PRESENT: Mayor Johnson (arrived at 7:55 p.m.), Hunt, Dick Johnson, Mottaz, Williams, City Engineer Prew, City Attorney Filla and Administrator Kueffner. 1. AGENDA Add: 6F. Request from residents for striping on 53rd Street to allow for a bike trail, Move 8B. Letter from Holmes & Graven requesting legal fees on behalf of Susan Dunn and Lee Hunt to 3. CLAIMS M/S/P Hunt/Dick Johnson - to approve the July 21, 1992 City Council agenda as amended. (Motion carried 3:1 Mottaz: This item does not belong under CLAIMS.) 2. MINUTES: June 9, 1992 (Continuation) The Council postponed action on this item until Mayor Johnson was in attendance. The approval of these minutes were suspended until Mayor Johnson could render his opinion based on Robert's Rules of Order. M/S/P Mottaz/Mayor Johnson - to approve the June 9, 1992 special city council minutes in the form to include the meeting was convened, there was not a quorum, motion to recess, and meeting was adjourned. (Motion carried 5-0). MINUTES: July 7, 1992 M/S/P Hunt/Dick Johnson - to approve July 7, 1992 City Council minutes as amended. (Motion carried 4-0). MINUTES: July 14, 1992 M/S/P Dick Johnson/Hunt - to approve the July 14, 1992 City Council minutes as amended. (Motion carried 4-0). LAKE ELMO CITY COUNCIL MINUTES JULY 21, 1992 2 3. CLAIMS B. Letter from Holmes and Graven requesting legal fees on behalf of Susan Dunn and Lee Hunt Councilman Mottaz explained he could not vote on this claim because he has not received a copy of the Judge's findings and requested an itemized list of expenses by Holmes and Graven for Council and City Attorney review. Mottaz asked if this claim can be sent to our Insurance Company. Attorney Filla explained the insurance company denied coverage because this type of claim is not covered by the policy. M/No Second/ Mottaz/No Second - to strike this from the claims and place on agenda the first meeting following the receipt of the detailed accounting of the expenses. M/S/P Dick Johnson/Williams - to approve the July 21, 1992 claims as amended, (add claim #790 Holmes & Graven $13,946.49) claims #753 thru claim #790 as presented and direct the city staff to request a detailed accounting of expenses before payment of claim #790 to Holmes & Graven. (Motion carried: 2-1-1:Mottaz, Hunt Abstained from voting on Claim #790). 4. PUBLIC INFORMATIONAL: A. "No Parking" Signs on the South and East side of Highlands Trail Dick Miller, 5790 Highlands Trail, suggested consideration of "no parking" on either side of the road and install a parking lot. Chuck Anastasi, 5850 Highlands Trail, explained he thought the original design of the park had a parking lot. He highly suggested installing a parking lot and posting "no parking" signs on one side. When he walked by the park during a ball game, there were 32 cars parked there. Councilman Johnson indicated he got a call from a Parks Commissioner who asked that action be taken until the Parks Commission looks at the proposal. M/S/P Hunt/Mottaz - to remand this issue to the Parks Commission for their recommendation with the proposal that a 40 stall parking lot be installed as shown in the location of Tom Prew's letter and that 100' either side of the driveway to the parking lot be designated as a "no parking area". (Motion carried 4-0). LAKE ELMO CITY COUNCIL MINUTES JULY 21, 1992 M/S/P Hunt/Mottaz - to authorize the city staff to post two- 30 mph speed signs (one sign on the top of the hill of Highlands Trail as you approach the park and the second sign placed in a location coming the other direction to be determined by the Maintenance Foreman) and add "slow, children playing" signs on the bottoms of these signs; approve installation of a crosswalk between the residential side of Highlands Trail and the park side with the appropriate location to be determined by consultation with the Maintenance Foreman, Parks Commission Chair, and Parks Supervisor; post a "no parking zone" (appropriate size based on safety standards) on the residential side of the crosswalk for now, and post "yield to pedestrians" signs at crosswalk location. (Motion carried 4-0). 5. OLD BUSINESS: A. Heritage Preservation Commission's Work Plan Dale Sherburne, Chair, explained the objectives of the commission: physical structures catalogued, collection and organization of historical materials and information, written history and interview people. Councilman Mottaz suggested the Commission contact Veronica Crombie who has recorded conversations with older residents on Lake Elmo history to see if she would share these tapes with the Commission. Mottaz volunteered his services to copy photographs if the Commission plans on making a photo collection. The Council answered the questions by the HPC: Display area - Parks & Rec Building: There could be a display area in the main room of the Parks & Rec Building. Mr. Sherburne asked "what happens when they outgrow this?" Gene Peltier has offered to sell his barn located on Lake Elmo Avenue for $1.00 to the city. Moving expense and site location would have to be considered. Budget: No budget was approved for the Heritage Preservation Commission. The Commission should submit proposed appropriations based on need now to the Finance Director who is working on the 1993 budget. What powers does the Commission have: The ordinance establishing the commission is specific as to what powers they have. Sherburne understood they are a recommending body to the City Council. LAKE ELMO CITY COUNCIL MINUTES JULY 21, 1992 4 The Council reviewed the Gift Donation Form and asked that donations be given to the City of Lake Elmo rather than the Heritage Preservation Commission because this commission has no legal existence outside of the ordinance passed by the City Council. It was also pointed out that the wording in both forms submitted should be changed to Historical Preservation Commission (not committee). Councilman Johnson suggested forming a Heritage Preservation Commission Fund which would be administered by the City. This would have to be discussed with the Finance Director. M/S/P Hunt/Williams - to direct the staff to review the forms for oral interviews and donations as submitted by the HPC and work with them to correct any legally required wording. (Motion carried 5-0). B. Hammes Update Jim McNamara made an inspection of Area #1 on the Hammes property on Wednesday, July 8th and reported that Area #1 did meet the clean-up deadline and is now in compliance with our city ordinance concerning outside storage. The next scheduled deadline is for Area #2 on September 8, 1992. C. MUSA Extension Update The City Administrator reported our Comp Plan Amendment is now proposed to go before the MCDC on August 3rd at 4:00 p.m. and on to the full Met Council on August 13th. 6. PLANNING/LAND USE & ZONING: A. Ordinance Rezoning from RR to AG, Tom Soderberg (Continuation) B. Resolution Approving CUP for Equestrian Center (Continuation) MIS/ Williams/Hunt - to grant the Conditional Use Permit to Tom Soderberg for an Equestrian Center contingent upon the rezoning being obtained and including the conditions listed in reference document Ordinance 8068 with the following changes: Item No. 7: Temporary storage of manure shall be at a maximum of two covered roll boxes stored inside until it is transported off site. Item No. 10: No retail sales other than to horse care clientele and employees shall be conducted on the premises. Item No. 25: No daily or hourly rental of horses will be permitted. LAKE ELMO CITY COUNCIL MINUTES JULY 21, 1992 5 Item No. 26: A caretaker shall occupy and maintain a residence on site. When the caretaker is not present, another qualified person shall be on call and the name and phone number shall be registered with the Washington County Sheriff's Dept. Item No. 27: A maximum of 25 horses shall be allowed to run unrestrained in areas outside the stables. M/S/P Mayor Johnson/Mottaz - to postpone further consideration of the motion until August 4th when documentation has been provided to substantiate 140 horses is an appropriate and manageable number on this property under the management plan that Mr. Soderberg has indicated to the City. (Motion carried 5-0). Councilman Mottaz volunteered to also look for information addressing the maximum number of horses allowed on this property. Mr. Soderberg agreed to provide the city attorney for his examination evidence of title and any unrecorded documents which gives him equitable interest in the property at least three days before the council meeting. The Planning Commission approved this rezoning June 22nd so the Council has (60 days) until August 22nd to act upon the application. C. Limited Business (LB) Zoning District Ordinance (Continuation) City Attorney Filla provided the council with proposed wording for a section which could be inserted in the LB District Regulations regarding the collection of impact fees. Councilman Williams asked that this information be provided to them in ordinance form. Councilman Mottaz and Mayor Johnson have each been working on a LB Zoning Ordinance and will submit them at the next meeting. Councilman Williams commented that the PZ has worked very long and hard on this ordinance and hoped the council could pass the ordinance without too many major changes. M/S/P Mayor Johnson/Mottaz - to postpone further consideration of this item until the August 4th meeting. (Motion carried 5-0). LAKE ELMO CITY COUNCIL MINUTES JULY 21, 1992 6 D. Ordinance Rezoning From RR to RE, Gene Peltier M/S/P Williams/Mottaz - to adopt Ordinance 8068 rezoning the property requested by Gene Peltier described in said ordinance from Rural Residential (RR) to Residential Estates (RE) as supported by the Future Land Use Map, the Comprehensive Plan and by the recommendation of the Planning Commission. (Motion carried 5-0). E. Resolution No. 92-16, Hidden Valley The City Attorney provided a copy of Resolution No 92-16, adopted by the Council on July 14th, 1992, on the plat known as Hidden Valley in the City of Oakdale. F. Striping on 53rd Street in Arabian Hills The City Administrator received a telephone call asking if the city would consider striping a portion of the road that would be used for a bike path. If this is designated a bike trail and was not included in the trail designation plan of the Park Plan that was just adopted, the comp plan would have to be amended. M/S/P Williams/Mottaz - that this matter be remanded to the Parks Commission and that the Parks Commission be directed to contact the resident involved and to come back to the city council with a well thought out recommendation. (Motion carried 5-0). 7. CITY ENGINEER'S REPORT: A. Kenko: Work Performance on Water System Installation: Recommendation to Call Bond Since Kenko Inc. received his letter giving them a 7-day notice to terminate the contract, Tom Prew reported Kenko has completed sodding and plumbing work that needed to be finished. Prew reported a curb stop still needed to be fixed, a meter needed to be installed in Fire Station #2 and one homeowner did not want to be hooked up to the water system. B. Highlands Trail/DeMontreville Park Parking Concerns Tom Prew reported in his letter dated July 17, 1992 it is estimated that at the park-s current use there is a need for about 40 parking spots. There is room to construct a 40- stall parking lot to serve the park. The estimated cost is $10,000 and could be included in the 1992 street maintenance program. LAKE ELMO CITY COUNCIL MINUTES JULY 21, 1992 7 8. CITY ATTORNEY'S REPORT: A. Definition of "secured" as it relates to manhole covers Attorney Filla contacted Dave Gustafson of the University of Minnesota Extension Service regarding the meaning of the term "Secured" as it is used in the Minnesota PCA Rules. Mr. Gustafson stated that the term was left undefined in order to allow local units of government some flexibility in adopting regulations. He indicated that in his judgment the following types of covers would be considered secure: 1. Covers which are twelve inches below grade. 2. Covers which are heavy enough to prevent young children from readily moving the cover. (Manhole covers in the street weigh 125 lbs. and are considered secured.) 3. Covers which are in some manner bolted to the tank or which require a special tool to remove. M/S/P Williams/Hunt - that the staff be directed to come back to the Council at the August 4th meeting after having contacted Jay's Precast who supplied the septic tanks for the 201 project and one other septic tank lid making company with what their standard lids weigh. (Motion carried 5-0). 9. CITY COUNCIL REPORTS: Mayor Johnson asked for volunteers to serve on the Community Advisory Boards for School District #622 and 4t832. Councilman Hunt stated there was another accident at the intersection of County Road 19 and County Road 10. The Council asked that this safety concern be added to the agenda when Washington County comes in to discuss the proposed 10th Street plan. Sue Dunn and Councilman Williams pointed out the lights from the parking lot of the new Outlet Mall in Woodbury shine in your eyes as you approach the I-94 overpass. 10. CITY ADMINISTRATOR'S REPORT: A. Recommendation on Civil Attorney M/S/P Mottaz/Williams to appoint Jerry Filla's firm, Peterson, Fram & Bergman thru December 31 1992, not to exceed $900 per month, with the direction to set a policy procedure for a prosecuting attorney be completed and presented to the city council by November 1st, 1992. Non -Intoxicating Liquor License for Huff n'Puff Days: Lake Elmo Jaycees M/S/P Dick Johnson/Hunt - to grant a Non -Intoxicating Malt Liquor License to the Lake Elmo Jaycees for Huff n'Puff Days, August 13-16, 1992 at Lions Park and for the street dance located at the Lake Elmo Hardwood umber parking lot on August 15th, and further to waive the license fee.
