Mary,
letter is to address the road easement problem through Fox
Manor in order for Rolling Hills to have access from Keats
to 55th Street. Pacesetter Property Management, Inc.
rstands the necessity for this easement and will gladly give
easement so that the Rolling Hills development can continue
the platting process. It is important that Fox Fire
and Rolling Hills work together so that both developments
be completed this year.

LAKE ELMO CITY COUNCIL MINUTES
JUNE 1, 1993
Mayor John called the special meeting to order at 5:30 p.m.
in the council chambers to review comment on the EAW for
Highway 10 and discuss Todd Williams' memo dated May 24,
1993.
M/S/C Conlin/Johnson - to adopt Resolution No. 93-42, A
Resolution Requesting Evaluation of an Alternate Route for
County Road 10 around, rather than through, Armstrong Lake.
(Motion carried 4-1: Mottaz: He felt the Council had made a
decision and the County should proceed.)
Mayor John will attend the Washington County Board meeting
where County Road 10 is an agenda item (8:30 p.m.) and
submit the adopted resolution.
Mayor John adjourned the special meeting at 7:05.p.m.
Mayor John called the regular meeting to order at 7:08 p.m.
in the council chambers. PRESENT: Mottaz, Conlin, John
(departed 8:20 and returned 10:45 p.m. from the Washington
County Board meeting), Johnston, Johnson, City Engineer
Bohrer, City Attorney Filla, City Planner Black and

2. MINUTES: May 18, 1993
M/S/C Conlin/Johnson - to adopt Resolution 93-21 through 93-
29 Ordering Preparation of Feasibility Report for 1993
Bituminous Overlays. (Motion carried 5-0.)
M/S/C Johnston/Johnson - to approve the May 18, 1993 City
Council minutes as amended. (Motion carried 5-0.)
3. CLAIMS
M/S/C Johnson/Johnston - to approve the June 1, 1993 Claims
#1641 through #1685 as presented. (Motion carried 5-0.)

B. Lake Elmo Jaycees Proclamation:1993 Huff'n Puff Days
Mayor John proclaimed Huff n' Puff Days on August 12-15,
1993 as the official city celebration for 1993.
The Jaycees requested the cities waive the field light
charge at Lions Park and the liquor license fee for Huff
n'Puff Days.
M/S/C Mottaz/Johnson - to waive the field light charge for
Lions Park from August 12-15, 1993 and to waive the fee for
the liquor license for Huff'n Puff days. (Motion carried 5-
0.)
C. Derrick Lots (Residents in area & Update)
The Council received a letter from City Engineer Larry
Bohrer, dated May 27, 1993, reporting the 1993 water level
testing has been completed on Lots 2-4, Block 2,
Demontreville Highlands 3rd Addition A tabulation of water
level readings was provided. Although there has been a
general lowering of the water levels from previous year's
observations, the lots still do not pass the requirement of
the code.
The council received a letter, dated May 24, 1993 from
concerned homeowners in the 3rd Addition of Demontreville
Highlands indicating their concern of the health and safety
of the residents living in the area. Gary Bance, spokesman
for the homeowners, indicated the added fill is unacceptable
and a detailed study has to be done on the construction of
the mounds. He felt these lots would be beneficial as a
park.
M/S/C Mottaz/John - to refer this item to the Parks
Commission to consider if this would make a reasonable
addition to the Lake Elmo Parks system. (Motion carried 5-
0.)
Suzanne Haugen, 5770 Hytrail Avenue, pointed out that there
is bad visibility at the intersection because of the height
of the weeds and the mounds.
M/S/C Mottaz/Johnston - to instruct the city administrator
to have the weed inspector take whatever action to remedy
the visibility situation. (Motion carried 5-0.)
D. John Nicholson, 8975 15th Street, regarding
accessory structure
M/S/C Mottaz/Conlin - that the city council should not
discuss this matter, but refer this matter to the code
enforcement officer, with the aid of the city attorney, for
resolution. (Motion carried 5-0.)

5. OLD BUSINESS•
Olson Lake Pond:
Larry Bohrer will make a report on the Olson Lake Pond at
the June 15, 1993 city council meeting.
Acting Mayor Johnson continued the meeting because Mayor
John left at 8:20 p.m. to attend the Washington County Board
meeting.
6. CITY ENGINEER'S REPORT:
A. DNR Fill Permit: Tartan Park
M/S/C Mottaz/Johnston - to direct the staff to reply to the
DNR that the City has no negative comments on the request of
Tartan Park to fill wetlands according to the plans
submitted to and reviewed by the City Engineer. (Motion
carried 4-0.)
B. 1993 Bituminous Overlay Project
M/S/C Mottaz/Johnson - to adopt Resolution No. 93-30 through
93-38 accepting the feasibility reports for the 1993
Bituminous Overlay Projects and calling a public hearing for
proposed improvements for June 3, 1993. (Motion carried 4-
0.)
C. Pebble Park Tennis Court Resurfacing
M/S/C Mottaz/Conlin - to adopt Resolution No. 93-39 ordering
the resurfacing of the Pebble Park Tennis Court and
directing the City Engineer to prepare the plans and
specifications for said project and solicit bids according
to State Law and the City's purchasing policy. (Motion
carried 4-0.)
The City staff will review the purchasing policy for
incorporation of state statute.
7. PLANNING/LAND USE & ZONING:
A. 1993 Comprehensive Plan Amendments
The Planning Commission held a public hearing on May 10 and
continued discussion at it's May 24, 1992 meeting. The
Commission recommended action on 7 of the 8 Plan Amendments
under consideration. The Hesse property was tabled until
June 14, 1993.
The Council received a memo, dated May 27, 1992, From Mike
Black describing the process we must go through to finalize
these amendments and a flow chart describing the process and
timing for an amendment.

M/S/C Conlin/Johnson - to table the proposed 1993
Comprehensive Plan Amendments pending the Planning
Commission's recommendation on the following properties:
Hesse (10830 50th St. N., Klatt (25 acres commonly known as
11825 50th St.), 8+ acres south of 10th St. (11817 10th
St.), three residential properties, 8718, 8728, 8790
Demontreville Trail N., adjacent to the Mottaz property.
(Motion carried 3-1: Mottaz: Abstain: His property is being
considered for a Comp Plan Amendment.)
B. City of Oakdale: 1993 Comprehensive Plan Amendment
The Council received a report from Mike Black, dated May 25,
1993, on the Major Comprehensive Plan Amendment submitted to
Met Council by the City of Oakdale.
M/S/C Mottaz/Johnston - to direct the city staff (planner
and administrator) to attend the Metropolitan Council
meeting to speak to the issues raised by the city planner in
his memo dated May 25, 1993 regarding the city of Oakdale's
Comprehensive Plan Amendment and to further communicate
these comments to the Metropolitan Council in writing.
(Motion carried 4-0.)
C. Request from T.P. Armstrong for Amendment to
Section 301.070.D.b.
The Council received a memo from Mike Black, dated May 24,
1993 and a letter from Tom Armstrong Jr., dated March 22,
1993, requesting the city consider amendments to
Agricultural CUP Ordinance 301.070D.b.
M/S/C Mottaz/Johnson - to deny the changes,submitted by Tom
Armstrong, Jr., amending the Alternate Ag Zoning ordinance.
(Motion carried 4-0.)
D. Rolling Hills Estates: Final Plat
The Council has received from Chuck Nelson a signed
developer's Agreement approved by both the city engineer and
city attorney. The issue regarding the standards for the
street in Rolling Hills has been resolved and they will
build a 9-ton design.
Larry Bohrer has reviewed the construction plans and
specifications, grading plan, landscaping plan, and final
plat, and found they are in compliance with the city code.
M/S/C Conlin/Johnston - to adopt Resolution No. 93-40, as
amended (Condition #4:... said easement must be signed by all
record owners), granting final plat approval to Rolling
Hills Estates as conditioned. (Motion carried 4-0.)

E. Request for Extension of Final Plat for Fox Fire
Manor
Larry Liles, Pacesetter Property Management, Inc., submitted
a letter, dated June 1, 1993, indicating they understand the
necessity for this road easement through Fox Fire Manor and
will gladly give this easement so that the Rolling Hills
development can continue through the platting process.
M/S/C Johnston/Conlin - to approve the request from Larry
Liles for an extension to August 1, 1993 for the completion
of Fox Fire Manor; contingent upon Larry Liles/Pacesetter
Properties providing an easement through Fox Fire Manor for
a future street on or before June 14, 1993 and said easement
shall be approved by the City Attorney. (Motion carried 4-
0.)
F. Resolution No. 93-41: Approving accessory structure
nearer to street than main structure. Applicant:
Tim McDonough, 4711 Birch Bark Trail
M/S/C Conlin/Mottaz - to adopt Resolution No. 93-41, as
amended by language by the city attorney, for Tim McDonough,
4711 Birch Bark Trail, allowing him to construct a garage,
as shown in Exhibit A, between the public road and the main
entrance. (Motion carried 4-0.)
' 8. CITY ATTORNEY'S REPORTa
A. Response from Oakdale on Section 32/33
M/S/C Mottaz/Johnston - to direct the city attorney to work
with the city engineer to come up with recommendation
referred to in his letter dated May 25, 1993 for extension
of sewer and water facilities (In the form of two documents:
joint power's agreement for sewer and water and a joint
resolution dealing with the establishment of a border) for
the June 15, 1993 council meeting. (Motion carried 4-0.)
The Oakdale City Council invited the Lake Elmo Council and
Administrator to attend a meeting on Tuesday, June 22, 1993
at 5 p.m. at the Oakdale Municipal Building Council
chambers. The purpose of this meeting is to provide a forum
for the Oakdale council to review and clarify its position
relating to various issues and concerns with Lake Elmo.
M/S/C Conlin/Johnston - to contact the city of Oakdale to
request an agenda for the June 22, 1993 meeting. (Motion
carried 3-1: Mottaz: It's Oakdale's meeting and he doesn't
want to antagonize them).

9. CITY COUNCIL REPORTS:
( Mayor John reported he submitted the resolution adopted
by the Council to the Washington County Board. In view of
the various inputs and the fact the Public Works Dept. had
not studied the northerly route, they would make estimates
for the northerly route and report back to the Washington
County Board in two weeks' times.
10. CITY ADMINISTRATOR'S REPORT:
A. Resignation of Ed Stevens from PZ
M/S/C Johnston/John - to accept the resignation of Ed
Stevens from the Planning Commission and send him a letter
of appreciation, to appoint Margaret Carlson (1st Alternate)
to serve out the term of Ed Stevens (through December 1995),
to move Marcus Gernes to 1st Alternate position and to
direct the staff to seek applicants for the PZ in the next
newsletter. (Motion carried 5-0.)

10:57 p.m. (Motion carried 5-0.)

Re: Water Ski Course on Lake Jane
Dear Mayor John and City Council:..
We wish to make the following statements a part of the hearing regarding the
slalom course which is to be discussed on Tuesday, May 18, 1993.
1. Because of past experience, we request that Justin be advised of the following
two rules that already exist.
A. There is to be no water skiing before noon or after sunset.
B. Skiing is to be in a counter -clockwise direction only.
2. We request that the course be located in front of the Bloyer household as much
as possible in an effort to inconvenience other property owners as little as possible.
3. We request that the City Council receive written confirmation from Justin's
parents that they will be responsible for supervision of this activity so that this does not
become the responsibility of other residents.
4. We request that this matter be open for review by the City Council if problems
and/or complaints are received.
Due to the high water, we all lived several years without being able to use the
lake. How wonderful it is now that we can use the lake for all water activities. Let's do
our best to make the lake an enjoyable place for all of us, from toddlers splashing along
the shore, to kids skiing, to people fishing, and even for those who just want to sit outside
and enjoy the beauty of the lake.

X have been a member of the American Water Ski
Association (AWSA) and a competitive water skier since 1965.
1 am also an AWSA certified tournament boat driver and
regular Judge. This Year T. will be the chief ,.fudge for the
Wisconsin State Championships to be held at Adams Wisconsin.
Slalom skiing is a competitive event at AWSA tournamenl-s;and
the availability of slalom courses to practice on is
essential to the growth of our sport. During all my years
competing and .judging water ski tournaments throughout the
mi.dwest: 1 have never heard of a safety problem with a slalom
course. The bouys' are.soft and if hit by a boat would not
damage the boat.
As a member of the Half Moon Ski Club on Half Moon
Lake .in Folk county Wisconsin 1 have helped maintain a
slalom course since 1959 with no accidents or safety
problems.
Some people may object to slalom courses because they
are relatively new and people are someti.mers, slow to accept
something different. There is plenty of room for all forms'
of recreational water activity, both new and old„ if
everyone respects the rights of others.
