LAKE ELMO CITY COUNCIL MINUTES
JANUARY 21, 1992
Mayor Johnson called the City Council meeting to order at 7:00
p.m. in the City Council chambers. Present: Mayor Johnson,
Hunt, Dick Johnson, Mottaz, Williams, City Engineer Tom Prew,
City Attorney John Miller, City Planner Mike Black and
Administrator Kueffner.
1. AGENDA
Add: Councilman Hunt: Update on Improvement for County Road 10

2. MINUTES: January 4, 1992

4. OLD BUSINESS: Set date for workshop
M/S/P Hunt/Williams - to schedule a city council workshop to
discuss Old Business items on January 28, 1992, at 7:00 p.m. in
City Hall. (Motion carried 5-0).
Administrator Kueffner reported that Attorney Filla will have a
recommendation on Hammes Mining at the February 4th Council
meeting.

5. PUBLIC HEARINGS:
A. Water Rates - Old Village
Mayor Johnson opened up the public hearing at 7:30 p.m. in the
City Council chambers. The Public Hearing notice was published in
the January 8, 1992 St. Croix Valley Press and affected property
owners were notified.
City Engineer, Tom Prew, explained the Old Village system was
built in 1962 consisting of a well, a pump, a water tank and a
distribution system. The City has 243 users, and we bill about
17 million gallons a year. The total cost of production and
maintenance is $21,025 a year. He is proposing setting up a water
main replacement fund. Annual cost for replacement is $5,876.79.
Currently the water rate is $1.00/1,000 gallons plus $5.00
quarter service charge. The service charge is an administrative
fee and is not considered water revenue. The average home using
approximately 200 gallons/day pays $93.00/year for water. Cost
of production and maintenance ($21,025) divided over the 17
million gallons used gives a rate of $1.25/1,000 gallons.
The largest part of this water rate increase will be in the
creation of a watermain replacement fund. In order to cover all
the costs of operating this water system, Prew recommended that
the new water rate be $1.25/1,000 gallons, that a new
$6.00/Quarter watermain replacement fee be added, and that the
current $5.00/Quarter service charge remain the same.
There was no one to speak for or against the increase in water
rates.
Mayor Johnson closed the public hearing at 7:35 p .m.
The Council agreed to $1.25 per thousand (1,000) gallons of water
used, with a minimum usage charge of $7.50 per quarter, plus a
$5.00 service charge per quarter for each user, plus a $6.00
water main replacement fee per quarter for each user.

for each user), establishing water service rates from January 1,
1992 for the "Old Village" water system. (Motion carried 5-0).
B. Water Rates - Lake Jane
Mayor Johnson opened up the public hearing at 8:00 p.m. in the
City Council chambers. The Public Hearing notice was published in
the January 8, 1992 St. Croix Valley Press and affected property
owners were notified.

Tom Prew reported there will be 83 users on this system with an
estimated 8.3 million gallons per year being billed. We will be
buying the water from Oakdale who charges us $0.79 per 1,000 for
the water. Lake Elmo will flush and repair the system at an
estimate of $1,500 per year. Replacement cost for this watermain
system over a 100 year life would necessitate a charge of $1.35
per 1000 gallons.
Through negotiations with Washington County when the system
was being proposed, $25,000 was negotiated to offset the cost to
the residents of the city water versus their well water. We can
collect interest on the $25,000 and use that to offset the water
rates and propose to charge $1.15 per 1000 gallons, plus the $5
per quarter service charge. The average annual cost for a Lake
Jane area water system user would be $120 per year.
Dick Quinn, 8929 36th St., explained Oakdale is charging $0.79 to
their own residents and we (Lake Elmo) are not getting any break
at all. What about Oakdale billing us directly as they do their
own customers saving $0.36 per 1,000. Then the $0.36 for our
city's administrative costs could be eliminated.
Tim Zilles, 8890 36th St., read an article in the St. Paul paper
about the EPA is negotiating with the two counties over landfill
on -going charges of appox $2.4 million. Could this water charge
be construed as on -going?
Councilman Hunt explained the counties were not required to put
in the water system. To meet the requirements set out by the
Minnesota EPA and PCA all they would have to do is install carbon
filters in about 4 or 5 homes. The Counties elected to put the
water system in the entire area (both developed and undeveloped)
at an expense far greater than what they would have had to bear.
The City entered into this agreement that would allow the water
system to go in very quickly. According to the MPCA there is no
longer a problem for the homeowners because now they have safe
water.
Councilman Johnson noted the article discussed a responsible
party search and it would behoove the City to follow up on this.
This may be a possible way to get the landfill cleaned up.
Mayor Johnson closed the public hearing at 8:18 p.m.
Councilman Williams suggested a watermain replacement fee rather
than incorporate this water main replacement fee into $1.15 per
1,000 gallon fee as we did in the old Village because he liked
the idea of a dedicated fund for water main replacement.
The City Administrator has not heard from Oakdale regarding her
inquiry about the $162 bill the City received for Oakdale's water
rates of $2.00 per unit per month and $0.79 per 1,000 gallons.

The Council agreed to $1.00 per thousand gallons of water used,
with a minimum usage charge of $7.50 per quarter, plus a $5,00
service charge per quarter for each user, plus a $5.00 water main

6. PLANNING/LAND USE & ZONING:
A. Linder's Greenhouse: Amendment to CUP
Charles Hoffman indicated Pete, Dave, and Lill Linder who were in
attendance, had asked him to be the principal spokesman for the
Linders. The information that the Linders were requested to
produce at the last PZ meeting was provided in a series of
letters from Linders and the engineers that produced the EAW.
Mike Black gave a summary and status report of the 13 conditions
placed on the CUP amendment and asked for Council discussion and
then direction to draft an appropriate Resolution.
The applicants have agreed to Condition #1. Proper Maintenance of
the Storm Pond and Outlet Structure, Condition #2. Obtain a Water
Appropriation Permit from the MN DNR, and Condition #3. Phase II
Condition 4. No chemicals shall be stored on the site:
The Council indicated their desire for a list of chemicals
being stored, quantity, and how they would be stored so that the
Building Official can check the list for conformance with the
CUP. The locker should be sized for ultimate Phase II expansion
based on locker figures provided in Dave Linder's letter of
January 14, 1992.
Hoffman: We could update the Council on an annual basis and
will estimate the size of the lockers optimistically.
Condition 5. No petroleum products shall be stored on the site:
The Council suggested the Planner sit down with the Fire Chief
and Building Official and come up with reasonable wording setting
the type of products and limits being stored that would insure
the type of operation the Linder's want, but leave the City
enough control to make sure amount of storage doesn't get out of
control.

movement will not be obstructed.
City Council: Request the Fire Chief and Sheriff review the
site for what on -site maneuvering is needed and come back to the
Council with a report. Also, the site should be reviewed as
construction is starting.
Mayor Johnson voiced his concern on the explosive potential
of the polyethylene plastic used in the building. The Council
requested the applicant provide a flammability rating on the
plastic to the Fire Chief.
Hoffman: We know the distance between the building of Phase
I and Phase II and could explain it either on a drawing or to the
Fire Marshall and other emergency city officials. In discussion
with the Fire Chief we will provide him with this flammability
rating.
Condition 10. City Staff prepare a written condition clearly
stating the road maintenance responsibilities and associated
costs to be born by the applicant.
The City Engineer, Tom Prew, reported the City has to
contract with the County for road grading and they set it up on a
rotational basis. We would have to get a private contractor to
take care of the calcium chloride.
City Council: How can we assess the impact of their
development on that road? Is there any way other than vehicle
counts? Can we put a condition in the CUP permit?
Prow responded they can look at the number and type of
vehicles the operation would use, and what type of vehicles the
homes use. Then we can figure out the net effect of each, farm
operation and residential, on the road and come up with a
rational basis or look at, an ad valorem assessment.
Mayor Johnson pointed out in the Agricultural use zone the
policy is that we will not allow uses that would expand a need
for improved city services.
Hoffman: Linders have in the past provided the dust control
and agreed to the extent that if more than normal grading and
dust control is required that can be attributed to the use of the
OGreenhouse, we would pay our reasonable share of that. If it
ever came to the point for requiring blacktopping, based on an
accurate traffic count of usage by the Linders, then we would
expect the assessment consistent with this usage. If the thought
were that because we were using it more than other people using
the road, that we then become responsible for all of the
maintenance of the road, we would consider that unfair.

The trucks are basically large delivery vans, appox, 15,000-
20,000 gross lb. vehicle weight. We would be happy with any
system that seems to have a rational basis and represents an
honest effect from the greenhouse on proportion of maintenance.
The Council wished to see additional landscaping higher on
the site and closer to the buildings which would breakup and
soften the visual impact of this facility, particularly from the
Regional Park.
Mayor Johnson noted this structure is 60,200 sq.ft. and is
the largest structure in the City. Each time we add to this we
establish a precedent in the Ag District. Johnson asked that the
Linders prove to him this facility would become invisible because
our comp plan and code states that we will preserve Ag land and
open spaces. In addition to plantings, he asked if there was a
way of making the plastic less reflective.
Councilman Johnson noted he didn't see greenhouse operations
as an ugly operation and considers the buildings as not a
permanent structure. He requests a condition that temporary
retail greenhouse structures will not be allowed to be put up on
site.
Councilman Williams explained when Phase I came in, he had
apprehensions about it primarily the visual impact from the Park
but you can also see it from 10th Street. There have been
concerns expressed publicly. Regardless of what Linders have
proposed right from the beginning as far as eventual expansion,
no one on the Council could conceive what it would be like
because they have never seen anything like it before. He
objected to the comment of changing the rules in the middle of
the game because now we have a better understanding of what this
is like. Councilmen Williams and Mottaz felt this operation was
more like a commercial operation than a farm field; therefore;
requires different criteria for mitigating its impact on the
environment. Along with the plantings, he would like to see
consideration of some berming.
Hoffman: We do have a problem with the suggestion with
additional screening. Linders have planted twice as many trees as
they were asked to do. If that was sufficient at the time, given
that Stage II was going to have a minimal impact in terms of
visibility from the park, this would be changing the rules in
midstream and felt it was unfair. As to additional plantings
along the edge of the gravel, the land is currently being used to
grow hay and the effective ability of the trees closer to the
building, increases the screening minimally by the time these
trees begin to grow compared to the trees that have grown
considerably at the edge of the property.

We have not heard anything from the management of the park
indicating this was a concern. The suggestions that are being
made are economically crippling from the Linder's point of view,
given the additional impact available. Linders have made a good
faith effort to deal with this issue and attempting to revisit it
at this point simply becomes and arbitrary and capricious attempt
to prevent us from doing something this Council knew about when
it first began.
The Linders will come back with a proposal that will be
economically feasible to them and also provide the type of
enhancement of screening that the Council is looking for.
Condition 12. No artificial liahtina shall be used without first
obtaining an amendment to the CUP.
Existing CUP addresses this.
Condition 13, Phase III construction shall reauire a CUP
Amendment.
Phase III will require another CUP amendment.
Councilman Williams noted the existing 3-row tree barrier has
some holes in it and requests they get plugged up this year. He
pointed out in our code under the commercial zoning district,
impervious coverage for lot size larger than 8 acres is a maximum
coverage of 25% of the lot size. If you have 54 acres total, 25%
of that is 16 acres which you are running close to at full scale.
His concern was that this 25% is not exceeded by roads and
greenhouses.
Mayor Johnson indicated he looks at CUPS in our code as granting
a special privilege not generally available in the regular zoning
category. There are other reasonable uses for that property.
Mike Black noted he would do his best to do his report and a
resolution for the February 4th meeting, but would have to meet
with the applicant this week, the Fire Chief and Sheriff to
proceed.
B. MUSA Update: Request for extension
The City received a letter from Richard Thompson, Metropolitan
Council, regarding the city's request for a MUSA extension. The
Met Council would like additional time (approx.. 75 days) until
March 31, 1992 to review those items noted in his letter.
M/S/P Hunt/Williams - the City Council grants the Metropolitan
Council additional time until March 31, 1992 to complete the
review of our Comprehensive Plan amendment. (Motion carried 5-
0) .

Mayor Johnson reported Donald Blohm, Metropolitan Waste Control
Commission, had written a letter to the Met Council on December
16, 1991 which was prior to the meeting between the Met Council,
Cities of Oakdale, Woodbury and Lake Elmo which formed the basis
for that discussion. Mayor Johnson explained he wrote a letter
to Mr. Blohm stating that he felt his letter was incorrect and
led the Met Council away from the issue. There are approx. 475
acres of municipal urban service area within Section 32 and west
half of Section 33. Of the 475 acres approx. 355 acres are in
the City of Oakdale and 120 acres are in Lake Elmo. The purpose
of this letter was to let MWCC and the Met Council know that our
position is we are not asking for a new sewer capacity, we have
capacity and we want to move some of that capacity to a 440 acre
strip along our I-94 frontage. He has asked that the MWCC review
the data he has suggested and get back to him with their
comments.
Councilman Johnson noted he didn't disagree with his comments and
holds the same position. However, the City Council should have
granted approval of a letter prior to the Mayor writing a letter
to a governmental agency stating an opinion that you hold on City
of Lake Elmo stationery and implying it is the official city's
position.
In the future Mayor Johnson stated he would poll the Council or
have the Administrator poll the Council to see if they are in
agreement with what is stated in the Mayor's letter.
At the last meeting with Oakdale, the City Councils decided that
at the next joint meeting the first agenda item would be Section
32 & and 33 Annexation area.
M/S/P Hunt/Mottaz - to direct the City Administrator to send a
letter to the Oakdale's City Administrator and Council expressing
the merits of working together and promoting some development
along I-94 to County Road 19 and co-operating on our MUSA
extension. (Motion carried 5-0).
7. CITY ENGINEER'S REPORT;
A. Old Village Septic Problems
Tom Prew reported the City had received requests from some of the
businesses in the Old Village Area to allow them to connect to
the existing Old Village Drainfield. They made the requests
because they have insufficient area on their property to install
a legal drainfield.

The City Staff had found that a number of other homes and
businesses in the area do not have sufficient room for a
drainfield. The staff conducted a survey to see if other property
owners would support a new community drainfield. The City
received seven responses to this survey, there was no objection
to this proposal and some support for it. The Building Official
did not look at the size of the lots throughout the residential
area to see if a drainfield could be built up to state and city
code.
Councilmen Johnson and Williams voiced their concern on where
this money would come from to do a feasibility study.
The Council asked that the Building Official go through the
building records and find which residents have pulled a permit
for a new septic system and add those to the systems that were
done on the 201 Program. This way you would know which ones are
left.
M/S/P Hunt/Mayor Johnson - the city staff be directed to send
letters to the remaining Old Village residents asking for their
interest in participating in any kind of program to aid in
failing or sub -standard systems, and to prepare a quote for a
feasibility study for the area served by the City water system.
(Motion carried 5-0).
B. Sunfish Lake Underpass
At their January 13th meeting, the Parks Commission unanimously
turned down the proposal for a TH5 pedestrian/bicycle underpass
project for reasons stated in the Parks Commission letter dated
January 16, 1992 to the City Council and City Engineer. The
Commission recommended adding a separate bike trail along the
area to be improved with the hope it could be added to later.
Tom Prew reported he had talked to William Crawford, Chief
Engineer for the Metro District, who said an underpass could be
added on to the overall project. Mr. Crawford referred this
request to the State Aid Engineer to find out if this 5' trail
would be State Aid eligible.
M/S/P Mottaz/Dick Johnson - to direct the City Engineer to engage
in correspondence with the Highway Dept. regarding a parallel
bike trail along State Highway 5 and to investigate the
possibility of a state grant for aid for developing a trail.
(Motion carried 5-0).
As they did at their last meeting, the Council voiced strong
opposition to the State's removal of the large oak trees in front
of Shiltgen's farm. They understood that the project would
affect driveway access in the Old Village, such as, Brockman
Motors entrance across from Lake Elmo Avenue would be shut off,
and the Twin Point and 76 Station entrances will be narrowed to
32'.

Mayor Johnson indicated that once they have come to a resolution
that would be satisfactory to the property owners, MnDOT would
come before the City Council with their proposed project.
8. CITY COUNCIL REPORTS:
Councilman Hunt explained that some of the conditions such as
a parkway system and 45 mph speed limit that he had wanted to see
are not in the improvement project for 10th Street. He
understands the County's design does not include a bridge over
the wetlands, plantings in the center and the speed limit is 55
mph.
Councilman Williams referred to Steve DeLapp's letter which
raises a number of significant issues and requested the Council
think about what do we really need there for now and for 10 or 15
years. We do not need a 4-lane divided highway because the
traffic counts do not support it now and the projections of M.
Herold are vastly overestimated. Both communities would be very
well served by upgrading the existing road to two good lanes and
2 paved shoulders. 4th Street would take this hypothetical
Woodbury to Oakdale traffic off of 10th Street. This is an
important alternative that the County Engineers admitted they
hadn't thought of. Williams suggested the City send a letter
indicating we have significant concerns, that ground work needs
to be done before the County goes too off in one direction.
Councilman Mottaz indicated he would like to see a traffic
count for 120/Century Avenue and for consideration of this kind
of design and stay away from a 4-lane. Would like to know the
traffic count on State Highway 5 because the State feels a 2-lane
can handle a certain amount of traffic. We said if it is going
to be a 4-lane divided highway we want 45 mph parkway, curves,
and plantings.
Councilman Johnson noted this Council would not have gone to
the County and stated we have a problem with 10th Street and
request a 4-lane divided highway. Until I see what the plan the
County is proposing and what the City of Oakdale is willing to
give, I would be willing to hear the process out.
Mayor Johnson stated we allowed the County to begin the
process on the basis that the plan should be cut back from what
was proposed, and we requested the state allow us a 45 mph
parkway arrangement. He asked the vote be postponed until the
January 28th meeting so they can review the December 17th minutes
as to what was agreed upon.
The Mayor also suggested we formally ask the State for
traffic counts on Highway 5 and for accident stats at County Road
15. He is particularly concerned with County Road 17 where we
have been asking for a stop light.

M/S/P Williams/Dick Johnson - to direct the staff to send a
letter to Washington County with a copy to city of Oakdale
indicating upon further consideration of the issue of 10th Street
from Helmo to County Road 13 significant questions remain which
need to be answered including, but not limited to, a proper
traffic study, comparisons with similar roads in the area and
alternative routes for handling the traffic including, but not
limited to putting 4th Street through to County Road 13 and
whether or not the upgrade to 4-lanes is justified. (Motion
carried.3-2: Mayor Johnson: I agree there are some concerns, but
feels comfortable that we answered most of the questions at the
last meeting and should let the process run.;
Mottaz: I think in part this motion is justified as far as
requesting new traffic counts, but would go along with postponing
voting on this motion until January 28th.)
9. CITY ATTORNEY'S REPORT:
10. CITY ADMINISTRATOR'S REPORT:
A. Cost of Living Increase for Staff (Continuation)
At the last meeting, the Council directed the staff to look at
the budget to see if we could find the funds (excluding reserves)
that would enable the staff a pay increase.
The following was proposed: The payroll budget for 1991 was
$330,410 and the actual expenditure was $310,925, a savings of
$19,485. Part of this can be attributed to not hiring a fourth
maintenance employee until November, rather than the first of the
year which was originally proposed. Four of the nine employees
the City has are salaried which means that no matter how many
hours they work, (with the exception of the Maintenance Foreman
for snowplowing and emergency call outs), they receive the same
pay. Some of the employees that have earned overtime have chosen
comp time versus pay. This is a benefit to the city as we match
social security, PERA, and Medicare on all wages paid.
MIS/ Mottaz/Dick Johnson - to grant a a 3% cost of living pay
raise to all the city employees retroactive to January 1, 1992
and this money be taken out of the payroll budget.
Councilman Williams indicated he was interested in giving the
City staff a raise if we could find the money. This would require
more information such as updated figures from the budget for 1991
and 1992 before the Council votes on this motion. There is no
such thing as a payroll budget, it's part of the General Fund.
We are missing $17,000 this year from the state cutbacks, vastly
overspent in 1991 for attorney and planner costs, and this money
has to come from somewhere.

M/S/P Williams/Hunt - to postpone consideration of this motion
until we have received from the Finance Director total budget
figures for 1991 and 1992. (Motion carried 3-2: Mayor Johnson: I
believe the Finance Director has already gone thru the entire
budget before this recommendation was made, Mottaz.)
B. Conference and/or Seminar for Elected Officials
If any members are interested in attending either of these three
conferences, they are to get back to the City Administrator so
that reservations can sent to the League.
C. Town Meeting - February 12, 1992
At the last town meeting, residents questioned the financial
impact of development on a city. Therefore, Kathy Aho, of
Springstead Company, the city's financial consultant, has been
invited to attend the Town Meeting at Tartan Park on February
12th at 7:30 p.m.
D. Request for Funds for ISD 832
ISD 832 has requested a contribution from the City for its
comprehensive arts planning program (CAPP).
The Council noted they were interested in mailing a contribution,
but didn't have and money put aside in the budget. The Council
will consider this request at next budget time.
E. Community Day Celebration
The City received a memo from Watson Centers, Inc. regarding
Community Days at the St. Croix Mall which is scheduled for
Saturday and Sunday, March 7th and 8th. The goal of this event is
to provide community -wide exposure to groups dedicated to serving
the community and its members.
Mayor Johnson, Councilmen Mottaz and Hunt indicated they would be
interested to spending couple of hours to inform citizens on such
items as recycling program, office hours and other services
offered by the City. The Solid Waste Committee will be invited to
get involved.
F. Maintenance Advisory Update
The City Council received the minutes from the Maintenance
Advisory Committee since its first meeting in June, 1991.
Mayor Johnson voiced concern on the on -going audit of all city
purchases requiring the staff to spend time copying requisitions,
invoices, receipts for every purchase and asked what the
committee's purpose was for this request.
Councilman Johnson responded he supports this committee and felt
they have raised valid questions that this Council should

address. Because of this committee, the Maintenance Dept. now
has files on maintenance work on city equipment and an inventory
list with equipment numbers identifying what the City owns. He
asked that the City Council meet with them at a joint meeting to
discuss their concerns.
M/S/P Mottaz/Mayor Johnson - to set a joint meeting between the
City Council and MAC for February 24th at 7:00 p.m. and to
discontinue the provision of providing all invoices, but
restrict it to purchases of $200 or more for MAC's review, until
the meeting of February 24th at which time MAC would justify the
continuing audit. (Motion carried 4-1: Dick Johnson:
Most of the work required here, besides running off enough copies
for the entire MAC, is work that should be done as part of the
purchasing policy of the city.)

at 12:02 p.m. (Motion carried 5-0).
