PRESENT: Mayor Johnson, Dick Johnson, Mottaz, Williams, City Attorney Filla, City Engineer Prew (arrived 8:35 p.m.), Building Official Jim McNamara and.Administrative Kueffner. ABSENT: Councilman Hunt. 1. AGENDA ADD: 8. Update On Arabian Hills, 9. Update on Kunz Oil M/S/P Williams/Dick Johnson - to approve the June 16, 1992 City Council agenda as amended. (Motion carried 4-0). 2, MINUTES: June 2, 1992 M/S/P Williams/Mottaz - to approve the June 2, 1992 City Council minutes as amended, (Motion carried 4-0). 3. CLAIMS Councilman Johnson asked about the repair charges (Claim #670 Mac Queen Equip $419.47 and Claim #671 Zarnoth Brush Works $87.07) for the newly purchased Elgin Sweeper.. He had the understanding that this sweeper we purchased from Ramsey County was in "tip-top" shape and with the sweeper we received a complete 136t of extra brooms. M/S/P Mottaz/Williams - to request Dan Olinger to come to the early portion of the next council meeting to explain claim #670 from MacQueen Equip and #671 from Zarnoth Brush Works. (Motion carried 4-0). In regard to the Mayor's question to Attorney Filla about the telephone conference with Mr. Herreid on encroachment of 34th Street, Filla explained if there is an open file he will bill it to that file. If there is no active file, 'he will put this charge into the Administrators part of the bill. Mayor Johnson indicated when a resident who on their own behalf and to their own benefit make inquiries of our city attorney, we should make it a policy of the city to bill those costs back to the resident. Councilman Williams agreed with the Mayor and felt we should try to recover these costs whenever possible. LAKE ELMO CITY COUNCIL MEETING JUNE 16, 1992 2 M/S/P Mottaz/Williams - to approve the June 16, 1992 claims 4636 thru #673 as presented. (Motion carried 3-1: Dick Johnson: He would like items #670 and #671 delayed until an explanation is received from the Maintenance Foreman) 4. PUBLIC INFORMATIONAL: A. Jan Rosenthal - Suburban Cable - Informational Commissioner Dave Garloff reported on the recent transfer of sale to a company out of Iowa purchasing all of the cable company franchises under the Hauser system and are hoping to close sometime in September. It is not clear what will happen to the rates, but there will be no change in present operations as far as personnel and activities. One change happening concurrently is transfer of public access. Carol Banister, President of the Board of Suburban Community Channels, explained the role of the Board. Jan Rosenthal read the resolution adopted by the Board. B. Washington County Commissioner, Mary Hauser Washington County Commissioner Mary Hauser explained when the County gets a request from the city to have the speed zone re-evaluated, the Washington County Public Works Director contacts MnDOT. A copy of the letter from D.Theisen, Deputy Director of Washington County Public Works to Mr. Dixon of MnDOT was distributed to the City Council. Once MnDOT has been apprised of the need for re-evaluation, they send people out to do speed checks. One of the criteria used to arrive at the speed limit is based on the rate that 85 percent of the motorists travel. The Commissioner of Transportation is the decider of these issues. - Councilman Mottaz explained it was his understanding from Dick Herold, the state does not allow an increase in a speed limit on a road where there is shared surface for bicycle trails. The portion of Olson Lake Trail where they proposed to change the speed limit is part of the Country View Bicycle trail; therefore, if this is true the speed limit cannot be changed on that portion. Councilman Williams asked when did the county board become aware of MnDOT's authorization to raise the speed limit. Hauser responded she became aware of this authorization when she received Ken Sovereign's letter. It is not usual that the Board receive this information or notification because the Board does not get involved in reviewing the City's request because they do not vote on this information. The City certainly should have been notified of raising the speed limit. LAKE ELMO CITY COUNCIL MEETING JUNE 16, 1992 3 Councilman Williams asked the Commissioner if she would propose a policy at the County Board level to make sure that any future matters such as this is referred to the city before the signs go up next time. Hauser answered that this would be the appropriate thing to do and she certainly intends to do that. Williams also asked that the city be copied on any future correspondence from the Public Works Dept, related to this particular matter. Mayor Johnson explained, typically, before they raise the speed limit, the state will offer an opportunity to the requesting party and remind them that their first action might be enforcement of existing limits. If there is an opportunity to put the old speed limit signs back up and get extraordinary enforcement and see if we cannot get people to abide these limits; thereby, not increase the limits. Councilman Johnson asked if the City could be notified to have a representative when they meet at the site as noted in Mr. Theisen's letter. Mayor Johnson: The question was asked if the County Attorney could look into the existence of this state law (1973) and what ramifications it has to this particular stretch of road. This is our city and one of our streets even though it is a county road and it is our residents that live along there and the safety of our residents is what we are concerned with. This entire process is very ill conceived. M/S/P Dick Johnson/Williams - to direct the city administrator to write a letter to the Dept. of Transportation reiterating points made this evening. (Motion carried 4-0). Mary Hauser will inquire on the status of what the County can or cannot do regarding enforcement of the regulations in place on our lakes. The City Administrator reported that new signs stating city lake regulations will be received in three weeks and then will be posted. C. Petition for speed limit and no parking signs on east side of Highlands Trail M/S/ Mottaz/Johnson - to instruct the Maintenance Dept. to post "no parking" signs on the south east side of Highlands Trail N. approx 150' on either side of the playground. LAKE ELMO CITY COUNCIL MEETING JUNE 16, 1992 4 Councilman Williams indicated he was in favor of posting the "no parking" signs and realized there is a safety hazard. He was not trying to prolong the existence of the safety hazard, but as a matter of good public policy, we should give the people to be effected an opportunity to speak and bring up other facts that might influence their decision. M/S/P Williams/Dick Johnson - to postpone consideration of the motion until such time we can have a public hearing on this question and further that we call a public hearing for the first meeting in July and notify all residents within 500 ft. of the boundaries of that part of DeMontreville Park. (Motion carried 3-1: Mottaz: If we recognize there is a safety hazard here, we should do something about and a postponement is not necessary). MIS/ Dick Johnson/Williams - to direct the city administrator to have the Public Works Dept. install two-30 mph speed limit signs each 150, on either side of Demontreville Park for the on -coming traffic in the park area. Councilman Mottaz suggested installing the large yellow signs that state "play ground ahead" or "slow, children playing" because he felt they were more effective than speed limit signs. M/S/P Mottaz/Mayor Johnson - to amend the motion to postpone consideration of the main motion and to include prior to consideration of posting of the signs, the public works dept be directed to evaluate the situation and recommend the total signage needs of the area. (Motion carried 3-1: Dick Johnson: we were just arguing about the safety situation and we have to get some signs up, and now we are postponing placement of speed limit signs.) 5. OLD BUSINESS• A. Cottage Grove Ravine Watershed Councilman Williams brought up the following concerns: The state law which states that decisions by joint powers boards shall not require more than a majority vote except for capital improvement projects. Therefore, we should insert a stipulation that all capital projects need to have a 4/5ths vote. Attorney Filla explained decisions to amend the agreement itself require the approval of the city council with the exception if you want to change the voting requirements to authorize project you need five votes. This could be a potential problem for the City of Lake Elmo because the Board has reserved for itself the authority to order projects with three votes, and they would LAKE ELMO CITY COUNCIL MEETING JUNE 16, 1992 5 restrict the authorities of the cities to amend that procedure by requiring that all cities agree instead of just four cities. Page 16, Concern that a simple majority of the Board can force some things on all the members. Page 20, Under Land Acquisition, concern with the simple majority of the commission has the power to order the member governmental units to make necessary land acquisition. The City Administrator will contact Rose Armstrong about scheduling a special meeting for Tuesday, June 30th to discuss the Joint Powers agreement. The Council was asked to send their comments about the plan to the Administrator so Rose can incorporate them into her comments. The City Administrator reported that no agreement had been reached with the owners of Cimarron, but it appeared to be negotiable. She had not heard from Dennis Balyeat, HRA, because he was out of town. C. Sign Ordinance Amendment - "City Identification" M/S/P Dick Johnson/Mottaz - to adopt Ordinance 8067. (Motion carried 4-0). Councilman Williams requested that the Building Inspector be directed to report back at the next meeting on the status of the Tri-Lakes signs. If he finds a correction is needed, he is to come back with suggested correction. D. "Old, Old, Lake Elmo Bank Building" Street Encroachment Mr. Herreid indicated he would be willing to reimburse the city for attorney costs. M/S/P Williams/Mottaz - to direct the staff to set up a public hearing at the earliest possible date to consider vacating a portion of 34th Street (vacate property sufficient to include the overhang). (Motion carried 4-0). E. Bids for appraisal of "Landfill Park" M/S/P Mayor Johnson/Williams - to hire Bill Schwab, Penfield, Inc, to appraise the 110 acre "landfill park" as well as the dedicated area of the Stonegate property at a charge not to exceed $1,200 and direct the city administrator to make an effort to recoup city costs from Ramsey and Washington County. (Motion carried 4-0). LAKE ELMO CITY COUNCIL MEETING JUNE 16, 1992 6 F. C.U.P. Update: (1) Armstrong When he looked at the city regulations, Attorney Filla found that in some manner the city treats Alternate Ag different and require that the entire site be included within the confines of the permit. We don't require that for other kinds of conditional uses in the Ag zone. Other than a procedural matter, he did not see anything improper with the way Mr. Armstrong is using the property in connection with our regulations. Filla was asked to address the way in which the city handles procedure on permits and give his opinion as to what you may do prospectively, as opposed to retroactively. The concept of site plan and permits go hand in hand. As part of this conditional use process, the city should require applicants to explain what they intend to do with the property, in addition to what is currently being used on the property. If that plan changes, the city has a chance to review what is occurring. (2) Bergmann Attorney Filla reported as far as he knows, the Bergmanns are still working within the site plans that were approved with possibly the exception of the pole barn. If the pole barn is located on the area that is not covered by the permit and is otherwise allowed in the Ag zone, it is not a problem. If the pole barn is located on the area covered by the permit, then there should have been an amendment to the permit at the time they made the addition. The problem with the Bergmann file there is a rather sketchy site plan. (3) Miscellaneous Councilman Williams made the following motion because he felt this would take care of the Bergmanns if the pole barn is not in the CUP property, there is no problem. Whatever number of greenhouses that are in their site plan when they first applied for the CUP and in the amendment is fixed and they can build up to that number. As far as the Armstrong CUP, Williams agreed with the city attorney's opinion that the entire parcel of contiguous land is included in the CUP and we should be aware of what is going on in that entire parcel. However, any uses consistent with our Agricultural zoning would be allowed including one house per forty. LAKE ELMO CITY COUNCIL MEETING JUNE 16, 1992 7 MIS/ Williams/Mayor Johnson - to direct the city staff to prepare a resolution stating the city will henceforth consider conditional use permits and site plans of all land included within the CUP together and any modification of the land or structures within the conditional use permit shall require an amendment to the CUP. Councilman Williams made the following amendment because a discrepancy had been pointed out. Our ordinance states in a normal CUP the site plan includes only that area regulated by the conditional use and does not include the rest of the Ag property. However in the Alternative Ag use, our ordinance clearly states that all of the landowners contiguous real estate shall be included in the granted CUP. We should make it clear that the site plan for the Alternate Ag Use shall include all of the landowners contiguous real estate. M/S/P Williams/Dick Johnson - to amend the motion to include the site plan for an Alternate Ag Use shall include all the landowners contiguous real estate. (Motion carried 3-1: Mayor Johnson: we have to go back to the whole idea of a CUP and spend time on this and act rationally and reasonably and come up with something that will satisfy us so we can present to the public and ask for their comments). M/S/P Williams/Mottaz - to direct the city staff to prepare a resolution stating the city will henceforth consider conditional use permits and site plans of all land included within the CUP together and the site plan for an Alternate Ag Use shall include all the landowners contiguous real estate and any modification of the land or structures within the conditional use permit shall require an amendment to the CUP. (Motion carried 4-0). 6. PLANNING/LAND USE & ZONING: A. PUBLIC HEARING: Shoreland Permit & Variance to required 100, setback for structures, Jeff Leitch, 9025 Jane Road N. Councilman Williams asked if all the documents required by our ordinance for an application of this type are in hand. The Building Official stated the materials provided did not contain the legal description of the property, the required site plan details or a soil analysis. Mayor Johnson opened up the public hearing at 10:28 p.m. LAKE ELMO CITY COUNCIL MEETING JUNE 16, 1992 8 M/S/P Williams/Dick Johnson - to postpone further consideration on this item and will continue the public hearing until the next meeting, 8:00 p.m., at which time the required documentation will be presented. (Motion carried 4- 0) . Mayor Johnson asked that public hearings be placed on the front-end of the council agenda and modify the ordinary order of business where Old Business was first item on the agenda. Councilman Williams suggested specifying a later starting time for the public hearing in the notice. Then we can follow the normal agenda and we get to the public hearing ahead of time we can postpone it until the published time. If we set it on our agenda for a specific time, under his direction, Mayor Johnson will interrupt other business and go to the public hearing. 7. CITY ENGINEER'S REPORT: A. Water Tower Maintenance M/S/P Mottaz/Dick Johnson - With the assurance of Mary Kueffner that there is $1635 available in the Water Fund, the council authorizes Esping Forensic Engineering to prepare an inspection report as outlined in Tom Prew's letter dated June 11, 1992. (Motion carried 3-1: Williams: There may be more than one paint sample needed and $1635 may not cover the cost of the paint testing). B. Old Village Projects - Update from Special Meeting At the special council meeting on June 11, 1992, Tom Prew was asked to address the suitability of other sites for a community drainfield. Prew provided this information along with soil borings and percolations test. Prew also contacted Mr. Schiltgen's attorney, Mike Kula, who suggested that the City prepare an offer for the property and present it to them. Mr. Kula did not anticipate condemnation being necessary. Councilman Mottaz indicated before they proceed they had to know what the benefit would be and the cost of the project and how it can be assessed. Mayor Johnson suggested we can now discuss this with our financial consultants. Tom Prew will have a color coded map showing the different charges on parcels for all the projected projects available at the July meeting. LAKE ELMO CITY COUNCIL MEETING JUNE 16, 1992 9 8• CITY ATTORNEY'S REPORT: A. Derrick Lots Attorney Filla reported that he, Larry Bohrer, Mr. Derrick and his attorney and consulting engineer, were present at the site and heard the reason for the activity observed. When the representatives were monitoring the site to determine water levels, of the they concluded that part reason the water elevation was not of was because of the nature of soil conditions between the bottom of the mound and the curtain drain was impervious and they might improve the statistics by replacing that soil. As Larry Bohrer gets the data from Barr Engineerisoon as the nature of this replacement soil isng to see what opinion to the City , he will render an test as to whether or not we can accept the receivessatisfying the city code. As soon as he opinion. results as Bohrer satisfying response, Filla will give the city his B. Arabian Hills The First State Bank of Spring Lake Park called the city administrator and indicated they would be willing to renew the letter of credit for Northern Lakes Diversified, Arabian Hills, for six months. Filla explained there is about $15,000 worth of improvements left to be going to get building Permits done. They are not done. ts until the improvement work is Filla suggested a motion authorizing the mayor to sign the letter that called the letter of credit and instruct the city administrator to hold onto to this until Friday. if new letter of credit was here, this letter would not be sent. If the new letter of credit was not here, the letter would be sent. This means the bank would give us the money and we can deal with the developer. M/S/P Mottaz/Dick Johnson - to authorize the Mayor to sign the letter to First State Bank of Spring Lake Park and instruct the city administrator to .hold the letter until Friday. If a new letter of credit arrives, this letter would not be sent, but if the letter does letter will be sent. (Motinot arrive, the on carried 3-1: Williams: It has been a year to get these improvements done, and he-s not interested in letting this drag on any longer. We should call the letter of credit and get the work done). LAKE ELMO CITY COUNCIL MEETING JUNE 16, 1992 10 9. CITY COUNCIL REPORTS: Kunz Oil Mayor Johnson explained Label Lawn has been running a retail operation selling sod out of the Kunz Oil property. The owners of Label Lawn have called the Mayor and requested they be given an opportunity to stay there until the end of this year, because the city is pursuing removing that use from the property because it does not fit our Highway Business Zoning. The City Administrator added these same people were directed to come to a Council meeting and get their request formalized which was for temporary selling of sod that was stockpiled, but chose not to do so. The Building Official stated Label Lawn does not meet the Highway Business zoning and has illegal outside storage. McNamara added no one had contacted him and felt he was not in fault in issuing the formal complaint. Councilmen Johnson and Williams indicated they felt the city staff has taken appropriate action and is proceeding properly. Councilman Mottaz and Mayor Johnson indicated they felt under broad interpretation, sod could be considered seasonal produce and allowed. Prosecuting Attorney: Councilman Johnson noted the six month trial of our prosecuting attorney has ended and asked for an administrative review from the staff for the next meeting. If the report warrants, we will invite the attorney in. 10. CITY ADMINISTRATOR'S REPORT: None M/S/P Mottaz/Dick Johnson - to adjourn the council meeting at 11:30 p.m. (Motion carried 4-0).
