LAKE ELMO CITY COUNCIL MINUTES
SEPTEMBER 7, 1993
Mayor John called the city council meeting to order at 7:01 p.m. in the city council
chambers. PRESENT: Mottaz, Conlin, John, Johnston, Johnson, City Engineer
Bohrer, Attorney John Miller, Maintenance Foreman Olinger and Administrator
Kueffner.
1. AGENDA
Add: 4B. Clarification request from Sheriff's Dept., 11 C. Resolution for Tax Forfeiture
M/S/C Johnson/Johnston - to approve the September 7, 1993 City Council agenda as
amended. (Motion carried 5-0).
2. MINUTES: August 10, 1993
M/S/C Johnston/Mottaz - to approve the August 10, 1993 City Council Minutes as
amended. (Motion carried 5-0).
MINUTES: August 17, 1993
M/S/C Johnson/Johnston - to approve the August 17, 1993 city council minutes as
amended. (Motion carried 4-0-1:Conlin).
3. CLAIMS
M/S/C Conlin/John -to approve the September 7, 1993 claims #1904 through #1944;
conditioned upon Claim #1912 shows the following breakdown:HP Laserjet IV Printer
$1,350.00, installation $95.00, and tax $87.75. (Motion carried 5-0).
4. PUBLIC INQUIRIES
Ray Boche, 8801 37th St. N., asked if the city engineer could look at his drainage
problem because the water from the land west and northwest drains onto his property
and there's standing water over his septic system and backing into his house. The City
Engineer was directed to review this drainage problem.
Dave Johnson questioned the council about how an unknown Senate File number
could appear in the minutes of a meeting. Mayor John defended the council's actions
and questioned why the matter was brought up when it had no significance on the
actual action of the council.

Tom Prentice, 8151 Hill Trail N., spoke on lake levels and "No Wake Zone" for himself
and Dana Surface who are the owners of the two houses that have the lowest
basement elevations and neither house is in danger in terms of damage to the house.
They are adamantly opposed to a No Wake zone.
M/S/C Johnson/Johnston - to amend the agenda by moving ITEM 7G. to 4B. (Motion
carried 5-0).
7G. Ordinance Declaring "No Wake" when lakes reach OHWM
The Council considered the No Wake rule after residents on Lake Elmo had called
complaining of erosion and property damage due to the wake of the lake. Residents on
Lakes Olson and Demontreville expressed concern over the proposed ruling citing no
need for it on their lakes. A suggestion was made that the newly formed Water Study
Committee look into the No Wake ruling.
M/S/C Mottaz/Johnson - to table action until September 21 st meeting and ask for more
input from residents. (Motion carried 5-0).
4B. Request for Clarification from the Sheriff's Dept.
Captain Johnson, Washington County Sheriff's Dept. questioned whether or not it is the
desire of the city council that the sheriff's dept. initiate a bike patrol in Sunfish Park to
catch the bikers that are riding illegally.
M/S/C Johnson/Conlin - that the council would appreciate more input from the Sheriff's
Dept. as to how best this can be controlled and at what cost and direct the city
administrator write a letter to all PZ and PA commission -members that any request for
increased enforcement be directed to the city and to not represent themselves as a city
official speaking for the City. (Motion carried 5-0).
Captain Johnson would like to know how many council members will be present at the
meeting Wednesday at 3:00 p.m. to discuss the language used in the contract with the
Sheriff's Dept.
Council man Mottaz explained he made this appointment with Sheriff Trudeau, not
Captain Johnson, to discuss issues not all related to the contract. Mottaz thought he
made it clear he was not speaking for the City Council, but as a citizen of Lake Elmo.
He will cancel his meeting with Sheriff Trudeau.

5. OLD BUSINESS:
A. City Engineer -Response to Engineering Costs for 1993 M.S.A.
The Council received a letter from Larry Bohrer dated September 3, 1993 explaining
the engineering fees for the 1993 MSA Improvements. Councilman Johnson stated the
council passed a motion to proceed with this project based on an estimate that TKDA
prepared, but it was 25% low. At that point if the Council had known this, they may
have made a different motion.
Bohrer indicated TKDA will do as efficient job as possible. At the end of the project, he
will provide a recap and the council can evaluate their services at that time.
B. 10th Street & Jasmine Intersection
When Don Theisen, Washington County Engineer, reviewed this street on the
preliminary plat and made an on -site inspection, the street was not staked. There is a
difference of approximately 50 feet from where the County thought the street was going
to go and where it actually is. There is nothing that can be done at this point, but if and
when the road is ever upgraded, the crown in the road can be reduced to alleviate this
problem. In the meantime, they will immediately put up a sign noting "blind
intersection".
Bohrer reported that the site distance is not going to be improved as far as 10th Street
is concerned, however the trees might be an inhibiting feature of the site and will look
into this
M/S/C Mottaz/Conlin - to direct the City Engineer to work with the City Attorney to
prepare an ordinance that would require that all driveway, streets, etc., be staked prior
to submitting for approval by any and all regulatory agencies. (Motion carried 5-0).
C. City Engineer's Update on 509 Plan Revisions
Larry Bohrer provided a Water Quality Data Summary on Long Lake, Olson Lake, and
Olson Lakes Estates Pond. Bohrer attended the workshop held by VBWD regarding
the 509 Plan's proposed revision and addressed comments on the workshop held on
Lake Olson/Lake DeMontreville/Lake Jane.
--There was a well installed on the south side of Lake Olson for the purpose of
maintaining the lake level. Bohrer's concern is maintaining the integrity of the drinking
water supply of a number of municipalities. He questioned whose jurisdiction is the well
under, has the well been turned over to the DNR. The Council's position was the
unused well should be closed and sealed, but would make a motion at the time the
public hearing is held.

--The Brown and Furseth homes on the north side of 50th street are in the flood plain.
The elevation information on these homes will be turned into the VBWD to be
incorporated into the report. When the 509 project was done, there was some money
available for flood proofing. Bohrer will see if there are VBWD funds available because
these two homes continue to have water problems.
--The 100 yr. flood elevation was established for the Olson Lake Estates pond when the
subdivision was approved. The 100 yr. high water level on the pond was established
as 967. The minimum building elevation was established by the VBWD at 968. The
watershed district's definition of minimum building elevation and the City of Oakdale's
definition of minimum building elevation is the same. This means that the lowest floor
shall not be below 968. However, two of the new houses that have been built with
basements below that level. (961.7 and 964.3). It was the potential for getting these
basements wet by seepage that caused the watershed district to initiate this
emergency. It should be pointed out very strongly that actions are being taken based
on elevations that surely could have been avoided. Who was to enforce that these
structures would not been built below the building elevations?
--The incremental increase in the concentration of phosphorus was only 4% . It cannot
be assumed that complete mixing with all the water of Olson Lake occurred.
( --Several VBWD managers pointed out that they have not come to a preferred option at
this time. The city needs to continue to encourage the VBWD to look at other
alternatives as the plan says they are going to.
--If the language is "watered down" too much, they will defeat one of their goals of
revising their plan
M/S/C Johnson/John - to direct the City Engineer to place the city's official comments in
writing to the VBWD. (Motion carried 5-0).
Barb Walsh advised the Council that the VBWD did not get a DNR permit nor a PCA
Chapter 7050 permit to discharge the water into Olson Lake. The Council suggested
the city attorney contact Barb Walsh for names and information she has received from
these agencies.
Barb Walsh also reported that Richard Murray who serves on the Technical Advisory
Committee of the VBWD has never attended one meeting and suggested the Council
write a letter of recommendation to the VBWD recommending Larry Bohrer be
appointed to this committee. The surrounding communities have their city engineer
serve on this committee.

M/S/C Mottaz/John - that the city administrator send a letter to the VBWD requesting
that Richard Murray be replaced by our city engineer to serve on the technical advisory
committee as other cities have done. (Motion carried 5-0),
The Council received a letter from J. Peter Zetterberg indicating his term is going to
expire and expressed his desire to continue to serve on the VBWD. The Council
supported his application to serve as a member on the VBWD.
6. PUBLIC WORKS:
A. Washington County C.I.P.
Dan Olinger, Maintenance Supervisor, reviewed the Washington County Capital
Improvement Program which indicates that work will be done on County Roads in Lake
Elmo and answered questions of the city Council.
B. Update on Public Works' Projects
Dan Olinger gave the Council an update on Maintenance Department activities; such as
starting a gate valve location program in the Old Village, updating files on location of
curb stops, flushed hydrants on the SW-1 water system to correct dirty water complaint
from four residents on the 3700 Block, and mowed the right-of-way twice this year.
Upcoming projects are equipment repairs and maintenance and continue to do street
patching.
The Maintenance Foreman has received a request for a "Slow, Children At Play" sign at
the Intersection of 49th Street and Jerome Avenue. The City Engineer's opinion is that
signs should be reserved to point out special conditions and hazards. If the Council
approves the sign, there should be four signs at the entrances or nothing at all.
M/S/C Johnson/Conlin - to deny request for a "Slow, Children At Play" sign placed at
the Intersection of 49th Street and Jerome Avenue because this is not an unusual
situation in the city, it is a flat street, there is good site distance, and the streets are 32'
wide. (Motion carried 5-0).
C. Chipper Recommendation
Administrator Kueffner asked that this item be postponed for two weeks.
7. PLANNING/LAND USE & ZONING:
A. Zoning Code Amendment (Section 301.040.117.1) and 301.070D.1.b.(6)
to define and allow Recording Studios in AG Zoning District (Continued)
The Planning Commission held a public hearing on this request at its August 8, 1993
meeting and recommended on a 7-0 vote that the code be amended to allow Recording
Studios by Conditional Use Permit in the Agricultural Zoning District.

M/S/C Johnson/John - to adopt Ordinance 8089, as presented, adding Section 301.040
117.1 and Section 301.070 D.1.b.(6) allowing Recording Studios in Ag Zoning District
based upon the 7 acre parcel is less than the 40 acres required in the Ag Zone, the
buildings on site, if left as is, would continue to comply in the Ag Zone, the proposed
use of a recording studio does not change the land or the exterior of the buildings, and
the discharge of the effluent from this facility is less than an equivalent Ag facility.
(Motion carried 4-1: Mottaz: Does not like to see City continue additional allowed uses
in the AG Zoning and turning the AG zone into a General Business zone).
B. Conditional Use Permit for Recording Studio in AG Zoning District
(Continued)
The Planning Commission held a public hearing on this request and recommended on
a 6-1 vote that this Conditional Use Permit be granted if the City is going to allow
recording studios in the AG zoning district.
M/S/C Conlin/John - to adopt Resolution No. 93-65 as presented, granting g a
conditional use permit to Richard Driscoll, Driscoll and Daughters, for recording studio
in AG Zoning District. (Motion carried 4-1:Mottaz: for reasons stated above ).
C. Comprehensive Plan Amendment - Goetschel/Klatt
MS/C John/Conlin - to approve the Comprehensive Plan amendment for the
Goetschel/Klatt property, changing the future land use designation from RAID to RED,
conditioned upon submitting this minor amendment to the Metropolitan Council and
receiving a determination from the Metropolitan Council Chair of no system impact.
(Motion carried 4-1:Mottaz: The adjacency provision of the 1979 Comp Plan still
remains as part of the revised Comp Plan and this amendment violates the 1979 comp
plan).
D. Resolution No. 93-66, Garage Placement -Myron Wendt, 11306 32nd St. N.
M/S/C Johnston/John - to adopt Resolution No. 93-66, A Resolution allowing an
accessory structure to be located between the public road and the principal structure
for Myron Wendt at 11306 32nd St. (Motion carried 5-0).
E. St. Croix Equestrian Center-Cty Rd. 17 & Cty Rd. 10
M/S/C Mottaz/Johnston - to refer the development and maintenance of the
pedestrian/equestrian trail to the Parks Commission for their comments on whether or
not they would recommend to exercise Lake Elmo's options for the easements, would
they consider a Lake Elmo access to the Regional Park and report on the costs and
funding of such a city access and maintenance of those trails, and to send a letter to
the Washington County Parks and Open Space Commission for an update on their
position and what would their requirement be for an access. (Motion carried 5-0).

Tom Soderberg stated he would make a proposal to develop the trail and was willing to
work with the Parks Commission to establish specifications of trail along with the other
property owners.
F. Minor Subdivision:Joni Foster/Wayne Marzolf
At their August 23, 1993 meeting, the Planning Commission recommended approval of
the request of Joni Foster/Wayne Marzolf for a minor subdivision based on the
following findings of fact: 1. The subject land is designated RAD on the City Land Use
Plan Map, 2. The property is zoned Rural Residential (RR), 3. The minimum lot size in
the RR zoning district is 10 acres and 4. No variances are requested.

Granting A Minor Subdivision to Wayne Marzolf and Joni Foster. (Motion carried 5-0).
8. CITY ENGINEER'S REPORT: (covered in 5. OLD BUSINESS)
9. CITY ATTORNEY'S REPORT: None
10. CITY COUNCIL REPORTS:
Council member Conlin provided a letter from George Rouse, Ramsey Washington
Cable Commission member on Redistribution of excess franchise fees to member
communities. Rita will report back to the Council with more information and options.
11. CITY ADMINISTRATOR'S REPORT:
A. Stillwater Sesquicentennial Parade
M/S/C Johnson/John - to direct the staff to confirm with the Sesquicentennial
Committee the Council's desire to participate in Saturday, September 11 parade.
(Motion carried 5-0).
B. Letter from Gazette regarding Sesquicentennial Souvenir Edition
Mayor John will send out a congratulatory letter to the City of Stillwater.
M/S/C Mottaz/Johnson - to decline the offer of placement of a congratulatory letter to
the City of Stillwater at a cost of $179 or $99 in the Sesquicentennial Souvenir Editor of
the Stillwater Gazette. (Motion carried 5.0).

C. Resolution requesting conveyance of certain tax forfeited properties
M/S/C Johnson/Johnston - to adopt Resolution No. 93-68, A Resolution Requesting the
Conveyance of certain Tax Forfeited properties, (Lot 1, Block 1, Ruth's 1st Addition) to
the City of Lake Elmo. (Motion carried 5-0).
M/S/C Mottaz/Conlin - to adjourn the city council meeting at 11:45 p.m. (Motion carried
5-0).

Re: Request for Clarification from Sheriffs Department
Captain Johnson, Washington County Sheriffs Department, called me today on
two issues that he would like clarified.
The first issue is the repeated phone calls his department is receiving from Judy
Blackford requesting that the Sheriffs Department initiate a bike patrol in Sunfish
Park to catch the bikers that are riding illegally. Mrs. Blackford represents
herself as a member of the Lake Elmo Parks Commission. The question from
Captain Johnson is whether or not it is the desire of the City Council to enforce
these code violations to this extent. If it is, that direction should come from the
City.
The second issue is the meeting tomorrow at 3:00 p.m. in his office to discuss
the language in our contract with the Sheriffs Department. He would like to
know how many Council members will be present, and if any other issues will be
discussed. He would like to know this so he can be prepared for the meeting.

Mayor John called the recodification workshop to order at 5:00 p.m. in the city
council chambers. PRESENT: Mottaz, Conlin, John, Johnston, Johnson, and
Administrator Kueffner.
The Council reviewed Section 200 Administration, Operations and
