LAKE ELMO CITY COUNCIL MINUTES
JULY 20, 1993
Mayor John called the council meeting to order at 7:06 p.m. in the city council
chambers. PRESENT: Mottaz, Conlin, John, Johnston, Johnson, City Engineer
Bohrer, City Attorney Filla and Administrator Kueffner.

3. CLAIMS
M/S/C Conlin/Johnson - to approve the July 20, 1993 claims #1795 through #1837
as presented. (Motion carried 5-0.)
4. PUBLIC INFORMATIONAL
A. MTC Public Hearing
Administrator Kueffner reported she attended the public hearing at the Oakdale City
Hall regarding the changes proposed by MTC that includes the possible elimination of
bus service to Cimarron Park. MTC has proposed eliminating the service altogether
and suggested that Cimarron residents catch the bus at Highway 5 and Lake Elmo
Avenue. The administrator pointed out 30% of the City's population live in Cimarron
and the City could not tolerate any further reduction in service provided to these
residents.
Administrator Kueffner has spoken with Craig Moris, our Metropolitan Council
representative, who will ask that the MTC staff review the data on ridership that is
challenged by the residents. An update is expected by the end of the week.
M/S/C John/Johnson - to request the city administrator send a letter to the MTC, RTV
and our legislators, registering our opposition to insure they get the city's message.

B. Comments by Wyn John on Cimarron Meeting
Wyn John updated the council on items discussed at the Cimarron Community meeting:
(1) Request they have more than one civil defense drill because the first drill would
identify the problems and the second drill would rectify the problems. (2) NHD would
prepare to have a community gathering where they would supply hot-dogs and pop. It
appeared Cimarron didn't have a number of residents to organize such a function so
Mayor John volunteered to help. (3) Report by Washington County Deputy on
neighborhood watch, property identification, and other items that affected the general
security.
Attorney Filla is preparing a draft on standards for accessibility of the storm shelters
that will be circulated to the council, Fire and Sheriff Dept. and Cimarron Park for
comments. John pointed out there was a need to clarify the boundaries on where the
city's jurisdiction lies for general safety.
C. Video Recording Problems for July 6, 1993 council meeting:
Administrator Kueffner reported a service call was made the night of the meeting, but
the sound problem was not corrected until Monday, July 12. The Cable Commission
assured her that problems in the future would be corrected more expeditiously. The
July 6, council meeting will be broadcasted on Wednesday at 10:00 a.m. and again
after the July 20 council meeting is broadcasted on Thursday.
D. Letter Regarding Burning in Cimarron Park
Mayor John explained a letter was sent to the city from Captain Johnson, Washington
County Sheriff's Dept. , about a deputy citing a resident in Cimarron for an alleged
illegal burn that is being handled by the city attorney. At the same time the Sheriff's
Dept. became aware of the letter that was issued by former Mayor Dave Johnson and
Council member Mottaz about the fact they felt the fire did not contravene our
ordinances.
Administrator Kueffner reported Captain Johnson questioned whether the letter he
received represented the position of the city with Councilman Mottaz speaking for the
city and whether they should continue to issue burning citations when they find a
violation.
Discussion followed on the content of the letter whether it was an official document
issued by the city or whether it was the opinion of the former Mayor and one of the
council members. It was the opinion of Attorney Filla that what they were doing was
uttering an opinion by identifying their previous associations with the governing body of
the city. It is the city's position for the Sheriff's Dept. to enforce the state and local
regulations. The question is do we want them to respond to and issue citations to all
the various code violations in the code book.

M/S/C Johnson/Conlin -- to reinforce the position of the city council that the Lake Elmo
( Deputies and Washington County Sheriff's Dept. continue to handle code violations that
are appropriate for them to issue citations, if required, and it be left up to their judgment
whether it is in their authority or whether it should be referred to some other officer of
the city. (Motion carried 4-1:Mottaz: The deputies should not be involved in building
code violations. Anytime during working hours the code enforcement officer should be
out inspecting and deciding if they are violating the code. We are trusting that the
deputies are familiar with the Lake Elmo Code. )
5. OLD BUSINESS
A. #622 Bond Referendum notification - Informational
Administrator Kueffner has talked with representatives of ISD 622, the County Auditor's
Office, and the Secretary of State's office regarding the lack of notification of the 622
Bond Issue election.
The School District indicated its only obligation is to notify the county auditor, but in the
future will add Lake Elmo to its list of municipalities to notify. The Washington County
Auditors office explained it must notify municipalities only when there is a county
election. The secretary of State's office said there is definitely a problem with school
elections. Joe Mansky, the person in charge of elections for the Secretary of State,
said that is one of the reasons they have tried, albeit unsuccessfully, to change the law
so that all elections be on the same day. Mansky asked the city write to the secretary
of state explaining what happened and copy the letter to the two legislators that will be
introducing a bill to this effect during the next legislative session.
6. PLANNING/LAND USE & ZONING:
A. Resolution approving minor subdivision to David Herreid and
Lake Elmo Inn
Dave Herreid is requesting that the city approve a minor subdivision to allow a lot line
adjustment between his property and that of the Lake Elmo Inn. It seems that his
building is on the Inn's property and there appears to be an encroachment of the Inn's
property onto Herreids. The Planning Commission has reviewed this request and
recommended unanimously that the minor subdivision be granted.
M/S/C Mottaz/John - to approve Resolution 93-56, granting a minor subdivision that will
allow for a lot line adjustment to Dave Herreid and the Lake Elmo Inn. (Motion carried
5-0.)
B. "Moving Buildings into or within City" Draft Ordinance
The Planning Commission has reviewed the city's ordinance relating to moving
buildings into the City. Attorney Filla commented on this draft ordinance in his memo
dated June 16, 1993.

M/S/C Mottaz/ Conlin - to table the draft ordinance for moving buildings into or within
the city until the August 3 council meeting to receive comments from the Code
Enforcement Officer. (Motion carried 5-0.)
Council member Johnston requested the reason the particular numbers were chosen
by the Planning Commission for the performance bond and insurance.
C. "Driveways" Draft Ordinance
Jim McNamara, Building Official, submitted his comments on the driveway ordinance in
his memo dated July 16, 1993. McNamara indicated he didn't believe limiting the width
of a driveway was necessary so long as the property in question can meet a maximum
percentage of hard surface coverage.
M/S/C Mottaz/Conlin - to table until comments are received from the Planning
Commission why they did not develop a design standard to allow for a 24' maximum
driveway width with a minimum flared area to accommodate a larger than 2-stall garage
as requested by the city council on September 3, 1991 and request the PZ submit their
response for the August 3 council meeting. (Motion carried 5-0.)
Noxious Weeds:Keith Raleigh:
Northern Diversified, developer of Arabian Hills, has informed the administrator they will
cut and spray for noxious weeds on this Wednesday.
M/S/C Mottaz/John - that Northern Diversified, developer of Arabian Hills, has ten days
to remove the noxious weeds, if the weeds are not removed within the required time
given, the city will take appropriate action. (Motion carried 5-0.)
D. Recodification: Direction requested from Planning Commission
M/S/C John/Mottaz - to direct the PZ to review the portions that would concern them as
to their responsibility; (such as fees for buildings. Etc.) in Section 100 and Section 200
and leave the remainder. If they feel that means there is very little to review, then they
should review Sections 300, 400 and 500 that relate to zoning. (Motion carried 5-0).
OLD BUSINESS ITEM: At the August 3, council meeting, the council will set a
workshop date to review Section 100 and Section 200 of the recodification.
E. 5-Acre Zoning District - Direction requested from Planning Commission
M/S/C Johnson/Mottaz - to direct the Planning Commission to continue to consider RE
zoning district as a 2.5 to 10 acre lot size without any separate zoning for 5 acre
minimum unless more defined reasons can be given for the need for a 5 acre zone.
(Motion carried 5-0.)

F. Comprehensive Plan Amendments - Direction requested from Planning
Commission
M/S/C Conlin/Johnson - to inform the Planning Commission that the council will review
the FLU plan for city initiated changes to the Comp Plan jointly at the annual meeting at
the Planning Commission's first meeting in May because our Comprehensive Plan
requires this. (Motion carried 5-0.)
F(f). Discussion on PZ action on the feasibility of establishing RE on the eastern
border of the City in relation to the Geotschel/Klatt property
Council member Conlin indicated the PZ did not favorably receive establishing RE on
the eastern border of the city and she was in error when she voted against the comp
plan amendment for the Geotschel/Klatt property because she did not find a provision
in the comp plan or in the code that required adjacency for rezoning. Conlin explained
she supports RE along the east border of the city and made the following motion.
M/S/C Conlin/Johnston - to amend prior council action of July 6, 1993 on the request
for the Comp Plan amendment for Geotschel/Klatt property by directing the staff to
prepare a resolution approving the Comprehensive Plan Amendment for the
Geotschel/Klatt property, changing the future land use designation from RAD to
Residential Estate Density (RED), conditional upon submitting this minor amendment to
the Metropolitan Council and receiving a determination from the Metropolitan Council
Chair of no system impact. (Motion carried 5-0.)
M/S/C Conlin/John - to call a public hearing as soon as possible to reconsider a
Comprehensive Plan Amendment for the Geotschel/Klatt property changing the future
land use designation from RAID to Residential Estate Density (RED). (Motion carried 5-
0.)
G. "Rural" Definition - Request from Planning Commission
If we do a survey and collect data, Council member Johnston asked for what purpose
would we be using this information. Johnston also questioned budget implications for
this survey process.
Council member Conlin felt it would be helpful for the Council to have some indication
from residents on how they would like to see Lake Elmo in the future.
Councilman Johnson pointed out in preparation of the 1979 Comp Plan the city
authorized a professional survey done and we should look back at the questions that
were asked. He would like the council to review the survey questions before they are
placed in the newsletter.

M/S/C Johnson/Mottaz - to direct the Planning Commission establish a task force to
assemble a comprehensive survey (Suggestions: how would you like to see Lake Elmo
develop without using the word "rural", surface water use, park use, proposed trail
system) of the citizens of Lake Elmo and submit survey to the city council for issuance.
(Motion carried 5-0.)
H. "No Parking signs requested on Lake Elmo Avenue
(Adjacent to Tartan Park)
M/S/C Johnston/Mottaz - to direct the staff to draft a resolution requesting Washington
County to look into the feasibility of erecting "No Parking Signs" from the Tartan Park
entrance gate on the west side on County Road 17, Lake Elmo Avenue, for about 300
yards south on both sides of the road. If it is feasible in their opinion, Lake Elmo would
request these signs be placed. (Motion carried 5-0.)
I. Travel Plaza (concept) 1-94 and County Road 19
Attorney Filla explained the court order did not prevent the city from changing its
comprehensive plan that the city has done and now there are rules that Federal Land
has to comply with. As part of their application they would make a request to amend
the comp plan to suit their proposal and rezone. The city would have to decide if they
would want to agree with those changes to the comp plan and rezoning. Legally, the
city does not have to listen to their presentation unless they comply with the code.
M/S/C Mottaz/Johnson - to set up a joint meeting at a future date of the City Council,
Planning and Parks Commissions to review and consider the proposed Travel Plaza on
CR 19 and 1-94. (Motion carried 5-0.)
7. CITY ENGINEER'S REPORT:
A. Resolution approving Plans and Specifications for 1993 Overlays
Larry Bohrer reported Steve Ziniel, Kraft Circle, has reconstructed his driveway and
has improved the slope and raised it up from the existing bituminous surface. Bohrer
has reviewed a proposal with Mr. Ziniel to improve the drainage in the area by offering
to regrade approximately 150 sq.yds. of his north lawn area to improve the drainage
away from the street. This is included in the bid package as a separate bid. Mr. Ziniel
is undecided if he wants the lawn improvement done right away or just have the overlay
done and observe how it works. Bohrer believes the yard improvement will still be
necessary.
Attorney Filla commented if the city has any exposure today it will be less after this
project because we are improving whatever is there now.
M/S/C Mottaz/Johnston - to adopt Resolution Nos. 93-47 through 93-55 directing the
City Engineer to prepare the plans and specifications for the 1993 Overlays and adopt
Resolution No. 93-57 approving plans and ordering advertisement for bids for the 1993
Overlays. (Motion carried 5-0.)

B. Resolution awarding bid for 1993 MSA Project
Larry Bohrer explained that at present the city does not have final approval. The low
bid from Tower Asphalt, Inc. is about 13% more that what the city engineer estimated in
the feasibility report and public hearings. This has a financial impact on the state aid
account and what we were planning to do with our future state aid allotments. It was
planned that this project would use up the amount we presently have in our
construction account plus use a portion of the 1994 allotment. Bohrer requested more
time to review the financial impacts of doing this and requested the council receive the
bids but take no action for the award. By the August 3 meeting, final state aid approval
and recommendation of financing the project will be received.
M/S/C Mottaz/John - to accept the bids for reconstruction of Jamaca Avenue between
TH5 and Lake Jane Trail, and Lake Jane Trail between Jamaca Avenue and Jane
Road and delay action on awarding of bid until the August 3, 1993 city council meeting.
(Motion carried 5-0.)
C. Streets in Fox Fire
Bohrer reported that the streets in Fox Fire Estates and adjacent Springborn Green
Acres were paved in 1979. The streets have received one sealcoat since then and one
or two spot repairs and are a strong candidate for crack sealing and spot overlay in
1994.
8. CITY ATTORNEY'S REPORT: None
9. CITY COUNCIL REPORTS:
Council member Conlin reported she attended the July 8 cable commission meeting at
Birchwood city hall. There is money allocated to suburban cable channels for updating
their equipment and $100,000 allocated through government access. Conlin met with
David Currence on July 12 and one of the things cable access could use this money for
would be in a form of Public relations. Staffing would be available to the cities to do
video productions and scripting which would be on a first come first serve basis. Conlin
asked the council to make a list of types of service they would like the city supplied
which will then be submitted to the cable commission.
Council member Johnson registered an official complaint that recreational buoys were
placed on Lake Jane and requested Washington County Sheriff's Dept. to take action.
Administrator Kueffner noted she received the same complaint and the Washington
County Sheriff's Department has been notified and is investigating the complaint.
10. CITY ADMINISTRATOR'S REPORT:
A. Team Building - Goal Setting
OLD BUSINESS ITEM: Set a date at the August 3 council meeting for a September
goal setting meeting.

B. Resolution No. 93-10
Administrator Kueffner received a letter from Council man Mottaz regarding Resolution
93-10 being amended on March 19, 1993 and there was no meeting held on that date.
Kueffner explained the time the original resolution was adopted at the regular council
meeting of February 16 and the emergency meeting on February 19 (attended by
Mayor John, and council members Johnson and Conlin), we found that a companion
bill had been introduced in the Senate, Therefore, a change was made to the resolution
to reflect both the House and Senate bill.
M/S/C Johnson/John - to amend the minutes of February 19,1993 council meeting to
state a motion amending Resolution 93-10 to include reference to senate file 491 and
correct the typographical error of line 2: Change March 19, 1993 to February 19,1993.
(Motion carried 3-0-2:Abstain: Mottaz, Johnston did not attend the February 19, 1993
council meeting.)
C. Replacement Doors for Garage Bays at Parks Building
Based on the MAC recommendation, the Parks Commission recommended on July 19,
1993 accepting the bid of $2,164 from A-Doorable Grate Door Co. of Cottage Grove
and a continuous angle be used for mounting the track at a cost of $50 for both doors.
M/S/C Johnson/John - to accept the quotes received for replacement doors for Garage
Bays at Parks Building and to accept the quote of $2,164 from A-Doorable Garage
Door Co., Cottage Grove ($1,992 + 2 windows + tax) and include $50 for continuous
angle track mount for both doors as recommended by the MAC and Parks Commission.

Our proposal would create a landscape which would be characterized by an average size
road (regulation 24' wide to the current traffic studies) with a four foot shoulder on each side of
the 12' lanes, a curb on the eastern edge, and 10' open space to separate the vehicular traffic thorn
the pedestrians/recreational users, and an 8' wide trail. The 19 open space is our idea to physically
separate the traffic from the trail while leaving apace to plant trees or other vegetation as
secondary barriers from the road. The vegetation could block sound for the
pedestrians/recreational users, as well as for the homeowners adjacent to the road. Below is a
diagram of the proposed road in cross section;
As the the graphics show, our proposal would only require a space of 54' with only 32' of it paved,
while the past recommendation is for V of asphalt. Also remember the given amount of land that
is government owned is 64' wide.
Although our ideas are well thought out, there are still some questions we have left
unanswered about the proposed Jamaca Ave. as it turns the corner on it's Northern edge. We have
agreed that this area should reflect the existing road that has already been repaved as in the width
of the road and the shoulders, curbs, etc. We also have expressed concern over the amount of
land that must be used at this comer area. To reduce the loss of land to the adjacent owners, we
would like the paved trail to be moved closer to the roadway, therefore reduce the impact of the
trail to the landowners but still connecting the trail to the existing Posted Bike Path & Sunfish
Park.

Proposal for Jamaca Avenue's Repaving by the Circulation Task Force
We would like to change the current proposal of the redesign of Jamaca Avenue from a
forty foot wide swatch of pavement to a road which incorporates the travel of automobiles, as
well as the movement of people using un-motorized methods of transportation. Given our main
goal to create access from the neighborhoods (or population centers) to the recreation centers
(parks) located throughout the beautiful city of Lake Elmo, we would like to implement a trait
along side of the new Jamaca Ave.
I). Connecting a path from the population centers to the areas of recreation
This paved path would insure a route for un-motorized vehicles and walkers from the
neighborhoods surrounding Lake Jane to Sunfish Park, then from Sunfish Park to Downtown
Lake Elmo (including Lions Park, L.E, Elementary, the VFW Ballfields and the major population
center of our city). The connection of the neighborhoods to Su s P{nk could also be used as a
means of creating an access to the Regional Park from Sunfish. This trait could also provide
future means from the L. Jane area to the Tablyn Park area, as well as connecting the Tablyn Park
area to Sunfish Park,
2).Our Proposal Follows Approved City Plan
This connection also follows a pre -city approved plan (completed by a paid, Planning
Professional) to use Jamaca as a connector route from the south to the northern parts of L.E.
3). Safety
It also creates an access to our parks that is much more safe than traveling the existing roads
