LAKE ELMO CITY COUNCIL MINUTES
JUNE 15, 1993
Mayor John called the council meeting to order at 7:04 p.m.
in the council chambers. PRESENT: Mottaz, Conlin, John,
Johnston, Johnson, City Engineer Bohrer, and Administrator
Kueffner.
1. AGENDA
M/S/C Johnson/Conlin - to approve the June 15, 1993 city
council agenda as amended. (Motion carried 5-0).
2. Minutes: June 1, 1993
M/S/C Conlin/Mottaz - to approve the June 1, 1993 city
council minutes as presented. (Motion carried 4-0-1:
Abstain: John).
Minutes: June 3, 1993
M/S/C Conlin/Johnston - to approve the June 3, 1993 City
Council minutes as presented. (Motion carried 5-0).
3. CLAIMS
M/S/C Mottaz/Johnson - to approve the June 15, 1993 claims
#1686 through #1726 as presented. (Motion carried 5-0).
4. PUBLIC INFORMATIONAL:
A. St. Croix New Area Group:Chris Aamodt & Mike Polehna
Chris Aamodt introduced a new organization called the St.
Croix New Arena Group, Inc. The mission of this
organization is to build a new 2,000-2,500 seat ice arena
that would help to serve the hockey needs of the St.Croix
Valley area. The estimated cost to build an arena is $2.5-3
million. A fair subsidy cost program will be put together
for all the cities in the St. Croix Valley to consider. Two
sites are being considered for this arena: a five acre site
adjacent to Tom Thumb store in Stillwater, and a 28 acre
park site behind Walmart in Oak Park Heights.
B. Letter from Judy Blackford on Sunfish Lake Park
Judy Blackford submitted a letter and pictures and voiced
the need to address the erosion in Sunfish Lake Park. She
asked that this information be inserted in the Sunfish Lake
Park file. As a parks commission member, she took the
pictures and is requesting reimbursement costs for film and
photo processing in the amount of $22.16.

Council member Conlin disagreed with Judy Blackford's
assessment of the condition of the trails because she had
walked the trails in the park and found them to be in
excellent condition. Conlin felt that the expectation of
total vegetation of the trailways would not be possible and
still keep the park open for use.
Larry Bohrer suggested materials such as gravel, rather than
wood chips, be used for wooded areas because wood chips will
decay and will lead to spongy trails. There is woven fiber
mats and netting that will hold the mulch in place until
vegetation can be established. He would prefer to rely on
natural means of growing vegetation rather than artificial
means such as timbers and structures.
Mike Bouthilet agreed that erosion is an ongoing problem in
the Park. Every Fall he tries to make the trails good
enough for skiing season. He suggested the city consider
closing off a trail in order for it to re-establish
vegetation. Wood chips have been placed several times, but
wash away.
Nancy Hansen indicated that Sunfish Lake Park is full of
trees, underbrush, animals, but devoid of people because we
shut them all out. She feels we need to maintain the trails
so that everyone can use the park and not just the people to
stroll. The trails were developed for skiing and not for
hiking, Metro Mountain Biking Resource Group are
professional people whose aim is to promote biking by
working on proper trail construction and maintenance
throughout the metro area. They are now working with the
City of Burnsville who is developing a new trail in one of
its parks. The problem will not go away unless we address
it positively.
The council appreciated that this concern was brought to
their attention and remanded the stabilization of the
trailways to the Parks Commission with recommendations for
trail materials to be submitted from Mike Bouthilet.
5. OLD BUSINESS:
A. Washington County Landfill No. 1 Methane Issue
M/S/C Mottaz/John - that the City Administrator informs the
county that we don't object to their installing monitor
wells at the public works building or any other test sites,
but request they come to the city first for permission to
install the wells. (Motion carried 5-0).

B. Direction to Parks Commission to discuss lake usage
At a previous meeting, the council requested the city
administrator to approach the parks commission to organize a
subcommittee whereby they would develop and define
acceptable uses for the lakes within the city.
The Parks Commission will reschedule a meeting to address
this issue.
C. Discussion on upcoming joint meeting with Oakdale
City Council
Mayor John stated he sent a letter to Mayor Ted Bearth
suggesting a revised agenda, but no response has been
received.
School #622 Bond Referendum Election:
It was brought to the attention of the City Council that
School District #622 was having a bond referendum election
and polls closed at 8:00 p.m. Upon the recommendation of the
city attorney, the council repeated the motions that were
made before 8:00 p.m. The City Administrator noted that she
received no notice from the County Auditor's office as is
the practice for any election.
6. PLANNING/LAND USE & ZONING:
A. Comprehensive Plan Amendment: Hesse Property
Item Postponed
B. Site & Plan Review: Temporary Classroom at Lake Elmo
Elementary School
M/S/C Johnson/Conlin - to approve the request from ISD #834
to place a temporary classroom at the Lake Elmo Elementary
School for five school years; contingent on the (5)
conditions outlined in the June 14, 1993 Planning Commission
minutes. (Motion carried 5-0).
7. CITY ENGINEER'S REPORT:
A. City Council tour of Project Streets
Some of the residents at the 1993 Overlay public hearing
questioned the need for the improvement. The Council
thought a drive over inspection with the Engineer and Public
Works Foreman would help them reach a consensus.
Councilman Mottaz did not see a need to pay money for the
city engineer to go over this when the original
recommendation on road projects was made by the city
engineer and maintenance foreman. Mayor John disagreed and
felt a council inspection required a technical authority of
the city engineer for validity.

Council members Mottaz and Conlin reviewed the roads on
their own and would not be available for the road tour.
The Council called a special meeting to tour the project
streets for June 18, 5:30 p.m., and will meet at city hall.
All affected property owners will be notified.
B. 3265 Kraft Circle Drainage Problem
Larry Bohrer met with Mike Ziniel about a drainage problem
on his property. Mr. Ziniel is seeking bids to replace his
concrete driveway that will correct some of the problem.
Neighbors testified that over the years the boulevards have
gradually increased in height because of wintertime sanding.
Bohrer offered to work with Mr. Ziniel if he decides to
replace his driveway so that it will be constructed to allow
for the overlay.
C. Highlands Trail MSA Designation
Some property owners at the public hearing stated that
Highlands Trail functions as a collector road and the
engineer was to determine whether it could be designated as
a Municipal State Aid Street. In this way, there could be
another source of maintenance or construction funds.
Bohrer reported that under the present criteria, Highlands
Trail cannot be designated as MSA. MSA designation was
removed a few years ago and assigned to Inwood Avenue. The
County realized that DeMontreville Trail could never be
improved to meet State Aid standards. They felt the State
Aid funds could be better utilized on Inwood Avenue and that
allowed 15th Street to be designated MSA. The City Council
concurred in that designation change.
D. Public Hearing on Improvements for Laverne Avenue
Larry Bohrer reported that ISD #834 was not notified of the
Public Hearing on improvements for Laverne Avenue and
requested the council set July 6, 1993 for a public hearing
to give the property owner a chance to speak.
M/S/C Conlin/Johnston - to call a public hearing for July 6,
1993 for Improvements on Laverne Avenue N. (Motion carried
5-0).
D. Pebble Park Tennis Court Overlay Award of Bid
M/S/C Mottaz/Conlin - to award the contract for the Pebble
Park Bituminous Overlay Project to T.A. Schifsky and Sons
with a completion date set for July 23, 1993 in the amount
of $15,714.00. (Motion carried 5-0).

E. 1993 MSA Improvements: Jamaca Avenue and Lake Jane
( Trail, Resolution No. 93-43
M/S/C Mottaz/John - to adopt Resolution 93-43, Approving the
plans and specifications, and authorizing the advertisement
for bids for Jamaca Avenue/Lake Jane Trail Street
Reconstruction. (Motion carried 5-0).
F. Update on Olson Lake Estates Pond
Larry Bohrer reported in his June 10, 1993 letter to the
Council that the condition of the Olson Lake Estates Pond is
as follows:
Present Pond Elevation 956.5
Critical Pond Elevation 962.0
Bohrer stated there are no plans at this time to release
water to Olson Lake unless a 3" rainfall occurs, in which
case an emergency release of water would be necessary.
8. CITY ATTORNEY'S REPORT:
A. Joint Powers Agreement Utility Extension
M/S/C Mottaz/John - to accept the amended DRAFT Joint Powers
Agreement Utility Extension Project to be used to fulfill
f Item #3 in June 14, 1993 letter from Mayor John to Mayor Ted
Bearth. (Motion carried 5-0).
9. CITY COUNCIL REPORTS:
Council member Conlin suggested the following items be
considered at the July 6, 1993 city council meeting:
M/S/C Conlin/John - to consider a $1,000 charge card limit
for the city administrator. (Motion carried 5-0).
M/S/C Conlin/Johnston - to consider purchasing business
cards for the city council. (Motion carried 5-0).
M/S/C Conlin/John - to discuss a workshop retreat for the
city council. (Motion carried 5-0).
10. CITY ADMINISTRATOR'S REPORT:
A. Recodification Update
The City Council received Chapters 4 through 13 of the Lake
Elmo code codification leaving two chapters yet to be
completed by the League.

B. Request from the Maintenance Advisory Committee
Bill Wacker, Chair, requested he receive the city council
agendas because there might be items on the agenda that the
MAC should be aware of.
M/S/C Mottaz/Johnson - to send city council agendas to all
the city committees. (Motion carried 5-0).
C. Review the Annual Financial Report
M/S/C Johnson/John - to set up a workshop for July 13,1993,
7:00 p.m. to review the Annual Financial Report with the
city auditors. (Motion carried 5-0).
M/S/C Mottaz/Johnson - to adjourn the council meeting at
10:50 p.m. (Motion carried 5-0).
