LAKE ELMO LTY COUNCIL MINUTES
WEDNESDAY, SEPTEMBER 16, 1992
Mayor Johnson called the city council meeting to order at
7:OQ p.m. in the city council chambers. PRESENT: Mayor
Johnson, Hunt, Mottaz, Williams, City Attorney Filla and
Administrator Kueffner. ABSENT: Councilman Johnson.
1. AGENDA
Add: 4. Request by Family Violence Network for $1,000
Donation, 5C. Update on Old Village Projects, 9. Resolution
and Water problems.
M/S/P Williams/Hunt - to approve the September 16, 1992 City
Council agenda as amended, (Motion carried 4-0).
2. MINUTES: September 1, 1992
On Page 3: check the tape for the Mayor's response to
Councilman Williams in regard to the Comp Plan Amendment.
On Page 7: Hidden Valley. Add the reason Mayor Johnson voted
against the motion.
M/S/P Williams/Hunt - to table the September 1, 1992 City
Council minutes until the next meeting. (Motion carried 4-
0) .
3. CLAIMS
M/S/P Williams/Hunt - to approve the September 16, 1992
claims #893 thru #930 as presented. (Motion carried 4-0).
4. PUBLIC INFORMATIONAL
1. Youth Service Bureau
Paul Weiler, Executive Director, reported the City of Lake
Elmo is the second largest community they serve and are
requesting a $10,500 donation.
M/S/P Williams/Mottaz - to direct the staff to include as a
budget consideration entry for the Youth Service Bureau for
the next budget workshop. (Motion carried 4-0).

2. St. Croix Valley Animal Shelter
The St. Croix Valley Animal Shelter is requesting $10,000
per year for the next three years as financial assistance to
construct new shelter.
M/S/P Mottaz/Williams - to direct the staff to include as a
budget consideration entry for the St. Croix Animal Shelter
for the next budget workshop. (Motion carried 4-0).
3. Family Violence Network
Family Violence Network is requesting a $1,000 donation.
M/S/P Mayor Johnson/Hunt - to direct the staff to include as
a budget consideration entry for the Family Violence Network
for the next budget workshop. (Motion carried 4-0).
5. OLD BUSINESS:
A. Hammes Clean -Up Update
Jim McNamara reported that on September loth he inspected
Area 2 of the Hammes property. AREA 2 has been cleaned to
our requirements and AREA 1 has remained cleaned. The next
area, AREA 3, is to be cleaned by October 8, 1992.
B. Ordinance No. 8071, Exceptions to Platting
Attorney Filla presented an ordinance for council review
which incorporated the council's concerns of September 1st
and the request by Planner Mike Black.
M/S/P Mottaz/Williams - to adopt Ordinance 8071, Exceptions
to Platting. (Motion carried 4-0).
C. Old Village Projects
Councilman Williams asked what the status was of the Old
Village Projects. Administrator Kueffner reported that,the
staff will be coming back with information to the council at
the next meeting.
6. PLANNING/LAND USE & ZONING:
A. PUBLIC HEARING: Variance to setback in Shoreland
District and Shoreland Permit
Applicant: Mike Wagner, 9040 Jane Road N.
Mayor Johnson opened up the public hearing at 8:03 p.m. in
the Council chambers. The public hearing notice was
published in the September 2, 1992 St. Croix Valley Press
and adjoining property owners were notified.

The Council received a letter from Molly Shodeen, DNR, and a
report from Mike Black.
There was no one to speak for or against the variance
request.
Mayor Johnson closed the public hearing at 8:06 p.m.
Councilmen Williams, Mottaz, and Hunt indicated they had no
problem with rebuilding the deck, but felt the addition
expands a currently non -conforming use and the proposed size
is over what is considered a boathouse.
Mike Wagner gave his permission for postponement of
consideration of the addition variance request until the
time the new shoreland ordinance is passed.
M/S/P Williams/Mottaz - that the variance request and
shoreland permit for a deck by Mike and Gayle Wagner, 9040
Jane Road N., be granted based on (1) the proposed deck is
less area than the existing deck, (2) the proposed deck does
not extend closer to the water than the existing deck and
(3) that the existing deck is in obvious need of replacement
and is a current safety hazard; and the variance request for
the addition be postponed until the Shoreland Ordinance has
been passed. (Motion carried 4-0).
B. Comprehensive Plan Amendment Update from PZ
United Properties will attend the September 29th meeting,
but there will not be a developer present.
C. Emergency Phone in Sunfish Park
Mike Bouthilet reported the Parks Commission and our fire
chief have both recommended installation of an emergency
phone in Sunfish Park. The Lake Elmo Jaycees have given
verbal approval for payment (approx. $1500). Bouthilet has
come up with a way to make this phone as vandal resistance
as he could and this system has been approved by Captain
McGlothlin.
The Council asked that Mike make the Jaycees aware that the
Council thinks this is a good service and would prove
useful, but the city will remove the phone if there is
vandalism.
M/S/P Hunt/Mottaz - to direct the Parks Supervisor to
proceed with talking to the Lake Elmo Jaycees to secure the
payment for an emergency phone for Sunfish Park and the city
will pay the service charge of $30 per month and let the
Jaycees know the city will remove the phone if there is
vandalism. (Motion carried 3-1: Mayor Johnson: We are
forgetting about the added expense for fixing or replacing

the phone. There is limited access to it because most of the
activity in the park is outside and away from the area where
this phone is located and will be a target for vandalism.).
7. CITY ENGINEER'S REPORT: No Report
8. CITY ATTORNEY'S REPORT:
Attorney Filla reported that the appellate court denied the
Mn/DOT appeal so that Oakdale can proceed with the
signalization of Hadley and Hwy 36. If Mn/DOT wants to
contest that, they will have to go back to District Court
September 28th.
9. CITY COUNCIL REPORTS:
Mayor Johnson submitted a resolution for council review
soliciting Minnesota Municipal Board Action to detach
Section 32 and Section 33, Township 29 from the Municipal
Authority of the City of Oakdale to that of the City of Lake
Elmo because the Municipal Board's action was not in
accordance with the statutory.requirements. The City of
Lake Elmo cannot own streets in Oakdale.
M/S/ Mottaz/Hunt - to instruct the City Administrator to
have discussion with the Oakdale's City Administrator on the
different options of the trade off of the roads for this
southeast triangle of property and try to come up with some
kind of agreement.
M/S/P Williams/Hunt - to amend the motion to include the
city administrator contact the Executive Director of the
Municipal Board to discuss action to resolve this situation.
(Motion carried 4-0).
M/S/P Mottaz/Hunt - to instruct the City Administrator to
have direct discussion with Oakdale's City Administrator on
the different options to try to come up with some kind of
agreement and further, the city administrator contact the
Executive Director of the Municipal Board to discuss action
to this situation. (Motion carried 3-1: Mayor Johnson: We
have nothing to be gained by discussion with Oakdale and
there is a danger on the way we are proceeding).
OLSON LAKE ESTATES:
The Council received a report from Al Dornfeld, President of
the VBWD, on the Olson Lakes Estate Pond Outlet to Olson
Lake.
The Council asked that the City Administrator contact Gordon
Moosbrugger, VBWD, and inform him the City of Lake Elmo will
not take any water from the Olson Lake Estates development
and send a letter to the Tri-Lakes Assoc. indicating what
the city is doing and that we need their involvement.

As a result of the amount of rainfall, concern on waterflow
from Stillwater Blvd to East and West of Inwood Avenue:
Mayor Johnson submitted pictures showing a large waterflow
from Stillwater Blvd to East and West side of Inwood and
flooding into Tablyn Park. Johnson voiced his concern on the
possibility of flooding basements and asked if the VBWD has
deviated from the approved Surface Watershed Plan and what
is happening to Eagle Point Lake.
The Council asked the Administrator communicate this problem
and request this be fixed and we expect a response from Mr.
Moosbrugger within a week or two.
STONEGATE DEVELOPMENT:
Mayor Johnson asked the Building Official and City Engineer
check on the settlement ponds because they are not
restricting the rate of flow and if the road is being
constructed properly.
M/S/F Mottaz/Mayor Johnson - to adjourn the city council
meeting. (Motion failed 2-2: Hunt/Williams)
Councilman Hunt:
Councilman Hunt reported that the judges decision on alleged
violations of the state open meeting law by himself has been
appealed by Mr. Sovereign and Mr. Shervheim. Hunt considered
this lawsuit pure harassment and will provide copies of the
attorney bills at the next meeting.

at 10:15 p.m. (Motion carried 4-0).

ORDINANCE 8071, Exceptions to Platting
RESOLUTION OF THE LAKE C Mr CITY COUNCIL TO S0_ICIT IhISOTA MUNICIPAL
F=L
BOARD ACTION TO DETACH SECTION Ty AND SECTION 33, TOWNSHIP 29 FROM THE
tUJNICIPAL AUTHORITY OF THE CITY OF OAKDALE TO THAT OF THE CITY OF LAKE
ELMO.
Whereas, Mn. Stat. 414.061 (Subd. 4), "Concurrent Detachment and
Annexation of In__rplorated Lard - Board initiation", states that "The
board may initiate proceedings for the concurrent detachment and
annexation of portions of one municipality completely surrounded by
another municipality, on its own motions..." allows for Mn. Municipal
Board initiation of detachment proceedings; and
Whereas, it remains the City of Lake Elmo's contention that action by
the Municipal Board to grant concurrent detachment and annexation of
roughly 300 acres of lard in Sections 12 and _3 of the above described
township was not in accordance with statutory requirements: That ls, the
statutes appear clear that only "abutting" properties may be annexed to
another city. Not one of the properties petitioning to detach from Lake
Elmo and annex to Oakdale was, at the time the Municipal Board granted
detachment and annexation, "abutting" Oakdale; The State on behalf of
State streets and highway right-of-way, the County on behalf of County
Highway right-of-way, and, of course, all Lake Elmo streets and
right-of-way refused then and have not, to date, petitioned to detach
property from Lake Elmo, as required by statute. It is this property that
forms the barrier that continues to prevent abuttment of petitioning
properties with the City of Oak:dalo. Since our city was incorporated with
these bounding properties (streets_ and right-of-way) in 1969, we continue
to hold the position that there was not at the time of the Municipal
Board's decision in this matter nor is there now a single property that
was a part of this _action that was or is "-abutting" the City of Oakdale
and the area remains, to this day, surrounded by the original incorporated
bounding properties of Lake Elmo Qta w, County and City streets and/or
highway; right-of-way); and
Whereas, Mn. Stat. 414.+41, subd. 5 that define_ criteria to be used
by the Municipal Board in decisions of detachment and annexation: and
Whereas, the above referenced subdivision clearly states the following_
as important criteria:
"c. Degree of contiguity of the boundaries_ between the included
municipalities", and
"f. Analysis of whether governmental services now available in
the included municipalities can be more effectively of more economically
provided by consolidation."; and
Whereas, numerous islands of Oakdale remain, after the boards action,
completely surrounded by property tinder City of Lake Elmo municipal
authority; .and
Whereas, numerous examples Of conflict have ari'en in the provision of
municipal aarvic s. particularly those Of fire and rescue operations that
cause this city a .great deal of concern; and
Whereas, the City of Lake Elm_ sincerely desires to avoid a costly
legal battle between government agencies (Lake Elmo vs. Mn. Municipal
Board) '.yet we believe we would prevail at (court on the issue Of "abutting''
properties as THE criteria for concurrent detachment and annexation;
Resolved, That the City of Lake Elmo petition the Minnesota Municipal
Board to take their Statutory Authority, correct the error in their
proceedings in the concurrent detachment and annexation of Section 32 and
the western half of Section 33, and conduct hearings to detach that same
property from the municipal authority of the City of Oakdale to that of
the City of Lake Elmo; and
Resolved, That the City of Lake Elmo Administrator and the Mayor
prepare all required documents to solicit that action and incorporate, by
reference` this resolution.
