LAKE ELMO CITY COUNCIL MINUTES
MAY 4, 1993
6:30 p.m. BOARD OF REVIEW (Continuation)
Mayor John reconvene the Board of Review at 6:30 p.m.
PRESENT: John, Conlin (arrived 6:55 p.m.), Johnson,
Johnston and Assessor Frank Langer.
LaVerne Downs, 3759 Jamaca Avenue N., asked consideration of
reduction for her property and her mother's property because
it is near the landfill.
The Council recommended the following: Reduction of $2,000
to land for Laverne Downs, 3759 Jamaca, Reduction of $8,000
to land for Jeff Downs, 3793 Jamaca and NO reduction for
Lydia Richert, 3870 Jamaca.
The Council discussed the disrepair of property on 37th
Street which two residents (Case #48, #52) complained about
and asked for reduction to their property value. Jim
McNamara reported information is being sent to the City
Attorney to start a civil suit. Washington County Health
Dept. has been contacted and will issue citations.
M/S/C Johnson/Johnston - to accept the Assessor's
recommendation as to cases presented to the Board of Review
as reviewed, amended and recommended (See Exhibit A).
(Motion carried 4-0).
M/S/C Johnston/Johnson - to close-out the Lake Elmo Board of
Review at 7:12 p.m. (Motion carried 4-0).
Mayor John called the City Council meeting to order at 7:12
p.m. in the Council chambers. PRESENT: John, Mottaz,
Conlin, Johnston, Johnson, City Engineer Bohrer, City
Attorney Filla and Administrator Kueffner.
1. AGENDA
ADD: 7C. Discuss proposed traffic signal on Hwy 36 and
Manning Avenue, 10C. Status of Cimarron Storm Shelter
Construction
M/S/C Conlin/Johnston - to approve the May 4, 1993 City
Council agenda as amended. (Motion carried 4-0).
2. MINUTES: April 20, 1993
M/S/C Johnson/Conlin - to approve the April 20, 1993 City
Council minutes as amended. (Motion carried 4-0).

3. CLAIMS
M/S/C Johnston/Conlin - to approve the May 4, 1993 Claims
#1521 thru #1588 as presented. (Motion carried 4-0).
4. PUBLIC INFORMATION:
A. Public Inquiries
Dave Johnson, 11291 30th St. N., stated Washington County
has assured they would replace lost wetlands at least 1 1/2
acres to 1 acre taken and believes the wetland replacement
should be in our city or at least at a minimum on Armstrong
Lake.
Sue Johnson, member of Washignton County Parks and Open
Space Commission, reported June 5th, 8-6 p.m., will be a
free park day at all Washington County Parks and all the
citizens of Lake Elmo are invited to see what the county
parks have to offer. There will be free annual park tickets
raffled off, seedlings and refrigerator magnets given away.
B. Dan Burgess, 8085 Hill Trail N.
Illegal business in residential zoning district
Dan Burgess requested this item be placed on the Council
agenda.
Dan Burgess explained that he has been running a business
since 1989, but does not advertise, and has no signage. He
receives a call, operates a tow truck, picks up a vehicle,
(occasionally will bring a vehicle home), and brings it to a
recycling plant. He hauls other cars to Ideal Storage and to
Mike Severin's residential property. Burgess indicated he
does have a lot of cars in his yard occasionally --some our
his, some our company, some come and go --they are licensed
and operable. There are other properties in the city where
a business is run out of their home, has commercial vehicles
at their residences, and exterior storage of unlicensed and
inoperable vehicles. Burgess asked if the city consider his
a business, he wants to be treated the same as the other
properties in the City.
The City received a letter from a concerned neighbor and a
letter from the Tri-Lakes Improvement Association indicating
this resident is conducting a business that violates the
zoning regulations and encourages the Council to enforce the
zoning regulations.
Burgess submitted a list of signatures from his neighborhood
that did not have a problem with his business: LeMire,
Laschinger, Severin, Zabrok, Furseth.

The City's position is Mr. Burgess is operating an illegal
( business, the matter is in our city attorney's hand, and we
will continue to proceed in court to clean-up the property.
Other situations will be investigated and action, as
required, will be taken.
5. OLD BUSINESS:
A. Update on City Council Informational Requests
M/S/C Conlin/Johnson - to direct the staff to prepare a
draft policy for checking out keys to the City facilities
and access to the city office. (Motion carried 5-0).
M/S/C Mottaz/Johnson - to direct the Planning Commission to
discuss PF Zoning at their May 24th meeting. (Motion
carried 5-0).
B. St. Croix Animal Shelter's request for a "Community
Support Agreement"
Attorney Filla explained this would be a contract that would
be enforceable if signed and would obligate the city to
budget for the designated commitment. The Council suggested
directing an inquiry to the shelter asking them if they
would accept a provision for someone from Lake Elmo to serve
on the Board of Directors.
M/S/C Mottaz/Johnson - to postpone action on this item until
the next meeting in order for the City Attorney to review
the contract and direct an inquiry to the Shelter asking the
Board if they would consider a provision for someone from
Lake Elmo to be on their Board. (Motion carried 5-0)•
C. Street Standards, Request for Modification to
Engineering Standards adopted October 15, 1991
Councilman Johnson informed Mr. Nelson that it is the city's
desire to have 9-ton streets in a development which was
reflected by a previous council motion.
M/S/C Mottaz/Johnson - to instruct the City Administrator
and City Attorney to determine as a result of dates of
preliminary Plat approval of Rolling Hills with the new or
old street standards if the city is legally obligated to
honor the old street standards, the council should be
informed. If not, the developer will be instructed it is the
position of the city to require compliance with the new
street standards. (Motion carried 5-0).
Attorney Filla will meet with Mr. Nelson to go through the
file on Wednesday afternoon at city hall.

6. PLANNING/LAND USE & ZONING:
A. Conditional Use Permit Amendment
Ray Salus, Country Air Golf
M/S/C Mottaz/Conlin - to adopt Resolution No. 93-19, as
amended incorporating the site plan submitted, A Resolution
amending Conditional Use Permit No. 90-25 granted to Raymond
and Jane Salus, Country Aire Golf Driving Range to include a
three -hole practice/training golf course. (Motion carried
5-0).
B. Continuation of non -conforming use in the Highway
Business (HB) zoning district. (Kunz Oil Bldg, 4201
Stillwater Blvd.)
Administrator Kueffner reported Mr. Kunz will be applying
for a rezoning to General Business which will allow Tim
Myrha to continue selling sod from the Kunz Oil Building,
Attorney Filla indicated it is not good policy for the city
to ignore ordinances. It is better for the city to adopt
regulations that it wants to enforce and enforce the
regulations that we have.
M/S/C Mottaz/Conlin - the council allows the existing use to
continue until June 1st council meeting; contingent upon the
submission of a completed application for rezoning to
General Business on or before May 10, 1993. (Motion carried
5-0).
Filla explained to Mr. Myrha that this motion permits him to
continue selling sod out of the Kunz Oil Building until the
June 1st, 1993 City Council meeting; provided that a
completed application for rezoning is submitted to the city
by May 10, 1993.
C. County Road 10 Reconstruction
M/S/C Mottaz/Conlin - the Council makes the decision that
the proposed reconstruction of County Road 10 does not
conflict with the Lake Elmo Comprehensive Plan on Page 33 as
indicated by the April 12, 1993 Planning Commission minutes.
(Motion carried 3-2: Johnson: He does consider an amendment
to the comprehensive plan is needed; Johnston: The language
should be investigated further.)

D. Recommendation from Planning Commission on Hwy 36
M/S/C Mottaz/John - to schedule a joint meeting with the
representatives of the communities involved within the next
two weeks to discuss the study committee's recommendation on
Highway 36. (Motion carried 5-0).
7. CITY ENGINEER'S REPORT:
A. 1993 Overlay Project:
Draft Feasibility Report
City Engineer, Larry Bohrer, submitted a draft of the
Feasibility Report for the 1993 Overlay Project which
presented three options for assessments.
M/S/C Johnson/Conlin - to direct the City Engineer to
present Assessment Formula Option 2 - Each project assessed
separately, less 10% city's contribution. (Motion carried
5-0).
The City Administrator will submit for the next meeting a
draft assessment policy based on the front footage method.
In order to accommodate the large number of residents
attending this hearing, the Council discussed holding the
June 1st public hearing at the Lake Elmo Elementary School
and check into the availability of the school.
B. 1993 MSA Project: Right -of -Way Update
M/S/C Mottaz/Conlin - to authorize the City Engineer and
City Attorney to acquire easements as necessary for the 1993
MSA Project as proposed in memo dated April 30, 1993.
(Motion carried 5-0).
The City Engineer will get a position on trimming branches
from the State Aid Engineer.
C. Proposed Traffic Signal and Road Improvements
Larry Bohrer submitted a memo to the Council on the proposed
traffic signal at TH36 and Manning Avenue and road
improvements providing a double left turn from eastbound
TH36 to northbound Manning Avenue.
M/S/C Mottaz/Conlin - to direct the city engineer to respond
to the MN Dept. of Transportation indicating the city
council supports the project as a benefit to the general
motoring public, but does not agree with the funding
formula, but sees the project as a State responsibility with
no significant amount of traffic contributed by Manning
Avenue south of TH36; therefore the city is not interested
in contributing financially to the project for construction
or for electrical operating cost. (Motion carried 5-0).

8. CITY ATTORNEY'S REPORT:
A. Federal Land Company's Proposal for Automobile
Service Center at Cty Rd 19&I-94
Attorney Filla reported the city has received a concept for
the Flying J Travel Plaza. The City's position is
development applications must comply with the city's current
zoning regulations and the Comprehensive Plan.
M/S/C Johnson/Mottaz - to send a letter to Federal Land
indicating the council cannot take any action based on the
information submitted. (Motion carried 5-0).
9. CITY COUNCIL REPORTS:
Mayor John reported on April 21st he attended a meeting
with the VBWD, DNR, whereby they discussed various issues in
terms of surface water management within the VBWD.
On April 27 there was a special council meeting to
discuss legislation prepared by Representative Pam Neary in
relation to Section 32 and 33 where they unanimously thanked
Rep. Neary for her proposal, but they were not prepared to
go forward with this legislation.
On May 3rd he met with the Lake Elmo Business
Association to talk about the general direction of the City.
Council member Dick Johnson: Wood Chipper
M/S/C Johnson/Conlin - to direct the staff to determine how
to implement Option D and have the Maintenance Dept. and
Parks Dept. talk to Woodbury and look at equipment of other
firms and decide if it is favorable to stockpile brush.
(Motion carried 5-0).
Council member Conlin reported there will be a workshop
on a model Connecticut wet/dry recycling and composting
demonstration project that has achieved 70% diversion rates
held at the Wescott Library in Eagan on Tuesday, May 11 at
6:30 p.m. This notice will be sent to the Solid Waste
Committee.
10. CITY ADMINISTRATOR'S REPORT:
A. Request from Washington County HRA requesting City's
approval. of a Cooperation Agreement for HOME Program
Attorney Filla submitted a letter indicating the agreement
allows federal funds to be used on local projects under the
supervision of the Washington County Housing and
Redevelopment Authority. Since the program would be
supervised by the Washington County HRA, Washington County
would be responsible for making sure that the funds are used

in the manner required by all the various federal
regulations referred to in the agreement.
M/S/C John/Mottaz - to approve the Cooperation Agreement for
HOME Program with the Washington County HRA. (Motion
carried 5-0).
B. Sunfish Lake Parking Lot Rehabilitation
Parks Supervisor, Mike Bouthilet, reported that the
driveways and parking lot for Sunfish Lake Park need to have
maintenance. Roadbusters Inc. are doing the milling on the
final section of the Hwy 5 project and wish to sell the City
millings for the Sunfish driveway. There is $4,000 in he
Parks CIP for the driveways in 1994. City Engineer Bohrer
recommended 4" for driveways and 3" for parking lot. The
ground up asphalt millings should give the driveways a firm
base that would hold up year around.
Since this report was made, Roadbusters have offered
additional material for Pebble Park parking lot and Fire
Station #1 parking lot.
M/S/C Mottaz/Johnston - to authorize the Parks Dept. to hire
Roadbusters Inc., as bid on 4-27-93, to grade, place
millings, grade millings for roll for compaction for
$9,652.50. (Motion carried 5-0),
Bohrer reported the Valley Branch Watershed District will
have to be contacted if they will require a Watershed Permit
for a small ponding area.
M/S/C Johnson/Mottaz - to authorize the Parks Dept. to
proceed with obtaining additional material for Pebble Park
parking lot and Fire Station #1 parking lot not to exceed a
total of $15,000 (includes $9,652.50) providing we don't
need any decision on ponding. If ponding is required and
will exceed this amount, the Council will hold an emergency
meeting. (Motion carried 5-0).
C. May 18th City Council Meeting
The consensus of the council was to hold the May 18th city
Council meeting at 8:05 p.m. due to the #834 School Board
election.
D. Status of Cimarron Storm Shelters
Administrator Kueffner reported the plans have been
approved, a building permit has been issued today to
Rossbach Construction, and they will try to make the May
15th deadline.

addressed during your review. Because Mr. Burgess is conducting his business in a
residential area, he has and is causing dangerous conditions to the welfare of

almost been hit by cars.
* Mr Burgess test drives the vehicles he is hying to repair at a high rate of speed,
around the neighborhood, is he covered by proper business Insurance?
Who will be raspomsft when a child Is hurt? Mr. Burgess for having his fence
too high or driving too fast? The City of lake Elmo for allowing this to exist with their
M knowledge of the danger? or the council members as individuais7. No mattes who

Besides this business being a potential danger, has the city given any thought to
the potential of ground water pollution f m the oil and gasoline spills from the many

I like most other neighbors also am concerned with the appearance of this
business and potential decrease in our property values, but believe a greater concern
should be on what legal responsibilities and ramifications the city may be leaving its self
open to and possible legal expense

Dear Council Members:
I have been informed that MnDOT is planning to install a traffic signal at TH 36 and Manning
Avenue. Roadway improvements are also planned that would provide a double left turn from
eastbound TH 36 to northbound Manning Avenue. Manning Avenue would also be widened for
a certain distance north of TH 36 to provide the merging of the two northbound lanes to one.
The esthnated project cost for the signal is $100,000 and for the roadwork is $250,000,
MnDOT's policy on cost sharing for signalization is by each leg of the four-way intersection.
Under this policy MnDOT has two of the legs; or 50% of the cost. Washington County has one
leg for 25% of the cost. Lake Elmo and Baytown Township share the fourth leg for 12.5% of the
cost each. Under this formula, MnDOT would like Lake Elmo to agree to pay 12.5% of the
signalization costs; or approximately $12,500.
I advised MnDOT that Lake Elmo is not likely to agree to the proposed cost formula because
Lake Elmo's half of Manning Trail contributes so little traffic to the intersection. It is my
recollection that Lake Elmo's portion of Manning Trail has two rental houses and one farmstead
abutting it.
In addition, if this project were approved, MnDOT also asks that the abutting comtnunities pay
the electric costs of running the signals. I estimate that Lake Elmo's share of the power cost
would be around $35 per month or $420 per year.
I asked Michael Schadegg, MnDOT's Project Engineer, what would happen if the City did not
agree with the funding policy. He said the project is scheduled for a July letting. If there was no
agreement the project would probably not be done. Mr. Schadegg is interested hi the City's
comments and concerns on the project and the funding formula.

I have reviewed the proposed Cooperation Agreement and have
discussed its content with the project manager for Washington
County. The agreement is in proper legal form and can be executed
by the Mayor and yourself if approved by the City Council.
The agreement basically allows federal funds to be used on
local projects under the supervision of the Washington County
Housing and Redevelopment Authority. The projects range from an
individual home improvement to the purchase of several housing
units by the Housing and Redevelopment Authority for use by low
income families. Since the program would be supervised by the
Washington County Housing and Redevelopment Authority, Washington
County would be responsible for making sure that the funds are used
in the manner required by all the various federal regulations
referred to in the agreement.
