PRESENT: Mottaz, Conlin, John, Johnston, Johnson, City Engineer Bohrer, City Planner Black, City Attorney Filla and Administrator Kueffner. L AGENDA Move 9C to 4B. Add: 4C. School District #622 Bond Referendum notification, 5A(a). Request direction on 1993 Overlay Project, 5E. Update on Olson Lake Estates Pond M/S/C Conlin/Mottaz - to approve the July 6, 1993 city council agenda as amended. (Motion carried 5-0). 2. MINUTES: June 15, 1993 M/S/C Conlin/Johnston - to approve the June 15, 1993 City Council minutes as amended. (Motion carried 5-0). 3. CLAIMS M/S/C Johnston/Johnson - to approve the July 6, 1993 claims #1727 through 41794 as presented. (Motion carried 5-0). 4. PUBLIC INQUIRIES AND PUBLIC INFORMATIONAL A. Comments, questions, and inquiries Jerome Bartel presented a petition signed by residents on Jamaca Avenue N. and the surrounding area from Highway 5 concerning the noise pollution problem from the constant traffic of heavy trucks hauling twelve hours a day from Shafer Contracting Company. The petitioners are requesting the council investigate the possibility of Shafer Contracting using a road to the west of Jamaca Avenue across from the Animal Inn for access to and from the site. M/S/C Mottaz/Johnson - to instruct the code enforcement officer to investigate if Shafer Contracting Co. is operating outside the limits of their CUP, and if so, they should be brought within those limits and to request the city administrator work with the city attorney and Shafer Mining to see if an agreement for an easement for access to Highway 5 could be entered into. (Motion carried 5-0), Gloria Knoblauch expressed concern over the new tractor/mower the city bought at a cost of approx. $40,000. Mayor John defended the purchase and said he was disappointed that the issue was brought up in the newspaper rather than in front of the council. LAKE ELMO CITY COUNCIL MINUTES JULY 6, 1993 Dave Johnson explained that under his term as Mayor a development referred to as the "phantom development" was Lake Elmo's for the taking except for the diddling around for 16 months by the Council and Planning Commission.. The State Farm Headquarters is now planned for Woodbury. Johnson expressed his disappointment in the city, county, school district losing millions in tax revenue. Mayor John and Councilman Johnson pointed out there was no ordinance to cover that particular area of the city for the sort of development that was proposed and every attempt to gain support of this site was made. Lake Elmo was one of three alternate cities to be considered and it was not the fault of the city council or planning commission. B. Request from Cimarron Residents relating to Storm Shelters Jim Anderson, Manager Cimarron Park, explained the storm shelters are usable and the Park is considering keeping the shelters unlocked during the tornado season. The Park Office, Washington County Sheriff Dept., and an employee who lives in the park will have keys. The Park and Washington County Deputies will patrol for vandalism. Regarding the concern that the back storm shelter poses danger since the hill behind it allows easy access, NHD is looking at placing fencing around the roof of the shelter. Anderson will announce in the next Park Newsletter the time, day, scheduled for a mock tornado drill. M/S/C Mottaz/Johnson - to request the city attorney work with NHD, Fire Dept., Civil Defense Dir, and make recommendations for standards to be adopted in our Park ordinance to enforce safety in the accessibility of storm shelters (such as: requirement for access plan, notification to residents, routine patrol to insure the access is available, review by Sheriffs Dept. to make sure they feel there aren't any safety issues). (Motion carried 5-0). 9C. MTC Public Hearing The Council received a letter form Deborah Smith, 265 Cimarron, requesting the city consider interceding in the MTC proceedings to protect a major portion of the city from losing all access to public transportation. The Council strongly encouraged MTC to continue the bus service to Cimarron Park because that is where approximately one-third of the city population lives. M/S/C Conlin/Mottaz - to direct the city administrator to write a letter or attend the public hearing to voice our oppositions to the proposed change to the MTC.. (Motion carried 5-0). C. 4622 Bond Referendum Notification The City Administrator reported she has not received a response from the auditor's office. She did hear from the school district who stated they have never notified the city before even though Lake Elmo is the fourth largest area for children to attend their school. They have promised they would add the city to their list. LAKE ELMO CITY COUNCIL MINUTES JULY 6, 1993 5. CITY ENGINEER'S REPORT A. PUBLIC HEARING: Overlay of Laverne Avenue Mayor John opened up the public hearing at 8:00 p,m, in the city council chambers. Ind. School Dist. #834 was notified of the public hearing. There was no one to speak for or against the proposed street improvement. Mayor. John closed the public hearing at 8:03 p.m. M/S/C Johnson/John - that the council approves the 1993 Overlay Street Projects as listed with the improvements described by the City Engineer and request the staff to prepare a resolution approving the 1993 Overlay Street Projects and ordering the plans for the July 20, 1993 meeting. (Motion carried 5-0). The Council asked the city engineer to report on the condition of the street in Fox Fire Estates at the next meeting. B. Resolution No. 93-44 Plans and Specifications for CSAH 10 The Council received a letter from Larry Bohrer, dated July 2, 1993, indicating he has reviewed the plans for conformity to the concept plans previously approved by the city and recommende concept plans approval of the plans. Councilman Johnson inquired if a landscaping plan was being designed. Don Theisen explained they would provide plantings and trees along the road, but no budget has been set and this would be considered a separate project. M/S/C Mottaz✓Conlin - to approve Resolution No, 93-44, Approving the plans presented to the city by Washington County for Project No. SAP 82-610-04 showing proposed alignment, profiles, grades and cross -sections for the construction, reconstruction for improvement of County State Aid Highway No. 10 within the limits of the City as a State Aid Project based on the recommendation of the City Engineer. (Motion carried 5-0). Council member Conlin requested the parks commission consider black topping a bike trail along this portion of Highway 10 because it would be more economical to blacktop the trails at this time. She also pointed out that a bike path along Highway 10 is planned for in the City's Parks Plan. According to Dick Herold, Washington County Public Works, the surfacing of an 8' wide bicycle trail, estimated at approx. $25,000 within the city limits, can be included in the construction plan. They are willing to work with the city in obtaining possible Federal funds for the surfacing. M/S/C Conlin/Mottaz - to direct the parks commission to consider black topping bike trails on this portion of Highway 10. (Motion carried 5-0), LAKE ELMO CITY COUNCIL MINUTES JULY 6, 1993 Steve DeLapp pointed out that the federal government has $3.3 billion to spend on trails and landscaping on roads and the city should make application. M/S/C Conlin/Mottaz - to direct the city administrator investigate the resources for support of trails and other items as suggested by Steve DeLapp. (Motion carried 5-0). C. Surface Water Management Plan Council member Conlin indicated when budget time comes it is going to be difficult to add money needed for a Surface Water Management Plan. In view of already expending $4,573.91 in preparation of implementing this utility, Conlin was in favor of establishing a utility and process the billing through a new computer program that the auditors have discussed. M/S/F Conlin/John - to reconsider the Surface Water Management as a utility rather than a budget item. (Motion failed 2-3: Johnson:The amount of money expended to collect $10 from each property owner is extremely inappropriate where we could simply budget the money, If the council is unable to do this, then we can establish a utility; Mottaz:Agreed with Councilman Johnson, Johnston: Budget discussions will be starting so it is premature to change course) M/S/C Johnston/Johnson - to direct the city engineer to prepare a work scope for the Surface Water Management Plan, (Motion carried 5-0). (a) Water problems on 50th Street M/S/C John/Johnson - to direct the city engineer to review the options, at a cost not to exceed a $1,000 without authorization from the city council, that would alleviate the possibility of the pond in the Lanes DeMontreville area from overflowing and causing damage to existing homes. (Motion carried 5-0). D. Review suitability of paved shoulder for bike trail on Jamaca Avenue (1993 MSA Project) The Council discussed the suitability of a paved shoulder for bikes along Jamaca Avenue. Suggestions were made by the trail committee for a separate paved bike path instead of the proposed path. Members of the public spoke against a proposed detached trail. M/S/C Mottaz/Conlin - to not consider a detached bicycle trail for Jamaca Avenue at this time so not to further delay the 1993 MSA Project on Jamaca Avenue. (Motion carried 5-0). LAKE ELMO CITY COUNCIL MINUTES JULY G, 1993 E. Update on Olson Lake Estates Pond Larry Bohrer reported that pumping had begun by the VBWD and was directed north across 50th Street to a low lying area. Pumping removed 3' from the pond, but was stopped because there was insufficient outlet from that area north of 50th Street to Long Lake. The pond is now as high as it was before pumping began.. They have worked out the difficulties with the property owner and Corps of Engineers and there is an improved drainage way. Pumping should resume Thursday of this week. 6. OLD BUSINESS The Council set up a workshop meeting for July 14, 1993, 7:00 p.m. to discuss the Joint Powers Agreement Utility Extension Project with the city attorney. 7. CITY ATTORNEY'S REPORT: None 8. CITY COUNCIL REPORTS Mayor John reported that four council members attended the Oakdale Summer festival celebration parade. Councilman Johnson noted that if it was clear that its the Mayor's position and not the Council's position on the MAC situation then he had no problem with the Mayor submitting this letter to the newspaper. Councilman Mottaz referred to correspondence released at the July 22, 1993 meeting to Oakdale under the headline of Lake Elmo City Council Position Statement. He felt sarcastic statements were made which has a negative impact on our effort to improve our relations with City of Oakdale. Mottaz didn't recall the council ever voting on this correspondence so it cannot be a position statement of the City Council. 9. PLANNING, LAND USE AND ZONING A. Comprehensive Plan Amendments (Future Land Use Map) Recommendations from Planning Commission The Council received a memo from Mike Black, dated June 30, 1993, reporting the Planning Commission's recommendation on various amendments to the City's Comprehensive Plan. Bishop/Meehan/Eberhard M/S/C Johnson/John - to direct the staff to prepare a resolution approving the Comprehensive Plan Amendment for the Bishop/Eberhard/Meehan property, changing the future land use designation from RAD to Residential Estate Density (RED), conditional upon submitting this minor amendment to the Metropolitan Council and receiving a determination fro the Metropolitan Council Chair of no system impact. (Motion carried 4-0-1:Mottaz: The City has a contract now with Mr. Bishop for Outlot A). LAKE ELMO CITY COUNCIL MINUTES JULY 6, 1993 Midland Meadows M/S/C Johnson/John - to direct the staff to prepare a resolution approving the Comprehensive Plan Amendment for the Midland Meadows property, changing the future land use designation from SRD to Residential Estate Density (RED), conditional upon submitting this minor amendment to the Metropolitan Council and receiving a determination from the Metropolitan Council Chair of no system impact. (Motion carried 5-0). Goetschel/Klatt M/S/F Johnson/John - to direct the staff to prepare a resolution approving the Comprehensive Plan Amendment for the Goetschel/Klatt property, changing the future land use designation from RAD to Residential Estate Density (RED), conditional upon submitting this minor amendment to the Metropolitan Council and receiving a determination from the Metropolitan Council Chair of no system impact. (Motion failed 3-2: Conlin:not against this property being RE, but would like to look into establishing RE along that border and in the comp plan there is the condition of adjacency, Mottaz:there's a condition of adjacency in the comp plan. There's one comp plan that you can amend, but you cannot make a new comp plan) M/S/C Conlin/Johnson - to direct the Planning Commission to look into the feasibility of establishing the RE border to the eastern edge (Hwy 5 to Hwy 36). (Motion carried 5- 0). Hesse The Planning Commission recommended denial of amending the comp plan Future Land Use Map from RAD to RED for the Hesse property in order to be consistent with the development of the surrounding property. M/S/C John/Johnston - to deny the proposed Comprehensive Plan Amendment for the Hesse property, changing the future land use designation from RAD to Residential Estates Density (RED). (Motion carried 5-0). Boylan The Planning Commission recommended denial of amending the comp plan Future Land Use Map from RAD to RED for the Boylan Property in order to be consistent with the development of the surrounding property and to be consistent with the Planning Commission's previous recommendation on the Hesse property to the north of this property. M/S/C Johnston/Johnson - to deny the proposed Comprehensive Plan Amendment for the Boylan property, changing the future land use designation from RAD to Residential Estates Density (RED). (Motion carried 5-0). Mottaz M/S/C Conlin/Johnston - to direct the staff to prepare a resolution approving the Comprehensive Plan Amendment for the Mottaz property, changing the f ture land use designation from RAD to Residential Estates Density (RED), conditional upon submitting this minor amendment to the Metropolitan Council and receiving a determination from the Metropolitan Council Chair of no system impact. (Motion carried 4-1-0: Mottaz did not participate in the action, but there was a 4/5ths vote of the council necessary for a comprehensive plan amendment.) LAKE ELMO CITY COUNCIL MINUTES JULY 6, 1993 Emerson/Mordick M/S/C Johnson/Johnston - to direct the staff to prepare a resolution approving the Comprehensive Plan Amendment for the Emerson/Mordick property, changing the future land use designation from RAD to Residential Estate Density (RED), conditional upon submitting this minor amendment to the Metropolitan Council and receiving a determination from the Metropolitan Council Chair of no system impact. (Motion carried 5-0). B. Alternate Ag Uses Thomas G. Armstrong, 8281 15th St. N., provided the city attorney a second draft (June 27, 1993) of proposed changes to the Alternative Agricultural Ordinance. Attorney Filla commented that its apparent that the current wording of the Alternate Ag regulations is broad enough to allow almost any kind of use within an Ag zone if you have the appropriate number of acres, properly screened and non-agricultural use. As time goes by, the city may find itself with property owners who want to split off part of their Ag property for other residential uses and have them located next to what remains physically as Alternate Ag development in a way the city wouldn't normally allow under regular planning regulations. There could be pockets of industrial or commercial property located in the center of Ag land that may in the future be zoned something other than agricultural. M/S/C Mottaz/Johnston - to direct the Planning Commission to review the Alternate Ag Regulations and come back to the council with recommendations for changes at their earliest date, and the city attorney will submit his concerns to the PZ. (Motion carried 5-0). 10. CITY ADMINISTRATOR'S REPORT: A. Corporate Credit Card M/S/C Mottaz/Conlin - to approve a credit card, with a $1,000 limit, through the Lake Elmo bank with the authorization of the city administrator's signature.. (Motion carried 5-0), B. Team -Building Session M/S/C Conlin/Mottaz - to table discussion about a Goal Setting Team Building Retreat until the July 20, 1993 council meeting. (Motion carried 5-0). C. Parks Commission Appointments M/S/C Johnston/Johnson - to appoint Karen Leach, 11920 21 st Street N., to serve as second alternate on the Parks Commission. (Motion carried 5-0). MAC Resignation M/S/C Johnson/Johnston - to accept James Palecek resignation from the Maintenance Advisory Committee and direct the staff to send him a letter of appreciation and advertise the vacancies on this committee in the next newsletter. (Motion carried 5-0). F. Resolution No. 93-46:Accepting 1992 Audit and Ordering Transfer of Funds M/S/C John/Johnston - to adopt Resolution No. 93-46 Accepting the 1992 Audit Report and Ordering Transfer of Funds. (Motion carried 5-0). G. Invitation by the MAC Bill Wacker, Chair of the MAC,. invited the council to join them on a tour through Fire Station #1 and #2 on July 26, 1993 at 7 p.m. The staff will send out a meeting agenda. Dear kamt Enclosed is information I recently received concerning an MTC proposed re-route of the.94S bus. This bus currently stops at Cimarron weekdays only, three times in the morning and three times at night. There is no weekend bus service to Cimarron. This is the only source of public transportation available to the residents of Cimarron. As you can see from the enclosed plan, the MTC plans to aliainate rim>,Z=. I know of several residents who rely on this service to commute to work. Eliminating this service is merely promoting unemployment. I will be out of town during the.public hearings and am unable to attend. I am requesting that you please consider interceding in these proceedings to protect a major portion of your constituency from _A losing all access to public transportation.
