LAKE ELMO CITY COUNCIL MINUTES
APRIL 21, 1992
Mayor Johnson called the city council meeting to order at
7:02 p.m. in the Council chambers. Present: Mayor Johnson,
Hunt (Departed 10:30 p.m.), Dick Johnson, Mottaz (Arrived at
7:05 p.m.), Williams, City Engineer Tom Prew, City Attorney
Filla, and Administrator Kueffner.
1. AGENDA
Add: OLD BUSINESS: Response from Deputy Olson to Trans City
Investment, Petition from Trans City, Appointments to the
County Road 13 Pedestrian Trail Committee.

2. MINUTES: April 6, 1992
TH5 Mill and Overlay Project:
Councilman Mottaz indicted he was in error when he pointed
out there was historic significance where the 15 trees are
proposed to be eliminated.

4. MAYOR JOHNSON PROCLAIMED SATURDAY, MAY 2ND, ST. JUDE
CHILDREN'S RESEARCH HOSPITAL WHEELS FOR LIFE BIKE-A-THON
DAY IN LAKE ELMO.
PUBLIC INFORMATION:
A. Lake Elmo Jaycees, Charitable Gambling and
Huff'n Puff Days
The Lake Elmo Jaycees presented a check to the Council in
the amount of $3800 for playground equipment in Lions Park
which they will install sometime in the month of May.

The Lake Elmo Jaycees requested a resolution by the
Council supporting the Jaycees Lawful Gaming at the Twin
Point Tavern for 1992. The City Administrator explained the
City has not received any complaints on either the Lake Elmo
Jaycees or the VFW charitable gambling operations.
M/S/P Mottaz/Dick Johnson - to adopt Resolution No. 92-5, A
Resolution Approving the Issuance of a Charitable Gambling
License by the State of Minnesota to the Lake Elmo Jaycees.
(Motion carried 5-0).
John Hughes, Exec. Vice President of the Lake Elmo
Jaycees, asked if the City would issue a Proclamation
declaring Huff & Puff Days as the official City Celebration
for 1992.
The City staff will prepare a proclamation declaring Huff &
Puff Days on August 13-16 as the Official City Celebration
for 1992.
The Jaycees requested the City waive the field light
charge at Lions Park from August 10-17 as the City has in
the past.
M/S/P Williams/Hunt - to waive the field light charge at
Lions Park from August 10-17 for Huff & Puff Days. (Motion
carried 5-0).
The Jaycees are looking into having a street dance for
Huff & Puff Days. The three possible locations are the Fire
Dept Parking lot, City Hall parking lot and the Twin Point
Parking Lot.
The Council indicated their preference was either the City
Hall or Fire Dept.'s Parking lot. The staff will research as
to what is required and come back to the Council with a
recommendation.
Lake Elmo VFW Charitable Gambling
The Lake Elmo VFW has requested a Resolution by the City
approving issuance of their charitable gambling license for
1992.
M/S/P Mottaz/Williams - to adopt Resolution No. 92-6, A
Resolution Approving the Issuance of a Charitable Gambling
License by the State of Minnesota to the Lake Elmo Post
#5725 Veterans of Foreign Wars of the United States.
(Motion carried 5-0).

B. Temporary On -Sale Intoxicating Liquor
License for Guardian Angels Church
M/S/P Hunt/Dick Johnson - to approve Resolution No. 92-7, A
Resolution approving the issuance of a Temporary On -Sale
Intoxicating Liquor License for Guardian Angels Church on
the following dates: April 24, 1992, May 23, 1992, June 13,
1992 and June 19, 1992. (Motion carried 5-0).
Councilman Williams explained that the new Liquor License
Ordinance does not place any restriction on the number of
temporary licenses that can be granted to an applicant in
any one year. He requested that at the next Old Business
workshop the council discuss limiting the number of events
for a Temporary On -Sale Intoxicating License.
5. OLD BUSINESS
Trans City Investment
Kurt Lange submitted a petition signed by tenants at the
Trans City Complex requesting that the City consider their
request that Trans City be allowed to keep a 24 hour guard
at 11490 Hudson Blvd. This request is made because of the
past vandalism and theft occurrences at these premises.
Washington County Deputy Pat Olson reviewed the (15)
Initial Complaint Reports from October 1990 to March 1992.
In the period of time of these 15 calls were registered from
the Trans City Complex, there were 3,434 calls in the City
of Lake Elmo. Reports are being filed and investigations are
being conducted on these 15 calls and extra patrol has been
given to that area. Olson pointed out the parking lot is
unsecured and there are bank teller and vending machines and
semi -trailers stored on the parking lot. Olson suggested Mr.
Lang contact Deputy Harjes, Sheriff's Dept., who would do a
risk assessment of this property.
The Council indicated they had no objection to Trans City
hiring a guard, but did object to someone living on the
premises.
If there are vending machines on the premises and goods
being stored in semi -trailers, Jim McNamara requested they
be removed because the only outdoor storage area is in the
fenced -in area behind the building. Kurt Lange responded he
has sent letters to Diversified Banking Systems regarding
this storage because it is in the fire lane and against
their insurance regulations.

Mayor Johnson's and Councilman Mottaz's letter to the Met
Council
M/S/ Williams/Dick Johnson - to direct the City
Administrator to compose and send a letter to the Met
Council covering the three points as requested in the motion
made by council on April 11th, 1992.
M/ Williams - to amend the motion to
Mayor Johnson stated Councilman Williams could not amend his
own motion, but he could withdraw the motion and restate it.
M/S/P Williams/Hunt - to appeal from the order of the Chair.
(Motion carried 3-2: Mayor Johnson, Mottaz).
M/S/P Williams/Dick Johnson - to amend the motion that in
Item 3. delete words "and request that the Metropolitan
Council proceed with the MUSA Extension application using
the 1990-2010 comp plan as the base." (Motion carried 3-2:
Mayor, Mottaz).
M/S/F Williams/Dick Johnson - to direct the City
Administrator to compose and send a letter to the Met
Council covering the three points in the April 11th, 1992
motion; including amending Item 3 by deleting words "and
request that the Metropolitan Council proceed with the MUSA
Extension application using the 1990-2010 comp plan as the
base". (Motion failed: 2-3: Mayor Johnson, Mottaz, Hunt --I
believe the Mayor and Councilman Mottaz are wrong in this.
However, this is causing problems with our MUSA application.
The letter by the Mayor and Councilman Mottaz has caused the
city problems. Continuing action like this will hold the
city up to ridicule in the metropolitan community, and I
will not stand for this. I will personally write a letter
with my feelings and send it under my own cover to the
affected people stating my position and views in the matter;
Mottaz: I think Councilman Hunt is wrong. As far as our
letter affecting anything that happened at the Met Council
regarding the MUSA is a bunch of hogwash because the
decision was made by the staff before our letter was even
sent.)
Appointments to the Joint City/County Committee on a
pedestrian walkway along County Road 13.
Administrator Kueffner reported the Tri-Lakes Association is
meeting tonight and will call the city with their
recommendation as to who the Tri-lakes representative will
be. This will complete the committee consisting of
Councilman Mottaz, Mike Bouthilet, Randy Thoreson and a Tri-
lakes Rep.

M/S/P Dick Johnson/Williams - to appoint Councilman Mottaz,
Parks Commission Chair Randy Thoreson, Parks Supervisor Mike
Bouthilet to the joint city/county committee on construction
of a walkway along County Road 13. (Motion carried 5-0).
6. PLANNING/LAND USE & ZONING:
A. Stonegate - Final Plat (Continuation)
Parkland Dedication:
Jim Peterson: In Phase I there is 90.98 acres and the area
in parks and trails is 6.78 acres that is determined by
survey. 7% of 90.98 acres is 6.37 acres so he is .41 acres
in excess in Phase I in land only in terms of park
dedication. Because the active park is in Phase I, there is
not enough land in Phase II so he will be approx 6.25 acres
short of total land dedication. The cash equivalent will be
about $16,000 for Phase II. Total on the whole plat is the
active park, the trail all the way over to Keats Avenue and
$16,000-16,500.
The estimate to grade a trail in Phase I is $1,050. The
estimate to base Phase I is $7,665, 8' wide 4" crushed
limestone. Bituminous on an 8' width is $3.50 per lineal
foot. Phase II grading is $1575, 4" of base is $11,500.
TOTAL TO GRADE AND BASE both Phase I and II: approx $22,000.
Proposal by Peterson: since $7,665 for him is a lot to
carry for two years, he be allowed to carry the .41 acres as
a credit for park dedication in Phase II, grade in trails at
a cost and credit not to exceed $1,050 as approved by the
City Engineer.
All of the monuments on the corners of the park land will be
shown on the Final Plat and will be marked with irons and
stakes.
City Attorney review and approve title or abstract to this
property.
Attorney Filla has reviewed evidence of title which
indicates that the applicant is the owner.
Restrictive covenants:
Attorney Filla recommended a statement be placed in the
covenants indicating this property is located adjacent to
land being used for a mining operation. Anybody who buys
this property and examines title would find the lot subject
to easements and restrictions of record.

Street Access easement over Phase II:
Jim Peterson explained the property was subject to mortgage
and a street access easement over Phase II was better than a
blanket easement. Councilman Johnson asked if he was
willing to dedicate the right-of-way for the road as opposed
to just granting the city an easement over that property.
Attorney Filla pointed out the City's purpose can be served
either way. If you dedicate this as part of the plat, you
have the right to use that for road and utility purposes.
If you decide not to use it for that purpose in the future,
then you vacate part of the road which reverts back to
adjoining property owners. If you word the easement
properly, you can acquire the same use rights over that
particular area. Dedication at this point would require the
roads to be part of Phase I of the plat which could create
some financing problems.
Councilman Johnson stated he had two objectives: 1. is to
guarantee the city that we don't end up with an illegal cul-
de-sac,and 2. be consistent from one development to another.
Peterson will provide legal descriptions to the City
Attorney for the road and drainage easements in Phase II.
Street Design:
M/No Second Hunt/No Second - the city waives its engineering
roads standards in the Stonegate Final Plat to allow 24'
road width with rollover bituminous curbs
M/S/P Hunt/Dick Johnson - the city waives its engineering
road standards in the Stonegate Final Plat to allow a single
road type of 28' width with bituminous rollover curbing
based on the recommendation from the Maintenance Foreman
that we not mix curb and ditch within the same development
to aid in plowing. (Motion carried 5-0).
Radius of Cul-de-Sac with Islands
The City Council and Maintenance Foreman will meet at the
The Forest, Wednesday, 5:30 p.m. fora demonstration on
plowing a cul-de-sac to determine the desired radius of a
cul-de-sac.
M/S/P Mayor Johnson/Mottaz - to accept the islands in the
cul-de-sacs with the appropriate radius that would work for
the City as determined by discussions between the City
Engineer, Maintenance Foreman and Developer. (Motion carried
5-0).

Jim Peterson said he couldn't make the demonstration, but
felt the radius dimension had to be something the City could
live with. The standard cul-de-sac spec is 120' right-of-
way and 100' of pavement. If you are talking about a 250'
radius or anything larger, he would have to redraw the
entire plat. If that is the case, he would rather pay the
city and not talk about islands.
Landscape Plan:
M/S/P Hunt/Dick Johnson - to accept the landscape plan for
Stonegate as presented at the last Council meeting. (Motion
carried 5-0).
M/S/P Williams/Hunt - to approve the Final Plat for
Stonegate; subject to preparation of a developer's agreement
that includes a paragraph requiring the developer to prepare
restrictive covenants to include a statement on the
character of adjoining uses for review prior to the
recording, specifications for park dedication requirements,
subject to incorporating the actions taken by the Council in
regard to landscaping street design, street easement for
Phase II, dimensions for the cul-de-sac islands with the
stipulation that the staff develop a final resolution
containing all Findings of Fact. (Motion carried 3-2:
Mottaz: (See Appendix A), Mayor Johnson: He considers this a
protest vote and felt strongly about the position Councilman
Mottaz has stated.)
B. Fox Fire Manor
M/S/P Dick Johnson/Hunt - that 55th Street in Fox Fire Manor
development be allowed to develop in stages as long as an
easement is granted to the City through to Keats Avenue.
(Motion carried 5-0).
C. Access to Gateway Trail thru DeMontreville Park
Parks Supervisor Mike Bouthilet reported that the Parks
Commission recommended approval of the access to the Gateway
Trail thru DeMontreville Park.
If problems were to occur, the council wanted the ability to
close that access in the future. Bouthilet pointed out that
the DNR representative had stated the city could control the
access by any type of barrier on city property.
M/S/P Dick Johnson/Mottaz - to approve the access to Gateway
Trail thru DeMontreville Park conditioned upon: the DNR
improvement is on their property and does not encroach on
DeMontreville Park; and the city of Lake Elmo reserves the
right to close -off the access, on their own determination,
if DeMontreville Park is abused. (Motion carried 4-0),

D. MUSA Update
The Met Council will be voting on the City's amendment for
MUSA Extension on Thursday at 4:00 p.m. If the request is
not granted, the City Administrator suggested resubmitting
another application including 120 acres.
Mayor Johnson indicated he will be meeting with Mary
Anderson of Met Council to try to resolve this transfer of
capacity.
Councilman Williams indicated he was in favor of proceeding
with an amended MUSA application, but only on the condition
that no more money come out of city coffers for this. The
Council is talking about extending the MUSA line to include
essentially one owner's property, United Properties. He
would like to propose we tell United Properties if they are
interested in having the MUSA line extended we are willing
to carry it through with full intention of implementing it,
but that we are going to require them to put $2000 in an
escrow fund. We will draw on that escrow fund to pay our
staff costs which is consistent with what we do in
subdivision, rezoning applications. We have shown more than
good faith in the amount of money spent so far and think it
is time for the property owner to put up if he wants to
continue the process.
Mayor Johnson explained he believed we should be able to get
some assistance and has been trying to get ahold of the
Governors's office. The problem he had was that we have
talked to other people along that 440 acres who are going to
worry about the city reducing the scope of the MUSA
extension.
Tom Prew stated the only people allowed to run a treatment
plant in the seven county area is the MWCC. Lake Elmo can
build a plant, but we can't operate one.
Councilman Johnson agreed with the concept of having to stop
spending money out of city coffers, and that it was now up
to the property owner. At the hearing he attended, Johnson
noted the Mayor stated it wouldn't cost the Met Council or
any other government agency any money to accept this
additional sewer capacity. He wanted to make it clear it is
this city's intention that the taxpayer of Lake Elmo is not
going to cover this burden, and we discussed this at a
number of occasions. Johnson voiced his concern when the
Mayor and Mike Black make the statement to the Met Council
that we, as a city, are going to cover all the costs.

Mayor Johnson responded that when you say the taxpayer of
Lake Elmo, you talk about Dick and Dave Johnson paying
property taxes, picking up something for a development that
requires sanitary sewer that he won't pick up himself. The
point being made by myself and Mike Black relates to this.
The MWCC stated that they foresee no capacity problems until
earliest the year 2005. If the brightest development
scenario goes forward, then by the year 2005 there will have
to be downstream improvements made to facilitate further
development in our MUSA area. What we said is if we have
that kind of development that would increase the demand on
that capacity, that development would pay for that increase
capacity requirement. This is accomplished through the City
of Lake Elmo. We stated we are not asking them to make any
up front improvements in downstream capacity, Downstream
capacity would only have to be improved if we had
developments that exceeded the capacity requirements that we
had indicated. We weren't committing the City to anything
and we weren't asking the State or Metro governments to
commit to anything.
If after Thurs., it is decided the Met Council is not going
to approve the MUSA extension, Mottaz suggested that at the
next meeting the Council should come up with a resolution
regarding this joint meeting and how it will be paid for.
There are two groups that would benefit from this and both
groups should probably pay.
E. VBWD - Water Management Plan Update
Councilman Williams indicated he would be willing to serve
as the council representative for any kind of committee
established to provide a response to the pending revision of
the Valley Branch Watershed District's plan and will contact
the Administrator about getting together on this matter.
M/S/P Dick Johnson/Mottaz - to direct the City
Administrator, City Engineer and Councilman Williams to
voice their concerns and put together a response to the VBWD
Water Management Plan Update. (Motion carried 4-0).
M/S/P Williams/Mottaz - to amend the council agenda by
moving Item 10B Parks Committee Appointment and 8A. Hammes
next on the agenda. (Motion carried 4-0).
F. Oakdale Comp Plan Amendment (10th St. Walmart)
M/S/P Dick Johnson/Mottaz - to combine the two motions of
the PZ and direct the City Planner to write a letter
incorporating all the items and that the City Administrator
and/or designee attend the meeting at the Met Council.
(Motion carried 4-0).

7. CITY ENGINEER'S REPORT: No report
8. CITY ATTORNEY'S REPORT:
A. Hammes
The Council asked that Jim McNamara meet with the Hammes
family and develop a rational clean-up schedule. If any of
the clean up deadlines cannot be met, a citation will be
issued by the Code Enforcement Officer for each area in non-
compliance, and the city will proceed with civil court
action. The council would like to see the schedule at the
next council meeting. The Council made it very clear they
wanted this site cleaned up by the end of this year.
Mayor Johnson explained that on the Hammes Property, there
is a young man that is operating a transfer station for the
recycling of glass that comes from commercial establishments
in Lake Elmo. The operator and the Hammes were told 60 days
ago to apply for a CUP for such an operation. The Council
directed this proposal be sent to the Solid Waste Committee
and to the Planning Commission for consideration. The Solid
Waste Commission has recommended to not approve such an
application.
M/S/P Mayor Johnson/Dick Johnson - to grant an extension for
30 days from May 4th for clean up operation of the transfer
station for recycling glass with the provision during the
30-day period there will be no further glass collected and
brought to the site on the Hammes property while the PZ
investigates whether or not we should amend our regulations
and allow this use. If the PZ recommends allowing such a use
the applicants should apply for an amendment to their CUP,
but if the use is not allowed the operation should cease
immediately. (Motion carried 4-0).
B. Comp Plan - Administrative Judge Cost
Attorney Filla reported that the cost for an Administrative
Law Judge is $86/Hour, and the city would have to sign a
contract identifying the issue you want to be reviewed.
This is a process that would result in a non -binding
opinion. The Administrative Law Judge office had a concern
about making sure they understand specifically what it is
the city would like to be reviewed. This is not something
typically that their office undertakes and until they see a
definition of issues they cannot tell us for sure if they
will undertake this one.
C. Joe Rogers
This item was postponed until the next Council meeting.

D. Cardozo Claim
The Council asked the staff to look into why the Council
turned down insurance coverage for volunteers.
Based on the City Attorney's investigation, Filla reported
it would be difficult to find a basis on which to argue that
this person was doing work within the scope of employment or
was authorized by the city as a volunteer and the city was
not as responsible for the accident of the fallen tree.
M/S/P Mottaz/Dick Johnson - to direct the City Attorney to
write a letter to Ted Cardozo indicating that the city has
checked its insurance carriers for various coverages. They
have indicated there is no coverage based upon the facts of
this case the city is not able to offer any type of payment
on behalf of his expenses. (Motion carried 4-0).
The Park Commission would like to follow the lead of
Washington and Ramsey Counties and ban mountain bikes in the
parks. There has been considerable damage done by mountain
bikes in Sunfish Park and DeMontreville Wildlife Park.
M/S/P Dick Johnson/Williams - to direct the city staff to
prepare an ordinance banning use of bicycles in Sunfish Park
and DeMontreville Wildlife Park. (Motion carried 3-1: Mayor
Johnson: They don't make much noise and we should allow
bicycles for use in viewing these nature parks)
The Council gave the Parks Supervisor permission to post
signs prohibiting bicycles in these parks before the
ordinance was adopted.
9. CITY COUNCIL REPORTS:
10. CITY ADMINISTRATOR'S REPORTS:
A. City of Lake St. Croix Beach
Letter of Support for LCMR Funds
Police Protection Contract
M/S/P Williams/Dick Johnson - to direct the City
Administrator to draft a letter to be sent to all members of
the LMCR indicating Lake Elmo's support of the efforts by
Lake St. Croix Beach receiving funds to improve or enhance
the Lake St. Croix Shoreland Park and Bike/Walk Trail.
(Motion carried 4-0).
The Council asked the City Administrator to contact Mr.
Jansen indicating the city's interest to get together with
other communities to discuss cost issues for Police
Protection with Washington County.

M/S/P Mottaz/Dick Johnson - to direct the City Administrator
to send a letter to Deputy Jessie Kurtz thanking him for his
services and hope he gets better soon. (Motion carried 4-
0).
B. Parks Commission Applications
The Parks Commission reviewed the three applications and
felt all applicants were very well qualified. The
Commission based their recommendation on the date of the
first person that applied and Mr. Collette represents an
area we do not have representation on our Parks Commission.
M/S/P Mottaz/Williams - to accept the Parks Commission's
recommendation and appoint Tony Collette, 978 Lake Elmo
Avenue N., as the Second Alternate to the Parks Commission
and that a letter be sent to the other applicants thanking
them for applying and noting these applications will be kept
on file to fill other parks commission vacancies. (Motion
carried 4-0).
C. Heritage Preservation Appointments
M/S/P Mottaz/Mayor Johnson - to appoint Susan Johnson to the
Heritage Preservation Commission. (Motion carried 3-1:
Williams: It is in the best interest of the city to avoid
conflict of interest and not appoint City Council family
members to city commissions.)
M/S/P Williams/Mottaz - to appoint Gloria Knoblauch to the
Heritage Preservation Commission. (Motion carried 4-0).
D. Employee Evaluations
M/S/P Dick Johnson/Williams - to set April 29, 1992 at 7:00
p.m. as a City Council Workshop to discuss employee
evaluations in a closed session and to discuss Storm Water
Improvements. (Motion carried 4-0).
M/S/P Mottaz/Williams - to adjourn the City Council meeting
at 12:00. (Motion carried 4-0).

LAKE ELMO CITY COUNCIL MEETING
STONEGATE FINAL PLAT:
APRIL 21, 1992 (APPENDIX A)
Councilman Mottaz gave the following reasons for voting
against the Final Plat for Stonegate:
I will vote against this resolution for two reasons.
The first being the rezoning of the property for the
Stonegate development was not in compliance with the Lake
Elmo Comp Plan in effect at that time.
The second reason I feel that the rezoning of the
Stonegate property did not meet the requirement of the
Minnesota State Statute calling for a super majority to
rezone.
Two of the five votes cast for the rezoning resolution
were cast under duress or were rendered following the use of
"force or threats". Leading these threats was a statement
from Judge Quinn that failure to vote a certain way could
result in imprisonment or a fine.
The vote that I cast was done so to keep me out of jail
or to avoid a heavy fine. It was not made because I favored
that position. This then, I believe, became not my vote but
Judge Quinn's vote.
I believe that Judge Quinn exceeded his powers by
directing elected officials as to how they must vote on a
given issue. By doing this he assumed powers of, not only
the judicial, but the legislative branch of government.
With two votes cast under duress this gave a total of only
three Council votes, and I believe two were Judge Quinn's
votes falling short of the 4/5ths required by State Law.
The authority of any judge to direct an elected
official to vote a certain way has not been ruled on by the
high court. The City of Yonkers, New York presented the
question to the U.S. Supreme Court, but withdrew before the
Court ruled on the matter so it remains unanswered. An
effort is currently being made to get an answer to this
question. Until this is done, I must continue to vote
against further progress of the Stonegate development on the
grounds that I do not believe that the rezoning was legally
achieved.

The undersigned tenants, at Trans City Complex, 11490
Hudson Boulevard, Lake Elmo, Mn respectfully request that you
consider our request that Trans City be allowed to keep a 24
Hour Guard at the above premises.
This request is made because of the past vandalism and
theft occurrances at these premises. Also there are many
tenants who, because of the nature of their businesses, may
be in and out of the building at odd hours and on weekends
and the request is also to insure their personal safety.
