LAKE ELMO CITY COUNCIL MINUTES
JANUARY 19, 1993 -
Mayor John called the city council meeting to order at. 7:
p.m. in the city council chambers. PRESENT: Mayor John,
Mottaz (arrived 7:06 p.m.), Conlin, Johnston, Johnson, City
Engineer Bohrer, City Attorney Filla, and Administrator
Kueffner.
1. AGENDA
Add: 6. Ordinance amending Section 401.042, 7. Crackfilling
versus Sealcoating

City Council agenda as amended. (Motion carried 4-0).
2. MINUTES: January 5, 1993

A. Lake Elmo Jaycee Proclamation
MAYOR JOHN PROCLAIMED THE WEEK OF JANUARY 17-23, 1993
TO BE JAYCEE WEEK IN LAKE ELMO, MINNESOTA
B. Complaints on snowmobiles
Fred Ranallo, 8643 Stillwater Blvd., stated snowmobiles are
going through his yard 30, from his bedroom window. He would
like to see a sign posted "No Snowmobiling on Stillwater
Blvd."
Tom Armstrong, 8281 15th Street, stated there is a steady
stream of snowmobiles coming from Oakdale along 15th Street.
They have driven over his small pine trees that are off the
road right-of-way.
Mike Dirtzu, 8627 Stillwater Blvd., asked if the deputies
would enforce the curfew stated in the ordinance.
Gladys Goetschel stated they have crop damage between 50th
Street and the fairgrounds.

Ray Press suggested that the city run an auxiliary group,
not to ticket people, but to help the undermanned snowmobile
patrol.
Deputy Pat Olson reported the Washington County Deputies are
patrolling aggressively and snowmobilers have been cited.
The Council will look into signage along the highly traffic
areas, advise the residents, snowmobile clubs, neighboring
cities and Twin Point Tavern of the problems the City is
having with snowmobiles and that Lake Elmo is enforcing
their snowmobile ordinance. Another suggestion was to insert
an article in newsletters of neighboring cities.
The City Administrator will draft the wording and bring it
back for council approval.
Mayor John and Councilman Johnson indicated they would
support a complete ban of snowmobiling if needed. Council
members Conlin and Mottaz suggested waiting to see if the
signage would be effective.
5. Washington County: CSAH 10 Improvement
Don Theisen and Dick Herold, Washington County Public Works
Dept., presented plans for CSAH 10 improvements from I694 to
1/4 mile E. of CSAH 13. Mr. Farrel Robinson, Traffic
engineer, described how the traffic study was done and how
they arrived at the traffic count. The County said that a 4-
lane road will be needed in about six years, so the road
should be reconstructed to meet the future needs now.
Theisen pointed out they intend to provide replacement
wetlands on the property in the NW quadrant of CSAH 10 and
CSAH 13 north and west of Armstrong Lake. This project
requires a permit from the MN DNR for fill in protected
water and the city would be allowed to comment to the DNR on
this permit.
Tom Armstrong stated he owns 3/4ths of the frontage north of
the road bed and if Armstrong Lake is going to be disturbed
he would like to see the lake disturbed only once. The
County had planned on a 2-lane improvement, but is going to
purchase enough of his property for a 4-lane anyway.
Therefore, he would support the 4-lane done now so lie would
be able to build a fence and plant trees.
Councilman Johnson felt that the funds could be spent
improving other roads in the County. The reason he voted for
a 2-lane road was because it was pointed out that State Hwy
5 was 2-lanes from Jamaca Avenue to Hwy 36, and it would be
a long time before 10th Street reaches traffic counts that
are on Hwy 5 which in the judgement of the state highway
dept is not a 4-lane road. If highway 5 could be 2-lane,
certainly 10th Street could be 2-lane in that area based on

the traffic counts. Also, Johnson clarified the $12,000
traffic study was not at the insistence of certain members
of this council.
Councilman Mottaz asked, if the projection is 11,000
vehicles by the year 2010 on that intersection, then it will
be 11,000 vehicles up to at least County Road 19. Why then
isn't the county planning a 4-lane up to County Road 19?
M/S/P Mottaz/Conlin - to endorse Washington County Public
Works proposal for Option 1 for a 4-lane improvement of CSAH
10 from 1694 to 1/4 mile E. of CSAH13. (Motion carried 3-2:
Johnston: She hasn't seen enough traffic data to convince
her that a 4-lane facility is necessary; Johnson: See
reasons stated above.)
The County will prepare plans and come back at a later date
for official plan approval. The County will provide a berm
grading that would accommodate a bike trail. However, the
surfacing of that trail system would be the cities'
responsibility.
6. PLANNING/LAND USE & ZONING:
A. Ordinance 8078, An Ordinance amending Section
401.042(A)
At, their January llth meeting, the Planning Commission
concluded they could not approve a minor subdivision on this
property under the city's current regulations. If this
property is to be divided, it had to be platted.
Attorney Filla explained this proposed ordinance would give
the City the ability to treat this application as a minor
subdivision; therefore, avoid platting which requires
dedicated and constructed roads. If the Council adopts this
ordinance, then what is being proposed on the Raleigh
property would change so that only a rezoning, a minor
subdivision, and a variance to Parcel E for 300' of frontage
on an improved road and a variance to Parcel D which
currently has two accessory buildings that exceed 2000
sq.ft., which is the maximum allowed in an RR zone, would be
necessary.
City Engineer Larry Bohrer explained that when flag lots are
on collector type roads, the concern is that it is best to
have fewer driveways coming off a collector road rather than
more driveways. More driveways tend to inhibit the free
flow of traffic on a collector road. If you had the
situation where the lots already had the minimum frontage on
the road, allowing the subdividing of the lots behind with
no frontage would effectively double the amount of driveways
that you have abutting the road.

Attorney Filla suggested amending the ordinance by deleting
"publicly dedicated" in Item 3,
Item 3 should read:
3. ......shall be served by a restrictive access which is
protected by a restrictive covenant which includes the city
as a beneficiary.
M/S/P Mottaz/Johnston - to adopt Ordinance 8078, as amended,
An ordinance that ordains that Section 401.042(A)2. is
hereby amended and Section 401.042(A)3. is hereby added to
the Lake Elmo Municipal Code. (Motion carried 5-0).
B. Keith Raleigh/Joe Slomkowski
(1) Rezoning from AG to RR
M/S/P Mottaz/Conlin - to direct the staff to draft an
ordinance for rezoning 40 acres owned by Keith Raleigh from
Agriculture to Rural Residential recognizing the creation of
a legal non -conforming use of the accessory buildings.
(Motion carried 5-0).
(2) Minor Subdivision
(3) PUBLIC HEARING: Variance for frontage on a
dedicated & improved road
Attorney Filla pointed out that the only variance needed is
to the requirement of the 300' of road frontage on an
improved road. If there are concerns by the council, they
could be attached as conditions to approval of a variance.
Mayor John opened up the public hearing at 8:50 p.m. in the
City Council chambers. The public hearing notice was
published in the December 30, 1992 St. Croix Valley Press,
Joe Slomkowski stated he plans on building only one home on
the 20 acres and would be willing to work with Mr. Dege on
constructing a driveway that would not add runoff onto his
property.
George Dege, 5193 Keats Avenue N., stated he would like to
have Joel and his wife as neighbors, but voiced his concern
on the runoff from the slew at the bottom of the hill on the
road that is proposed which goes along his borderline. At
the Planning Commission it was brought up there is no
standards for a private access road, and they asked for
direction from the engineer or DNR for guidelines on
preparing the roadbed.
Larry Bohrer explained this will be a driveway for a single
home and there are no standards for driveway construction.
The responsibility is on the homeowner.

M/S/P Mottaz/Conlin - to direct the staff to draft the
appropriate resolution granting the variance to Section
301.090 I of the zoning code subject to the following
conditions: (Motion carried 5-0).
1. Payment of a park dedication fee in the amount of
$700 for Parcel E.
2. Preparation and submittal of restrictive covenants
which guarantees access from Keats Avenue to
Parcel E to be reviewed by the City Attorney prior
to issuance of the building permit for Parcel E.
3. An agreement from the owner of Parcel E that the
current access to Keats Avenue would be vacated and
the area restored. In the future if a road is
constructed to the east of Parcel E, this can be
used as a publicly dedicated right-of-way.
4. The width of the access shall be 30' and the
improved surface of the access will be at least 5'
north of the south property line.
5. The plans and specs for the construction of the
access drive will be submitted to the city engineer
for review and costs incurred by the city for
engineering review be paid by the property owner.
6. Lots be treated equally for purpose of any
assessments. (City Engineer explained public
improvements and assessing costs is based on
benefit. He suggested the way of doing this is to
assess on a unit basis as opposed to a front
footage basis).
7. The back lot, even though it is a nominal 20 acres
and zoned RR should be subdividable, that in this
case because of the variances being requested that
this property not be subsequently dividable unless
served by a public road.
This resolution will be brought back to the city council.
B. Gene Peltier
(1) Minor Subdivision
(2) PUBLIC HEARING: Variances to lot configuration;
the required 250' circle and the 3:1 lot ratio
Mayor John opened up the public hearing at 9:25 p.m. in the
City Council chambers. The public hearing notice was
published in the December 30, 1992 St. Croix Valley Press.

Todd Williams, 3025 Lake Elmo Avenue N., indicated this
property was rezoned as a 20+ acre parcel, thereby
conforming to our residential estates zoning district
requirements for rezoning. Because all of the property is
under one ownership, there doesn't seem any reason other
than economics for this parcel not to be fully subdivided to
the RE standards.
Mayor John closed the public hearing at 9:30 p.m.
Administrator Kueffner pointed out that at their December 9,
1991 and July 13, 1992 Planning Commission meeting, there
was a consensus of the PZ to rezone the 22 acres to RE and
plat the outlot at 2.5 acres and request the variance from
the 200' diameter requirement with the hardship being it
would create an odd shape lot due to the location of the
existing house and would hinder future platting access and
design.
M/S/P Mottaz/Johnston - to postpone action on this item and
invite Bruce Folz or Mr. Peltier's son to speak on the
issue. (Motion carried 5-0).
C. PUBLIC HEARING: David Wanless, 3515 Lake Elmo Ave.
Variance to side yard setback
Mayor John opened up the public hearing at 9:40 p.m, in the
City Council chambers. The public hearing notice was
published in the December 30, 1992 St. Croix Valley Press.
There was no one to speak for or against the variance
request.
Mayor John closed the public hearing at 9:45 p.m.
Although Dale Quast, an abutting property owner, did not
receive a mailed public hearing notice, Councilman Johnson
made him aware of the variance request which will be
discussed at this council meeting. Mr. Quast indicated to
Councilman Johnson that he had no objection to this request.
M/S/P Conlin/Mottaz - to grant a 15' variance to the side
yard setback requirement to David Wanless, 3515 Lake Elmo
Avenue N., for the purpose of building a 20' x 24' garage
for vehicle storage and other personal storage based on the
hardship that this property involves a private residence
rather than just a business and to include the conditions
stated in Mike Black's memo of January 11, 1993 and add the
conditions that a firewall be put in the garage and there be
minimum storage of highly flammable materials. (Motion
carried 4-1: Johnson: He doesn't recognize this hardship
because the garage can be constructed without a variance).

M/S/P Mayor John/Conlin - to add establishing an ordinance
for an Historical Overlay District in the Old Village to the
Planning Commission's work plan. (Motion carried 5-0).
D. Resolution No. 93-7, Adopting Thoroughfare Plan
M/S/P Johnston/Conlin - to approve Resolution No. 93-7, as
amended (include history of public hearing), Adopting the
Thoroughfare Plan approved at the December 15, 1992 Council
meeting. (Motion carried 5-0).
E. Septic Ordinance requiring manholes to be brought
up to surface retroactive to 1984
The new council members have stated that while they were
door -knocking during the last election there were many
comments about the ordinance requiring manholes to be
brought up to grade. The concerns expressed were on the
unfairness of the retroactive portion of the ordinance. Many
of the residents that were on the 201 program felt it
unreasonable to force them to change something that complied
with our code, especially when it was a city project.
M/S/F Conlin/Johnson - to direct the staff to prepare an
ordinance eliminating the retroactive portion of the septic
ordinance as it relates to bringing manholes up to grade for
the next meeting. (Motion failed 2-3:John, Johnston,
Mottaz)
7. CITY ENGINEER'S REPORT:
Larry Bohrer explained the differences between sealcoating
and crackfilling.
8. OLD BUSINESS•
A. Request from NHD (Cimarron Park Owners) regarding
storm shelters
At their October 6, 1992 meeting, the city council
determined the storm shelter capacity of Cimarron shall be
satisfied by two shelters and that the population to be
accommodated at 100% utilization as required by the state
shall be according to the 1990 census.
The Mayor and City Administrator received a letter from
Peter Herfurth, NHD, requesting council approval for one
large storm shelter and that the city issue a bond to
finance this project with a direct assessment back to the
property owner.
M/S/P Conlin/Johnston - to not change the previous council
action. NHD will finance the construction itself for two
storm shelters to be in place by May 1 to meet the state's
requirement. (Motion carried 5-0).

B. Conditional Use Permits
(1) Bergmann Site Plan
The Council received an updated site plan for area within
the CUP.
(2) Armstrong Site Plan
Tom Armstrong provided an answer to questions asked by the
Council regarding his CUP and submitted an updated site plan
on the entire 274.6 acres. Mr. Armstrong stated based on
the definition in the ordinance of the 150 sq.ft.
alternative there is no lack of compliance. Armstrong
requested meeting with the staff to work on proposed changes
to make the ordinance more workable.
(3) Shafer Mining C.U.P.
Jim McNamara reported he has been unable to contact Shafer
Mining. Therefore, this item was deferred until Jim comes
back with his report.
(4) Update on Hammes Cleanup
Jim McNamara provided pictures showing the progress of the
cleanup on the Hammes' property. Jim reported that a couple
vehicles and some other salvageable items were on pellets
and frozen to the ground, but will be removed when weather
permits.
C. Lake Jane Landfill
Councilman Mottaz pleaded with the Council to spend enough
time as they each require to understand this problem. He
explained that many residents in the area voiced strong
objection in making a dump of this gravel pit which was at
this time deeper than some of the wells in the area. They
felt there was not adequate safeguards or advanced
technology to the point where safeguards were even
developed. Despite the hard work at the time in opposition
to the dump, the dump was approved. This dump was filled to
capacity in one-half of the projected time.
when it was discovered that poisons were leaking out of
the dump into the underground water and poisoning the
drinking water of many homes in the area, instead of
providing the water system to be owned and regulated by the
city and the citizens that were damaged, we were required to
purchase water from the neighboring city along with loosing
some control of our development.

In an effort to correct this great affront to our
environment, the counties installed a water depleting and
environmentally damaging system called air stripping. There
is only one way that this mess can be cleaned up for certain
at a known expense and time. That is the material be
removed, recyclables be cycled, and other materials
composted.
Lake Elmo must maintain ownership of this property to
exert the greatest amount of influence toward the proper
solution of the problem. While doing this it is correct for
the city of Lake Elmo to expect the counties of Washington
and Ramsey to pay to the city of Lake Elmo $10,000 a year
for the loss of use of its land until this mess is cleaned
up and we can use this land for its intended purpose, that
is park land.
Councilman Johnson indicated he didn't see any advantage in
having an ownership or even an implied ownership in a dump.
Washington and Ramsey Counties bought this property, and it
is their mess to clean up. The City should get their
$75,000 back and let them deal with the problem.
M/S/P Conlin/Johnson - to proceed with cancelling the
contract, keep the area of our maintenance and fire dept.
sites, direct Pennfield to proceed with appraisals for both
Landfill Park and the park area within Stonegate. (Motion
carried 4-1: Mottaz: A vote in favor of this is doing a
tremendous disservice to the citizens of Lake Elmo, and it
is putting a strong 4-1 stamp of approval on the rotten,
messy job that Washington and Ramsey Counties are doing in
their efforts to clean up the dump).
OTHER:
Tom Prentice, Board Member of the Tri-Lakes Assoc and
representing Olson Lake Demontreville Assoc. for the
evening, requested from the council the possibility of
working with the city attorney in trying to prevent the
emergency gate of water from the Olson Lakes Estates pond
into Olson Lake.
Nick Winkel, 4575 Olson Lake Trail, explained he attended
the last VBWD meeting where they decided to start emergency
action (starting March 1st) by releasing water from Olson
Lakes Estate because they feel they are in a flood stage and
basements are at a point of flooding. They discussed having
eminent domain and running a temporary plastic pipe across
his property into the lake.
When the Council asked Mr. Prentice if there were
associations that could help the city offset the attorney's
cost, he replied the Tri-Lakes Assoc. does have association
fees that could be used for this. Councilman Johnson asked

that they be as organized as possible and designate people
responsible for the group's position.
M/S/P Mottaz/Conlin - to instruct Attorney Jerry Filla to
meet with Tom Prentice and the key people of the Tri-Lakes
Assoc. to formulate what action is needed and cost estimate
for such action and bring this back to the city council in
two weeks or hold an emergency meeting if needed. (Motion
carried 5-0).
CITY ATTORNEY'S REPORT: None
10. CITY COUNCIL REPORTS:
Mayor John:
Mayor John reported that he attended the pre -Oakdale City
Council meeting called by Pam Neary on January 12th. As an
observer he met with the Mayor and other councilmembers of
Oakdale and indicated he wanted to understand their concerns
and issues so that the two cities could appreciate each
others viewpoint.
On Thursday, January 14, he attended the Maintenance
Advisory Committee meeting and felt even though the members
are all concerned citizens wishing to do a good job, the
mission statement should be reviewed so that
misunderstanding on responsibilities can be minimized.
On Saturday, January 16th, he attended the opening
ceremonies program for the Stillwater Sesquicentennial.
As part of his responsibility for Highway 36 Study
Committee, he took the photographs of Hwy 36 and supplied
these prints to MnDOT and copies of the prints were
submitted to the Administrator.
Council member Conlin:
Council member Conlin stated she went to her first Cable
Commission meeting on Thursday where a management agreement
was approved, but still needs approval by FCC. Government
access would be coming out of the Oakdale City Hall
facility. Community access can still use the facility if
the schedule allows.
11. CITY ADMINISTRATOR'S REPORT:
A. Lillie Publications Letter
The City received a letter from Lillie Publications
requesting reconsideration of Lillie as designation of our
legal newspaper. Administrator Kueffner will respond that
they were not the low bidder.

legal newspaper remain the Stillwater Gazette as designated
by the Council on January 5 1993. (Motion carried 5-0).
