Adjourn MINUTES APPROVED: 3-2-93 LAKE ELMO CITY COUNCIL EMERGENCY MEETING FEBRUARY 23, 1993 Mayor John called the emergency meeting to order at 5:00 p.m, for the purpose of discussing strategy for the meeting with Oakdale and State Representatives Neary and Perlt regarding property in Section 32. PRESENT: Mayor John, Council members: Mottaz, Conlin, Johnston, Johnson, City Attorney Filla and Administrator Kueffner. Mayor John summarized the strategy discussion: First of all, we want to keep State Representative Pam Neary on our side. Secondly, at this meeting we will indicate to them and to the Oakdale representatives that this property is important to Lake Elmo. It has been a gateway to permitting high quality development with sewer for over the next 20 years along the I-94 corridor and the SAC units that are available are fundamental to this. Those are some of the SAC units available to us from the MnDOT property. We also have plans for this area. We developed a Business Park Ordinance, and we have always considered this area for some business development. We are willing to sit down and agree to mutually acceptable boundaries so that we can go to the Municipal Board with a joint application directed by the situation that has been let. If we get an agreement from Oakdale, then we explore what they are considering. If we don't get an agreement, then we oppose land development. M/S/P Mottaz/Johnson - that this be the instruction, as summarized by the Mayor, to Wyn John and Rita Conlin who are meeting with representatives from Oakdale and State Representatives Neary and Perlt. If they resist a joint application and go ahead with the bill, it is feasible to suggest a joint powers agreement to increase the capacity of the WONE interceptor as a second step. This negotiation would not be contingent upon withdrawal of the legislation even if they say they are going to leave it as is, we will continue on. (Motion carried 5-0), Council member Conlin indicated she saw this as a chance to improve our relations with Oakdale and didn't think we have to have this animosity. Since Wyn and Rita are going into this discussion and because of things that happened in the past, Rita felt there is probably some risk for them. She requested someone from the Council to move that the city will defend them if a suit is brought against them. LAKE ELMO CITY COUNCIL EMERGENCY MEETING 2-23-93 Attorney Filla explained the meeting is being called by a State Rep. in a state office. They are attending as a representative of the city council and not as a committee of the city council. They are attending to listen to what is going to occur and to offer that the city is willing to cooperate along these lines. State meetings are not covered by the Open Meeting Law. If you advise the press, which he suggested, that as a result of this meeting Council member Conlin and the Mayor will be attending a session of the state legislature on Thursday, 4:00 p.m., in a certain room. M/S/P Mottaz/Johnson - that providing there is public notification of the meeting, providing that they report back to the Council, and provided that there is no negotiations toward a commitment on the part of these two members, the city will defend them if a suit is filed. (Motion carried 5- 0) . M/S/P Mottaz/Johnson - to adjourn the emergency City Council meeting at 7:00 p.m. (Motion carried 5-0). MINUTES APPROVED: 3-2-93 LAKE ELMO CITY COUNCIL PUBLIC INFORMATIONAL MEETING SURFACE WATER MANAGEMENT UTILITY TUESDAY, FEBRUARY 23, 1993 Mayor John called the public informational meeting to order at 7:33 p.m. in the Council chambers. PRESENT: John, Mottaz, Conlin, Johnston, Johnson, City Engineer Bohrer and Administrator Kueffner. City Engineer Larry Bohrer presented the following summary for Surface Water Management Utility: The City of Lake Elmo has a surface water drainage system which consists of ponds, wetlands, ditches, culverts, dikes, weirs, storm sewers, catch basins and manholes. The City is responsible for the operation, maintenance, repair and improvement of this system. In the past, funding for this work has been provided by the general tax levy and has not been sufficient for anticipated expenditures. The City Council has sought a fairer way of funding this work based on amount of runoff rather than property value. Since all properties within the City are believed to generate runoff, all properties contribute to the need for this fund. Minnesota Law allows a City to operate its drainage system as a utility, much the same way it may operate a water or sewer system. A utility fee is charged based on usage. In a surface water utility, that usage is defined as the amount of runoff produced by that property. The fee calculation is based on the volume when comparing one land use type to another land use type. For example, the amount of runoff generated by one acre of commercial or industrial use is, on the average, three times the volume generated by the average residential lot because of the greater amount of impervious area. This ratio is defined as the Utility Factor. The revenue from the Surface Water Utility will be used for preparation of a Surface Water Management Plan, maintenance of existing ditches, culverts, ponds and storm sewers, capital improvements in developed areas, equipment, planning, inventories and water quality improvements, including weed control A draft ordinance establishing a Surface Water Management Utility had been prepared for review, along with a policy on the operation of the utility, and suggested fee schedule. Prior to adoption, the City Council is seeking public comment on the proposed ordinance. Dora Lee, Cimarron, stated her rent is already enough to take care of the ponds and culverts. She pays extra to have flood insurance because her home was flooded because of the culvert behind her. Floyd Olson, Cimarron, asked when the Council looks at this ordinance to consider the rate that is going to be imposed on the park owners for that land usage because its going to come back to affect 500 residents in this community. How could the benefit be determined for a Cimarron home? A Cimarron homeowner would be paying $13/Yr, versus a residential lot, approx. 1 1/2 acres, would pay $10/Yr. Michelle, Cimarron Park Manager, figured it would be $13/Year per Cimarron home based on 214 acres for Cimarron Park x proposed rate $30.80/acre divided by 500 residents. Beverly Pletsch, Tablyn Park, felt this meeting wasn't publicized enough, and we should have another meeting. The budget was cut $67,000 and now the city wants to levy another tax. Isn't this work what the Watershed District use to do? Will we not have the Watershed charge anymore? Jim Palecek, Jamley Avenue, reported he gets backup on 28th St. & Ivy Avenue since the VBWD installed a small culvert and asked if the City Council could put some pressure on the VBWD. Mayor John suggested he go to the VBWD meeting on Thursday. Another resident asked if there was an estimate of expected revenues and estimate of expenditures.
