PRESENT: Mottaz, Conlin, John, Johnston, Johnson, City Engineer Bohrer, City Attorney Filla and Administrator Kueffner 1. AGENDA Add: OLD BUSINESS: 5G. Recommendation from Parks Commission on Equestrian/Pedestrian Trail, 5H. Review report by Trail Study Group, 6A. Status of MSA Project, 7. Report on Olson Lakes Estates Pond, 10B. Section 32 Update M/S/C Johnson/Johnston - to approve the September 21, 1993 City Council agenda as amended. (Motion carried 5-0). 2. MINUTES: September 7, 1993 M/S/C Johnson/John - to approve the September 7, 1993 city council minutes as amended. (Motion carried 5-0). MINUTES: September 8, 1993 Budget Meeting M/S/C John/Johnston - to approve the September 8, 1993 Budget Meeting minutes as amended. (Motion carried 5-0). 3. CLAIMS M/S/C Johnston/Conlin - to approve the September 21, 1993 claims #1945 through #1972 as presented. (Motion carried 5-0). 4. PUBLIC INFORMATIONAL: A. Old Village --New Village: Mayor John Mayor John presented a concept plan for a Lake Elmo City Center. The aim of the plan is to create a focus for Lake Elmo Village Life, coordinated with the Old Village, which people will find attractive, leisured, and relaxing. John is interested in feedback from residents on whether this is what they would like to see for Lake Elmo. LAKE ELMO CITY COUNCIL MINUTES SEPTEMBER 21, 1993 B. Washington County Comp Plan Jane Harper, Project Manager of the Comprehensive Plan Update project, described the county's process for updating its Comp Plan over the next 18 months. Three sub- committees, Land Use, Transportation, Parks and Open Space, will meet throughout the comp plan process on these issues. If anyone wishes to get more information or participate in the above, they should contact Jane Harper at 430-6011. M/S/C Johnson/John - to amend the agenda to add 4C. Well Testing for Tri-Lakes Area. (Motion carried 5-0). C. Well Testing for Tri-Lakes Area Mary Kay Lang reported 16 wells were tested in a random pattern in the Tri-Lakes area. Of those 16 wells, seven wells failed with high levels of nitrates and coliform bacteria. Five wells were retested and failed again. Washington County has told them to not drink their water. Water testing kits ($25) can be obtained from Washington County. M/S/C Johnson/ Mottaz - to direct the city engineer to review the Washington County test results, location map identifying wells tested, any historical information of when the wells were tested in the past and to concurrently send information to State Health Dept. for investigation. (Motion carried 5-0). 5. OLD BUSINESS: A. Lake Levels (No -Wake) M/S/C Mottaz/Johnson - to table this item and direct the administrative staff to gather technical information from Barr Engineering, TKDA, DNR on what the ramifications are in the terms of flow into the lakes, practical level of lakes, and what is the impact of the levels if they are established. (Motion carried 5-0). B. Surface Water Use Study Group Brenda Taylor, 7945 Hill Trail N., asked that her application be withdrawn, M/S/C Mottaz/Johnston - to appoint the following members to the Surface Water Use Study Group: (Motion carried 5-0). Planning Commission Appointments Mara Metraus, 10550 50th St. N., asked that her name be withdrawn because of other commitments. M/S/C Johnston/Mottaz - to appoint Robert Helwig, 8247 27th St. N., as Second Alternate on the Lake Elmo Planning Commission. (Motion carried 5-0). D. Maintenance Advisory Committee Appointments The City did not receive any letters of interest to serve on this committee. M/S/C Johnston/Mottaz - to readvertize vacancies on the Maintenance Advisory Committee in the City Newsletter. (Motion carried 5-0) E. Heritage Preservation Committee Appointments M/S/C Johnson/ Conlin - to table until the availability of Dorothy Sherburne to serve on the HPC can be confirmed. (Motion carried 5-0). F. Recommendation to County Board for VBWD Appointment. M/S/C Mottaz/John - to direct the staff to send a letter to the Washington County Board in support of J. Peter Zeterberg's appointment to the VBWD and to make an effort to get another resident of Lake Elmo to apply to serve on the VBWD Board. (Motion carried 5-0). G. Recommendation from Parks Commission on Equestrian/Pedestrian Trail M/S/C Mottaz/Conlin - to send a copy of the September 20, 1993 Parks Commission minutes recommending to take no action on improving the equestrian/pedestrian at this time to Tom Soderberg, Genie Arabians. (Motion carried 5-0). H. Update on Trail Task Force Steve DeLapp provided a report of the Lake Elmo Trail Team with recommendations on the location of 24 segments selected for a city trail system and proposed designs for each segment. The system has a total length of 48 miles which includes routes on State, County and City streets and independent routes. DeLapp thanked the council for their support and urged a thorough review of this work. LAKE ELMO CITY COUNCIL. MINUTES SEPTEMBER 21, 1993 6. CITY ENGINEER'S REPORT: A. 1993 MSA Project Update Larry Bohrer reported that all the culverts and storm sewers have been installed and water mains have been relocated. The private utilities have begun moving their facilities. Construction has started on the retaining walls. The pavement on Lake Jane Trail and the northern portion of Jamaca Avenue has been recycled. The completion date of the contract is October 31, 1993. Washington County raised the concern that they would prefer the proposed additional ponding area would not be on the city park property and landfill property along Jamaca Avenue. Even though it isn't an active fill area, the County is concerned there might be some migration of gas. Also, the county has a discharge pipe running through the area that transports water from a gradient control well to the watershed district's pipeline, and they are unsure of the location. M/S/C Mottaz/Johnson - to respect the county's wishes and authorize the city engineer to change the mitigation area to the county's alternative of utilizing a large depression on the former Weldon Richert property. (Motion carried 5-0). With the proposed curb and existing swale on the Eder property, the apple tree area would not drain very well. The alternative is to eliminate the curb and revert this area to a ditch section which will function adequately. M/S/C Mottaz/John - to authorize the city engineer to eliminate the curb that had been planned between the Richert and Eder driveways. (Motion carried 5-0). B. Set date for Assessment Hearings 1993 MSA Project 1993 Overlay Projects M/S/C Mottaz/Johnson - to schedule an -assessment hearing for the 1993 MSA improvements and the 1993 Overlay projects for October 26, 1993 at 7:00 p.m. (Motion carried 5-0). M/S/C Johnson/John - for the purpose of published and mailed notices for the 1993 MSA Improvements and the 1993 Bituminous Overlay Projects, the city engineer is authorized to state that the proposed assessments may be paid at 6% rate of interest over 5 years. (Motion carried 5-0). C. Escrow Reduction for Rolling Hills M/S/C Mottaz/Conlin - to reduce the escrow requirement for Rolling Hills to $170,500.00; conditioned upon the developer submitting evidence of payment to his contractor. (Motion carried 5-0). LADE ELMO CITY COUNCIL MINUTES SEPTEMBER 21, 1993 D. Olson Lake Estates Pond Update There will be a meeting at the DNR headquarters on September 30, 1993 at 9:30 a.m. with the DNR, VBWD, and the cities of Oakdale and Lake Elmo. M/S/C John/Johnston - to instruct the city engineer to obtain samples of water from Olson Lake and Olson Lake Estates Pond to perform normal water quality assessments. (Motion carried 5-0). Jerry Filla provided a report on Discharge to Olson Lake, dated September 21, 1993, indicating what is necessary in order to persuade the court that injunctive relief is appropriate, but needs to gather additional data in order to satisfy those burdens. M/S/C Mottaz/John - to instruct the city engineer to furnish the city attorney any information he might need for litigation. (Motion carried 5-0). M/S/C Conlin/Johnson - to ask the Finance Director to prepare a tabulation of the city costs on the Olson Lakes Project thus far and request the city engineer advise the council on the scope of the work and updates at every council meeting. (Motion carried 5-0). 7. CITY ATTORNEY'S REPORT: 8. CITY COUNCIL REPORTS: No Reports 9. MAC RECOMMENDATION ON LIGHT RESCUE VEHICLE: The cost of the new light rescue vehicle will be approximately $60,985, which is higher than was expected when the call for bids was placed. The 1993 Fire Department's reserve fund contains $49,363 which means the city will have to provide the rest of the money from its 1994 reserve fund which $17,000 is proposed. M/S/C Mottaz/Johnson - to direct the Fire Chief and/or City Administrator to notify General Safety, the apparent low bidder ($60,985), that the city intends to award the contract for the Fire Department's light rescue vehicle, contingent upon receipt of change order reflecting additional items stated in Chief Sachs letter dated September 16, 1993 including changes in price. (Motion carried 4-1:Johnston:concerned about committing future resources that have not been approved. 10. CITY ADMINISTRATOR'S REPORT: A. Team Building:Goal Setting The Council consensus was to not take part in a Team Building:Goal Setting workshop j at a cost of $2,000. LAKE. ELMO CITY COUNCIL MINUTES SEPTEMBER 21, 1993 B. Update on Section 32/33 Administrator Kueffner reported she met with Oakdale Administrator, Craig Waldron, who will have a decision on the joint agreement between the two cities by the end of September. Representative Neary informed the city that annexation legislation will be introduced again, and she will not fight it. M/S/C Mottaz/John - to direct the city attorney to come back with suggestions to ward off legislation and place Lake Elmo in a favorable position. (Motion carried 5-0). Adjourn 7:00 p.m. City Council Meeting Convenes LAKE ELMO CITY COUNCIL WORKSHOP September 21, 1993 Mayor John called the recodification workshop to order at 5:12 p.m. in the city council chambers. PRESENT: Mottaz (arrived 6:05 p.m.), Conlin, John, Johnston, Johnson, and Administrator Kueffner. The Council reviewed Section 200 Administration, Operations and Administration, Pages 200-19 through 200-20. Language needs to be added noting immediate members of the same family shall not serve on the same city board or commission. In Section 205-Elections: Should we list the form of council? is this where the terms of Mayor and City Council should be defined. In Section 210-Planning Commission:210.02 Purpose: The Administrator will check PUD language in the state statutes and the PUD wording in Woodbury Ordinance for insertion. In Section 210.12 Voting: Commission members shall be bound by the same code of ethics that applies to the council in Section 200.06. The Administrator will check for redundancy in the Model versus Lake Elmo's code. There was council consensus on all proposed changes. The council set a recodification workshop for September 28, 1993 at 7:00 p.m. Council adjourned the workshop at 7:00 p.m.
