Present: Mayor Johnson, Dick Johnson, Williams, City Planner Mike Black and Administrator Kueffner. Absent: Councilmen Mottaz and Hunt. FLOODPLAIN ORDINANCE: Page 2: C. Interpretation: Item 1. Add: City of Lake Elmo in place of Governing Body. Page 3: Flood - Clarification requested on the distinction between basement and walkout. Definition needed on Finished Fill. Page 4: Variance - delete "practical difficulty or unique circumstance". Section 303.040 ESTABLISHMENT OF FLOODPLAIN DISTRICT 1. Add: ...and the Flood Boundary and Floodway Map and Flood Insurance Rate map, "both dated July 2, 1979 as the Official Maps." Page 5: 3. Compliance: Item 2. Add the words after elevated "or floodproofed" Page 6: B. Standards for Molly Shodeen will check 1. The use shall susceptibility. Floodplain Permitted Uses: on Item B(1). have a low flood damage 4. Add: New or replacement of on -site sewage treatment systems must be designed according with the City's and State's current standards whichever is more restrictive for on -site sewer treatment systems. C. Conditional uses: Molly Shodeen voiced her concern about the "taking issues" in regard to deleting "streets" under conditional uses. Item 3. Add: The finished fill elevation for structures shall be no lower than the Regulatory Flood Protection Elevation. Page 7: Item 5, Molly Shodeen stated conveyance is more of an issue than storage. Example: filling a little dip in the backyard. The City does not allow fill in the floodplain or the floodway. LAKE ELMO CITY COUNCIL WORKSHOP MARCH 16, 1992 2 ( Item 6. Delete: "In the absence of a state approved shoreland ordinance, the plan must clearly specify methods to be used to stabilize the fill on site for a flood event at a minimum of the 100-year or regional flood event." Page 8. Item 3. Question placement of Section 303.060 C., Insert as No. E4. Delete: "Roads" out of SECTION 303.060 and B. Public Transportation Facilities On -Site Sewage Treatment and Water Supply Systems: Delete: "minimize" in both places in paragraph. Add: ...in accordance with the "City's and State's current state-wide standards whichever is more restrictive". Page 9. SECTION 303.070 ADMINISTRATION A. Zoning Administrator: Delete: Governing Body and add "City Council of Lake Elmo" C. Application for Permit: Delete stream channel and add "floodplain" E. Certificate of Zoning Compliance for a New, Altered, or Nonconforming Use: Council postponed consideration to a later date for clarification from Molly Shodeen. Question asked: Should this be added to the other zonings in the City? Page 10 and 11: SECTION 303.080 BOARD OF ADJUSTMENT AND APPEALS (quote from 301.17) Rewrite to indicate our current variance procedure. Could not find any place appropriate for conditions and safeguards. Page 12: SECTION 303.090 CONDITIONAL USES - STANDARDS ON EVALUATION PROCEDURES Council questioned if the conditional uses are going to be handled differently. Change to read: The Planning Commission will make recommendations and hear applications for Conditional uses..... Page 14. D. (4.) Requested definition and standards of compensatory storage. Change to: ... compensatory storage "of a two to one replacement or greater" Mike Black will make the Section 303.100 NONCONFORMING USES consistent with the city code. Page 16: SECTION 303.102 AMENDMENTS There was discussion on fill added to raise a non -conforming house. Could not be an island. There have been areas that have been cleaned and most all of the vehicles that are not going to be kept (per list) have been removed. There has been work done on removing the barn; however, much still remains to be done. There is still other junk and debris throughout the area that must be removed and properly discarded. The west side of County Road. 19 has items and machinery used for glass recycling which is being done by a friend of the Hammeses. This operation should either cease immediately or become part of th C.U.P. While speaking with Dorothy and her brothers, I got the message that it is not possible to have the property clean by April or May of this year. We then talked about the possibility of having the entire area around the house cleaned as soon as possible --hopefully before your walk- through in April. This seemed more feasible and acceptable than other proposals. I, also, took pictures of the property and these will be available at the council meeting Monday evening or they will be'available in my office Monday during the day. Currently many of these properties still have a wetwell-drywell system. As you know, systems of this type do not treat sewage, Only dispose of it. These systems do cause ground water pollution, and are a health concern to the public. Because many of these properties do not have enough area to allow construction of a drainfield that meets City code, they have not upgraded their systems. At this time I call think of three possible solutions to this problem Construct a collection system and a new community drainfield to serve these properties. 2. Have these buildings placed on holding tanks. These tanks would be pumped each tine they fill up. Allow some of the properties with insufficient ]arid area a variance from the drainfield sizing mid setback codes. A new community drainfield will still be necessary for those properties with insufficient room for a variance. New Community Drannfield Option 1. Preliminary Design We have identified 16 buildings in the study area which would be connected to a City - owned drainfield. The combined estimated sewage flow from these buildings is 6,750 GPD. In order to treat this amount of effluent, a 1-1/2 acre drainfield site either east or west of the Old Village would be necessary. City -owned sewer pipes won](] be constructed is necessary to collect septic tank effluent from each connection and carry it to the drainfield site. Honorable Mayor and City Council February 28, 1992 Page 2 Q Ey Preliminary Costs It is proposed that each connection would pay equally for the sanitary sewer pipes on this project. However, each connection would pay for the drainfield according to their design flow. Also, each owner would install and maintain their own septic tank, pump station and service pipe as necessary to connect to the City system. As with our other community draunfields, a $35/Quarter service charge would be billed to each connection. Cost of Drannfield Property Because the drainfield property would be owned by the City, it is proposed that the City of Lake Elmo buy the drainfield property. Users of the drainfield would pay for improvements and maintenance of it. Discussion The installation of sealed holding tanks is an option. Septic pumpers charge about $80 for a 2,000 gallon load. It is this pumping cost, and the temptation for illegal pumping that make this an unattractive option. 2. Annual Cost Initial Cost $2,000.00 Annual Pumping Cost Plow Rate (GPD) na $80/2,000 Gallons 50 $730.00 100 1,460.00 200 2,900.00 Allow Variance Option Discussion A residential septic system is sized based on the number of bedrooms a house has. hi Lake Elmo this is 450 Gal/Day for a 2 bedroom house, and 600 Gal/Day for a 3 bedroom house. However, a typical Lake Elmo resident uses far less water than this. Also, the State code is 150 Gal/Day less than our code. Therefore it seems reasonable to allow, on a case by case basis, a reduction to this code so that some new on -site drainfields can be built. Also this would cost the area residents significantly less than the first two options. We would still need to acquire a community drauhfield site for those properties unable to get a varience.
