PRESENT: Mayor Johnson, Hunt, Dick Johnson, Mottaz (arrived 7:15 p.m.), Williams, City Engineer Larry Bohrer, City Attorney Jerry Filla and Administrator Kueffner, 1. AGENDA Add: 7F. Draft Policy for MUSA proposal by Councilman Williams, 8B. Update on Methane found in Fire Station #2, 9C. Christmas Party M/S/P Hunt/Dick Johnson - to approve the November 5, 1992 City Council agenda as amended. (Motion carried 4-0). 2. MINUTES: OCTOBER 20, 1992 M/S/P Dick Johnson/Hunt - to approve the October 20, 1992 city council minutes as amended. (Motion carried 4-0). 3. CLAIMS Councilman Johnson mentioned that the MAC Committee is still reviewing claims and still finding problems with requisitions in place for all purchases. There should be a policy where the city does not pay these claims until we have a signed receipt and a requisition filled out prior to the purchasing. This has been mentioned to the staff. M/S/P Dick Johnson/Mayor Johnson - to direct the MAC to place on their list of items to study the city's purchasing policy, review all aspects, and come back to the Council with a recommendation at their earliest convenience. (Motion carried 4-0). M/S/P Dick Johnson/Williams - to approve the November 5, 1992 claims #1044 thru #1082 as presented. (Motion carried 4-0). 4. PUBLIC INQUIRIES/PUBLIC INFORMATIONAL: Bill Stevenson, 8895 Jane Road N., submitted a petition with 19 signatures of homeowners objecting to the new proposed extension of Isle Avenue N. and offered an alternative proposal for Council consideration. LAKE ELMO CITY COUNCIL MINUTES NOVEMBER 5, 1992 2 M/S/P Williams/Hunt - to direct the City Administrator to consult with the City Engineer and ask if he can roll examination of Mr. Stevenson's proposal with the feasibility study without incurring any additional cost, then go ahead. If there is additional cost to the petitioner, they should come back to the City Council to decide what to do. (Motion carried 5-0). 5. Resolution No. 92-24, Canvassing Local Election Returns M/S/P Dick Johnson/Williams - to approve Resolution No. 92- 24, A Resolution Canvassing the Returns and Declaring the Winners of the 1992 Local Election. (Motion carried 5-0). 6. OLD BUSINESS: A. Shoreland Permit and variance for structure setback from OHWM, Applicant: Mike & Gayle Wagner, 9040 Jane Road N. At the September 16th meeting, the City Council made a motion to grant a shoreland permit and variance for a deck based on reasons stated. The variance request for the addition was postponed until the shoreland ordinance has been passed. The Council had taken action on an identical request at the October 20th meeting; therefore, the Council asked that Mr. Wagner's request be placed on this agenda. Mr. Wagner was unable to attend the meeting, but indicated in a telephone call that he be given equal treatment as was given to an applicant with a similar request. Otherwise, if it was in his best interest to wait, then he would do that. M/S/P Hunt/Mottaz - to amend the September 16, 1992 motion regarding Mike Wagner's request to delete the postponement of consideration of a variance request for an accessory building addition and to allow Mr. Wagner construction of a 20' x 16' accessory building addition to the east end of the existing home. (Motion carried 4-1: Williams: This would be extending a non -conforming use, and it is poor public policy to base any decision on an ordinance that has not been adopted. Dick Johnson: At the last meeting he voted against the Dillon request on a similar structure until the shoreland ordinance was in place. Since the Council chose to approve that variance, he felt it necessary to vote in favor of this amendment because a precedent has been set by the Council.) LAKE ELMO CITY COUNCIL MINUTES NOVEMBER 5, 1992 B. Petition for buoys on Olson Lake James Dillon reported he met with the Tri Lakes Association which approved purchase of no -wake buoys, anchor chains and anchors for the channel that connects Lake Demontreville and Lake Olson. They have spoken with Washington County Sheriff's Dept. who stated they will place and retrieve the buoys and store them. M/S/P Dick Johnson/Williams - to formally thank the Tri- Lakes Association for purchase of no -wake buoys, anchors and anchor chains and that the City requests the Washington County Sheriff's Dept. place the buoys on the channel that connects Olson Lake and Lake Demontreville. (Motion carried 5-0). PLANNING/LAND USE & ZONING: A. PUBLIC HEARING: Variance to structure setback from rear property line and altering a non -conforming use. Site & Plan Review: Twin Points Tavern Mayor Johnson opened up the public hearing at 7:35 p.m, in the City Council chambers. The public hearing notice was published in the October 21, 1992 St. Croix Valley Press and adjoining property owners were notified. Twin Point Tavern is requesting a variance to structure setback from the rear property line and for altering a non- conforming use for the purpose of constructing a 14' x 36' off -sale retail liquor store. There was no one to speak for or against the request. Mayor Johnson closed the public hearing at 7:36 p.m. M/S/P Hunt/Williams - to grant three variances: (1) a 10' variance to the rear yard setback, (2) a variance to the number of parking spaces required and (3) a variance to expand a non -conforming use to Twin Point Tavern/Dennis LaCroix, 11199 Stillwater Blvd., based on the following Findings of Fact: that this building was located prior to the adoption of our code, the city favors maintaining a viable business community, and with the historical fact that the Old Village has many small lots, there is no possibility of expansion because adjacent land is not available to purchase, it does not require expansion to the septic system, it does not increase the amount of impervious surface, appears to be the minimum variance allowed necessary to accomplish the applicant's desire, and to approve the site plan by McCombs, Frank, Roos, Assoc, dated LAKE ELMO CITY COUNCIL MINUTES NOVEMBER 5, 1992 4 9-21-92 as amended on November 5, 1992 (See site plan for amendments: removal of the existing/temporary sign, traffic direction should be counter clockwise from Hwy 5 entry, trash moved back to where the shrubs are located and delete shrubs, move entrance to the retail portion over to the side facing SW, the height of the hedge should be 36" and eliminate vines on the 4' wood privacy fence.) (Motion carried 5-0). B. Thoroughfare Plan M/S/P Mayor Johnson/Williams - to postpone action on this item pending notification of the twenty-five propertyowners affected of the existence of this plan and the purpose for it to give them an opportunity to comment on the plan. It should be pointed out in the letter that the main reason that these roads were placed where they were because of soil conditions and connecting up with other streets. (Motion carried 5-0). C. Parking Signs on Lake Elmo Avenue (Old Village) The City received a letter from Gisela's Interiors asking that the Council submit a request to Washington County to have the parking limitation in front of 3479 Lake Elmo Avenue N. changed to one hour between 6 a.m. and 6 p.m. M/S/P Dick Johnson/Williams - to instruct the Building Official to meet with the business owners (Library, Post Office, Gisela's Interiors and Savannah Designs) to work out something mutually acceptable and submit a recommendation to the Council on parking limitations. (Motion carried 5-0). D. Trunk Highway 36 Corridor Management Study M/S/P Dick Johnson/Williams - to appoint Councilman Mottaz to the Trunk Highway 36 Corridor Management Study. (Motion carried 5-0). E. Minor Subdivision Amendment The Staff will check if the Council adopted this Ordinance at the October 20th council meeting. F. DRAFT Policy for Extension Councilman Williams provided his proposed scenario for developer funding for utilities for United Properties area. The idea is to avoid any up front costs to the City, to have the Developer eventually pay only his fair share, but for that Developer to carry the excess costs until other property owners hook up. LAKE ELMO CITY COUNCIL MINUTES NOVEMBER 5, 1992 5 M/S/P Williams/Hunt - to direct the City Administrator to pass this on and any other information we have on this matter to the City's Financial Advisor and city council elect and have them react to it. (Motion carried 5-0). 8. CITY ENGINEER'S REPORT: A. Isle Avenue Update City Engineer Larry Bohrer reported on the option of completion of the road as a thru street and constructed as a city standard street. (bituminous surface, 28' feet wide with the bituminous berm type curb). The options that exist for the junction at the south end with Jane Road are: (1) bring it in at a T or (2) follow the present alignment of the right-of-way and then bring in with a slight curve at the western portion of Jane Road at about the centerpoint of the curve. The preliminary cost estimate, including certain amount of storm sewer, is $90,000. The consensus of the council was they preferred a through street if it could be made more affordable. Attorney Filla pointed out that the assessments should be a concern to the council because he was not sure if there are 4 or 5 parcels that effectively can benefit from this particular improvement. A benefit could be shown to the City in terms of overall traffic patterns. M/S/P Mottaz/Williams - to inform the (3) property owners on both sides of the road of what the cost would be and obtain their opinion as to if they could live with this. (Motion carried 5 -0). M/S/P Williams/Mottaz - to amend the council agenda by adding Item 10C. CHRISTMAS PARTY. (Motion carried 5-0). B. METHANE FOUND IN FIRE STATION #2 The City received a letter from Doug Ryan, Washington County Public Health and results of the methane gas study at the Lake Jane Landfill. They recommended a continuous methane monitor be installed inside the Fire Station #2 building. The Counties would provide the necessary funds for this project. M/S/P Williams/Hunt - to approve the installation of a methane gas detection device according to the recommendation of the Engineer in Fire Station #2 at the expense of the County and ask the Counties to explain the calibration of the organic vapor detector on a pentane standard rather than a methane standard because this is where the discrepancy LAKE ELMO CITY COUNCIL MINUTES NOVEMBER 5, 1992 6 between the 1 1/2% by volume methane comes in and the 5% lower explosive limit for methane as opposed to pentane. (Motion carried 5-0). CITY ENGINEER UPDATE: City Engineer Bohrer reported that in the next meeting or two he will bring to the Council the Engineers Workplan for 1993 and will review some of the problems they have had in the past with developer constructed road and drainage improvements and give his suggested recommendations for eliminating these problems. The Council asked that a Uniform Assessment policy for street improvements be brought to the City Council soon. 9. CITY ATTORNEY'S REPORT: A. Domestic Abuse Prosecution Plan Attorney Fills. reported that Family Violence Network has reviewed and approved this policy and his office has implemented the Domestic Abuse Prosecution Plan for domestic abuse cases originating in the City of Lake Elmo. 10. CITY ADMINISTRATOR'S REPORT: A. Cable Commission representative resignation The City received a letter from David Garloff notifying the city of his wish not to be reappointed as the city's representative to the Ramsey/Washington Suburban Cable Commission. Applications to the Cable Commission will be solicited and acted upon at the first council meeting in January. M/S/P Mottaz/Mayor Johnson - to invite Mr. Garloff and Ms. Wandmacher to the next City Council meeting to get an update from them as to where things are, and where things are going and to explain the reason for the cable increase which was brought up at the October 20th meeting. (Motion carried 5- 0). B. 1992/93 Agreement for Auditing/Accounting Services Tautges, Redpath & Co, Ltd M/S/P Hunt/Mottaz - to approve the 1992/93 Agreement for Auditing/Accounting Service with Tautges, Redpath & Co., Ltd and direct the Mayor and City Administrator sign the contract. SUBMITTED BY COUNCILMA14 WILLIAMS ON NOVEMBER 5, 1992 Proposed Scenario for Developer Funding for utilities for United Properties area. The idea is to avoid any up front costs to the City, to have the Developer eventually pay only his fair share, but for that Developer to carry the excess costs until other property owners hook up. 1. The "Developer", as owner of the property, signs an agreement with the City covering the following points. 2. City floats General obligation bonds to pay for utilities and other needed infrastructure and the feasibility study. 3. The Developer establishes an escrow fund to pay at least the interest on the bonds for three years or until City has actually started to receive taxes on the development. This may require a periodic renewal of the escrow if the development is delayed. The Developer may begin paying off his assessment immediately, if desired, but the escrow must be in place to cover at least the full bond interest until the development begins to generate taxes. 4. In the year after the City has first received taxes from the development, any remainder of the escrow fund is released, and the Developer starts paying off the entire bond (both principal and interest) by paying assessments on a 15 year basis. For the next three years, 50% of the City share of taxes from the development will offset the Developer's assessments. For the following three years, 25% of the City share of taxes from the development will offset the Developer's assessments. No further offset of assessments by taxes will be given. 5. At the time any other property connects to the utilities, the owner of that property will pay a fair share assessment on a 15 year basis, plus interest accrued from the date of bond issue, with this money being rebated to the (United Properties) Developer. 6. For any non-residential development worth $5,000,000 or more on any property served by the utilities, the same "three years - 50%, then three years - 25%, tax -assessment offset" in #4 above will be applied, beginning in the year after the City has actually received taxes from the other development.
