LAKE ELMO CITY COUNCIL MEETING
FEBRUARY 2, 1993
6:00 p.m. Intergovernmental Meeting
Mayor John called the city council meeting to order at 7:07
p.m, in the city council chambers. PRESENT: Mayor John,
Mottaz, Conlin, Johnston, Johnson, City Engineer Bohrer,
City Attorney Filla and Administrator Kueffner.
1. AGENDA
Add: 5H. Heritage Preservation Committee, I. Appointment to
School District Advisory Board #622
M/S/P Mottaz/Johnston - to approve the February 2, 1993 City
Council agenda as amended. (Motion carried 5-0).
2. MINUTES: January 19, 1993

C. Olson Lake Estates (Update from Jerry Filla)
City Attorney Jerry Filla reported he met with some of the
representatives from the lakes association groups. He handed
OUt a document ahowing the currant pond elevation at 955,3
and rising. The engineer for the watershed district was
going to take another measurement today, but had not
completed that process as of this time. The lowest elevation
of a basement around that pond is 962.8. There is a study
from Oakdale indicating that it is 961.7. The watershed
district is monitoring the level of the pond and taking
samples of the water in the pond to determine the various
chemical content. They are also taking samples of Olson
Lake.
The DNR's position was not certain. They have two
concerns: (1) the quality of the water that would go from
the pond to Olson Lake; (2) the pipe elevation is at 952
initially because that is where the DNR wanted it because
they wanted this particular pond to be a wetland.
There are a couple of alternatives to discharging
directly into Olson Lake. One is to pump the water from the
pond north into the wetland north of 50th St. According to
the watershed's engineer if they can figure out how to do
this or where they can put the pipes, they could pump
temporarily to that area. There is an advantage to this.
They can control the amount of the pumping, whereas if they
unplug the pipe, it's all going into Olson Lake. If they
pump north and west, they can control the amount that is
coming out the pond and monitor what's happening in the
wetland and the impact on Long Lake. It obviously costs
more money than simply pulling the plug. They can bypass
Olson Lake with a series of pipes, but that's long term and
very costly.
Pumping toward Long Lake and retaining water in the
system is a possibility that the engineers of the watershed
district are investigating and intend to do before they
release water into Olson Lake.
Filla pointed out we need to establish volume and the
quality of water and the impact of that on Olson Lake. It.
seems there will be a considerable amount of silty water
containing high phosphorus content which would have a
significant impact of Olson Lake.

Filla would like to be in a position to convince them that
the impact on Olson Lake is as or more severe than allowing
a basement in a home to flood; therefore, they should
consider the other option of going north to the wetlands
even if it's on a temporary basis thru pumping that they can
control and monitor and get us thru the spring runoff so
that other possibilities can be explored.
Tom Prentice reported at the annual meeting of the Tri-Lakes
Assoc. it was their position the water did not go into Olson
Lake in the past and prefer that it doesn't in the future.
They don't have a strong position as to which alternative in
the future. They just don't want the watershed to look at
this issue as a short term emergency, but need to get a long
term solution.
Barb Walsh reported at the last VBWD it was brought to their
attention that there are two homes on Lake Olson at an
elevation at 932. About 8 years ago, Lake Elmo tried to run
a storm sewer into the water on Hill Trail and they were
covered with asphalt.
M/S/P Johnson/Conlin - to postpone further discussion on
this item and hold an Executive Session after adjournment.
(Motion carried 5-0).
D. Snowmobiles
Washington County Deputy Mark Caroon, snowmobile patrol,
indicated he is spending an average between 2 and 3 days in
Lake Elmo, but has the entire county to cover. Part of the
licensing money that the DNR receives goes towards the
trails and part is suppose to go for enforcement, but the
County hasn't received money for the last 4 or 5 years.
Caroon indicated he would be hesitant to ask for assistance
from snowmobile clubs for patrolling. He suggested signs be
posted in front of the Twin Point that states "No
Snowmobiling" to combat snowmobiles from going on city hall
property.
Administrator Kueffner has sent a notice to Twin Point
Tavern, Lake Elmo Inn, North Star Snowmobile Club indicating
that the city has received many complaints from residents on
the blatant disrespect of snowmobile rules and regulations
effective in the city. The Council can ban their use on city
streets and they have indicated a willingness to do this if
this plea for compliance with city ordinance and regulations
are not adhered to.
M/S/P Mottaz/Conlin - to direct the staff to write a letter
to the DNR asking that more of the licensing receipts be
designated specifically for enforcement by Washington
County. (Motion carried 5-0).

The Council asked that the staff contact the County to find
out what sort of signs are available and also the
possibility to tap the financial resource in terms of the
North Star Club to get some support in getting these signs
in position.
E. Planning Commission Appointments
The City received the following applications for the
Planning Commission: Roger Columbo, Vicki Horton, Todd
Mathisen, Marcus Gernes, Margaret Carlson. The council
interviewed the applicants in attendance.
The Council voted by paper ballots for the following
Planning Commission members:
Full Voting Member: Vicki Horton, 9060 Demontreville Cir,
First Alternate: Margaret Carlson, 8735 27th St, N.
Second Alternate: Marcus Gernes, 10950 3rd St. Place N.
M/S/P Johnston/Mottaz - to notify Rob Enes that if he
doesn't respond by the next council meeting on whether he
desires to continue on the planning commission, his reasons
for missing so many meetings and whether or not his
situation will change, lie will be asked to leave the
Planning Commission. (Motion carried 5-0).
F. Parks Commission Appointments
The City interviewed the following applicants for the Parks
Commission: Steve Peterson and Kevin Heichel.
The Council voted by paper ballots for Steve Peterson, 3308
Kraft Circle, as Second Alternate on the Parks Commission.
G. Cable Commission Appointment
M/S/P Conlin/Mottaz - to appoint Steve Foster, 9409 Jane
Road N., as the alternate to cable commissioner Karen
Wandmacher and appoint Dick Johnson as the alternate for
cable commissioner member Rita Conlin. (Motion carried 5-
0).
H. Heritage Preservation Commission
The Council received an application from Dave Johnson, 11291
30th Street, for the HPC. Since there are two vacancies the
Council requested they be advertised and at the March 2nd
meeting the Council will make the appointments. The Council
asked that Mr. Johnson be notified and thanked for his
application.

I. School District 622 Advisory Board
M/S/P Johnston/Conlin - to appoint Carol Monette, 8623 28th
Street N., to the School District 622 Advisory Board.
(Motion carried 5-0).
J. Septic Ordinance
The Council received a memo from Todd Williams, urging the
council to reject the proposed change in the ordinance,
which change would avoid the need for manhole covers to be
brought to the surface based on reasons stated.
Marl, Rivard, 5290 Hilltop Ave., stated the idea of making a
septic system easier to clean out so it doesn't pollute the
environment and last longer is an excellent one and has no
objection to this. His reasons for objection to the
ordinance are:
1. It only addresses approx 25% of the septic systems in
Lake Elmo and the 25% that it addresses are the best,
newest, most effective septic systems in Lake Elmo. It
doesn't look at the other 75% which are far more likely to
fail.
2. Homeowners who were affected by this ordinance were
never once given an opportunity to voice their opinion prior
to the time that the legislation was passed.
3. We were lead to believe that the cost of making the
retrofit mandated by Ordinance 8053 could be as low as $20.
The fact of the matter is no one knows what it is going to
cost.
4. Because there was resistance to this ordinance, the city
held an informational town meeting. The agenda for this
meeting explained how this meeting would tell us how we
could better maintain our septic systems, why its important
to take good care of them, and conceptually was an excellent
idea. This agenda was sent only to the people affected by
Ordinance 8053.
Mr. Rivard asked the Council to evaluate what was in the
previous council's mind: were they looking at a ordinance
which is going to be effective for all of Lake Elmo or were
they looking at a means of appeasing the 250 residents who
were affected by Ordinance 8053.
M/S/F Conlin/Johnson - to reconsider the motion of January
19, 1993. (Motion failed: 2-3: John: You don't have any
teeth in an ordinance when you ask for volunteer compliance;
Johnston, Mottaz: This is a good ordinance and is not a
burden on anyone. The reason the other 75% was not included
was because chances are they did not have provisions for

their tank for a manhole. From the information the council
received, in order for them to have a manhole they would
have to put in a whole new tank.).
The City Administrator will add addressing the balance of
the septic systems to their work plan.
6. PLANNING/LAND USE & ZONING:
A. Ordinance 8080, Amending Section 1402 of the Lake
Elmo Code relating to Dog Licenses
The staff proposed a change to the month in which dog
licenses are due or renewable. Right now, the code states
that they are due in March of each year. All other licenses
(contractor, etc) are on the calendar year.

ordinance amending Section 1402,020 of the 1979 Lake Elmo
Municipal Code as it relates to the annual licensing date
for dogs. (Motion carried 5-0).
B. Ordinance 8081, Amending Section 204 of the Lake
Elmo Code relating to Planning Commission Meetings
At its last meeting, the Planning Commission voted to change
on a trial basis, its starting time from 7:30 p.m. to 7:00
p.m. with time limits set for each agenda item. If this
change creates a problem, the Commission will make a
recommendation that this ordinance be repealed and that it
go back to the 7:30 p.m. starting time, but will give it a
try for four meetings.

Ordinance amending Section 204.018 of the 1979 Lake Elmo
Municipal Code as it relates to the starting time of the
regular meetings of the Lake Elmo Planning Commission.
(Motion carried 5-0).
C. Ordinance 8082, Dangerous Animals
M/S/P Johnson/Johnston - to adopt. Ordinance 8082, An
Ordinance adding Section 1402.220 and its subdivision
relating to dangerous animals to the 1979 Lake Elmo
Municipal Code. (Motion carried 4-1: Mottaz: language is
too broad for our needs in Lake Elmo --dangerous animals
could be dogs, cats, horses, etc.)

7. CITY ENGINEER'S REPORT:
A. 1993 Engineer's Work Plan (Update)
City Engineer Larry Bohrer reviewed the proposed 1993
Engineer's Work Plan stated in his memo dated January 28,
1993 with the City Council.
B. 1993 Municipal State Aid Project (Update)
In correspondence to the city council dated November 11,
1992, Bohrer summarized the staff recommendation to proceed
with Jamaca Avenue and Lake Jane Trail from Jamaca Avenue to
Jane Road as the 1993 Municipal State Aid project. Even
though 33rd and Laverne rated highet in need than these two
other streets, he did not recommend 33rd and Laverne for
1993 because of difficulty in financing the project. The
Council ordered the engineer to proceed with easement
acquisition.
The Council discussed adopting a local street assessment
policy in which the city would contribute a portion of the
cost. There was also a desire on the Council to assess a
larger portion on MSA projects than just the part that was
not paid by MSA funds. By assessing more than the non-MSA
eligible portion of an MSA project, the city could start to
build a fund to participate in local road improvements. No
decision was made on an assessment policy.
M/S/P Mottaz/Conlin - to adopt Resolution 93-9, Ordering a
feasibility report for the reconstruction of Jamaca Avenue
from THS to Lake Jane Trail and Lake Jane Trail from Jamaca
Avenue to Jane Road. (Motion carried 4-0: Dick Johnson was
unavailable for voting).
C. Ordinance 8083, Relating to Public Improvements
At the November 17th meeting, Bohrer explained their concern
for developer -constructed improvements, especially in the
area of quality control. The Council agreed that the city
changed its past practice and require that the street and
drainage improvements within the right-of-way and permanent
easements to be constructed under city contract. A proposed
ordinance revising the city code to implement this policy
was provided.
When this change in the ordinance was discussed previously,
the city knew that there were two developments (Fox Fire
Manor and Rolling Hills) in the process. Because they were
in mid -stream of the policy change, some allowances would
have to be made for these two developments. Knowing that the
developer's engineer was already working on the construction
plans for those two developments, the developer's agreement
was worded such that the developer would finish those plans,

but the city would utilize those plans in bidding out the
work.
Larry Liles, Developer of Fox Fire Manor and Rolling Hills,
expressed his concern that he would lose control and the
city would impose a financial hardship on him by amending
our ordinance in the middle of this subdivision and asked to
be excluded. Liles said he had entered into a written
contract with his engineer on October 8th.
The City Attorney voiced his concern if some action of the
city would cause a breach of contract. Filla understands
from Mr. Liles he has a contract now to do certain
engineering things that our city engineer is not proposing
to duplicate so his concern was met. What Mr. Liles wants
to do, in addition to that, is construct the project.

repealing Sections 401,500 through 401.530 and their
subdivisions from the Lake Elmo Municipal Code and Adding
Section 401.505 and its subdivisions to the Lake Elmo
Municipal Code relating to improvements within subdivisions
excluding Fox Fire Manor and Rolling Hills.) (Motion
carried 4-1: Johnston: The City attorney's concern had been
met. We just adopted a septic ordinance and it seems we are
being inconsistent with our own residents).
D. Surface Water Utility (Update and Review of upcoming
Public Informational Meeting)
Larry Bohrer reported the revenue from the Surface Water
Utility shall be used for preparation of a Surface Water
Management Plan, maintenance of existing ditches, culverts,
ponds, and storm sewers, capital improvement in developed
areas, equipment, planning, inventories, and water quality
improvements, including weed control. A Public Information
meeting on the utility has been scheduled for Tuesday,
February 23rd at 7:30 P.M. The Council received a draft of
the ordinance, policy and fee schedule.
CITY ATTORNEY'S REPORT:
A. Update on "Responsible Party Search" as it relates
to the Lake Jane Landfill
City Attorney Jerry Filla submitted a copy of the City's
Response to the Minnesota Pollution Control Agency's Request
for Information on the matter of the Lake Jane Landfill.
The Minnesota Pollution Control Agency has said that whoever
put hazardous waste in the landfill is responsible for
cleaning it up. The attorney has discovered the city has
hauled municipal solid waste to the site, but never
hazardous waste. At budget time the council should start
thinking about budgeting funds for city's participation.

Filla will be taking depositions from Elmer Richert, Don
Mehsikomer and Bob Wier.
9. CITY COUNCIL REPORTS -
Mayor John reported he attended the second MnDOT meeting on
January 31st. The meeting was planned to develop a consensus
between MnDOT and the local cities and townships for the
accommodation of traffic growth particularly for Highway 36.
On January 28th he attended a joint meeting with the
Minnesota Board of Water and Soil Management Washington
County Commissioners and representatives from the Ramsey and
Washington County Water Board and the cities of Woodbury,
Cottage Grove, Afton and Oakdale. This was to discuss plans
to reactivate the Cottage Grove Ravine Watershed District
which had previously been dissolved. It was recognized by
Woodbury and Cottage Grove that the management of storm
water was an issue which had to be resolved.
On January 30th, he and Rita Conlin attended an all day
conference for newly elected officials run by the League of
Minnesota Cities,
10. CITY ADMINISTRATOR'S REPORT:
A. 1993 Pay Plan
M/S/P Johnson/Johnston - to postpone consideration of the
1993 Pay Plan for two weeks. (Motion carried 5-0).
B. Fire Department's Request to Prepare Specifications
for New Vehicle
The Fire Department has submitted a Capital Improvement
Request for replacement of a 1978 Rescue Truck with an
estimated purchase price of $50,000-$60,000.
Fire Chief Dick Sachs reported there is $30,000 in the
budget, $20,000 in the reserves, and another $10,000 in the
budget for larger fire department expenses. Through
fundraisers the Fire Dept. raised money and look for the
Lake Elmo Jaycees and other organizations to help them out..
Mayor John stated the Fire Chief was not expected to
approach the Lake Elmo Jaycees and raise the funds.
If the Fire Dept. can confirm these funds to support this
purchase, the Fire Chief is to inform the City Administrator
who will pass it onto the Council in two weeks. The Fire
Dept. would then submit specs, potential vendors, and approx
cost to the MAC.

RE: Septic System Ordinance

I regret that. I will not be able to attend the discussion on this ordinance, but I have another
commitment. I also regret that this topic is yet again on the Council agenda.
I urge you, as I have urged before, to reject the proposed change in the ordinance, which change
would avoid the need for manhole covers to be brought to the surface. I would very much
appreciate Someone's reading into the record my reasons, which are as follows:
1. The monetary cost involved is not very much: $65-120, excluding the labor to dig down to the
currcntly submerged manhole.
2. My current system was put in under the 201 Project. Yes, if the City had known then all it
knows now, the manholes would have been put at ground level. But we are (hopefully) smarter
now, If the current ordinance had been in effect during the 201 Project, would people have
refused to participate just because the manhole covers would have been at ground level?
3. The electrical box for the sump pump, which many (but not all) new systems use, is much
more visually obtrusive than a ground level manhole cover, This box is also much more
dangerous as far as people tripping over it or falling into it and being injured. Finally, this box is
an obstacle to lawn maintenance, whereas a manhole cover can be driven over with a power
lawn mower without difficulty.
4. The manhole covers used in the 201 Project are so heavy that a single grown man has great
difficulty moving them without special tools. Therefore, there is virtually no danger of small
children moving such lids and falling into the uncovered tanks.
5. The main reason for having manhole covers at the surface is to maximize the chance that,
when the pumper comes to call, that pumper can pump the tank through the manhole and not just
through an inspection pipe. I hope that by this time, after all the publicity, the visit by Dave
Gustayson of the University, the discussions with pumpers, there is no one in Lake Elmo who
would still argue that pumping through the manhole is not needed. There simply is no question
about it. I wonder whether those people who are putting so much energy into complaining about
this ordinance would put as much energy into digging up their submerged lids every two years
for pumping, especially in rainy or snowy weather.
6. There are many instances in our society when rules are made retroactive. The well-known
vehicle inspection law is an excellent example. When it is reasonable to require such
retroactivity, other governmental agencies show little reluctance to do so. It is reasonable to
require every manhole cover to be brought to the surface, as a matter of public health, so that the
septic tanks can be cleaned properly. The Council felt it was not reasonable to require older
tanks to be retrofit with manholes, although it could have done so. The objection of some people
to the retroactivity provision is really a red herring. If those people bought a new house in Lake

Elmo today, there would be an exposed manhole cover, and those people would not think twice
about it.
Every one of you on the Council has expressed the desire to avoid central sewer in all but the
MUSA area. The best way to avoid sewer is to have septic systcros which work properly. One of
the important ways to have a septic system work properly is to maintain it properly. This in turn
requires periodic pumping through a manhole. The best way to ensure pumping through a
manhole is to have the manhole cover accessible at all times, and this means having it at the
surface.
Please keep the septic system ordinance as it is. Thank you for your consideration of my
comments.

Mayor's Report February 2, 1993
I attended the second MnDoT meeting on January 21. The meeting was
planned to develop a concensus between MnDoT and the local cities and
townships for the accomodation of traffic growth, particularly for jQ� 36.

MnDoT felt a strong need to develop an access plan for the corridor, to
determine where additional rights of way would need to be acquired.
Future landscaping plans could consider these access ways to avoid
unnecessary tree destruction. From the photographs that had been taken
of the desirable and undesirable aspects of Highway 36, good landscaping
was a major concern of all communities.
MnDot stated that the 20 year Capital Improvement Plan for Highway 36
does not include any major investment. Only incremental improvements,
such as the addition of traffic lights and other safety refinements, are all
that are being considered. This is surprising, in view of the announcement
of plans to build a new bridge over the St. Croix using Federal funding.
Their concern was to see what can be done to mitigate congestion, in view
of the absence of funding to change Highway 36 into a freeway.
We have further meetings in February, so that MnDot can complete their
access plans in three to four months. This subject will be on the Planning
Commission's 1993 work plan.
On January 28, I attended a joint meeting with the Minnesota Board of
Water and Soil Management, Washington County Commisioners, and
representatives from the Ramsey and Washington County Water Board and
the cities of Woodbury, Cottage Grove, Afton and Oakdale. This was to
discuss plans to reactivate the Cottage Grove Ravine Watershed District,
which had previously been dissolved because of "grid lock" over any water
management proposal. It was recognized by Woodbury and Cottage Grove
that the management of storm water was an issue which had to be
resolved.
This was a preliminary meeting to discuss possible formats of the proposed
Board, whether it should include the area of East Mississippi, and who
should be represented on the board. The aim was to develop an agreed 5
year plan, with full city involvement, to determine what aspect of water
management is a City activity and what aspect a Watershed Board
responsibility. Oakdale and Lake Elmo discharge water into this
watershed area from section 32 and are in the head water area. Because
of potential developments which may take place in Section 32, the Council
should consider what representation it would like on the proposed
Watershed Board.
On January 30, Rita Conlin and I attended an all day Conference for newly
elected officials run by The League Of Minnesota Cities. This was an
excellent experience, we met other newly elected officials from
neighboring and outerstate cities. It was a well run conference; we noted
names of different speakers who could give helpful advice; we received a
daunting amount of useful reading material as well as other information
which
we
can pass
on to
the
Planning Commission.
Altogether it was a
good
day,
which I
hope
will
prove profitable in the
near future.

the snowmobile rules and regulations effective in the
City.
These complaints include: trespassing on private
property, excessive speed, and snowmobiling past
curfew.
Snowmobiling in the City of Lake Elmo is a
privilege. The City Council can ban their use onCity
streets, and they have indicated a willingness to do
this if this plea for compliance with City Ordinances
and regulations are not adhered to.
