PRESENT: Mayor Johnson, Hunt, Dick Johnson, Mottaz, Williams, City Engineer Larry Bohrer, City Attorney Jerry Fills, City Planner Mike Black, and Administrator Kueffner. 1. AGENDA Add: 4. Shoreland Ordinance Jan Kiefner, 8001 50th Street N., asked that the Council approve the proposed shoreland ordinance with the exception of #7, on page 13 because she felt this allows legal trespassing. LAKE ELMO CITY COUNCIL MINUTES OCTOBER 20, 1992 2 Barb Walsh, 8027 50th Street N., submitted for council consideration an ordinance from Forest Lake relating to lawn fertilizer and pesticide application control. The deadline for completion of the Shoreland Ordinance is February 5 1993. The Council will hold a workshop on the Shoreland Ordinance on Tuesday, November 10th at 7:00 p.m.. MIS/ Williams/Dick Johnson - to start the process for incorporating these definitions into the master list of definitions in our zoning code inserted in 301.040 under general definitions M/S/P Hunt/Williams - to continue the discussion and highlight the areas of this ordinance that we would like the staff investigate and then take those issues and find the appropriate places in the existing city ordinances that may have some correlation, resolve any conflicts and come back with a complete listing of all ordinances required and implement this. (Motion carried 5-0). B. Ordinance 8075 Relating to Platting Monumentation M/S/P Williams/Dick Johnson - to Adopt Ordinance 8075, as presented, An ordinance relating to platting monumentation. (Motion carried 5-0). C. Isle Avenue Feasibility Study At the October 6 meeting, the council directed the City Engineer to prepare a cost for the Isle Avenue Feasibility Report. Larry Bohrer reported, including the public hearing, TKDA would bill the city only for work actually done on the project, not to exceed $1,500. This amount was provided to the Colosimo's attorney, William Kronschnabel who indicated in his letter dated October 15 that the Colosimo's are agreeable to advancing these costs. Wyn John suggested the city invite the landowners involved both in the present cul-de-sac on Isle Avenue and also propertyowners abutting the eastern portion of Jane Road N., which would join into Isle Avenue N., because there are some strong opinions on whether or not this road should go through. M/S/P Williams/Dick Johnson - the city instruct the city engineer to prepare a feasibility report for the Isle Avenue project provided that the Colosimo's provide a $1,500 escrow fund and that the city staff communicate to the Colosimos that there is no commitment by the city to actually proceed with the project. Petition for buoys on Olson Lake Channel James Dillon has contacted the Tri Lakes Association regarding a potential purchase of buoys. This issue will be presented at the Tri Lakes Association Board meeting tonight. Dillon asked that this item be postponed until he can come back with the information. Dillon understands Washington County Sheriff's Dept. will install the buoys, but raised the question who will maintain and store them. Ordinance 8076 relating to signs Councilman Williams explained in the past we have not allowed business signs in residential areas, but found a nameplate sign, as defined in our code, includes a nameplate for a business. Also, nameplate signs are allowed in residential zones. Therefore, one can interpret the code as allowing business signs in residential zones. Dillon, 8190 Permit with variance from NOHWM and variance to the Trail N. Mayor Johnson opened up the public hearing at 8:12 p.m. the Council chambers. The public hearing notice was published in the October 7, 1992 St. Croix Valley Press adjoining property owners were notified. There was no one to speak for or against the request. Cottage Grove Ravine Water Management Resolution petitioning the CGRW to dissolve the Joint Powers Agreement M/S/P Dick Johnson/Hunt - to adopt Resolution No. 92-23, as presented, A Resolution Petitioning the Board of the Cottage Grove Ravine Watershed to Dissolve the Joint Powers Agreement and direct the staff to contact the other cities in the CGRW to determine how to get a joint petition to establish a watershed district. (Motion carried 5-0). CITY COUNCIL REPORTS: Mayor Johnson asked that the staff prepare a Proclamation for Child Awareness Month by the Lake Elmo Jaycees. Councilman Johnson brought up a resident concern on the wear and tear on Jamaca Avenue from the heavily loaded Shaefer gravel trucks. A background review on Shaefer Mining CUP is being done and the staff will report back to the council. A Real Estate agent has stated that some of Derrick lots have perked and these lots have "For Sale" signs on them. According to our city regulations, the Derrick lots are not buildable and a building permit cannot be obtained. Councilman Hunt received notification that his cable TV rates are going up and in some cases as much as 200. He suggested that a cable representative come in and give the council an update as to what is going on. Councilman Williams submitted a resolution for council review at the October 6th council meeting. M/S/P Williams/Hunt - to adopt Resolution No. 92-22, A Resolution relating to a policy if any city employee is ordered to perform a task by an individual council member not acting at the direction of the council as a whole, that city employee should direct the council member to direct his/her request to the City Administrator.
