Adjourn MINUTES APPROVED: 2-1-94 LAKE ELMO CITY COUNCIL MEETING JANUARY 25, 1994 THE JANUARY 18, 1994 CITY COUNCIL MEETING HAD BEEN CANCELED DUE TO WEATHER CONDITIONS AND RESCHEDULED TO JANUARY 25, 1994. . Mayor John called the meeting to order at 7:06 p.m, in the city council chambers. PRESENT: Mottaz, Conlin, John, Johnston, Johnson, City Engineer Bohrer, City Attorney Filla and Administrator Kueffner. 1. Pledge of Allegiance 2. AGENDA ADD: 4. White Hat and Lake Elmo Inn expenses to Claims list, 10A. Response to Stillwater Area Economic Development Corporation, Combine 713 & 6C M/S/C Conlin/Johnson - to approve the January 25, 1994 city council agenda as amended. (Motion carried 5-0). 3. MINUTES: January 4, 1994 M/S/C Conlin/Mottaz - to approve the January 4, 1994 city council minutes as amended. (Motion carried 5-0). M/S/C Mottaz/John - to amend the agenda to include crime prevention presentation by Deputy Kim Carey between agenda items 4 and 5. (Motion carried 5-0). 4. CLAIMS When the city was informed of water contamination, Washington County Health Dept. visited the White Hat restaurant and Lake Elmo Inn and requested disposal of food already prepared and to not use any city water until there was an all clear. The following were bills submitted: Lake Elmo Inn $800.00 and White Hat Restaurant $830.60. M/S/C Johnson/John - to approve the January 25, 1994 claims #2272 through #2344 as presented with additional claim #2345 Lake Elmo Inn $800.00 and claim #2346 White Hat Restaurant $830.60 and direct the staff to submit a claim to the insurance carrier. (Motion carried 5-0). LAKE ELMO CITY COUNCIL MINUTES JANUARY 25, 1994 2 Washington County Deputy, Kim Carey, asked the council's permission to implement a crime prevention program in the city through the Sheriff's Dept.. When a. building permit is applied for, a letter from the Sheriff's office with information from the crime prevention program will be handed out. The letter will explain how the Deputies would be willing to come out during the construction phase and do a home security survey and give suggestions on lighting or placement of windows. If this pilot program works in Lake Elmo and West Lakeland, the Sheriff's Dept. will go county wide with the program. The city council supported the concept and asked that the letter on the program be brought back to the council. 5. PUBLIC INFORMATIONAL A. "No Parking" on Jamaca Avenue N. and Lake Jane Trail Dan Olinger indicated a need to increase the "No Parking" zone on the following streets: on both sides of Lake Jane Trail North, from 250 feet West of Jamaca Avenue to Jane Road North and on both sides of Jamaca Avenue North, 475 feet south of its intersection with Lake Jane Trail, because people are currently parking in these areas and walking across private property to get to the west end of the lake to fish. M/S/C Mottaz/John - to adopt Ordinance 8091, an ordinance amending Section 1001.040G, and adding Section 1002.040J to the 1979 Municipal code of Lake Elmo. (Motion carried 5-0). The present ordinance does not allow an exception to the parking regulations for special circumstances, such as graduations, for parking to be allowed upon issuance of a permit by the city administrator. All the parking regulations should be reviewed and a general statement would have to be added. M/S/C Mottaz/Conlin - to direct the staff to prepare a resolution authorizing temporary (time limit set) on street parking for special circumstances upon issuance of a permit by the city administrator. (Motion carried 5-0). Olinger asked the council to consider installing a full three-way stop at Jamaca and Lake Jane Trailintersection to prevent speeding on the newly reconstructed road in that area. John asked for consideration and public opinion of stop signs on Jane Road N. and Jamaca on the north side of Lake Jane. Councilman Johnson asked that the staff check with MN/DOT to determine if stop signs will improve the situation and request confirmation. These requests will be added to the next council agenda. LAKE ELMO CITY COUNCIL MINUTES JANUARY 25, 1994 B. Oak Wilt Control Plan - Resolution No. 94-1 Mike Bouthilet provided an Oak Wilt Control Program and adoption of this plan is a prerequisite to obtain grant funds for oak wilt suppression. M/S/C Johnson/John - to adopt Resolution No. 94-1, A Resolution Adopting the City of Lake Elmo Oak Wilt Control Plan. (Motion carried 4-1: Mottaz:Trenching is an expensive proposition and has not been determined to be fully effective in controlling oak wilt.) C. Erosion Control - Sunfish Park Mike Bouthilet provided a memo describing erosion control measures that have been taken in Sunfish Park. All areas are to be inspected in Spring of 1994 to evaluate how well the erosion control efforts worked. 6. OLD BUSINESS A. Conditional Use Permit Review (Jim McNamara) Jim McNamara provided a review on the Conditional Use Permits for 1994. Three CUP's, Hammes Mining, Jamie Olson Advertising sign, and Armstrong (exterior storage), were not in compliance with the conditions set in their CUP. Jamie Olson Advertisina Sign: The support structure anticipated a 672 sq.ft. sign surface, but is limited to a 200 sq.ft. surface so the structure is way beyond the sign surface. The city has not pursued that because all of these matters were going through various stages of appeal. The time for appeal expired at the end of December. There is no litigation pending between the city and Jamie Olson. Her permit does indicate that the supporting structure of the sign shall not increase the perimeter of the sign anymore than 2 feet in any direction. The city may request that she reconfigure the supporting structure of the sign. M/S/C Mottaz/Conlin - to direct the staff to send a letter to Jamie Olson stating why she is not in compliance with conditions of CUP, give her reasonable time to correct problem and indicate if it is not corrected in that time, the city's next procedure will be to conduct a public hearing to consider rescinding the permit. (Motion carried 5-0). Armstrong (exterior storaae):Tom Armstrong had indicated to Jim McNamara that at this time the number of vehicles stored on the property are not in compliance with the condition set in the CUP. Hammes Mining: By their own admission, Hammes Mining is mining too close to the property line and a citation has been issued and they go to court on February 16, 1994. LAKE ELMO CITY COUNCIL MINUTES JANUARY 25, 1994 Attorney Filla reported that the Hammes' have been attempting to get together with the city staff and their attorney to talk about changes to the definition of sand/gravel operations to facilitate a recycling operation and have not been able to get a date that is acceptable to the people involved. M/S/C John/Conlin - to direct the staff to send a letter to Tom Armstrong and Hammes Mining stating why they are not in compliance with the conditions set in their CUP, give them reasonable time to correct the problem, and indicate if it is not corrected in that time the city's next procedure will be to conduct a public hearing to consider rescinding the permit. (Motion carried 5-0). B Cable Commission Update Councilman Johnson reported he attended the Cable Commission meeting in the absence of cable representative, Rita Conlin. The existence of the cable commission is up after a 15 year period which comes up in eighteen months. The cities either have to accept the existing joint powers agreement and extend it for another period of time or come up with some other plan. The commission took action on the equipment list and a part of that list was replacement equipment for items stolen from Lake Elmo city hall. This equipment should be received in 30- 45 days. Council member Conlin received a letter from the cable commission asking for comments on their proposed amendments to their by-laws. Conlin and Administrator Kueffner will review the proposed amendments to the cable commission by-laws and offer comments. C. Agreement of Undertaking, Joint Resolution, Joint Powers Agreement - Section 32/33 This was tabled at the January 11th meeting until this council meeting for proper wording to be inserted to resolve some concerns. M/S/ Mottaz/John - that the council sign the letter to the Mayor and city council of Oakdale stating our position M/S/C Johnson/Mottaz - to amend the motion with the following word change made in the Agreement of Undertaking, (Paragraph 3.1.a., 7th line) "...re- allocation of capacity from the Metropolitan Waste Control Commission and approval of the extension of the Municipal Urban Sewer area to include all properties described in this paragraph or a larger area if appropriate." (Motion carried 5-0). LAKE ELMO CITY COUNCIL MINUTES JANUARY 25, 1994 M/S/C Mottaz/John - that the council sign the letter to the Mayor and City council of Oakdale stating our position on Section 32/33 and amend the paragraph in the Agreement of Undertaking as stated above. (Motion carried 5-0). 7. PLANNING/LAND USE & ZONING A. Ordinance 8090 Highway Business - addition of Architectural and Landscape Standards M/S/C Johnson/John - to adopt Ordinance 8090, An Ordinance adding Section 301.070 D.8.e. Minimum Architectural Standards and Section 301.070 D.8,f. Landscaping to the 1979 Lake Elmo Municipal Code. (Motion carried 5-0). B. MUSA Update from City Planner At the January 4, 1994 meeting, the council requested Steve Schwanke to prepare a proposal for resubmitting the city's 440 acre Metropolitan Urban Service area expansion request to the Met Council. The council received Steve Schwanke's recommendation in his letter to the council dated January 13, 1994. The council reviewed the copy of Resolution 94-2 requesting that the legislators introduce legislation that would allow the city to petition for detachment/ annexation of certain land in Section 32/33. The following change was made to Resolution 94-2 (last paragraph should read): BE IT FURTHER RESOLVED THAT: The City of Lake Elmo believes that local issues are best resolved at local levels, and that intervention by the Minnesota State Legislature will set a precedent in this instance and interfere with continued efforts by the City of Lake Elmo and the City of Oakdale to negotiate an amicable resolution of this issue. The following change was made in the DRAFT bill: (line 10 should read) annexation of land presently under the jurisdiction of the City of Oakdale which is M/S/C Johnston/John - to adopt Resolution 94-2, as amended, A Resolution requesting that our legislators introduce legislation that would allow the City of Lake Elmo to petition for detachment/annexation of certain land in Section 32/33 and the attached Bill as amended. (Motion carried 5-0). M/S/C Mottaz/Johnson - to direct the staff to prepare a cover letter for this resolution to go to our two legislative representatives (Laidig and Neary) and tell them this is what we want done, if and when, Oakdale submits similar legislation. (Motion carried 5-0). LAKE ELMO CITY COUNCIL MINUTES JANUARY 25, 1994 8. CITY ENGINEER'S REPORT: A. MPCA - State Disposal Permit for 201 System Larry Bohrer reported that our state disposal system permit which covers our 201 system is now being reissued. He has reviewed a draft of the new permit and there are some areas of concern he would like to discuss with the MPCA staff. Concerns are stated in Bohrer's letter to the council dated January 12, 1994. Bohrer will keep the council informed on these results of the meetings with MPCA. 9. CITY ATTORNEY'S REPORT: No Report 10. CITY COUNCIL REPORTS: Mayor John reported the following: --The survey of the Olson Lakes Estates Pond has been completed and the results will probably be available at the next VBWD meeting. --Last Thursday he and Councilman Mottaz attended the Mn/DOT meeting on plans for Highway 36 and gave an update of the meeting. John suggested a working group be established between Lake Elmo, Grant Township and Pine Springs to develop a working system . The Planning Commission, City Engineer and City Planner should become involved and review possible routes. M/S/C Mottaz/Johnson - at the next council meeting bring material available on Highway 36 reconstruction to the council for. discussion. (Motion carried 5-0). --He was disappointed that the members of the staff were not in attendance at the Volunteer Recognition Party held on January 21, 1994. Whenever possible and when able, he invites all members of the city staff to join him in recognizing the volunteers of Lake Elmo in 1994. --The city has been approached by the Lake Elmo Business Assoc. to consider affiliation with the Stillwater Area Economic Development Corporation (SAEDC). M/S/C Johnson/ John - to invite Lake Elmo Business Assoc. to send a member to the next council meeting to address the benefits of such an affiliation with SAEDC. (Motion carried 5-0). Council member Johnson indicated that the MAC decided to meet on a quarterly basis to develop a better CIP and would not require review of the claims over $200 any longer. LAKE ELMO CITY COUNCIL MINUTES JANUARY 25, 1994 Mayor John suggested MAC meet the first Monday of the month instead of the fourth Monday, which is in conflict with the PZ meeting, in order for members of the Council to attend. Council member Johnston recognized and congratulated the Stock Market Team from Lake Elmo Elementary School on taking first place in the stock market game. M/S/C Johnston/Mottaz - to insert in the city newsletter and send a letter of congratulations to the Stock Market Team from Lake Elmo Elementary School on taking first place in the stock market game. (Motion carried 5-0). You also assured me that the city of Lake Elmo would reimburse me for costs incurred by the water problem. The Washington County Health Department arrived at my restaurant with a notice from the State Health Department specifically stating what procedures I must now follow. It is my understanding that you were also given a copy of this three page notice, The Health Department also said to throw out any foods on hand that were prepared with the contaminated water supply. I had bags of ice and bottled water delivered that day. I also went and picked up cases of canned pop to serve until I was notified that the water supply was o.k. (you estimated about a week). At 2:15 pm on Tuesday December 28, you called me and said "the Health Department found the water test to be o.k." and it was at this time that you notified me that we could resume using the city water supply. The City staff has met with the MPCA to review the 201 and discuss our operating procedures. We have reviewed a draft of the new permit and there are some areas of concern we would like to discuss with the MPCA staff. We are concerned about the following items: The MPCA would like a new monitoring well drilled at Oakland School. This new well would cost about $4,000. We feel that additional monitoring well is not necessary. 2. An increase in the frequency of drainfield inspections. Currently, the drainfields are inspected quarterly. The draft permit requires monthly inspections. This would increase the time the City staff spends on inspections, and in turn, increase sewer bills to our 201 system users. There is really no need to inspect the drainfields monthly, since in 6 years there has been no problem with the drainfields. 3. The frequency and number of ground water tests at Oakland School have been reduced. However, if an additional monitoring well is installed, there will probably be no reduction in cost to the school district. We will be meeting with the MPCA to discuss the new permit. LDB/mha EROSION CONTROL SUNFISH LAKE PARK A Park walk-thru and inspection was done to determine immediate erosion control concerns. The inspection was completed with the following people in attendance: Judy Blackford -Park Commissioner Nancy Hansen -Park Commissioner Conrad Koosmann-Wash Co. Soil and Water Conservation Ted Cardoza-North Star Ski Club Mike Bouthilet-Parks Supervisor Four areas were inspected and evaluated for erosion. There was a general consensus on how to attempt to correct and prevent further erosion in these areas. These areas were not the only erosion problems in the Park, but they did represent common erosion problems throughout the park. Site A- Camel Back Trail south of parking lot: Two additional water bars were installed to intercept r runoff. A diversionary trench was dug to pull the water further off the trail. Site B- Camel Back Trail east of parking lot. Three water bars to intercept water on trail were installed. Fill consisting of a 50/50 black dirt/wood chips was also put in place to replace eroded soil. Site C- Camel Back next hill east of parking lot: Same treatment as site B. Site D- Camel Back at Ernies' Trail intersection: Same treatment as Site B. One additional water Bar was placed on Oak Run. On the recommendation of Conrad Koosmann the water bars were built of 211x6" treated lumber as opposed to 2"x4" lumber that was used on previous water bars installed in the Park. The angle the water bars were installed was also adjusted to facilitate debris removal. All areas are to be inspected in Spring of 1994 to evaluate how well the erosion control efforts worked.
