LAKE ELMO CITY COUNCIL MINUTES
DECEMBER 3, 1991
Mayor Johnson called the city council meeting to order at 7:05
p.m. in the City Council chambers. Present: Mayor Johnson,
Hunt, Dick Johnson, Mottaz, Williams, City Attorney Filla and
Administrator Kueffner.
1. AGENDA
Add: 10F. Vacancy on Maintenance Advisory Committee
Interchange 7D. MUSA Ext with 7E. Stonegate
M/S/P Williams/Hunt - to amend the December 3rd Council agenda.
(Motion carried 4-1: Mayor).
Add: Water Problem at Cimarron, ReAPP Report
M/S/P Williams/Hunt - to approve the December 3rd City Council
agenda as amended. (Motion carried 5-0).
2. MINUTES: November 19, 1991
M/S/P Dick Johnson/Hunt - to approve the November 19th City
Council minutes as amended. (Motion carried 5-0).
3. CLAIMS
Councilman Johnson reported the Maintenance Advisory Committee
had a problem with Claim #95582 (Road Machinery & Supplies). The
City rented a front-end loader with a wing to widen the streets
which was done in lieu of a piece of equipment we already had.
The Committee had a problem with a full week rental on a daily
rental basis with a stiff rental charge. According to the City
Administrator because of the immense amount of snow we received
from the Halloween snowstorm, it was necessary to get a second
unit. Also, the City did some plowing on Cimarron streets which
we will be reimbursed for.

4. PUBLIC INQUIRIES:
ReAPP REPORT:
Margaret Carlson reported that REAPP is meeting the first Sunday
of every month. ReApp is meeting with members representing other
communities that have proposed landfill sites in their cities to
discuss the alternative siting process which is being considered.
Colley & McVoy, public relations firm, won a public service award
for their efforts in the Lake Elmo campaign against the landfill
and the Lake Elmo video.
Cimarron Water Problem:
Cimarron residents voiced their concern on if their water was
safe to drink again at the Cimarron mobile home park. Residents
were advised Friday to boil their drinking water while the park's
water system was being cleaned of bacteria.
Councilman Johnson asked Bonestroo Eng, firm if the source of the
contamination is known, is the contamination still there and are
we just getting rid of the contamination by adding more chlorine.
He had a concern of contamination getting to the aquifer and
requested technical details and operation of this system.
Tom Noyce, Bonestroo Assoc., responded they did not know how it
happened and are still looking for possible sources of
contamination. They did flush the entire system, chlorinated to a
chlorine residual so that the water supply is safe. The tests
that were taken were from the well in addition to the
distribution system itself and all are clear at this point. The
sample from the well is unchlorinated and if there is any
contamination there it would show up.
Dan Krawczyk, NHD, stated the samples that were positive were
taken from the child care center and from the club house. The
second set of samples were from the child care center.
Councilman Mottaz: Is there going to be an investigation to
determine where the contamination came from? Noyce: we may never
know where the contamination came from. This Park has been in
existence a long time and as long as he has been involved (11
years) this is the first time this has ever happened.
Mark Sieke, Bonestroo & Assoc., stated we don't operate water
systems or waste water plants routinely because that is not the
business we are in. Because we had someone leave for a period of
time, month or two, we are in the process of interviewing
candidates and getting someone to replace him. We try to fill in
while they get a replacement and this usually speeds up the
process because we are expensive. We are now writing a calendar
of happenings and had just received a verbal clear of nitrates
and coliform bacteria on samples that were taken at the well.

Councilman Johnson: I want to make sure the line of communication
continues between Cimarron and the City and ask that all test
results be sent to the City Administrator. Mike Sieke responded
that we could ask, but their contract was with the park and they
make the information available to the park so it is up to them.
Dan Krawczyk answered that he would not have any problem with
this request.
The Attorney for Cimarron stated he had prepared a letter
regarding what the relationship is between the city and the park
specifically on this issue.
Councilman Mottaz suggested developing a committee that would
look into all aspects of the park that deal with the health,
safety and welfare of the residents of Cimarron and work with the
professional experts to try to develop a better understanding of
the relationship of the park management, residents, city, etc.
Fran Pott agreed to chair such a committee.
The Council agreed that such a committee was desirable and a
charter would be developed.
A cimarron resident asked that the same news media that presented
this water problem to their readers now acknowledge the solution
to this problem. The Attorney added that when we get the reports
from the state they were planning to distribute these to the
Pioneer Press and the Star & Tribune.
Septic Tank Manhole:
Barry Weeks asked about the status of the Septic Ordinance
regarding manhole covers.
Dave Gustafson, Univ. of MN on -site sewage specialist, stated, in
general, in cleaning on site systems you need to go thru the
manhole to get the job done.
Tom Palecek, Pinky's Sewer Service, explained that all the newer
tanks, from 1975 on, have manhole covers but no one has made the
people aware of it or brought them to the top.
Councilman Mottaz noted this entire process should not be a
financial burden. A ring costs $20 which include the sealing
tape and an hour job.
Shirley McMaster, Lake Elmo resident, asked if it is only a half
hour job why can't I find the manhole every time I need the
system pumped since it is only 12 inches below grade.
Tom Palecek stated if these residents are willing to dig the
manholes up, there's nothing wrong with that.
Dave Gustafson will provide a slide presentation on on -site
septic systems at a January Council meeting.

OTHER:
Margaret Carlson noted that Councilman Mottaz stated at the last
Town Meeting and at the October 1st Council meeting that the City
has spent over $100,000 in detachment fees when the correct
amount is $52,500.
In regard to the Stonegate rezoning, the action initiated by
Mayor Johnson and Councilman Mottaz has cost the City $1700 to -
date plus $2000 in court ordered attorney fees to be paid and any
coming fees from our city attorney, plus any additional fines
levied for non-compliance. Carlson voiced her regrets that her
tax dollars are being spent in such a frivolous manner. A better
use would be to give the city staff a well -deserved increase in
salary or put toward recycling efforts. She urged Mayor Johnson
and Councilman Mottaz to vote for approval of this rezoning and
bring the city into compliance with the law and avoid any future
legal fees by the city.
Carlson voiced her alarm on the action taken by Mayor
Johnson and Councilman Mottaz against adopting the 1991
Comprehensive Plan. She urged them to adopt the resolution to
approve the 1991 Lake Elmo Comprehensive Plan.
Councilman Williams commented on the erroneous statement made by
Councilman Mottaz regarding the amount of money ($100,000) the
city spent to fight the detachment/annexation proceedings of
Section 32/33 at the October 1st meeting and the Town Meeting.
Councilman Mottaz claims he got the figure from Marilyn, but this
is not correct because the total figure I received from Marilyn
is $52,591.54.
5. PARKS AND OPEN SPACE:
Discussion with DNR reps regarding access to Munger Trail
through DeMontreville Park
Larry Killien, DNR, indicated the proposal of providing access to
Munger Trail thru Demontreville Park was discussed with the Parks
Commission who voted in favor of accepting this extension. If
there is a problem from the cul-de-sac or from the trail into the
park, a maintenance barrier could be designed to come up to the
connection.
Councilmen Mottaz and Williams voiced their concern on limiting
the access to proper uses and wanted to make sure if there is
some agreement between the city and DNR that the city can install
barriers at any time.

6. PLANNING/LAND USE & ZONING:
A. PUBLIC HEARING: Shoreland Permit with Variance
Dorothy Hanson, 7978 Hill Trail N.
Mayor Johnson opened up the public hearing at 9:15 p.m. in the
Council chambers. The public hearing notice was published in the
November 20, 1991 St. Croix Valley Press and adjacent property
owners were notified.
Dorothy Hanson, 7978 Hill Trail N., is requesting a shoreland
permit with a variance to setback from the Ordinary High Water
Mark for the purpose of constructing a 3-seasons porch where they
now have an existing deck. The required setback for the
principal structure is 100 feet from the ordinary high water
elevation. The applicant has stated that the proposed porch
structure will setback 51 feet from the OHWM and would be 2-feet
shorter than the deck.
The Council received letters from Timothy Gennrich, 7972 Hill
Trail N. and Charles Lea, 7982 Hill Trail N. indicating they had
no objection to granting the request variance for the purpose of
constructing a 3-seasons porch.
The Council received a letter from Molly Shodeen, DNR,
questioning whether there are alternatives to construct the porch
on the east side of the house.
Mayor Johnson closed the public hearing at 9:25 p.m.
Because the packet was received late, several councilmen did not
have time to visit this property. Therefore, the following
motion was made:
M/S/P Hunt/Williams - to postpone consideration of this request
until the December 17th Council meeting. (Motion carried 5-0).
7. OLD BUSINESS•
A. Carmelite Monastery variance to frontage on a public
dedicated road, Resolution No. 91-40.
M/S/P Dick Johnson/Hunt - to adopt Resolution No. 91-40, A
Resolution Granting a Variance to the Carmelite Monastery from
Section 301.090I. of the Lake Elmo Municipal Code (Frontage on a
public road). (Motion carried 4-1: Mottaz: This goes beyond a
private road. It's opened to the public and the city has
responsibility that all safety concerns are considered.)
B. Septic System Ordinance: Discussion with Tom Palecek,
Pinky's Sewer Service was held under Public Inquiries.

M/S/P Dick Johnson/Mottaz - to add the Hammes Property
Update to the agenda. (Motion carried 5-0).
Jim McNamara reported the clean up process on the Hammes property
was progressing slowly and provided pictures. Receipts for
removal of tires were submitted to the Council.
Councilman Williams indicated Hammes Mining has started hauling
gravel out from 10th Street. The mining operation now
encompasses the entire property and should be addressed by the
Council when reviewing the CUP. Also, the barn has not been
touched which was to be cleaned up by November.
The Council set Saturday, January 4th, 9:00 a.m. as a Council
walk-thru of the Hammes Property. The Building Official will
check the Council's schedule on dates set for cleanup.
C. Adoption of Comprehensive Plan, Resolution No. 91-41
Mayor Johnson indicated he would be in favor of adopting this
Resolution if the words, "AND SUPERSEDES" be deleted in first
paragraph and to direct the Planning Commission to review the
differences between the Comp Plans and determine those items
that should be deleted or inserted.
Councilman Williams asked the City Attorney the following
questions:
Does deletion of "supersedes" impair the effectiveness of the
resolution? Attorney Filla answered the word "supersedes" was
inserted to try and help clarify where the city is on this issue.
Without this wording it is less clear, but with the resolution it
certainly is more clear than it is now.
Would the Future Land Use Map amended by this resolution?
Attorney Filla answered that this resolution deals with the
booklet entitled, 111990-2010 Lake Elmo Comprehensive Plan"
including all the maps that are in it.

Mayor Johnson indicated he would be willing to rezone this
property with a strip of land providing a reasonable buffer
between this property and the Hammes Mining Property.
Discussion followed on adding a condition to the preliminary plat
that the property owner provide a 200' buffer (open space
preservation) easement along its common border to adjacent
properties until some future time. There was no agreement reached
on providing such a buffer between the City and the developer of
Stonegate.

Stonegate. (Motion Failed 3-1-1: Mayor Johnson, Abstain: Mottaz).
M/S/ Williams/Dick Johnson - to direct the city attorney to
report back to the city council at the next meeting on options
that the city can take to recover attorney fees awarded by the
court and also any penalties imposed by the court due to the
failure of rezoning and recover those costs from Mayor Johnson
and Councilman Mottaz.
M/S/F Mayor Johnson/Mottaz - to amend the motion to add while the
City Attorney is doing this he would like him to determine if
circumvention of the state statute with regard to rezoning
constitute a violation of the oath and; therefore, is it grounds
for removal of these three councilmen. (Motion Failed 2-3: Hunt,
Councilman Johnson, Williams).

report back to the city council at the next meeting on options
that the city can take to recover attorney fees awarded by the
court and also any penalties imposed by the court due to the

The property in question is a riparian lot on Lake DeMontreville.
Lake DeMontreville is classified a Recreational Development lake. The
ordinary high water (OHW) elevation is 930 and the 100 year high water
level (HWL) is 931. The required setback for the principal structure is
100 feet from the ordinary high water elevation (930).
The applicant has stated that the proposed porch structure will setback
51 feet from the ordinary high water elevation. That setback distance
cannot be verified on the scale drawing submitted by the applicant
because only the 100 year elevation (931) is shown and the ordinary high
water level (930) is not drawn on the site plan.
i recommend denial of the variance request for the following reasons:
1. The existing house and deck does not conform to the required 100
foot setback from the OHW (930).
2. Although two feet shorter, the construction of a completely
enclosed three season porch will be a larger visual encroachment
upon the shoreland setback standards than the existing deck.
3. No hardship has been demonstrated by the applicant.

Metro Region Waters has reviewed the request by Dorothy Hanson to
enclose a deck into a 3 season porch. We question whether there
are alternatives to construct it on the east side of the house.
This is an example of why the Department has generally taken a
negative position on decks. Decks seem to eventually be converted
into living space over time.
This proposal represents an expansion of the structure towards the
lake which increases its substandard dimensions. Even though it
will be two feet less than the existing deck, the proposed
expansion will include a roof and walls. The burden of proof of
hardship rests with the applicant, which is difficult to
demonstrate for a porch, since there is already reasonable use of
the property.
Please forward a copy of the final local decision within 10 days of
that decision. If you have any questions regarding the above
