MINUTES APPROVED: 3-3-94 LAKE ELMO CITY COUNCIL MINUTES FEBRUARY 15, 1994 Mayor John called the city council meeting to order at 7:00 p.m. in the city council chambers. PRESENT: Mottaz, Conlin, John, Johnston, Johnson, City Engineer Bohrer, City Planner Schwanke, City Attorney Filla and Administrator Kueffner. 1. AGENDA Add: 4B. Update by Carol Monette, Community Ed. Rep #622, 6D. Lake Elmo Elementary School, 10C. Stillwater Chamber of Commerce M/S/C Conlin/Johnson - to approve the February 15, 1994 city council agenda as amended. (Motion carried 5-0). 2. MINUTES: February 1, 1994 M/S/C Johnson/Johnston - to approve the February 1, 1994 city council minutes as amended. (Motion carried 5-0). 3. CLAIMS M/S/C Conlin/Johnston - to approve the February 15, 1994 Claims #2387 through #2425 as presented. (Motion carried 5-0). 4. PUBLIC INFORMATIONAL: A. SAEDC (Stillwater Area Economic Development Committee) Jim Kellison, Vice Pres. of SAEDC explained their function is to help encourage industrial/commercial growth in the communities of Lake Elmo, Grant Township, Stillwater Township, Stillwater, Bayport and Oak Park Heights. Don Broeman, Pres. of SAEDC, explained the benefits for a city with affiliation with SAEDC. Information on their work plan will be sent to the council, and Mr. Kellison will keep in contact with the city. B. Stillwater Snowmobile Club Bill David, Snowlord Snowmobile Club, indicated he thought the Lake Elmo snowmobile ordinance is difficult to understand and would be willing to submit changes to update the ordinance. Bill David and Nora Galmeyer will contact the city administrator to discuss ordinance changes, expanded signage, and resolutions of problems, LAKE ELMO CITY COUNCIL MINUTES FEBRUARY 15, 1994 2 C. "Tree City USA" Councilman Johnson (1) Arbor Day Proclamation (2) Resolution No. 94-4, appointing Parks Commission as Tree Board; Parks Department as Tree Department, and Parks Superintendent, Mike Bouthilet as "Tree Inspector". M/S/C Johnson/Conlin - to PROCLAIM April 29, 1994 as Arbor Day and May, 1994 as Arbor Month and to bring back the proclamation for reading at the April 19th city council meeting (Motion carried 5-0). M/S/C Johnson/John - to adopt Resolution. No. 94-4, A Resolution Designating the Lake Elmo Parks Commission as the Lake Elmo Tree Board; the Lake Elmo Parks Department as the Lake Elmo Tree Department, and the Lake Elmo Parks Department's Supervisor, Mike Bouthilet, as Lake Elmo's Tree Inspector. (Motion carried 4-1:Mottaz:Doesn't see a need to expand the Parks Dept., Added tax burden to solve a problem that isn't there.) D. Update from Carol Monette, Community Ed. Rep. School Dist. #622 Carol Monette explained the mission statement of Community Ed and her role as Community Ed rep to represent the views and needs of our city. 5. UNFINISHED BUSINESS: A. Trail Grant Update M/S/C John/Johnston - to direct the city administrator to work with Washington . County and City of Oakdale to collectively apply for the Ice Tea Grant and continue to work on the DNR Grant, if they are both allowable, so that the 10th St. bicycle trail project is cost effective and feasible. (Motion carried 5-0). B. Letter from Sheriff's Dept. Crime Prevention Program M/S/C Johnson/Conlin - to endorse the letter from Sheriff Trudeau dated January 31, 1994 on the crime prevention program with the following recommendations: customize letter for Lake Elmo citizens and indicate there is no charge for service. (Motion carried 5-0). Gary Swanson introduced himself to the council as the assigned sergeant for Lake Elmo and invited questions, problems and concerns to better open lines of communication with the city. LAKE ELMO CITY COUNCIL MINUTES FEBRUARY 15, 1994 C. Response from Rep. Neary regarding proposed legislation. M/S/C Mottaz/Johnson - to authorize the city administrator send a letter to Rep. Neary indicating the council's disappointment she would not sponsor Lake Elmo's legislation and, unfortunately, forcing the city to seek another author, such as Rep. Doug Swenson and/or Rep. Mark Holstein. (Motion carried 5-0). 6. PLANNING/LAND USE & ZONING: A. Resolution No. 94-5 Minor Subdivision for Goetschel/Klatt M/S/C Conlin/John - to adopt Resolution 94-5, A Resolution Granting a Minor Subdivision to Bonita and Donald Klatt and Walter and Gladys Goetschel. (Motion carried 5-0). B. PUBLIC HEARING: Vacation of Utility Easement Lot 2, Block 2, DeMontreville Highlands 6th Addition Mayor John opened up the public hearing at 8:15 p.m. in the city council chambers. The public hearing notice was published in the January 7,1994 Stillwater Gazette and adjacent property owners were notified. There was no one to speak against the vacation. Mayor John closed the public hearing at 8:20 p.m. M/S/C Johnson/Mottaz - to adopt Resolution 94-6, A Resolution for Drainage and Utility Easement Vacation in Lots 1 and 2, Block 2, DeMontreville Highlands 6th Addition. (Motion carried 5-0). C. Highway 5 Overlay M/S/C John/Johnson - to table until the Planning Commission has a full quorum to review the TH 5 Corridor Study by Steve Schwanke and come back to the council with a recommendation. (Motion carried 5-0). D. Lake Elmo Elementary School: Jim McNamara Jim McNamara reported Lake Elmo Elementary School is requesting consideration of waiving fees ($350) for a site and plan review on a proposed 12' x 20' temporary storage structure at a cost of $700 for the Lake Elmo Elementary School. M/S/C Mottaz/John - to waive fees for a site and plan review for a temporary storage structure located at the Lake Elmo Elementary_ School, but to require a site and plan review by the Planning Commission. (Motion carried 5-0.) LAKE ELMO CITY COUNCIL MINUTES FEBRUARY 15, 1994 M/S/C Conlin/Mottaz - to direct the staff to prepare an ordinance allowing the site and building plan review requirement be waived by the zoning administrator for accessory buildings which are estimated not to exceed a certain value. (Motion carried 5-0). 7 CITY ATTORNEY'S REPORT: A, Nuisance, declaration & abatement Attorney Filla reported that Section 1501.060 and 1501.070 provides the city ability to declare the site a nuisance for a number of reasons and requires the property owner abate the nuisance within a certain amount of time. If he fails to do so or is unable to do so, the city would undertake the abatement procedures and special assess the cost against the property. M/S/C Johnson/John - to declare the site in the area on 36th Street and Jamaca Avenue a nuisance for a number of reasons and require the property owner abate the nuisance within a certain amount of time and direct the city attorney to prepare the appropriate resolution for council approval. (Motion carried 5-0). 8. CITY ENGINEER'S REPORT: A. Water Tower Update Larry Bohrer reported that all of the steel work will be completed by Wednesday, and the tank will be disinfected and go back into service this weekend. According to the Finance Director preliminary indications are that the insurance will cover the repair. It took approx. 116 man-hours to remove all the ice in the tank and will cost approx. $10,000. B. Stop signs at Jamaca & Lake Jane Trail, and Jane Road & Jamaca Avenue M/S/C Mottaz/Conlin - to direct the Maintenance Dept. to proceed with the installation of stop signs and stop ahead signs at all three legs of Lake Jane Trail and Jamaca and Jamaca Avenue and Jane Road and any vegetation which limits sight should be removed. (Motion carried 5-0). C. Erosion Control Standards M/S/C Mottaz/John - to adopt Ordinance 8092, An Ordinance adding Sections 502.160, 502.166 and 502.170 relating to erosion control to the Lake Elmo Municipal Code. (Motion carried 5-0). LAKE ELMO CITY COUNCIL MINUTES FEBRUARY 15, 1994 D. MPCA Permit:201 Septic Systems M/S/C Mottaz/ Johnston - to instruct the City Engineer to continue discussion with the MPCA on their condition of an additional monitoring well for the Oakland Jr. High School for permit renewal for the 201 septic system projects. (Motion carried 5-0), E. Letter from Grace Colisimo dated January 22, 1994 Bohrer explained that for a public project the financial security is provided through a developer's agreement which provides for the engineer to make an estimate of the cost of the improvements. The ordinance requires 125% of that estimated amount to be deposited with the city in the form of a cash escrow or letter of credit. The road has to be built to city standards and if something goes differently than what is estimated now, the city is adequately protected. The letter from Grace Colisimo objects to the estimated project cost of approx $30,000, particularly the engineering and legal fees. M/S/C Mottaz/Johnson - to direct the city administrator send a letter, with the input of the city engineer, to Grace Colisimo notifying her what recourse she has. (Motion carried 5-0). 9. CITY COUNCIL REPORTS: Lake Elmo City Center Concept: Mayor John updated the council on the February 8th Town Meeting where he presented the concept plan for a Lake Elmo City Center. John suggested setting up a time for holding a charette which is a series of meetings where all the issues surrounding such a development can be aired. Council members Conlin and Johnson supported further discussion on the concept. Councilman Mottaz supported the senior citizen housing, but does not support the entire project. John will make a presentation on the city center concept at the next Planning Commission meeting. Highway 36 Intersections: Mayor John reported the proposed intersections on Highway 36 were reviewed at the Washington County Public Works Department. The diagrams of the various interchanges that he had shown at the last council meeting were discussed. John presented revised sketches of the interchanges'which reflect current thinking. This does not mean that the ideas are totally acceptable by MnDOT, but at least they have been agreed to by Pine Springs and Grant Township. LAKE ELMO CITY COUNCIL MINUTES FEBRUARY 15, 1994 Cable Commission Council member Conlin reported that at the last cable meeting she received a report which included amendments to the joint powers agreement. She will give a report at another meeting on what ramifications, if any, on these changes. Lake Elmo will receive $3,000-$4,000 out of the $84,000 that is considered excess money that the cable commission figured for their budget this year. This share is according to the number of subscribers and can be used at the city's discretion. 10. CITY ADMINISTRATOR'S REPORT: A. League of Minnesota Cities Goals & Policies The council strongly supported the League's stand on annexation and was interested in Water Treatment, Water Conservation and Preservation, and Open Meetings and Data Practices. B. Set date for Recodification Workshops The Council set the following dates for recodification workshops: February 22, March 8 and 22, 6-9 p.m. in the city council chambers. C. Stillwater Area Chamber of Commerce The city received a letter from Chris White, Exec Vice Pres., regarding a meeting at the Washington County Government Center from 8 -10 a.m, on Friday, February 25, 1994 to discuss a total reform of the state's property tax system.. M/S/C Conlin/Johnson - to adjourn the council meeting at 10:35 p.m. (Motion carried 5-0). However, your trail proposal stops short of connecting up with Lake Elmo Park. There appears to be one and a half mile gap that would require trail users to travel along the road shoulders. As we have discussed, I would like you to consider the possibility of amending your proposal to extend easterly along Tenth Street to the entrance into Lake Elmo Regional Park. It appears from our discussion with Don Theisen, Washington County Public Works, that they would lend their support for such a project. The major obstacle to construction appears to be wetland mitigation necessary at Goose Lake along the road. I believe that the purposes of the Cooperative Trail Grant Program would be better served by challenging your community and Washington County to extend the project with our financial cooperation, than to fund a vastly inferior proposal at a lesser amount. Based upon your earlier request of $10,752.00, the Cooperative Trail Grant Program could contribute another $39,248.00 to the total cost of the project (at a 50 percent reimbursement rate). It is my understanding that you will officially notify me of your community's decision in this regard by February 14, 1994. 1 would expect that your decision in part would be based on a preliminary feasibility discussion on Goose Lake wetland mitigation between Washington County and the Department of Natural Resources, Division of Waters. (Please see the attached maps 1 and 2)e. This new LB designation is to be similar,in.nature as the LB - designation along.I-94. The three votes against the 'action were related to insufficient time to fully evaluate the land use issues and impacts associated with the action. 'At the same meeting, the Planning Commission voted 9-0 to have: the City Planner review the above action of the Planning Commission and prepare a written report for the City Councils review. The following is the report requested by the Planning Commission.. ANALYSIS The Planning Commission's discussion of land use issues along TH 5 was based on recent developments in the legal action taken by Joe Rogers against the City of Lake Elmo. Mr. Rogers has indicated a willingness to accept some form of commercial land use. The City's legal representative.in .this matter.(League of Minnesota Cities) has. found it difficult to find expert witnesses supporting a low density residential land use for the Rogers property. The Rogers litigation is currently inactive. ,( As a result of these events, the City of Lake Elmo Planning Commission reconsidered whether the land along TH 5 should be . Civil Engineering . The Planning Commission's action on December 13, 1993 related only to a triangular parcel of :land bordered by TH 5, CR 13, and the railroad tracks. Upon review of this matter, it is recommended that the City of Lake Elmo undertake a corridor study to address the issues raised as part of the Joe Rogers lawsuit and to evaluate the potential for alternative residential and commercial land uses in this part of the City. The following is a general outline for such a study. The purpose of this outline is only to provide the City Council with a reasonable understanding of what a corridor study may entail. Purpose for the TH 5 corridor study 1. To analyze whether (and the types of) residential, commercial or highway related land uses may be planned and allowed in the project area. 2. To provide policy and planning guidance to the City Council regarding land use and development issues in the project area. 3: To provide a.mechanism for public input regarding land use decisions in this part of the City. 4. To create.a decisionmaking framework, if it becomes . necessary, for the City Council to amend the comprehensive plan and zoning ordinance, provide for related engineering studies, and facility financing methods. II. Time frame for the corridor study 1.: It is anticipated that the study area could be complete by July, 1994. 2. The time frame for the study area would be from 1994 to the year 2000. This is consistent with the time frame for the City's comprehensive plan. MEMORANDUM City Council February 8, 1994 Page 3 III. Study area boundaries (see attached map 3) 1. The study is proposed to be as follows: Ideal Avenue\CR 13 on the west; Stillwater Blvd\CR 6 on the south; Jamaca Avenue on the east; northern line generally follows the northern boundary of Section 16, between Jamaca Avenue and Ideal Avenue. .2. The size of this study area is larger than the triangular piece of property considered by the Planning Commission. The reason for this larger project area is to incorporate existing land uses, plan for development along TH 5, and construct overall development standards for the project area. The proposed study area is approximately 500 acres. IV. Existing land uses 1. Vacant and farmed land. 2. Developed area includes both commercial and residential _ land uses. 3. Railroad corridor on the south,boundary. V. Future land uses 1. Goals, policies and objectives of the 1990 comprehensive plan for commercial land uses. 2. Type of land uses and zoning standards currently allowed in the City's comprehensive plan. 3.. Potential land uses for the project area other than those allowed in the Village or along I-94. 4. Compatibility of land uses with nearby residential land uses. VI. Development -related impacts 1. Type of sanitary sewer system: on -site septic or central sanitary,sewer. 2. Type of water system: private wells or central water supply.. 3. Fire and police protection. 4. Type and nature of transportation system: limited roadway access along TH 5; frontage and interior ( roadway system; public vs. private improvements. Estimated Cost It is estimated that it will take approximately 1-10 hours to complete the above described tasks. The total estimated cost for completing the TH_ 5 Corridor Study project is $4,700.
