PRESENT: Mottaz, Conlin, John, Johnston, Johnson, City Engineer Bohrer, City Attorney Filla and Administrator Kueffner. 1. AGENDA ADD: 7B. Request from School Dist. #834 M/S/C John/Johnston - to approve the May 3, 1994 City Council agenda. (Motion carried 5-0). 2. MINUTES: April 19, 1994 M/S/C John/Conlin - to approve the April 19, 1994 city council minutes as amended. (Motion carried 5-0). 3. CLAIMS M/S/C Mottaz/Johnston - to table Claim #2627 RLK Assoc. Ltd, until the May 17 meeting so the City Administrator can review charges with the city planner. (Motion carried 5-0). M/S/C Conlin/Johnston - to approve the April 19, 1994 Claims #2616 through #2648 as presented; excluding Claim #2627. (Motion carried 5-0). 4. PUBLIC INQUIRIES/PUBLIC INFORMATIONAL: A. Public Inquires Dora Lee, Cimarron Park resident, indicated the Park will not be having a cleanup day; therefore, Cimarron residents will be forced to use Lake Elmo Clean-up Day. She voiced her concern if the city was prepared with dumpsters to handle these additional residents. B. Invitation to D.A.R.E. Graduation at Lake Elmo Elementary School Deputies Osterman and Peterson and Sergeant Swanson appeared before the council to extend a personal invitation to the Council and the public to attend the D.A.R.E. graduation on May 20 at 12 o'clock at the Lake Elmo Elementary School. Heritage Preservation Committee The Council will provide their comments on the Heritage Preservation Commission Ordinance for review by May 17 and then decide when a a public hearing will be called. D. Waiver of Fee for Youth Baseball Team M/S/C Mottaz/John - to waive the $15/night light fee at Lake Elmo Lions Park for the baseball season of the 13 year old Traveling Baseball Team as requested in their letter dated April 27, 1994. (Motion carried 5-0). 5. UNFINISHED BUSINESS: A. Board of Review Mary Leslie, 11546 20th Street N., was not able to make the Board of Review on April 14th. She indicated their property is over assessed because it's being assessed for a porch that doesn't meet code, materials used originally were defective, and they are unable to find a company to complete it. Frank Langer did not have the information to make an assessment and recommended Ms. Leslie appeal to the County Board. M/S/C Mottaz/John - to reduce land value to 1993 market value in Case #14 and correct bldg. value error to $9,000 in case #37. (Motion carried 5-0). M/S/C Johnson/ Mottaz - to accept the Assessor's recommendation as to cases presented to the Board of Review as reviewed, amended (Cases #14, #37) and recommended and to close the Lake Elmo Board of Review. (Motion carried 5- 0). B. Human Rights Committee The Council received a letter from Attorney Filla, dated April 27, 1994, with his comments on Section 3. Organization. M/S/C John/Johnston - to direct the staff to prepare an ordinance establishing a Human Rights Commission using the same format used for other city commissions. (Motion carried 5-0). C. Hammes Sand & Gravel (Letter of 4-19-94) Attorney Filla reported the definition of mining is not broad enough to include recycling. If you change the definition of the mining concept, you should change it in the zoning code and in their Conditional Use permit. The representatives of the property owners have indicated that they would be willing to provide an educational presentation on the recycling operation. The Council is interested in confining recycling of blacktop and concrete to existing mining operations and not opening this to all Ag properties. M/S/ Mottaz/Johnston - to direct the staff to prepare an amendment to the definition of mining to include recycling of blacktop and concrete M/S/C Conlin/John - to amend the motion to include the Planning Commission be directed to address the environmental issues, defined as noise, dust, ground contamination, and address the question whether or not the city would want to support recycling of blacktop and concrete. (Motion carried 4- 1: Mottaz: Asphalt in the non -liquid state is not environmentally damaging. He considers this redundant because environmental issues would be discussed in a public hearing.) Larry Bohrer explained that sometimes mining is considered a temporary use in that the natural resource is processed and hauled out. Once the resource is used up, the land is put to another end use. With recycling, since the raw materials are brought into the site, this essentially could allow the use to go on in perpetuity. M/S/C Mottaz/Johnston - to direct the staff to prepare an amendment to the definition of mining to include recycling of blacktop and concrete for review at a Public Hearing: (Motion carried 4-1:Conlin:Asphalt or blacktop is known to be highly toxic, environmental effects are unknown, how would we enforce standards needed). Attorney Filla stated the city would not approve expansion of this concept unless it was environmentally safe. Filla made it clear to the Hammes' that in addition to a change in the definition of mining, considering environmental impacts, his advise to the council is that they (Hammes) would have to change/amend their CUP sometime during this process. This is not just a zoning code amendment. D. Appointment to M.A.C. M/S/C Johnston/Johnson - to appoint Curtiss (Bud) Talcott, 8051 Hill Trail N., to the MAC Committee. (Motion carried 5-0). LAKE ELMO CITY COUNCIL MINUTES MAY 3, 1994 4 E. Update of VBWD Meeting relating to Olson Lake Estates Pond The Mayor, City Engineer and Special Counsel, Chuck Dayton, attended the April 28, 1994 VBWD District Meeting. Mayor John provided an update on the meeting in his memo dated May 3, 1994. A special VBWD meeting will be held on Thursday, May 5, 6:30 p.m. to discuss Olson Lakes Estates Pond which is currently at the level approaching possible discharge. 6. PLANNING/LAND USE & ZONING: A. Request from Colosimo regarding extension of Isle Avenue Cul-de-sac The Council received a letter, dated April 18, 1994, from Grace Colosimo asking that the City allow her to retain a private contractor for the engineer and construction of the Isle Avenue cul-de-sac. M/S/C Mottaz/John - to direct the city administrator to send a letter to Grace Colosimo requesting she furnish an Itemized Statement, item for item that the city engineer has presented to the city, regarding extension of Isle Avenue cul- de-sac and to explain in the letter justification of City Engineering fees. (Motion carried 5-0). B. PUBLIC HEARING: Christopher Taylor/George Taylor (Application Withdrawn) The Council received a letter, dated April 29, 1994, from Lonny Thomas, Attorney for Christopher Taylor, confirming that the named applicant has chosen to temporarily withdraw his application for variances. 7. CITY ENGINEER'S REPORT: A. MSA Update - Conrad Fence The Council had no problem with Mr. Conrad installing his own fence as long as it was under the city engineer's supervision. M/S/C Mottaz/Johnston - to instruct the staff to schedule a public hearing for May 17, 1994 for a variance request by John Conrad, 3812 Jamaca Avenue, for a 6- foot high solid wood fence on the right-of-way line to replace the screening provided by the lilac hedge which was removed. (Motion carried 5-0). LAKE ELMO CITY COUNCIL MINUTES MAY 3, 1994 B. Request from School District 834 Phi Fisher, School District #834, asked if the city would consider allowing them to extend city hall's parking lot as far west as possible to resolve a parking problem at the Lake Elmo Elementary School. They have looked at various ways of solving this problem, They are willing to pay for improvement, engineering costs, maintenance fee, and would build a bridge across drainage easement and path to school from the parking lot. This would benefit the city when the council conducts public hearings and additional parking is required. M/S/C Mottaz/John - to direct the city engineer at a cost not to exceed $200 to prepare a cost estimate to extend the parking lot and determine how many parking spaces can be gained and submit this information to the School District to see if they want to proceed. (Motion carried 5-0). 8. CITY ATTORNEY'S REPORT: None 9. CITY COUNCIL REPORTS: Mayor John reported there was a successful tree planting by Lake Elmo Elementary Students, on Friday, April 29, in observance of Arbor Day. Mayor John, Councilman Johnson, Mike Bouthilet and other commission members assisted in the tree planting. Council member Conlin reported today was Mayor John's birthday and to celebrated his birthday a cake was presented. M/S/C Conlin/Johnston - to take a 10 minute break to enjoy Mayor John's birthday cake. (Motion carried 5-0). 10. CITY ADMINISTRATOR'S REPORT: A. Fire Department Annual Report Chief Sachs presented a very comprehensive 1993 Fire Department Annual Report. The new personnel carrier will be presented to the council at their May 17 council meeting. M/S/C Johnson/John - to accept the 1993 Fire Department's Annual Report. (Motion carried 5-0). B. "Sam's Club" Membership M/S/C Conlin/Johnston - to direct the city administrator to obtain a $25 per year membership with Sam's Club. (Motion carried 5-0). Vehicle for Building Official M/S/C Mottaz/Johnston - to instruct the MAC to work with the Building Official to analyze the purchase versus lease options for a vehicle for the Building Official. (Motion carried 5-0). D. Guardian Angels Church -Liquor License M/S/C Johnston/John - to adopt Resolution No. 94-14, approving the application from Guardian Angels Church for the issuance of a Temporary On -Sale Intoxicating Liquor License. (Motion carried 5-0). E. Recycling Containers M/S/C Johnston/Johnson - to approve the purchase of 100 recycling containers at a cost of $715 from Shamrock Industries, as recommended by the Solid Waste Advisory Committee. (Motion carried 5-0). M/S/C Johnson/Conlin - to adjourn the council meeting at 11:15 p.m. (Motion carried 5-0). Lake Elmo, MN From: Local 13 Year Old Traveling Baseball Team. Subject: Waiver of light fees at Lake Elmo Lions Park. Over seventy thirteen year old baseball players from the Stillwater Area attended tryouts for the local traveling team. Fourteen of these players were selected and represent the best baseball players in the Stillwater area. All fourteen players are on the Honor Role at Oakland or Stillwater Junior High Schools. They will be competing against the best baseball players from surrounding communities. ie. White Bear Lake, Forest Lake, Oakdale, Mahtomedi, etc. We have arranged for the Lions Park Field to be our home baseball field. We will also be hosting a sixteen team tournament the middle of June at the Lions Park and VFW Fields in Lake Elmo. Teams from the metropolitan and outstate area are registered. These home field games and tournament games will bring a number of people to Lake Elmo who undoubtedly will utilize local restaurants, lounges, and shops. Each player pays $80.00 to play on the team and is required to raise a minimum of $55.00 in a fund raiser to pay for league fees, uniforms, equipment, and field improvements. We are asking that the City of Lake Elmo consider waiving the $15.00/night light fee to help these players and families keep their costs down. We will need to increase fees if the city elects not to waive this fee. The team members and parents have been involved with field improvements at the Lions Field and will continue to work to improve the field throughout the summer. This team will be an excellent representative for the City of Lake Elmo and the Stillwater Area Baseball Program. Thank you for your time and consideration on this matter. This would be something, that Lake Elmo would want done, if plans to discharge into Olsen Lake from OLE are carried out. At this stage I read out the attached note which sunamarised the Lake Elmo Councils position after the last special Council meeting on 1pri136. President Zetterherg asked that the note be made a part of the minutes. He also stated that he expected that Lake Elmo s attorney would intervene under the Minnesota Environmental Rights statute, l said we would do so.
