Mayor Johnson called the city council meeting to order at 7:10 p.m. in the council chambers. PRESENT: Mayor Johnson, Hunt, Dick Johnson, Mottaz, Williams, City Attorney Filla, City Engineer Prew and Administrator Kueffner. 1. AGENDA ADD: 6D. MUSA Update, 8. Handout on Assessments for all of the proposed projects in the Old Village on individual propertyowners, 6A. Handout from Fran Pott relating to Cimarron Shelters, 12C. Update on meeting with Oakdale regarding Hwy 36 and Hadley Avenue. Mayor Johnson indicated he received a call from the Cimarron Parks Manager who would not be in attendance at the meeting, but asked that the Council not take any action but receive and discuss the report. Mayor assured him that they would not take action without his having some ability to have input. M/S/P Hunt/Dick Johnson - to approve the July 7, 1992 City Council agenda as amended. (Motion carried 5-0). 2. MINUTES: June 9, 1992 Councilman Hunt indicated he didn't see any reason to type the meeting in its entirety. It appears two people showed up and they convened the meeting to order and adjourned it to June 11th. Councilman Mottaz called Councilman Hunt's attention to the state statute that forbids administrative personnel to call off a meeting. If a meeting is called, it must meet even if only to adjourn. Councilman Williams responded if there is no quorum, there is no meeting. All that can be put into public record is the fact that the meeting was convened, there was not a quorum and the meeting was adjourned. Anything else is irrelevant. LAKE ELMO CITY COUNCIL MINUTES JULY 7, 1992 2 Councilman Johnson pointed out that it was stated in the minutes the Mayor indicated Councilman Johnson had a legitimate reason for not being here because he was out-of- town. Johnson objected to the fact the Mayor decided his reason was legitimate. M/S/F Mottaz/Mayor Johnson - that the minutes, as printed for the special council meeting of June 9th, 1992, be approved. (Opposed: Hunt, Dick Johnson, Williams). Mayor Johnson declared that a vote, 2-3, to not approve the minutes was invalid because he claimed that the three opposed votes should not have voted since they did not attend the meeting. Councilman Mottaz felt a person not in attendance could not vote to approve or disapprove minutes. MIS/ Williams/Hunt - to appeal from the Chair's order Mayor Johnson refused to hear the appeal from the Chair's order. He would accept the appeal request and deal with it as a protest and render his opinion at the next meeting. Councilman Williams asked that the Mayor abide by Robert's Rules, adopted by ordinance as set in the city code, and call a vote on the appeal. He asked, where in these rules does it say you can refuse to acknowledge this appeal? Mayor Johnson explained he would suspend further action on these minutes until he renders his opinion in two weeks. He will give the page and verse of Roberts Rules that allows him to disallow an appeal when it is dilatory. Mayor Johnson withdrew his vote on the motion. Councilman Mottaz indicated this DRAFT was an accurate account of the June 9th minutes. He agreed to withdraw his vote at this time until the Mayor rendered an opinion. MINUTES: June 11, 1992 M/S/P Hunt/Mottaz - to approve the June 11, 1992 Special Council minutes as presented. (Motion carried 3-0-2: Abstain: Williams, Dick Johnson). MINUTES: June 16, 1992 M/S/P Mottaz/Williams - to approve the June 16, 1992 City Council minutes as presented. (Motion carried 4-0-1: Abstain: Hunt). LAKE ELMO CITY COUNCIL MINUTES JULY 7, 1992 3 3. CLAIMS M/S/P Mottaz/Hunt - to approve the July 7, 1992 claims #674 thru #752 as presented. (Motion carried 5-0). 4. PUBLIC INQUIRIES/INFORMATIONAL Margaret Carlson, 8735 27th St., congratulated Councilman Lee Hunt on dismissal of a lawsuit filed against him claiming he violated Minnesota's Open Meeting law. Carlson added that Councilman Hunt has done an excellent job of representing the city fairly, honestly, and with dignity. Carlson spoke in favor of Mr. Soderberg's request for a boarding stable next to the Regional Park. She thought this would provide an excellent opportunity to fully utilize the equestrian trails in the park and thought it was the type of development that Lake Elmo should encourage. Sue Dunn, 11018 Upper 33rd St., reminded the Council that two people are not a quorum and at the June 9th meeting, the Mayor threatened to have her removed from the meeting. Dunn added that there are lots of people that like to hear you read and suggested the Mayor donate some of his time to "Talking Books". 5. PUBLIC HEARING: Vacation of a Portion of 34th Street Mayor Johnson opened up the public hearing to consider the vacation of a portion of 34th Street at 8:00 p.m. in the Council Chambers. The public hearing notice was published in the June 24, 1992 St. Croix Valley Press and required property owners were notified. There were no public comments against this vacation. Dave Herreid, Wichser & Herreid Architects, has requested vacation of a portion of 34th Street in order to gain clear title to his property. Mr. Herreid owns the building now, but plans on it being owned by a partnership. Mayor Johnson closed the public hearing at 8:02 p.m. Councilman Williams suggested adding the following amendment to the proposed resolution. WHEREAS, the infringing building is at least 70 years old and has historic value, and it is undesirable to attempt to move the building out of the right-of-way; and M/S/P Williams/Mottaz - to adopt Resolution No. 92-12, as amended, vacating a portion of 34th Street in Lake Elmo. (Motion carried 5-0). LAKE ELMO CITY COUNCIL MINUTES JULY 7, 1992 4 6. OLD BUSINESS: A. Cimarron Park Storm Shelters - Fran Pott Fran Pott reported very little information is available on specific requirements for shelters. In his memo to the Council dated July 7, he lists the State Building Code requirements. The following items were discussed: Requirement of a four square foot space for each person living within the park and the average occupancy per home is estimated at three persons. Glen Schumacher, APAC, explained there is litigation around this park issue in three cities (Hastings, Hutchinson, Shafer) and suggested research be done to see how these cities are handling this. Attorney Filla suggested that the Council, based upon the occupancy and lay out, location and dimension of this park, determine in their judgement what is necessary in terms of safety for Cimarron whether that is more or less restrictive than some other park. The Committee consisting of Cimarron Management, Cimarron resident Ray Press, Fran Pott, Jim McNamara will meet and come up with a recommendation that can best address public safety concern on size, capacity and convenience of a facility for the Council at their August 4th meeting. B. Response from Public Works Director regarding: (1) Expenses for street sweeper Dan Olinger explained the only expenses incurred were a pair of hydraulic cylinders for lifting the main conveyor. One cylinder broke a piston and needed to be replaced and due to factory modifications both cylinders needed to be replaced as a set because of a change in operating pressure. Gutter brooms, main brooms, rubber dirtshoes and shear pins are normal wear items and need to be replaced on a normal schedule. With 77 hours put on the sweeper, Olinger indicated the expenses have totaled approximately $765 or $9.94 an hour to do our spring clean-up. With a contract sweeper, our cost was up to $4500 for the same cleaning and Dan felt his crew did a much better and more thorough job. (2) Signs on Highland Trail Dan Olinger reported that after researching the Uniform Manual of Sign Placement, he indicated the signs that are in place on Highlands Trail are satisfactory. He had spoken to sign department personnel at Washington County, MnDOT and a Deputy Sheriff who felt "slow, children playing" signs have a potential of giving parents and children a false sense of LAKE ELMO CITY COUNCIL MINUTES JULY 7, 1992 5 security. Olinger suggested putting in a striped crosswalk and not allow parking within that area. M/S/P Mottaz/Williams - to hold a public information meeting on July 18th to discuss the following items: No Parking signs, Slow, children playing signs, cross walk, and parking lot in park. (Motion carried 5-0). M/S/P Dick Johnson/Hunt - to postpone consideration of the main motion from the June 16th meeting until the public hearing is held. (Motion carried 5-0). C. Tri-Lakes Signs Jim McNamara provided the November 21, 1989 council minutes approving the installation of two Tri-Lakes signs (on 45th Street and the corner of 42nd Street and Jamaca Avenue). The other Tri-Lakes signs were installed in the early to late 1960's. These signs have been repainted and updated from time -to -time, but the size and locations remain the same. M/S/P Dick Johnson/Mottaz - to direct the staff to prepare an ordinance creating a category for informational and directional signs. (Motion carried 5-0). Councilman Johnson requested a definition of such a sign. Councilman Mottaz cautioned that this ordinance not eliminate church signs. D. MUSA Update The City Administrator reported the Met Council response date of July 13th has been moved back because Woodbury has a special meeting scheduled with the Met Council for July 20th. 7. PLANNING/LAND USE & ZONING: A. Goetschel Property Rezoning Mr. & Mrs. Walter Goetschel have asked that the City initiate a comp plan amendment and rezoning of their property from RAD to RED and have indicated that the fees involved would create a hardship for them. Section 301.060E of the code stated an amendment to the ordinance can be initiated by the City Council, the Planning Commission, or by petition of affected property owners. The Council agreed that since the hardship was not defined the fees should not be waived. Without any charge to the applicant, the Council suggested the concept plan be brought before the Planning Commission for their review. LAKE ELMO CITY COUNCIL MINUTES JULY 7, 1992 6 B. Ordinance 8068, Rezoning from RR to AG, Tom Soderberg At their June 22nd meeting, the Planning Commission recommended the approval of the rezoning from RR to Ag and recommended approval of the CUP for a stable used for boarding and training of horses with conditions. The reasons for their approval were: 1) Maintain open spaces that the Comprehensive Plan has stated that we desire, 2) It is not detrimental to the health, safety and welfare of the residents, 3) It is consistent with the intent of the Agricultural zoning district uses, 4) It provides a service to the residents of Lake Elmo that does not currently exist, 5) Based on the standards of the applicant's property in Hudson, the proposed facility as reflected in the architectural and landscape plan would enhance the facilities in the City of Lake Elmo. The Council received a letter from Ron Smith, 9999 10th St. N., asking the city to welcome Mr. Soderberg to Lake Elmo. Mayor Johnson indicated he shared the concerns of Washington County Parks and Public Works on traffic hazards and access to the Park. From his estimation this is a commercial operation, and he did not receive any overwhelming information to downzone this property to Ag for an upzoning to a commercial business. He would like to see the PZ work on Limited Business zoning ordinance and provide for this type of use within our LB Ordinance. M/S/F Hunt/Williams - to adopt Ordinance 8068, Rezoning from RR to Ag. (Motion Failed 3-2: Mayor Johnson: This would result in a downzoning to agricultural land for an upzoning to commercial use; Mottaz: This is not a rezoning to put the land to agricultural use and we cannot separate the rezoning from the CUP. This proposal is an overuse for this property and this proposed commercial operation is right across the street from the Stonegate development). Mr. Soderberg explained that the City's ordinance for Ag zoning permits horse stables as a conditional use and the Future Land Use Map shows this area as RAD which includes both Rural Residential and Agricultural. Soderberg added that he had been approached by the Mayor after the first PZ meeting who told him that he would not vote for this rezoning with a CUP attached to it. The City Attorney pointed out that the code states the applicant could not reapply for a rezoning for six months after it has been denied. LAKE ELMO CITY COUNCIL MINUTES JULY 7, 1992 7 When asked by Mr. Soderberg to visit his facility in Hudson, Councilman Mottaz indicated he would review the facility on Saturday at 10:00 a.m. M/S/P Mottaz/Williams - to reconsider the Council-s motion to deny the rezoning. (Motion Passed 4-1 Mayor Johnson). M/S/P Hunt/Dick Johnson - to postpone consideration of this item until the July 21st meeting to give Councilman Mottaz and Mayor Johnson time to visit Mr. Soderberg's Hudson facility on Saturday morning 10:00 a.m. (Motion carried 5- 0) . C. CUP for Equestrian Center The following items in the Conditional Use Permit for an Equestrian Center were discussed: --Condition No. 7, Roll boxes should be covered. --Condition No. 5, Questioned allowing 140 horses --Condition No. 10, Definition of "clientele" should be contracted horse care clientele --Condition No. 19, Removal of solid waste should be more often than once every two weeks. D. Limited Business Ordinance Mayor Johnson and Councilman Mottaz felt this ordinance is an ultra limited district business ordinance because we are only permitting certain kind of office uses and everything else is permitted as conditional uses. M/S/P Williams/Hunt - to direct the staff to prepare an ordinance, in accordance with the recommendation from the Planning Commission, for adoption at the next meeting. (Motion carried 5-0). The City Administrator asked the Council to be prepared to make suggestions to the list. M/S/P Hunt/Williams - to direct the City Attorney to work with the City Administrator to define criteria permitting the city to assess Impact Fees. (Motion carried 5-0). E. Resolution No. 92-13 Adopting Park Plan M/S/P Williams/Hunt - to adopt Resolution No. 92-13, approve and adopt the 1992 Lake Elmo Park Plan as an amendment to the Comprehensive Plan and direct the staff to print 15 final copies. (Motion carried 5-0). LAKE ELMO CITY COUNCIL MINUTES JULY 7, 1992 8 F. City Planner M/S/P Hunt/Mayor Johnson - to appoint Mike Black, McCombs - Frank -Roos Associates, Inc. (MFR), as city planner until December 31, 1992. (Motion carried 5-0). 8. CITY ENGINEER'S REPORT: Assessments for Proposed Projects on Individual Property Owners: M/S/P Hunt/Williams - to postpone consideration of handout and this will be the second agenda item at the special council meeting on July 14th. (Motion carried 5-0). 9. CITY COUNCIL REPORTS: Valley Branch Watershed Citizen Advisory Committee: Mayor Johnson advised the Council that Valley Branch Watershed Citizen Advisory Committee member, Barb Walsh, has had one meeting on June 1st and not heard anything since. If they are going to involve our residents, he would like to see that the Committee become an effective part. The City Administrator will contact Al Dornfeld, VBWD, either by letter or phone, and ask why this wasn't done. Kunz Oil: The direction given to the City Attorney was that the approach to take was these people recognize they have a non- conforming use and rather than litigate it and pursue it to criminal court they would agree to discontinue this use by October 1st and all refuse from this sod produce operation must be cleaned up in conformance with the direction of our Building Inspector and to direct the prosecuting attorney to dismiss the prosecution upon receipt of a signed agreement. They are to still continue clean-up of the junk in the outside storage unrelated to this operation. Report on the County Highway 13 Study Committee: Councilman Mottaz reported at the last meeting the committee made two motions to be presented to the Public Works Dept. (1) Short range solution to the trail problem. The County would add a 4' blacktop shoulder to both sides (east and west side from trunk Hwy 5 to trunk Hwy 36). This addition will be separated from the existing blacktop by a 1' wide white stripe and signed appropriately. (2) Long range solution: The County in the next reconstruction of Cty Rd 13 they construct a separate 8' blacktop trail along side Cty Rd 13 going north to 50th Street. This would be separate from the highway and at 50th the trail would then go west on 50th to Hadley Avenue and then a trail LAKE ELMO CITY COUNCIL MINUTES JULY 7, 1992 paralleling Hadley north to the Munger Trail. The 4' width would remain. A Public Information meeting will be held at City Hall on July 16th from 3:00-8:00 p.m. Interpretation of state rule reaardina septic tank manhole covers: If they are not covered by 6" of dirt, they have to be secured. What is the legal definition of "secured". The City Attorney will talk to our City Engineer and come up with a definition of "secured" Status of Employee Evaluations: The City Administrator reported the evaluations are done, but three employees have yet to sign their evaluations. 10. FIRE DEPARTMENT REPORT: A. Annual Report Fire Chief Dick Sachs reviewed the Annual Report for 1991. Mayor Johnson commended the Fire Department on doing an excellent job. There was discussion on whether Lake Elmo or Oakdale service the roads and the residents in Section 32 and 33 who are still in Lake Elmo and were not annexed to Oakdale.. The Council asked that the City Administrator communicate to Washington County that Lake Elmo recognizes that we will continue to service our area. B. Blacktop at Station 2 Steve Speltz, Chairman of the Building that the requirements for blacktopping specifically stated so all bids can be he should talk to the Finance Director money will come from. Council action new bids are received. 11. CITY ATTORNEY'S REPORT: Derrick Lots: Attorney Filla stated engineer on July 17th construction process that any professional will be at their cost Committee, was asked Station #2 be consistent and that as to where this was postponed until he is scheduled to meet with Derrick's who will explain why they took the they did. Filla had indicated to them services from himself and Larry Bohrer It was the will of the council that Derrick set up an escrow fund to pay for all professional services. City Attorney's (Prosecuting) six month review Prosecuting Attorney, Carl Blondin, announced his resignation and indicated he wished to act in the city's best interest and agreed to postpone his resignation until August 1, 1992 to allow for a smooth transition for the next attorney. M/S/P Dick Johnson/Mottaz - to accept the resignation of Carl Blondin, prosecuting city attorney, as of August 1, 1992, and direct the staff to prepare a recommendation for another city prosecuting attorney. (Motion carried 5-0). B. Temporary Liquor License for Guardian Angels Church M/S/P Hunt/Dick Johnson - to adopt Resolution No. 92-14, Approving Temporary On -Sale Intoxicating Liquor Licenses for Guardian Angels Church. (Motion carried 4-1: Williams: He is not happy with these licenses being allowed for unlimited number of events.) C. Update on Meeting with Oakdale on Hwy 36 and Hadley Avenue The Council supported Oakdale's request of MnDOT to delay action for a sufficient time to obtain current data on frequency of accidents to make a decision on restricting access. Mayor Johnson indicated he was not in favor because this would make Hwy 36 simply impassable.
