LAKE ELMO CITY COUNCIL MINUTES
MARCH 2, 1993
Mayor John called the city council meeting to order at 7:00
p.m. in the city council chambers. PRESENT: John,
Johnston, Johnson, City Engineer Bohrer, City Attorney Filla
and Administrator Kueffner. ABSENT: Conlin, Mottaz.

4. PUBLIC INFORMATIONAL:
A. Public Inquiries
David Richter, 10841 10th St. N., questioned the legality of
a proposed subdivision of a four acre lot owned by his
neighbor, Mr. Collette. When Richter bought his lot, he was
under the impression that these lots could not be
subdivided.

Hans Stockstead, Real Estate Properties, stated he sold the
( 12 lots in Midland Meadows on the basis that when this plat
was approved, the City of Lake Elmo desired large lots in
the rural residential nature. In order to remain with the
rural residential large lot planning, he recommended the
city deny an application for a subdivision on that basis.
County Road 10:
Sue Dunn explained that some of the information that had
been gathered on this project has come from mainly the City
of Oakdale. Dunn referred to particular sections of the
booklet from the Washington County Board of Commissioners,
On Page 10 it stated that it is likely that a 4-lane section
will be needed in the future on County Road 10 east of
Inwood Avenue. In 1992 Washington County did a traffic count
of 4,150. Then in April, 1992 the County for $10,000
contracted with a firm which traffic count was 3,777 over a
24 hr. period. Dunn respectfully requested the council
review this plan.
B. Recycling Update
The Lake Elmo Solid Waste Advisory Committee (LESWAC) met
with representatives of Pine Springs, Grant Township and
John and Mike Maroney of TMT Recycling on Thursday, February
25th. TMT suggested that the city consider once -a -week
recycling pickup. The LESWAC unanimously recommended that
the city council adopt this new schedule. The cost for
recycling will remain at $90 per ton which is the same price
we have been paying for the past three years. TMT Recycling
will now accept magazines which needs to be separated from
newsprint and only narrow neck, screw top, plastic bottles
with a 1,2,3,4, or a 5 on the bottom.

5. OLD BUSINESS:
A. Derrick Fill Permit
The Council received a report from Barr Engineering Co.
dated December 15, 1992 discussing an option Derrick
Companies may wish to pursue pertaining to the mounds on
Lots 2,3, & 4, Block 2 Demontreville Highlands 3rd Addition.
City Engineer Larry Bohrer explained that additional fill is
being proposed by Derrick in the hope of avoiding springtime
water level testing. The height of the proposed mounds was
chosen from the highest recorded water elevation, then
adding 4 feet for unsaturated soil, then adding 2 feet for
drainfield placement and cover. Since Derrick is proposing
to add approximately 3.5 feet of fill to Lots 3 and 4, the
drainfield trenches would terminate in this fill. This is

not allowed by City Code until the soil has settled for one
year. Even if the trenches did not terminate in fill, the
City Code does not provide an exemption from the springtime
water level monitoring. Also of concern is the vital impact
of these mounds being 9-10 feet above street level.
Derrick delayed installing the approved curtain drain system
until March, 1992. Water level readings commenced in April,
1992. There was insufficient time between the installation
and testing for the full benefit of the curtain drain system
to be realized. Additional sand drain work was done by
Derrick at the end of May, 1992.
Bohrer recommended that Derrick be allowed to retest, in
lieu of their request to add additional fill and not retest,
this spring on the existing mounds. No additional fill
should be considered until the effectiveness of the
previously allowed improvements can be measured.
Bohrer encouraged council action this evening because he
would not want to delay a decision that would not provide
the applicants sufficient time to do the spring type
testing. If this proposal doesn't pass, then we are into
another season of testing. This testing needs to commence
around the beginning of April. If the applicant chooses to
do another round of testing, there is some work that has to
be done before that testing can occur. Tom Radio and Roger
Derrick agreed with the City Engineer.
If this Spring's round of testing show that they meet the
separation distance, but still needed less than 2' of fill
to achieve some type of cover requirements, Roger Derrick
asked if that could be done. Bohrer responded that, then they
would have satisfied the septic system requirements, but
they still would need to get approval for a revised grading
plan to change the top elevation of the mounds.
Attorney Filla recommended the council consider making a
motion to deny the request for the reasons given by the City
Engineer. If the developer wants to do the retesting, he
knows there is a certain timeline he has to do that in. If
he wants to come back and request that the city reconsider
its final grading plan for these three lots, that is his
choice. At that point the city can consider the
presentation of the impact and make their decision.
Tom Radio suggested the entire issue be tabled. It may
become moot or may be necessary for additional testimony,
but you have not prejudged the whole issue at this time.
Filla was not legally opposed to what Mr. Radio was
suggesting, but the record should make it clear that if it
is going to be tabled, it is with the developer's consent
and with the understanding that he is responsible for
conducting that series of tests this Spring consistent with

the city's code. After that if he chooses to come back with
another request he could do that.
M/S/P Johnson/Johnston - to deny Derrick Land's request for
an alternative to testing in the spring and that Derrick has
to test and can take whatever action he chooses after that.
(Motion carried 3-0).
Councilman Johnson commented that it was not the fault of
the city that Derrick's timeline would be delayed by a
motion to postpone because they could have brought this
before the council much earlier.
B. Response from Lake Elmo Jaycees
At the last meeting, it was brought to the council's
attention that there were some residents in the area of
Lions Park that complained about the noise and the late hour
of the dance during Huff n'Puff last year. The council
received the residents list of concerns and the response to
their concerns from the Jaycees. It appears that the
Jaycees are more than willing to work with the residents,
and the residents are willing to give it another chance as
long as their concerns are recognized. If the residents have
concerns that are not resolved, they will be in right after
the dance to express them.

between the Jaycees and the residents. (Motion carried 3-
0).
6. PLANNING/LAND USE & ZONING:
A. PUBLIC HEARING: Shoreland Permit with variance
to OHWM and a variance to the non -conforming use of
the zoning code, Charlotte Morgan & Mark Fritsch,
4563 Birch Bark Trail N.
Mayor John opened up the public hearing at 8:45 in the city
council chambers. The public hearing notice was published
in the February 17, 1993 Stillwater Gazette Extra and the
adjacent property owners were notified.
William Park, 4589 Birch Bark, who also submitted a letter
of support, indicated this addition would be situated
adjacent to their property and felt that in no way will this
addition create or cause any sort of hardship or eyesore.
Moreover, he felt it would be an enhancement to the
community and more specifically to the neighborhood.
Mayor John closed the public hearing at 8:50 p.m.

M/S/P Johnston/Johnson - to grant a variance to Section
308.060.D1A of the Shoreland District and grant a variance
to the Section 301.050B3 of the zoning code to Charlotte
Morgan and Mark Fritsch, 4563 Birch Bark Trail N., for the
purpose of constructing an 18' x 22, addition based on the
following reasons: (Motion carried 3-0).
" 1. that the addition does not encroach upon the distance
between the OHWM any further than the existing
dwelling.
2. that the addition cannot logically be placed on any
other side of the house.
3. that there exists now vegetative screening.
4. that the DNR does not object to the addition.
5. that there is no objection to the request by the
neighbors.
6. that the existing septic system is adequate for the
addition because it does not add a bedroom, but
expands upon the existing bedroom and there is
adequate room for expansion of the drainfield.
B. Minor Subdivision with Variances: Gene Peltier
Resolution No. 93-11
Council member Karen Johnston indicated she received a phone
call from Todd Williams urging the Council not to grant this
minor subdivision because it involves variances to the
Residential Estates ordinance which he thought would not be
necessary and should not be granted.

amended (add property address: 220 Lake Elmo Avenue N.),
granting a minor subdivision with variances to Gene Peltier.
(Motion carried 3-0).
C. Ordinance Amending Section 212 Heritage Preservation
of the Lake Elmo Municipal Code
The State Historic Preservation Program Specialist, Michael
Koop, informed the LEHPC that Ordinance 8062 and 8063 were
not acceptable to the State and would not qualify Lake Elmo
to participate in the certified local government (CLG)
program.
At the February 3rd meeting, the Heritage Preservation
Commission recommended the following changes:

212.012 COMPOSITION: The HPC shall consist of nine (9)
members, two alternate members and shall include, if
available, a member of the Washington County Historical
Society,
212.013 QUALIFICATIONS: Each commission member must be a
person with demonstrated interest and expertise in historic
preservation and must reside within the City of Lake Elmo
with the exception of ex-officio members.
212.027 POWERS: To actively promote historical preservation
within the City. To establish and maintain liaison with
civic, church, and other groups for the purpose of promoting
historic preservation. To promote gifting of structures or
money to promote the activities involved in historical
preservation.
M/S/P John/Johnson - to adopt Ordinance 8086, as amended,
(212.012 COMPOSITION: HPC consist of five members, two
alternate members) amending Sections 201.012, 212.013 and
212.027 of the Lake Elmo Municipal Code as it relates to the
Heritage Preservation Commission. (Motion carried 3-0).
D. Recommendations for Appointment to VBWD
Three applications have been received for the Valley Branch
Watershed District Board of Managers: Barbara Walsh, 8027
50th St. N.; Susan Dunn, 11018 Upper 33rd St. N.; J. Peter
Zetterberg, 8018 Hill Trail N.
M/S/P Johnston/Johnson - to direct the staff to submit the
three applications from Barbara Walsh, Susan Dunn, J. Peter
Zetterberg for the Valley Branch Water District; including
letters of recommendation, to the Washington County Board
with a strong letter of concern that Lake Elmo does not have
representation on the VEND and ask the County to carefully
consider this when making the appointment. (Motion carried
3-0).
7. CITY ENGINEER'S REPORT:
A. Olson Lake Estates Update:
Larry Bohrer reported as of last Wednesday the pond level is
unchanged and all other conditions have remained the same.
Olson Lake is still at its runoff elevation, just beginning
to trickle out. The water content in the snow upstream of
the Olson Lake Estates pond were to all melt and runoff, the
pond would reach an estimated elevation of 961 which is
below the lowest home in the area.

In regard to Karen Chandler's report dated February 5, 1993,
which identifies various options for the discharge of water
from Olson Lake Estates Pond, Attorney Filla suggested the
VBWD utilize the Long Lake Option at the present time before
an emergency arises so that there will be adequate storage
capacity in the Pond to accommodate spring runoff.

prepare a resolution advising the VBWD the City has reviewed
Karen Chandler's engineering report dated February 5th, 1993
and that the City Council urges the Watershed District to
adopt a contingency plan and recommends the Long Lake
Option. (Motion carried 3-0).
8. CITY ATTORNEY'S REPORT:
9. CITY COUNCIL REPORTS:
Mayor John and Council member Johnston reported on the
meeting with State Representatives Neary and Perlt and
Oakdale Mayor Ted Bearth and council member Timmerman.
Mayor John and other council members will visit the owners
in Section 32/33 to establish what their true interests are
on the assumption there is a sewer line going through. A
collection of information should be completed for the next
meeting scheduled for Friday, March 12.
M/S/P John/Johnston - to authorize Bruce Folz, surveyor, to
do the investigation of the Order by the Municipal Board,
not to exceed $1,500, and report back in all possible haste
before the March 12th meeting with Oakdale. (Motion carried
3-0).
10. CITY ADMINISTRATOR'S REPORT:
A. Purchasing Policy
The Council received a city purchasing policy revised by the
Maintenance Advisory Committee. The MAC has suggested the
use of the Capital Improvement Plan form and the Request for
Purchase/Repair. Finance Director Marilyn Banister reviewed
the new purchasing policy and indicated she had no problem
with it.
The MAC recommended amending the Requisition for
Purchase/Repair to include: Reason for Need:, Mileage for
Hourly Meter Reading:, Department Head Signature, and
Approval by City Administrator or Finance Director.

revised by the MAC, the Capital Improvement Plan form and
Request for Purchase/Repair form, as amended, (Motion
carried 3-0).
B. Employee Pay Rate for 1993

The City Council received job descriptions and proposed pay
increases for all employees for 1993.
M/S/P Johnston/Johnson - to postpone council action on the
Employee Pay Rate Increases for 1993 in order for the
council to have an opportunity to review data presented.
(Motion carried 3-0).
C. Fire Department
This item was tabled at the February 2nd meeting so that the
fire chief could confer with the finance director about the
availability of funds. There is $49,362 in the fire
department's reserve fund. The fire chief indicated to the
finance director that he would be able to keep this purchase
within budget.
M/S/P Johnston/Johnson - to direct the fire department to
prepare the plans and specifications for the vehicle as they
proposed within budget and send on to the Maintenance
Advisory Committee for review. (Motion carried 3-0).
D. Minutes & Agendas
M/S/P Johnson/Johnston - to terminate the policy of mailing
free copies of city council minutes to interested parties
and charge $75/year for council minutes and $15/Year for
agendas and publish the summary of the council meeting
minutes in the Stillwater Gazette Extra. (Motion carried 3-
0) .
M/S/P Johnston/Johnson - to terminate the policy of mailing
free copies of Planning Commission minutes and agendas and
charge $75/Year for minutes and $15/Year for agendas to
anyone who request them. (Motion carried 3-0).

Notes on meeting with State Representatives and Oakdale Council
members on February 25, 1993 at 4.00 p.m. in State Offices 4th
Floor Conference Room.

Ted Bearth commented that the situation was a mess, Public Land is Public
Land, and should be transferred with the related annexation. Oakdale
wanted the situation resolved because they could not proceed with their
plans for developing Section 32, as they could not get access to the
roadways for sewer installation, since the roads are still in Lake Elmo.
Pam Neary indicated that the purpose of the meeting was
• to understand the positions and attitudes of Oakdale and Lake Elmo,
• to put past history behind,
• to move forward from the current situation without recourse to
legislation which would be expensive for both cities,
• to establish broad areas of agreement which the representatives can
submit to their councils with a good chance of success.
Pam indicated that Oakdale wished to construct a sewer line along 4th
Street to terminate at the North East corner of the Guardian Angel's Church
property.
Ted Bearth indicated that in constructing this sewer line, Oakdale is
prepared to build it oversize. This would accomodate the SAC units to
which Lake Elmo is entitled for the Business Park District. Oakdale had no
wish to take over. this sewer capacity, but would charge Lake Elmo for the
increased cost of building the line to the larger dimension. In order to
build the sewer, the land had to be transferred to Oakdale. Oakdale
wanted to order the project to bring sewer capacity to the single family
homes on the frontage road, many of whom had failing cess pools. Lake
Elmo ownership of the rights of way was blocking the project, which he
wanted completed in Mid '93.
Rita pointed out that the SAC capacity went with the land. If the MinDoT
areas were transferred to Oakdale the sewer capacity would transfer too.
There was some discussion on this, Pam Neary felt that if we reached an
agreement the capacity would be stay with Lake Elmo. Both Rita and Wyn
1 felt that we had no authority to assume that such a decision would be
supported by the Metropolitan Commission.
In response to Pam, Wyn stated that he did not feel that the Oakdale offer
was attractive enough for him to feel comfortable in offering it to the Lake
Elmo council. All it did was to provide a sewer line of enough capacity to
meet Lake Elmo's short term needs, assuming .that the capacity would still
be available after the land transfer. If Oakdale were able to provide a
"loan" of sewer capacity to enable the MUSA to be extended to the bounds
of our original submission, then maybe this was something we could offer
the Council for consideration. We would "replace" this capacity when the
project for increasing the capacity of the WONE interceptor to meet
Woodbury needs was ordered.
Rita Conlin suggested that as we were being asked to transfer land to
Oakdale, that some land should be transferred to Lake Elmo in exchange.
She suggested that perhaps a parcel in the SE corner would be appropriate.
Ted Bearth's reply was short - "No way". When Wyn John expressed
surprise that he could be so forthright, Ted Bearth replied that that was his
characteristic - to tell it like it is. As the owner in this parcel had asked for
annexation, he did not feel he could now undo that request and return the
land owner to Lake Elmo.
Wyn John responded that if the landowner's sole reason for requesting
annexation had been the lack of sewer availablity, this deficiency would be
remedied by the construction of the proposed 4th Street sewer. It might
not then matter (to the landowner) if the land were to be transferred back
to Lake Elmo.
He also felt that with the current situation, there was nothing preventing
Lake Elmo putting in a sewer along 4th Street to tie in with the Business
Park Area. Although it might not be an economically viable solution, the
streets being in Lake Elmo provided that right, for which we did not need
Oakdale approval. This was yet another reason why Oakdale's proposal
gave no perceived benefit to Lake Elmo.
Ted Bearth remarked that Oakdale had always been a supportive friend of
Lake Elmo. He cited the unsigned agreement which had been reached with
Sue Dunn, Lee Hunt and Todd Williams (who was NEVER involved in any
such discussions), Oakdale support of Lake Elmo over the proposed Bishop
an and its preparedness to provide Oakdale City water to Lake
Elmo homes whose water supply was contaminated.
( After some further discussion, it was agreed that the parties would return
to brief their respective councils. Another meeting was arranged for
3.30 p.m. March 2, again in the State Offices.

OAKDALE IS AN ACTIVE SYMPATHISER
OF LAKE ELMO?
• The proposed agreement covered detachment and annexation of
Section 32 land to Oakdale with reimbursement of 35% of sewer
availability charges and 50% of park dedication fees to Lake Elmo.
Estimated worth is unknown.
• Annexation of Bishop property in Lake Elmo, previously the subject
of a cluster development outlot agreement, was proposed to Mr. Bishop by
Oakdale.
• The annexation of the Bishop property failed on a 3/2 vote in
Oakdale Council. Mr. Bearth voted for the annexation.
• Oakdale supplied water to Lake Elmo properties that had water
supplies contaminated from the Washington/Ramsey County landfill No 1.
The contamination was a Washington/Ramsey County problem to be
resolved by them. Mr. Bearth resisted, and voted against this project at
council level.
• The proposed Lake Elmo extension of the MUSA along the I-94
corridor was actively resisted by Oakdale, in spite of Oakdale having
"enough" sewer capacity for its own needs.
• Oakdale actively pursues development. Lake Elmo prefers to manage
development to maintain a rural ambience. Oakdale developments utilize
wetland mitigation to the full. Surface water run off is approved by their
surface water management plan. Development is allowed to continue in
spite of construction problems associated with downstream percolation
ponds, as in Olsen Lake Estates. In this case, potential flooding is expected
to be mitigated by discharge into Olsen Lake, located in Lake Elmo.
• Lake Elmo Council recently agreed to an upgrade of CSAH 10 to a
;our lane divided highway to avoid unnecessary dual disturbance of a lake
and associated wetland area. These areas are located in Lake Elmo, but the
new roadway will relieve a major communication concern of Oakdale's.
• Lake Elmo Council supported Oakdale in its Hadley/Hwy 36 traffic
light controversy with MinDoT and opposed blocking off the cross over to
divert traffic through residential neighborhoods.
