LAKE ELMO CITY COUNCIL MEETING
JUNE 21, 1994
6;00 P.M. Workshop with Cottage Grove Ravine Watershed Board Members,
and Bonestroo Engineering, CGRW Engineers
Mayor John called the meeting to order at 7:00 p.m. in the council chambers.
PRESENT: Mottaz, Conlin, John, Johnston, Johnson (arrived 7:10 p.m.), City Engineer
Bohrer, City Attorney Filla and Administrator Kueffner.
1. AGENDA
M/S/C John/Johnston - to approve the June 21, 1994 city council agenda as presented.
(Motion carried 4-0).
2. MINUTES: May 17, 1994
M/S/C Johnston/John - to approve the May 17, 1994 City Council minutes as amended.
(Motion carried 4-0).
MINUTES: June 1, 1994
M/S/C Conlin/Johnston - to approve the June 1, 1994 City Council minutes as
presented. (Motion carried 2-0-2:Abstain:Mottaz, John).
3. CLAIMS
M/S/C Johnston/Conlin - to approve the June 21, 1994 claims #2693 through #2770
as presented. (Motion carried 4-0).
4. PUBLIC INFORMATIONAL: - None
A. Public Inquiries
5. UNFINISHED BUSINESS:
A. Heritage Preservation Ordinance
M/S/C Johnston/Conlin - to delay consideration until July 5th meeting so the council can
review the proposed HPC ordinance, get suggested changes to the City Administrator
before June 27, and invite the HPC to the July 5, 1994 meeting to discuss the
ordinance. (Motion carried 5-0).

6. PLANNING/LAND USE & ZONING:
A. Resolution No. 94-17: Ubl/Anderson Minor Subdivision
M/S/C John/Johnston - to adopt Resolution No. 94-17 granting a minor subdivision to
Tom and Lisa Anderson based upon the recommendation of the Planning Commission.
(Motion carried 5-0).
B. PUBLIC HEARING: Variance to height standard for a front yard fence,
Applicant: John Conrad, 3812 Jamaca Avenue
Mayor John opened the public hearing at 7:16 p.m. in the council chambers. The
public hearing notice was published in the June 8, 1994 Stillwater Gazette Extra and
adjoining property owners were notified.
There was no one to speak for or against the variance request.
Mayor John closed the public hearing at 7:18 p.m.
M/S/C Conlin/Mottaz - to grant a variance to John Conrad, 3812 Jamaca Avenue N., to
allow a six-foot high solid wood fence on the right of way line to replace the screening
provided by a lilac hedge that existed prior to the 1993 MSA Project based on the
following findings:
1. The six-foot high fence is to replace screening which was formerly provided
by a much higher lilac hedge.
2. The hedge removal and subsequent need for the screening fence was on
account of a public road improvement.
3. The hardship for the variance was caused by the public project and not the
property owner.
4. The circumstances in this case are unique and the fence would not alter the
character of the area.
5. The city will provide the material and applicant will construct the fence.
Applicant must obtain a building permit for fence and it must be completed
within one year from date of issuance.
6. The fence is located in the middle of the block and not on the corner,
therefore, will not obstruct the view of oncoming traffic. (Motion carried 5-0).

C. PUBLIC HEARING: Variance to impervious surface standard:
Applicant: D.C. Sales, 9242 Hudson Blvd.
Mayor John opened the public hearing at 7:21 p.m. in the council chambers. The
public hearing was published in the June 8, 1994 Stillwater Gazette Extra and adjoining
property owners were notified. The Council received the June 14, 1994 memo from
City Planner, Steve Schwanke.
Greg Dovolis, D.C. Sales Company, stated the building expansion is needed to meet
growth in business activity and the hardship is unique to the land, and the building
involved cannot be expanded vertically.
There was no one to speak against the variance request.
Mayor John closed the public hearing at 7:23 p.m.
M/S/C John/Johnston - to grant the request of D.C. Sales, 9242 Hudson Road, for a
variance to the impervious surface standards in the GB zoning district provided the
applicant constructs the reserved parking area out of porous block structures which
would meet the city's impervious surface coverage and to require an additional 0.11
AcYt. of dead storage in the pond as recommended in Larry Bohrer's letter dated
March 18, 1994. (Motion carried 4-1:Johnson:The 35% impervious surface coverage
requirement was already a compromise. Granting this variance would establish a
precedent).
M/S/C John/Johnston - to approve the requested 14,632 square foot addition to the
existing building by D.C.Sales. (Motion carried 4-1:Johnson: Without additional parking,
he did not know if there would be ample parking.)
D. Site and Plan Review: Springborn Green Acres - Addition to existing
building
M/S/C Mottaz/Conlin - to approve the site and plan review for the proposed 40' x 40'
addition to the Springborn Green Acres chalet as recommended by the Planning
Commission. (Motion carried 5-0).
E. Alternative Ag: Recommendation from Planning Commission
Todd Williams, 3025 Lake Elmo Avenue, stated if the council is concerned that some of
the uses that are normally allowed in commercial zoning district are not appropriate for
Alternative Ag uses why not amend the ordinance to restrict these types of uses and
define the allowed uses rather than repeal the entire ordinance. He feels it does allow
preservation of Ag land which is a dwindling commodity in this city.

Tom P. Armstrong asked the council not to repeal the ordinance because they would
be punished severely if the ordinance is repealed. This would make their buildings non-
conforming and if they are destroyed over 50% by fire, tornado or other hazards, they
would not be able to rebuild. Items that need to be addressed are in terms of the
outside storage definition, the actual defined CUP site, what is the contiguous land,
what is the actual CUP site control, and how does that affect surrounding parcels
regarding the zoning.
M/S/C Mottaz/Conlin - to adopt Ordinance 8097 repealing 301.070 D.1.b.(6) of the
Lake Elmo Municipal Code relative to Alternative Uses in the Agricultural Zoning
District. (Motion carried 4-1:Johnson:He shares Armstrong's concern on rebuilding
there is ever a fire if he becomes a non -conforming use. He doesn't want to put
Armstrong out of business.)
F. Text Amendment to Alternative Ag
Tom P. Armstrong asked cannot their application be processed if the application was
submitted when the ordinance was still valid. Attorney Filla responded they do not have
a vested right to proceed with that application even though it was submitted before the
council's action this evening. The text amendment is a moot issue at this point.
G. Petition for Walter & Gladys Goetschel for detachment from Baytown and
a concurrent annexation to Lake Elmo
The City received a petition from Walter and Gladys Goetschel requesting annexation
to Lake Elmo of their property that lies between Highway 5 and the boundary line.
There are two small parcels within this area that are not owned by the Goetschel's.
M/S/C John/Conlin - to direct the city administrator to write a letter to Baytown formally
making this request and request time on their July 11, 1994 agenda to discuss the
Goetschel annexation and also approach the other owners to find out what their action
would be to this proposal. (Motion carried 5-0).
M/S/C Johnson/Johnston - to designate Mayor John to attend the July 11, 1994
meeting to talk with the Baytown Township Board subject to the following conditions: (1)
The Mayor shall not be considered a committee or subcommittee of the council for this
purpose as those terms are used in the MN Open Meeting Law, (2) The Mayor shall
have no authority to act on behalf of the city without further council approval, (3) The
Mayor shall report to the Council regarding the content of such discussions, (4) The
council reserves the right to reevaluate the efficacy of the discussion process after the
meeting of July 11, 1994. (Motion carried 5-0: Mayor John modestly accepted this
designation).

H. Petition for signs on 32nd Street
The City received a petition from property owners living on 32nd Street requesting (1) a
25 mph speed limit sign at the beginning of 32nd Street for westbound traffic entering
from Lake Elmo Avenue; (2) a "slow children" sign; and (3) a "blind driveway" sign to
alert drivers of the driveway at 11075 32nd Street, that according to the petition is not
visible to traffic traveling from he Klondike end of 32nd Street (towards Lake Elmo
Avenue).
The Maintenance Department has already put up the 25 mph speed limit sign. Now
there is a 25 mph sign at each end of 32nd Street.
The County had reservations on "slow, children" signs because they felt it gave people
a false sense of security and too many signs can be a distraction. The purpose of all
advisory signs is to call attention to a special hazard that exists; whereas, children
playing can be in any block of the city. A "blind driveway" sign is not a standard sign
and would not fall under the standards established under the MN manual of Uniform
Traffic Control Devices and would require a special manufacturer. A more appropriate
sign would be "Limited Sight Distance".
M/S/C Johnson/Conlin - to direct the staff to erect a "Limited Sight Distance" sign
with appropriate distance added at both ends of 32nd Street and reject the petition for a
"Children Playing" sign on 32nd Street based on discussion. (Motion carried 5-0).
7. CITY ENGINEER'S REPORT:
A. Partial Payment #5, Tower Asphalt in the amount of $105,082.14
1993 M SA
M/S/C Johnston/Mottaz - to approve partial payment #5 to Tower Asphalt in the amount
of $105,082.14 for work done on 1993 MSA Project per recommendation of the City
Engineer. (Motion carried 5-0).
B. 1994 Crack Sealing Program
M/S/ Mottaz/Conlin - to contract with Bergman Companies for the City's 1994 Crack
Sealing in accordance with the low bid submitted to Washington County up to $10,000.
Councilman Johnson pointed out this motion was in violation of the city's purchasing
policy because sealed bids are mandatory. Attorney Filla explained the city's
purchasing policy contains some amounts that are much lower than what the State Law
now permits.

M/S/C Johnston/ Mottaz - to amend the city's purchasing policy to include an exception
to the sealed bid requirement for joint government purchasing to allow the city to
authorize those if the proper sealed bid procedure has been followed by the authority
who has accepted the bids initially. (Motion carried 5-0).
M/S/C Mottaz/Conlin - to contract with Bergman Companies for the city's 1994 crack
sealing in accordance with the low bid submitted to Washington County up to $10,000.
(Motion carried 5-0).
8. CITY ATTORNEY'S REPORT:
The Burgess matter is currently set for trial in front of Judge Maas on July 15, 1994,
10:00 a.m. Mr. Burgess has retained an attorney to represent him and that is why it
was continued.
Attorney Filla has not discovered anything new on the Woodbury/Lake Elmo boundary
line.
9. CITY COUNCIL REPORTS:
A. Mayor John reported the following:
A letter was received from Mr. James Jennings recognizing the efforts of Washington
County Deputies, Carey and Osterman, on keeping an eye on their home while they
were on vacation.
In May he flew over Lake Elmo and took pictures of discharge into Olson Lake
indicating the impact was not as drastic as it was in the first few hours of discharge.
A letter was sent to newspapers in relation to Oakdale's proposed golf course in
Section 32/33. Councilman Mottaz congratulated the Mayor on a very well written letter
and accepted the Mayor speaking on his behalf.
Issue of privacy in the city offices: The city offices are private and the appropriate spot
is to approach the city staff at the counter and not through the back door.
Year book of School District #622 which reviews their accomplishments was received.
A request was made for the proposed Surface Water Use Ordinance be printed in the
city newsletter.
B. Council Member Conlin
M/S/C Conlin/John - to direct the staff to approach the adjacent cities and discuss the
possibility of a multi -community Human Rights Commission. (Motion carried 5-0).

C. Council Member Mottaz
M/S/C Mottaz/Conlin - to direct the staff to draw up a proposed stable ordinance using
information in Resolution No. 92-19. (Motion carried 5-0).
10. CITY ADMINISTRATOR'S REPORT:
A. Maintenance agreement with Washington County for a stop light at
County Road 15 and Highway 36
M/S/C Johnston/John - to approve the Agreement proposed by Washington County for
the Maintenance of the Traffic control signals at the Intersection of Manning Avenue
(CSAH 15) and Highway 36 at a cost estimated to be $400 per year. (Motion carried 5-
0).
B. Trail Grant Resolution
M/S/C Johnston/Johnson - to adopt Resolution No. 94-18, approving the application for
a Department of Natural Resources Park Grant for the ski trail winter grooming in
Sunfish Park. (Motion carried 5-0).
C. Vacancies on Cottage Grove Ravine Watershed
M/S/C Johnston/Conlin - to direct the city staff to contact residents in Lake Elmo of the
CGRW to let them know of vacancies on the watershed board and ask if there is any
interest in participating. (Motion carried 5-0).
D. Rescue Truck Transfer
M/S/C Mottaz/ Johnston - to reject all bids received for the 1978 Dodge one -ton truck
currently assigned to the Fire Dept. and transfer the 1978 Dodge one -ton truck to the
Parks Dept. and to not transfer funds ($1500) from Parks to Fire Department Reserve
and that the Parks Dept. and Maintenance Dept. share the use of this truck. (Motion
carried 5-0).
E. Liquor License: Guardian Angels Church
M/S/C Johnston/John - to adopt Resolution No 94-16 approving a Non -Intoxicating
Liquor License requested by Guardian Angels Church for 7/9, 7/16, 8/13, and 8/20/94.
(Motion carried 5-0).

F. Recommendation from MAC on vehicle for Building Official
The Council received the June 6, 1994 MAC minutes. There is $3,000 in the budget for
this vehicle.
M/S/C Mottaz/Conlin - to direct the city administrator to investigate different financing
options; such as, Lake Elmo Bank, dealer finance package and also look into other
funds available with the Finance Director, obtain quotes and report back at next
meeting. (Motion carried 5-0).
G. Improvements in Private Developments
M/S/C Mottaz/Johnson - to table action on this item until the July 5, 1994 council
meeting. (Motion carried 5-0).
M/S/C Mottaz/Conlin - to adjourn the meeting at 10:05 p.m. (Motion carried 5-0).
