Home My WebLink About10-26-93 CCMLAKE ELMO CITY COUNCIL MINUTES OCTOBER 26, 1993 Mayor John called the council meeting to order at 7:08 p.m. in the city council chamber. PRESENT: Mottaz, Conlin, John, Johnston, Johnson, City Engineer Bohrer and Administrator Kueffner. 1. AGENDA M/S/C Conlin/Johnson - to approve the October 26, 1993 City Council agenda as presented. (Motion carried 5-0). 1993 MSA IMPROVEMENTS: Mayor John opened up the Public Hearing at 7:10 p.m. in the council chambers. The public hearing notice to pass upon the proposed assessment for the 1993 MSA Improvements, Reconstruction of Jamaca Avenue between TH5 and Lake Jane Trail and Lake Jane Trail between Jamaca Avenue and Jane Road was published in the October 12, 1993 Stillwater Gazette and the Stillwater Gazette Extra on October 13, 1993 and all affected property owners were notified. Larry Bohrer reported the total amount to be assessed is $48,950 which is only about 5 1/2% of what the total project actually costs. The remainder is made up of Municipal State Aid Funds. It is proposed to assess each buildable lot abutting these streets $1,100/1-ot. For the purpose of assessment, a lot is defined as the maximum number of lots which a parcel could be divided into under present zoning. No. of Units: 44 1/2 Total Assessment: $1,100/Unit Mayor John closed the public hearing at 7:15 p.m. Jim Jungmann, 9404 Lake Jane Trail, asked the following questions: When and who is going to take care of the damage done to his property? The brick columns on the west end of his driveway have been tilted because of excavation and the elevation of his driveway needs to be taken care of. He was asked if they could move the power pole back into his property 4'. If he allows this, how are the trimming of his trees going to be handled? Bohrer explained in order to qualify for state aid funds we have to construct the road in accordance to state standards. One of the standards is safety if a car should leave the road. There should not be any fixed objects within 32' of the center line of the road. Bohrer will inquire from NSP if alley arms could be used and will have a NSP representative in charge of tree trimming look at the trees to see if they can be trimmed uniformly. Bohrer will set up a meeting with Mr. Jungmann in order to review these concerns. LAKE ELMO CITY COUNCIL MINUTES OCTOBER 26, 1993 Elizabeth Halden, 8312 Deer Pond Trail, asked if the city would consider white lines on Deer Pond Trail because the line helps define the edge of road for night driving. Bohrer responded there is no plan to add white stripes and striping would be a maintenance item. Nancy Tschumperlin, 9149 Lake Jane Trail, voiced her concern about the bituminous curb matching the blacktop of their driveway. Bohrer has looked at the dirveway and felt the curb match her driveway very well. 1993 BITUMINOUS OVERLAYS: Larry Bohrer reported that annually the City Public Works Department and the City Engineer review the condition of the city streets and report to the City Council the streets which need overlays. Mayor John opened up the Public Hearing at 8:30 p.m. in the council chambers The pubic hearing notice to pass upon the proposed assessment for the 1993 Bituminous Overlays was published in the October 12, 1993 Stillwater Gazette and the Stillwater Gazette Extra on October 13, 1993 and affected property owners were notified. Hidden Bay Area: Assessable Units: 111 Previous Estimate: $922 Assessment Rate*:$710 *Based on actual construction costs The Council received a letter from Grant Nelson, President -Corporation 14, indicating the parcel of property, 37546-2750, is an unbuildable lake access lot located at the end of Birch Bark Trail. This lot is jointly owned in the name of Corporate 14 by approximately 18 lot owners in the Hidden Bay area and they object to the assessment of this lot and request an abatement of the assessment. Administrator Kueffner suggested they go in front of the Board of Review and request this lot to be designated as non -buildable. The Council received a letter from Anton & Donna Johnson, 8405 Deer Pond Trail questioning the need for the overlay because the asphalt road was removed and replaced when the VBWD 1007 project was done in 1987. Bohrer explained during the Watershed project some pipes went through and the road was cut and patched and they were not assessed. The overlay did go over this patch and the road is uniform. Everyone in the neighborhood travels the same roads to get out so he didn't look at what was in front of each house Eleanor Skoog, 8573 Hidden Bay Trail, pointed out a deep rut on the inside of the curve which was made from large vehicles turning that needs to be patched. Bohrer responded that this is one of the hazards when roads are so narrow and he would look into patching the rut. LAKE ELMO CITY COUNCIL MINUTES OCTOBER 2G, 1993 The council received a letter from James Fisher, 8249 Deer Pond Ct N., indicating he ( felt the repair was unneeded and the assessment extensive. 37th Street (West of Jamaca) Assessable Units: 11 Previous Estimate:$827 Assessment Rate*:$715 *Based on actual construction costs. There was no one to speak for or against the street assessment. Kraft Circle Assessable Units:8 Previous Estimate:$751 Assessment Rate*:$596 *Based on actual construction costs The Council received a letter from Ronald Naatz, 3311 Kraft Circle N., indicating he felt the assessment was extreme and did not call this a $751 improvement. Naatz submitted suggestions to help overcome some problems for the next street project. Langley Court Assessable Units:4 Previous Estimate:$975 Assessment Rate*:$650 *Based on actual construction costs There was no one to speak for or against the street assessment. Legion Avenue (20th Street to Legion Lane) Assessable Units:10.5 Previous Estimate:$1,686 Assessment Rate*:$1,536 *Based on actual construction costs John & Mary Leslie, 11546 20th Street, stated they thought the assessment was too high for the benefit derived and should be given consideration for payment of resurfacing of 20th Street. They cannot access off Legion Avenue because of the terrain. Councilman Johnson responded that he thinks the assessment policy is fair Laverne Avenue (TH5 to 39th) Assessable Units:6 Previous Estimate:$2,413 Assessment Rate*:$1,681 *Based on actual construction costs There was no one to speak for or against the street assessment. Pipe installation will likely.begin this week. About three weeks will likely be required to install the pipe and an additional week will be required for restoration of Deer Pond Trail. Schedule can be affected by weather and other factors over which there is little control. Project construction will result in some temporary inconvenience, primarily in the area of vehicle access to your home.
