Adjourn MINUTES APPROVED: 3-2-93 MINUTES AMENDED: 7-20-93 LAKE ELMO CITY COUNCIL EMERGENCY MEETING FRIDAY, FEBRUARY 19, 1993 Mayor John called the emergency meeting to discuss the city's strategy in opposition of House File 220 at 3:11 p.m, PRESENT: John, Conlin, Johnson, Administrator Kueffner, State Representative Pamela Neary, City Attorney Filla (arrived 3:20). State Representative Pam Neary reported she will be meeting with Oakdale on Monday night. There is strong interest among the staff and one city council member to not have this legislation go through, but to sit down with the Lake Elmo City Council. She has talked to MnDOT who will not take a stand either way on this, but indicated typical procedure would be to offer this land to the public entity within whose boundaries it resides. She is getting confirmation from the Dept. of Transportation to make sure that there is no other MnDOT property within the description of Section 33 that may have been inadvertently be encompassed by this bill. She has contacted United Properties who are willing to come and testify. Neary was hopeful that there would not be the hearing on Tuesday, February 23rd. Neary explained where she is coming from had to do with the process and not on the merits of whether or not this land should be annexed. A number of things should be stressed in this hearing: process, expense, and point out that the city came up with some agreement with United Properties and that this particular company is also looking at options in Oakdale and Woodbury. Neary voiced her strong preference for both cities to sit down and come up with a solution so it isn't decided in court. She urged the Council to go into the meeting with no assumptions about motivations because the key issue is what affect this would have on your City. At this time no meeting date was set for the two cities to meet. Attorney Filla agreed with Rep. Neary for the two cities to get together because what this bill allows is for one or both of the cities to continue to ignore each other. Councilman Johnson pointed out the Council approved a Resolution where the Lake Elmo Council offered to meet with the Oakdale City Council to identify and discuss matters of mutual concern in connection with the development of property within Section 32 and Section 33, Copies of Resolution No. 93-10 will be sent to every member of the Local Government & Metropolitan Affairs Committee. The Council amended Resolution No, 93-10 to reflect both the House File 220 bill and the Senate Pile 491 bill, LAKE ELMO CITY COUNCIL EMERGENCY MEETING 2-19-93 2 Councilman Johnson asked what happens to the SAC units if the MnDOT land is annexed to Oakdale. Attorney Filla responded if those units are available for use in this area and if part of this area goes to Oakdale, Lake Elmo will loose those SAC units available from this site. Filla also pointed out that the bill is mistitled. In terms of interpretation you look at the content of the bill instead of the title, but the title is very misleading. Councilman Johnson felt it was essential the City have legal representation at the subcommittee hearing on Tuesday. Therefore, he made the following motion: M/S/P Johnson/Conlin - to authorize Attorney Filla to attend the subcommittee hearing on Tuesday, February 23rd (Motion carried 3-0). Mayor John will gave a brief history and introduced Resolution 93-10 adopted by the Council which the subcommittee received copies of. The Lake Elmo Council has endorsed meeting with Oakdale to try to resolve these issues on a local basis and does not need to have special legislation or other people less impacted make these decisions. Attorney Filla will point out the consequences of this action on our Comp Plan and as a city how critical it is to maintain control. If anyone looks at this configuration most people are going to conclude that Oakdale and.Lake Elmo should sit down and work this out because it is not good for the citizens who live in that area. Neary explained that if the bill is heard Tuesday as scheduled, it would have to be passed by the subcommittee in order to get to the full committee. The next step is to hear the bill on the floor and the final step is put it in front of the senate. There is a deadline of April 4th. Wyn John, Mayor Mayor's Report February 16, 1993 I attended the February 11 meeting of the Valley Branch Watershed District. I was disturbed to find that no agenda was in circulation prior to the meeting, and that minutes of previous meetings were distributed in batches. The Chair indicated that a phone call could determine agenda items. In the absence of minutes and vague descriptions of agenda subjects, I consider this to be prejudicial to Lake Elmo interests.and contrary to the intent of the open meeting regulations. As the majority of development in the Valley Branch Watershed District occurs in Oakdale, it is understandable that the VBWD appears to work with that city in the main. I therefore wrote to the Board of Soil and Water Management, which oversees Watershed activities, asking for the regulations and the mandates of Watershed Districts to be reviewed. You have a copy of this letter, and I trust I have your support. In situations which can impact the interests of neighboring cities, it is vitally important that the Watershed Districts are even handed in their treatment of those cities' interests. I have received a letter from Barb O'Neal, Mayor of Oak Park Heights, challenging the City of Lake Elmo to participate, with the Cities of Stillwater and Bayport, in the annual Stillwater Jaycees Leukemia Bowl-a- Thon. It will be held on March 13, at the St. Croix Bowl. Registration is at 12 noon, with bowling starting at 1.00 p.m. I would like to know whether I can gather a team from the Council, or whether we should recruit from a bigger pool. 5teven C. DeLapp February 16,1993 Lake Elmo City Council 3800 Laverne Avenue Lake Elmo, MN 55042 Councllors: I am writing to invite your reconsideration of the decision to replace 10th 5t. with a high speed 4 lane divided highway. The premise of the declslon as I understand it is the traffic forecast indicatfng that by the year 2000 volume meet or exceed design standards for a two lane road. The projection was reached with two factors that I believe merit review. • The historical traffic count during the 1980's fs skewed by traffic diversfons to 10th 5t. during major highway reconstructions of 1-94, 4th 5t. and 15th Street. • The projection for 1992 of 6,000 vehicles per day is 30% greater than the verified traffic count for 1992. Attached is a previously unavailable computer tabulation of the Average Annual Daily Traffic (AADT) for 10th 5t. west of Inwood taken by MnDOT District 9 in Oakdale on September 9, 10, and 11 of 1992. The AADT is 4.637 with a peak hour count of 508 vehicles per hour. With speeds reduced to 45 mph, 2-lane existing road, with long overdue repalrs and improved shoulders, should be able to handle an AADT of 14,000 vehicles per day with a peak hour count of 10% of the total --or 1,400 vehfcles per hour. I Invite the Council to consider this long term alternative --Fix the roadbed, including shoulders, and resurface the driving lanes for County 10 to accommodate a 45 mph two lane 40 foot wide urban profile (curbs) after a 1/4 mile taper from a four lane section between 1 694 and Helmo. Include, at State cost, the full amount of the landscaping allowance. By Installing curbs, and limiting speeds to 45, trees and shrubs can be planted to separate the road from adjacent houses and wetlands and be esthetically desirable This design would be an asset to the City of Lake Elmo and is a balanced response needed to address traffic management, wetland preservation, and land use issues for 10th Street. Lake Elmo, MN 55042 Dear Ms. Kueffner: Regarding Ed Stevens pine management: The pine stand in question is overly dense and needs to be thinned to improve the overall health and vigor of the trees. Trees that are overcrowded are more susceptible to invasion by insects and also disease problems. Often the problem originates on the property of one person and spreads to the surrounding areas. By removing every other row of trees this area will have approximately the correct density. As the trees continue to grow the process will need to be repeated in another sunlight reaching the ground will during the first year. This will 10 to 15 years. The increase in also result in a growth of shrubs reduce the wide open appearance that results immediately after thinning.
