 3, 1991, as to options the City can follow
to recover penalties awarded against the City in the Trailhead Development
case;
2. Actions the City can take to enforce the court order to rezone the
Stonegate property;
