Mayor John called the council meeting to order at 8:00 p.m. in the council chambers. PRESENT: Mottaz, Conlin, John, Johnston, Johnson, City Attorney Filla and Administrator Kueffner. 1. AGENDA ADD: 6A. Revised Ordinance on Fences, 5B. Petition in Intervention of DNR Permit No. 94-6193, 5C. Surface Water Ordinance 10B. Request from Bonestroo Engineering regarding Cottage Grove Ravine Watershed. M/S/C Johnston/John - to approve the May 17, 1994 council agenda as amended. (Motion carried 5-0). 2. MINUTES: April 27, 1994 M/S/C Johnson/Conlin - to approve the April 27, 1994 council minutes as amended. (Motion carried 5-0). MINUTES: May 3, 1994 M/S/C Johnston/Johnson - to approve the May 3, 1994 council minutes as amended. (Motion carried 5-0). 3. CLAIMS A request was made for separated accounts for civil attorney charges versus criminal attorney charges. M/S/C Johnston/Conlin - to approve the Claims #2649 through #2692 as presented, including Claim #2627. (Motion carried 5-0). LAKE ELMO CITY COUNCIL MINUTES MAY 17, 1994 4. PUBLIC INQUIRIES/PUBLIC INFORMATIONAL: A. Legislative Update, Rep.Pam Neary Rep. Pam Neary updated the council on the 1994 legislative session and several laws and impending issues for next year that will affect cities; such as local government aid, annexation, TIF, and landfill cleanup. 5. UNFINISHED BUSINESS: A. Council comments on Heritage Preservation Ordinance Councilman Johnson was uncomfortable giving an appointed commission the power to make decisions in the city. By approving this ordinance, the HPC could approve or deny permits. Johnson suggested meeting with the Heritage Preservation Committee and the city attorney to talk about this. He requested the city administrator investigate what other cities have done. Mayor John liked the idea of the HPC for Lake Elmo, but agreed with Councilman Johnson that decisions on what action to take is the council's job. The Council suggested meeting with the HPC at the June 7 council meeting to discuss this delegation of authority. B. Olson Lake Pond Administrator Kueffner submitted memo to council indicating confusion on the part of the DNR and VBWD on the Motion to Intervene filed by Attorney Dayton. M/S/C John/Johnson - to instruct the city administrator to contact Attorney Dayton to correct his Intervention to clarify that what we intended was a discharge down to 952 after having had the pond treated with alum to bring down the phosphorus levels to acceptable limits, about .031 to .041 mg/per liter. (Motion carried 5-0). Barb Walsh explained she had talked to Molly Shodeen, who did not give a permit for discharge. The permit was given for the pipe in place. The discharge is done by VBWD. DNR Fish and Wildlife gave a permit to treat the pond with alum and as a condition of that permit there was specific testing stipulations outlined. There will be a meeting to discuss Olson Lake Estates Pond on June 7, 5 p.m., Washington County Board of Commissioners. LAKE ELMO CITY COUNCIL MINUTES MAY 17, 1994 3 C. Surface Water Ordinance The Council received a copy of the Surface Water Use Ordinance which includes the recodified version from the League and the version that was prepared by the Surface Water Committee. M/S/C John/Mottaz- to schedule a meeting on June 1, 1994, 7-8:30 p.m., to review the Surface Water Ordinance jointly with the Surface Water Committee. (Motion carried 5-0). 6. PLANNING/LAND USE & ZONING: A. Ordinance 8096 Adopting Recodification Fence Ordinance At the last meeting, the council suggested Mr. Conrad, the resident who would like to construct a fence in his front yard to replace the lilac bushes that were lost during the Jamaca Avenue reconstruction, apply for a variance so that the proposed fence could exceed the four foot height limitation. In preparing for Mr. Conrad's public hearing, it was discovered there is no provision in the "Fence" section of the code for variances. This provision was added to Ordinance 8096 adopting the Recodified Fence Ordinance. Once this ordinance is adopted and published, Mr. Conrad can apply for a variance. M/S/C John/Conlin - to adopt Ordinance fences of the Lake Elmo Municipal Code carried 5-0). 8096 adopting Section 1425 relating to and repealing Section 1505. (Motion M/S/C Johnson/Johnston - to adopt summary of Ordinance 8096 relating to fences. (Motion carried 5-0). B. Resolution No. 94-15, Amending Resolution 87-33 relating to Lake Elmo Heights 2nd Addition M/S/ Johnson/John - to adopt Resolution No. 94-15 amending Resolution 87-33 M/S/C John/Johnston - to table resolution until city administrator returns with clarification of 440 versus 464 acres. (Motion carried 5-0). M/S/C Mottaz/Johnson - to take the motion off the table. (Motion carried 5-0). M/S/C Johnson/John - to amend the motion to include the change of acreage from 440 to 464 acres. (Motion carried 4-1: Mottaz:we should be consistent with the previous council's opinion and not remove Condition #6). LAKE ELMO CITY COUNCIL MINUTES MAY 17, 1994 M/S/C Johnson/John - to adopt Resolution No. 94-15, as amended (change the acreage from 440 to 464 acres), amending Resolution 84-33. (Motion carried 4- 1:Mottaz:Same reason stated before) 7. CITY ENGINEER'S REPORT: A. Cost estimate for expansion of city hall parking lot The Council received a report from Larry Bohrer, dated May 13, 1994, explaining the city hall parking lot could be expanded to the west creating 36 additional parking spaces. This would increase the total city hall parking to 56 plus 2 handicap stalls. The estimated total cost is $13,070.00. This letter was also sent to School District 834 for their response. 8. CITY ATTORNEY'S REPORT: None 9. CITY COUNCIL REPORTS: Mayor John reported on the May 12 meeting regarding the traffic signal project at Manning Avenue (CSAH 15) and TH 36. The agreement calls for the County to perform the painting, cleaning and relamping and for the City to pay one - quarter of the electricity costs ($30/month). Grant, Stillwater and Baytown Township will also pay one -quarter of the electricity costs. The County will bill each municipality yearly. Mayor John presented the concept plan on the city center to the School Board Members of 834. They were supportive of the concept, but as the plan develops, the need for space around the Lake Elmo Elementary school should be recognized. Council member Conlin reported on the cable commission meeting where any amendments to the joint powers agreement were tabled. A committee got together to look at the franchise renewal and decided to have a committee of the cities, consisting of the city administrators, to set parameters for a new franchise. Councilman Johnson reported members of the Lake Elmo Jaycees and Parks Commission planted 16 large trees that the Jaycees contributed in five parks around play ground areas to provide shade In the future. On Thursday, 32 children from Sandy Fisk's' 3rd grade class and 10 parents planted 250 small seedlings in Sunfish Park. On the last day of school, this class will return to water the trees. Councilman Mottaz submitted a letter from Attorney Filla, dated April 22, 1994, addressing the question of front yard designation and shoreland regulations. LAKE ELMO CITY COUNCIL MINUTES MAY 17, 1994 10. CITY ADMINISTRATOR'S REPORT: A. City Planner M/S/C Mottaz/John - to accept the recommendation from the city administrator and take no action at this time, but to seriously discuss hiring a full-time planner at budget time. (Motion carried 5-0). Councilman Johnson suggested the MAC look at possible expansion of City Hall for more office and storage space. B. Request from Bonestroo Engineering regarding Cottage Grove Ravine Watershed Dan Edgerton, Bonestroo Engineering (the Cottage Grove Ravine Watershed Engineering firm) suggested a one -hour workshop prior to a council meeting. The workshop would be between the Cottage Grove Ravine Board of Managers and the City Council. The purpose is to meet each other, discuss concerns we have, discuss what we expect of the Board, and any other questions. The Council scheduled a one -hour workshop for June 21 st at 6 p.m. M/S/C Conlin/Mottaz - to adjourn the meeting at 10:40 p.m. (Motion carried 5-0). The additional parking is necessary for special events or sports events. An inquiry was made if the City Hall parking lot could be expanded to the west. The matter was referred to the City Engineer. There appears to be about 120 feet from the west edge of the existing parking lot to the east edge of the drainage easement along the west lot line. This is sufficient room to construct four (4) rows of 18-foot wide parking stalls and two (2) aisles 24 feet wide. 36 Additional parking spaces would be created. This would increase the total City Hall parking to 56 plus 2 handicap stalls. Additional ponding would not have to be created for this additional impervious surface. The Brookman Addition pond was constructed to accommodate an overall impervious coverage of 67%. Even with this parking lot expansion, the City Hall lot will still have more than 33% green area. The anticipated construction would consist of removal of about the top one foot to remove the topsoil, about 6 inches of sand fill to level the area, 6 inches of gravel base, and 2 inches of bituminous surfacing. We just became aware that the School District may also want a bituminous walking path from the parking lot to the school. We do not have a current site plan of the school, especially with the temporary classrooms, so I cannot estimate the length of path that would be needed. The reasons for these requests is as follows: -There are no sidewalks or shoulders on 32nd Street North for pedestrians. -There is a speeding problem. -32nd Street North is narrow. -Cars are using it as a bypass from Lake Elmo Avenue North to Highway 5. (C) Hazardous Elimination Safety Program - Sign Inventory The City Engineer and Maintenance Foreman felt it was in the city's best interest to have all traffic signs meet the current standards and supported the Hazardous Elimination Safety Program Sign Inventory. M/S/C Johnson/Mottaz - to direct the City Administrator to authorize Washington County to secure bids for the Hazardous Elimination Safety Program and recommend SLOW CHILDREN signs replace WATCH FOR CHILDREN signs with the understanding that the City of Lake Elmo will have the opportunity to accept or reject participation in the program once a final cost is determined. (Motion carried 5-0). (D) Olson Lake Estates Pond - Update Larry Bohrer reported that the DNR asked the developer of Olson Lake Estates to fund an independent survey of the Olson Lake Estates pond and the developer has agreed to pay for that survey. Based on that survey we will be able to determine if any corrective measures need to be done on the pond. Bohrer pointed out range of values (3 & 9 times as concentrated) seen in the tests that the MPCA took in August on Olson Lake Pond as compared to Olson Lake. 9. CITY ATTORNEY'S REPORT: None 10. CITY COUNCIL REPORTS (A) Mayor John: Letter from Sheriff Trudeau Mayor John received a letter from Sheriff Trudeau, dated October 8, 1993, where he indicates that the Washington County Sheriffs office has increased the number of arrests made for persons responsible for burglarizing private homes. The Sheriff is asking residents to contact their office by dialing 911 when any suspicious incident occurs. The Sheriff Dept. would like to see more Neighborhood Watch Programs in place. Ponding The site has an existing detention pond which was built with the 1986 addition. To the best of our knowledge, turf was never established in the pond. Erosion and excessive weed growth have occurred as a result of a lack of ground cover. The proposed addition will require an additional .11 Ac.-Ft, of dead storage in the pond. This additional storage can be accommodated by regrading the pond, and cleaning out the bottom to a 990 elevation, 3:1 side slopes should be maintained on the pond, Topsoil should be spread on the side slopes of the pond, and turf established as pan of this project. LDB/mha Memo To: Mayor and City Council From: Mary Kueffner Date: May 15, 1994 i Subject: Petition in Intervention of DNR Permit No 94-6193 At a special meeting with Chuck Dayton on April 27, 1994, the council unanimously directed Mr. Dayton "to intervene by filing a verified pleading under the Minnesota Environmental Rights Act". Mr. Dayton has done that, and I believe you were all supplied with a copy of that petition. The DNR and VBWD have received this notice and are very confused. OLE Pond has been treated with alum, in preparation of a "spring time draw down", which they understood was the desire of the City of Lake Elmo. You have been provided results of the phosphorus testing that has been done to date. Samples were taken again last Friday (prior to the Saturday rainfall) and it will be retesting after OLE Pond has been discharge. Where things have got confused is that the Motion to Intervene will prevent the discharge that we anticipated would occur after the alum treatment. I don't believe that was your intention: I thought the intention was that if OLE Pond was treated, and the water would not be any worse than Olson lake, we would allow the Pond to be discharged, and to -function as designed for one year. And, in the meantime, VBWD would be going through their Plan Amendment and addressing the issues the City has raised, time and time again (alternate routes for discharge, moving the inlet and outlet pipes, permanent treatment of the Pond, etc.) Memo To: Mayor and City Council From: Mary Kueffner Date: May 15, 1994 Subject: Surface Water Ordinance Attached is the Surface Water Use ordinance. I have shown where each line item originated: i.e.; City Code amended by League or the Water Surface Committee, or a combination of both. The minutes reflect that we were supposed to have a public meeting/hearing tonight, but that did not get called because you have not had a chance to review this document. I think the Council could look.this ordinance over, decide if it wants to go to public hearing with the entire document, or make revisions prior to the hearing. We.will have to have something to give to residents that request copies, which they will do after the notice is published. This workshop would be between the Cottage Grove Ravine Board of Managers and the City Council. The purpose is to meet each other, discuss concerns we have, discuss what we expect of the Board, and any other question you may have. We also appreciate the City's cooperation in this important safety improvement project. Enclosed is the maintenance agreement between the City of Lake Elmo and Washington County. The agreement calls for the County to perform the painting, cleaning and relamping and for the City to pay one -quarter (1/4) of the electricity costs. Grant, Stillwater and Baytown Township will also pay one -quarter (1/4) of the electricity costs. The County will bill each municipality yearly. Please have your City Council execute the enclosed agreement and return to the County for our signatures. If you have any additional questions regarding this issue, please call me at 430-4330. President Zetterberg opened the meeting by announcing that as of May 3, the pond level was at Elevation 962.3. Also, that the level of Long Lake was up 31 inches from the previous week. They had had a response from PCA and BWSR stating that it would.be best if OLE Pond could be brought back to its correct level. Because of recent rains, and the liklihood of more, it was likely that they would have to discharge the pond water before June, to protect property. At the last meeting the managers voted to test the pond, and depending on the result, debate the need for a one time alum treatment of the pond water. ( Since the previous meeting, President Zetterberg had worked with Barr Engineering. The company used by the PCA for alum treatment happened to be available on May 6 and 7, but not again for about a month. The VBWD. would need a permit for the alum treatment from the DNR and for the discharge. He had had verbal agreement that following submittal of a permit request, the discharge could take place and that the permit process could proceed. A letter had been sent to the DNR indicating their intent, and he expected to get a FAX approval from the DNR contingent on completion of testing. These tests related to measuring Ph, turbidity, and phosphorus levels while discharging. Once the pond is treated with alum, it is likely that the DNR (Fish and Biological) would give approval to the discharge. Mr. Brenner wondered whether there was a possibility that the water quality could deteriorate within two days after treatment, so rendering the treatment ineffective. President Zetterberg responded that it would depend on the quality of the inflow water. The costs of the tests and treatments were discussed. Each of the tests on May 4 and May 9 (after potential treatment), would cost $360. The alum application, originally estimated as $4500, assumed the pond would be at Elevation 956. At Elevation 963, the additional storage meant more alum would be needed, increasing the cost to $8,000. Results of the sampling taken on May 4 were then presented. The pond phosphorus levels ranged from 0.125 mg/L near the surface to 0.139 mg/L at 5.6 meters depth. These compared with Olsen Lake total phosphorus of 0,020 to 0.022 mg/L for a similar depth range. Total dissolved phosphorus for Olsen Lake Estates Pond was between .054 and .058 mg/L as against 0.009 mg/L for Olsen Lake. The effect of not treating the water and discharging to Lake Olsen had been discussed (Hal Lunke?) There was a strong possibility of a green algae bloom occurring now in Lake Olsen or a blue green bloom in late summer. Based on a mass balance between the pond and the lake, the phosphorus concentration in Lake Olsen would increase from .020 mg/L to .026. With treatment it would increase from .020 to .021 mg/L. Comparing Secchi disc readings, at 20 mg/L water clarity would be 3.4 meters, at 26 it would be 1.8 meters. There would be no noticeable difference between 20 and 21 mg/L. President Zetterberg then proposed a motion: 1. To go ahead and treat the pond on May 7, and 2. To outlet the pond to Lake Olsen, but at no specific time - sometime during the week of May 9, by which time they hoped to get the temporary easement across Mr. Winkel's property. This was subject of some discussion - on the gain for $8,000 expenditure, the time for which the treatment would be effective, and the precedent to the need for treating other bodies of water as the need arose. The motion was passed 4/1 on a rollcall vote, Mr Moosebruegger voting Against. 4 Questions were raised by local residents, as well as comments to the effect that when the level of 952 was reached, they would expect that the City of Oakdale would correct the erosion and plant the vegetative mitigation. Mayor Bearth indicated that Oakdale's position was that the pond was a VBWD matter, to be resolved by them, as they had agreed to it. Oakdale would comply with whatever they (VBWD) resolved to solve the technical problem. Since we do not have time to discuss every point presented, it ( may seem that decisions are preconceived. However, background information is provided for the City Council on each agenda item in advance from City Staff and appointed Commissions; and decisionsare based on this information and past experiences. In addition, some items may also have been discussed at previous Council meetings.
