Adjourn MINUTES APPROVT"D:11arch 22, 1994 LAKE ELMO CITY COUNCIL MINUTES MARCH 8, 1994 Acting Mayor Johnston called the city council meeting to order at 6:10 p.m. in the city council chambers. PRESENT: Mottaz, Conlin, Johnston, Johnson, City Engineer Bohrer, City Planner Schwanke, Attorney Chuck Dayton and Administrator Kueffner. ABSENT: Mayor John. 1. AGENDA Add: 3A. Update on Legislative Hearing, 3B. Afton City Officials to be reimbursed for legal fees. M/S/C Conlin/Johnson - to approve the March 8, 1994 city council agenda as amended. (Motion carried 4-0). 2. MINUTES: February 22, 1994 M/S/C Conlin/Johnson - to approve the February 22, 1994 city council minutes as presented. (Motion carried 4-0). 3. Discuss the Olson Lake Pond Survey with Attorney Chuck Dayton and City Engineer, Larry Bohrer Larry Bohrer submitted a memo dated March 8, 1994 indicating he has made a calculation of the volume of Olson Lake Estates pond represented in the "as - approved" plan and compared it to the "as -constructed" plan as prepared by the DNR. Pond volume below the outlet elevation is considered "dead" storage. It is this volume which is most beneficial for water quality improvement. We find that the dead storage as constructed exceeds the dead storage provided by the approved plan by 13%. Attorney Dayton stated that the size of the pond is only one of the issues. The real question is what is the quality of water being transferred from this pond into Olson Lake and what the affect of this water will have on the quality of Olson Lake. The water is stormwater runoff from urban area that is going to have nutrients and phosphorus. A water quality analyst from PCA suggested alum treatments of the water in the pond which had been used in Lake Vadnais and Loon Lake. Bohrer reported the following elevations: 952 constructed runout elevation 965.9 100 yr. High Water level 966.9 VBWD Minimum Building LAKE ELMO CITY COUNCIL MINUTES MARCH 8, 1994 2 VBWD recommended 966.9 as the minimum established building elevation to the city of Oakdale. Oakdale accepted this, but it was not enforced. Therefore, there are at least two homes that were built below this 966.9 elevation. M/S/C Mottaz/Johnson - that the.city will not voluntarily accept the discharge of water into Olson Lake which will'degrade the quality of water in Olson Lake. (Motion carried 4-0). M/S/C Johnson/Mottaz - to authorize Chuck Dayton, Leonard, Street and Deinard, to attend the DNR meeting on Friday, March 11, at a cost not to exceed $1,000. (Motion carried 4-0). Letter to MWCC At the March 3rd meeting, the council directed Larry Bohrer to draft a letter to the Metro Council•and'the MWCC objecting to the projected sewer flows and lack of interceptor for Lake Elmo. M/S/C Mottaz/Conlin - to submit the draft letter, signed by the City Administrator, to. the MWCC with copies to Craig Morris and Jack Frost. (Motion carried 4-0). Update on Legislative Hearing Councilman Johnson reported House File 1828, as introduced by Walt Perlt, to allow Oakdale to petition independently to annex properties currently owned by MnDOT that are within the jurisdiction of lake Elmo was defeated today by a vote of 11-9 in the House Committee on Local Government Affairs. The Acting Mayor, City Administrator, and City Attorney did a fine job of presenting the opposition case. Afton City Officials Court Case:Officials to be reimbursed for legal fees M/S/C Johnson/Conlin - to direct the City Attorney to investigate this and report to the council as to our chances of getting insurance money for fees that we paid out in the case of a similar charge of former councilman Lee Hunt and the City of Lake Elmo. (Motion carried 4-0). 4. Recodification of Lake Elmo Municipal Code Steve Schwanke reported that his experience has been that most city councils and advisory commissions establish an advisory body or have the staff go through what has been revised and then bring it to the policy making body for the broader policy issues and hold the public hearing. The concern he has it can take so long that the recodification review may die before the document can be completed. LAKE ELMO CITY COUNCIL MINUTES MARCH 8, 1994 At the February 28th meeting, the Planning Commission tabled further review of the recodification until they receive more detailed direction the City Council or City Administrator. M/S/C Conlin/Johnson - to direct the Planning Commission to establish a sub committee of three PZ members that would work with Steve Schwanke to set up an aggressive schedule to accomplish completion of Sections 300 and 400 in one month and report back to the council within one month on their progress and to request the planner meet with the city administrator to discuss revision of his contract for him to work with the Commission. (Motion carried 4-0). Section 540 - Uniform Naming and Numbering System• The following questions were asked of the Building Official: Section 540.01: What is the map they are referring to that is adopted and made a part of this section? Section 540.02: Does this commit the city to change the exceptions; such as Jackpine Trail, Cherrywood Trail, etc.? Section 540.03, Subd. 1, What is Section 405 they are referring to? Section 545-Manufactured Home Park, Subd.1 What is the definition of "body feet'? Who is the secretary that the manufacturer files a certification with. Subd. 8 Utility Building: What does this refer to? The Council accepted the proposed changes through Subd. 13 Open Space.
