LAKE ELMO CITY COUNCIL MINUTES
JULY 19, 1994
Mayor John called the council meeting to order at 7:05 p.m. in the council chambers.
PRESENT: Mottaz, Conlin, John, Johnston, Johnson, City Engineer Bohrer, City
Attorney Filla, Building Official McNamara (departed 8:00 p.m.) and Administrator
Kueffner.
1. AGENDA

2. MINUTES: July 5, 1994

(Motion passed 4-0-1:Abstain:Conlin).
3. CLAIMS
Administrator Kueffner reported the fees for the IBM Maintenance Agreement has been
the same for the last 5 years and that is their minimum charge.. One service call could
exceed this maintenance fee.
M/S/P John/Johnston - to approve Claim #2782, IBM Maintenance Agreement. (Motion
passed 5-0).
M/S/P Johnston/John - to approve the July 19, 1994 Claims #2855 through #2902 as
presented. (Motion passed 5-0).
4. PUBLIC INFORMATIONAUINQUIRIES:
The Council received a letter for John & Joan Bodey, 8155 15th Street N., and Annette
Pierre, 8167 15th Street N., expressing their support and gratitude to the council for
their decision to repeal "Alternate Ag" and deny the amendment to the existing CUP
request by Armstrong Farm. As adjacent property owners they are concerned about

the effects of any further expansion of commercial property and/or business so close to
their homesteads. This expansion could have negative effects on their property values
as well as the unsightliness of several more storage buildings on the adjoining property.
A letter was received from Susan Dunn, P.O. Box 153, requesting the Council to ask
the Washington County Public Works Dept. to address the council and interested
residents on what is now proposed for the road known as County 10.
In the letter dated July 19, 1994 to the City Council, Donald Theisen, WCPW,
responded to Susan Dunn's letter, dated July 16, 1994, stating the 10th Street project
has not changed in scope from their discussion and city approval. They do plan on
updating the Council as pertinent information evolves.
M/S/P Johnson/John - to invite a representative from the WCPW Dept. to give an
update on the project and changes at the next council meeting, (Motion passed 5-0).
Huff'n Puff Days
Cindy Quick, Huff'n Puff Chairperson, asked the city to proclaim August 11-14, as Lake
Elmo's Huff'n Puff city celebration, and to waive the fees for the lights at Lions Park and
for the liquor license. An invitation was extended to the city council to play in the
celebrity softball game.
The proclamation and liquor license application have not been submitted and will be on
the next council agenda.
M/S/P John/Conlin - to waive the fees for the lights at Lions Park during Huff'n Puff
Days, August 11-14, 1994. (Motion passed 5-0).
5. UNFINISHED BUSINESS:
A. Heritage Preservation Ordinance (Tabled until the final draft has been reviewed
by the HPC.)
B. Vehicle for Building Official
M/S/P Mottaz/Conlin - to authorize the staff to purchase a 1994 Escort wagon from
Stillwater Ford and budget an additional $9,000 (General Fund) in 1995 for Building
Inspector's Vehicle. (Motion passed 5-0)
Council member Conlin suggested a City of Lake Elmo sign, either magnetic or painted,
be placed on the vehicle. She also questioned what will happen to the old truck.
Councilman Johnson questioned storage for the vehicle. Such possibilities discussed:
Parks Building, Maintenance Garage, adding a lean-to on the back of the Parks Bldg.,
or permitting vehicle be driven by Building Official back and forth so it can be kept in his
garage.

M/S/P John/Mottaz - to direct the staff to put together a proposal for construction of a
garage suitable for this vehicle and comeback with a recommendation on the old truck.
(Motion passed 5-0).
C. Stable Ordinance (Tabled)
D. Improvements in Private Developments
Larry Bohrer and Jerry Filla has reviewed the new ordinance submitted for council
consideration.
M/S/P Mottaz/Conlin - to adopt Ordinance 8099 repealing Section 401.505 and its
subdivisions and adopting Section 400.18 and its subdivisions relating to Required
Improvements/Financial Arrangements (in Subdivisions) as amended (9A. Add to end
of paragraph: ..."City Attorney, including, but not limited to, provisions for default
including fines and penalties."; Add to Subd. 10. "...developer may enter into an
agreement signed by 100% of all owners of the land to be developed, requesting the
City to install some or all of the improvements, request all of the costs be assessed
against the property and waiving the rights to appeal from the levied special
assessments." and correct typos). (Motion passed 5-0).
E. Olson Lakes Estates Pond Update
The Council received a memo from Administrator Kueffner expressing Attorney Chuck
Dayton's thoughts regarding the VBWD temporary discharge permit and the public
hearing scheduled for August 11. Attached to memo were results of testing on Olson
Lake Estates Pond submitted by Randy Peterson, Barr Engineering.
M/S/P John/Mottaz - to table discussion in order to review information submitted and
place item on August 2nd council agenda under UNFINISHED BUSINESS. (Motion
passed 5-0).
6. PLANNING/LAND USE & ZONING:
A. PUBLIC HEARING: Variances for Parking Area -Lake Elmo Elementary School
The Public Hearing notice for a variance to Section 301.130 requiring all parking areas
in non-residential zoning districts be covered with bituminous blacktop or concrete and
a variance to Section 301.130E(e) that requires a setback of 5 feet from the side
property line for off street parking areas was published in the July 11, 1994 Stillwater
Gazette Extra and adjoining property owners were notified.
Mayor John opened up the Public Hearing at 8:06 p.m.

Dan Parker, Business Manager, Stillwater Area Schools, requested a change in the
variance request. A decision had been made that it would be in the best interest of all
parties if this parking lot could be developed on district property. Therefore, only a
variance from (Section 301.130) the hard surface requirement is still requested.
There was no one to speak against the variance request.
Mayor John closed the public hearing at 8:08 p.m.
M/S/P Mottaz/John - to grant the requested variance to Section 301.130 relating to
bituminous surface coverage of all non-residential parking areas to Stillwater Area
Schools for a proposed temporary gravel parking lot, sketch dated 7/19/94, based on
the following reasons:
1. This property is zoned PF. There is not a lot of PF zoned property in the city. The
property is in the vicinity of the "Old Village". Numerous variances have been similarly
granted in the Old Village.
2. A school should have safe and adequate parking for staff and visitors.
3. The school district is not the cause of the increased enrollment. They are trying to
deal with a crisis situation for the health, safety and welfare of the school's staff,
students, and visitors.
4. Since there is very little PF zoning, there have not been other requests.
5. The applicants are proposing approximately 6,000 square feet of additional parking
space.
6. The variance is proposed to be temporary (3 to 5 years). There should d be no
long-term affect on any property in the area or in the same zoning district. (Motion
passed 5-0).
Larry Bohrer reported that the Stillwater School District has asked TKDA to assist them
in the design on the construction of the parking lot.
M/S/P John/Mottaz - to support TKDA as the consulting engineer for the Stillwater
School District on construction of the parking lot. (Motion passed 5-0).
B. PUBLIC HEARING: Surface Water Use Regulations Ordinance
The Public Hearing Notice was published in the July 13, 1994 Stillwater Gazette Extra
and the Surface Water Use Ordinance was published in the July City Newsletter.

On June 1, 1994 the Surface Water Use Committee met with the City Council to
discuss the Surface Water Use Ordinance Some suggested changes made at that
meeting were:
1. Specific exclusion of any kind and all motorboat races.
2. Specific exclusion of water skiing schools for money)
3. Specific exclusion of water ski jumps.
4. Address bathrooms, particularly in the winter.
Mayor John opened up the public hearing at 8:15 p.m.
The Council received a letter from Meier, 4731 Birch bark Trail; Hirsch, 4689 Birchbark
Trail; McDonough, 4711 Birchbark Trail; and Taylor, 4677 Birchbark Trail submitting an
addition to Section 1455.03 Subd.9, Safe Operation Distance as follows: It is unlawful
to operate or permit the operation of motorboat, which includes personal watercraft, in
excess of slow -no wake speed, or to tow a person(s) on water skis or other devices
within one hundred (100) feet of a shoreline, dock, raft, swimmer or any other
watercraft.
Mayor John brought up his concern on the confusion of the terminology of Surface
Water Use Ordinance and proposed the name of the Ordinance to be Recreational
Lake Use. Nancy Hansen explained the DNR refers to the regulations as Water Surface
Use.
Joe Kiesling, 9359 Jane Rd N., pointed out on page 6, Prohibited Uses, such as
regattas and races were never discussed at the joint meeting. The Tri Lakes Assoc. is
celebrating their 40th anniversary and would like to have.a regatta and races.
Administrator Kueffner explained she added all the language out of the Minnesota
boating regulation handbook for purpose of discussion and elimination.
Mike Moen, supported the ordinance as written, and added that motor boat races,
water skiing schools for money, and water ski jumps were discussed at the June
meeting, but NOT the other prohibited uses. It is very important to him to make sure
that the adolescents feel this is the place where they can feel comfortable and water ski
and use the lakes. Sometimes what appears as nuisances to us, those are things, not
necessarily dangerous, adolescents like to do and would like the council to keep that in
mind.
Nancy Hansen, 8024 Hill Trail N., explained the DNR must approve the ordinance if
there are any changes or additions. The draft ordinance as submitted was approved by
the DNR.
Chris Nelson asked how do you determine how far a raft can be put out into the water
and suggested rafts be marked in order to be seen . Joe Kiesling responded that rafts
are regulated under the DNR.

Paul Huot, 4955 Jamaca Avenue N., thought the ordinance as written is good. The
intent of the 1 00'from the shoreline is a DNR regulation and allows skiers to make a
direct path out into the boating lanes from their dock or shore straight out and then out
into the boating lanes, but not to go parallel to shoreline within a 100'. The Tri-Lake
Assoc. offers swimming lessons for free so would this be a prohibited use as stated on
Page 6. Subd 2.
Scotty Lyall had no objection to appropriate marking on rafts. At one time there was a
fee taken by property owners to allow ice fisherman on Lake Jane. He has not found
any relationship between the speed and the wake and felt it must be in the hull design
and motor.
Mayor John received a telephone call from Diane Acree who lives on Lake Elmo now,
but previously lived on Lake Minnetonka. Her concern is there's no indication of any
speed limit in the ordinance as it is on Minnetonka and on super power boats traveling
at over 30 mph with non muffled exhausts that make high noise levels. Joe Kiesling
responded that the DNR has a decibel level to stay within.
Jim Dillon, 8190 Hill Trail N., indicated the committee had Mark Caroon, Washington
County Sheriff's Dept., discuss that issue and his response was that the state of
Minnesota has no speed limits on its lakes, but does have noise levels.
` Jim Burns asked where can he find out the lake levels. Administrator Kueffner
responded the city has monthly reported lake levels. He added they use the lake for
recreation and felt it's great to have the children stay home to water ski or play
volleyball rather than go to St. Paul. What some may construe noisy, is indeed very
wholesome recreation to others. Burns provided pictures of erosion control methods on
lake property with a no -wake situation in Wisconsin.
Mark Peterson asked how many days this year have we reached the high water level
on Lake DeMontreville? Kiesling responded that the high water level had not been
reached this year, nor last year, and have not been affected by the no -wake regulation.
Peterson questioned the purpose and found the following confusing: Subd d 4.
Excessive Speed: all motorboats operating in excess of slow/no wake shall operate in a
counter clockwise direction such routes are to cross the North/South East/West
medians of the Lake. Mayor John explained this was added because of his concern of
boaters who left their dock and zipped past their shoreline within 100' going clockwise
at full speed.
Marilyn Kennedy voiced her concern that the 100' regulation is not specific enough. A
rule in which people are trying to define and depict what behavior should be. Obviously
we have a situation in which people are not trying to cooperate, but doing what they
want to do. Unfortunately, we cannot legislate good behavior or honesty within people.
The Lakeshore owners that have signed the letter are low to the water and.have a

problem with erosion. At what point do we disregard the respect of others for our own
benefits and say its up to you to protect your property, at what cost, so that I can have
fun. Address issues of good neighbors, tolerance and respect.
Bill Stevenson, 8895 Jane Rd. N., reinforced Marilyn Kennedy's comments about rules
of decency and good behavior. These people that are violating most of the rules of the
lake know they are violating them. Where is the enforcement of these regulations?
Debbie Dean, 8028 Hill Trail N., stated if you put more restrictions on the lake is that
going to help it or hurt the people that do abide by the laws. Obviously, they do have a
problem with a few people on the lake that are not following the laws. This is a
question of enforcement. Dean voiced her objection to prohibiting swimming lessons.
Joe Kiesling indicated the ordinance is fine, but what we need to do is develop
enforcement.
Ann Scovill explained the DNR already has regulations on rafts --you have to have a
permit number and lights or reflectors on rafts. Maybe, we should consider changing
the hours according to state law. The 100' from shoreline regulation should be looked
at again because the verbiage may be more restrictive than the original intent of the
committee.
Lois DeLong stated they are using Olson Lake as a holding pond for Oakdale's
drainage ditches and ponds. Another Oakdale development has scheduled runoff into
Olson Lake. The level of Olson Lake is higher than Lake Jane. We didn't get relief for
lowering the lake that was promised from the VBWD plan We might not be able to
have water-skiing on Lake Olson because the lake is so high.
Mayor John closed the public hearing at 9:12 p.m.
Council member Conlin indicated she received telephone calls with the same concerns
that were expressed tonight. The committee recommended that all lake residences
receive a copy of the new ordinance, but asked how do we ensure these homeowners
receive the regs covered by the DNR.
Councilman Mottaz would like to see addressed the speed of automobiles, racing, on
the lake in the winter.
Attorney Filla stated even if there is a budget for the Sheriff's to patrol, the number of
hours and lakes is such that effective law enforcement has to have input from
lakeshore owners. The process is to file a complaint, a citation would-be issued, if the
matter has to go to trial, you have to testify. A directive or memo from the city
explaining the process is appropriate.

M/S/P Mottaz/John - to ask the Water Surface Use Committee to work, one more time,
l on the Surface Water Use Ordinance, come to an agreement, submit a final proposal
and the council will communicate their concerns and recommendations to Nancy
Hansen and/or Joe Kiesling. (Motion passed 5-0).
C. Ordinance 8100-Goetschel Annexation
M/S/P John/Mottaz - to adopt ordinance 8100, as amended (Add: WHEREAS the
Baytown Township Board resolved in a meeting of July 11, 1994 to support this
annexation request. Under Section 1. Determination of Facts move Item (5) up to (2) so
there is a reference as to what the Goetschel property means and renumber items.
Correct typo in Section 2. Population "...below is two..."), extending the corporate limits
of the City of Lake Elmo to include the Goetschel property described in their petition of
June 3, 1994 conditioned upon receiving a copy of the minutes related to the Baytown
meeting. Further to direct the staff to file certified copies of this ordinance with the
Secretary of State , the Washington County Auditor, Baytown Township' Town Clerk,
and the Minnesota Municipal Board. (Motion passed 5-0).
D. Ordinance 8098 - Sign Ordinance
M/S/P John/Johnson - to adopt Ordinance 8098 (sign chart will be added at later date)
adopting Section 535 of the Municipal Code and repealing Section 505 based on the
recommendation of the Planning Commission. (Motion carried 5-0).
M/S/P Johnson/John - to adopt the Summary of Ordinance 8098 relating to Signs.
(Motion passed 5-0).
E. Comp Plan Amendments: Highway 5 Property & Howard & Betty Michels'
Property on Stillwater Blvd.
Council member Conlin didn't know if it should be up to the PZ, but the Council, to
extend boundaries for public hearing notices. This would require an amendment to the
code.
M/S/P John/Johnson - to approve the Comprehensive Plan Amendment for a future
land use designation of RED for the Howard and Betty Michels' property on Stillwater
Blvd. conditioned upon approval of minor amendment by the Metropolitan Council.
(Motion passed 5-0).
M/S/ John/Conlin - to approve a future land use designation of LB of the Highway 5
property (South Highway 5 north of the Chicago North western Railroad tracks between
Ideal Avenue and Stillwater Blvd.) conditioned upon minor amendment by the
Metropolitan Council

Council member Johnson pointed out that the Limited Business Ordinance is
designated along 1-94 and not along Highway 5.
Attorney Filla explained the comp plan text, page 28, commercial property goals and
policies includes section on Limited Business. A new Limited Business District is being
considered to control commercial development in the proposed 1-94 commercial strip
outside the MUSA. Filla's opinion is that if the Council wants to proceed with addition of
this comp. plan amendment, it should also amend the text of the comp plan. Before
someone makes an application to rezone property consistent with the comp plan, you
should also amend the text of the zoning code. The notice of the hearing dealt with the
future land use map portions of the comp plan as opposed to the section of the text.
He would have to review the public hearing notice to see if it was broad enough.

recommendation. (Motion passed 5-0).
F. Notification of Highway 36 Joint Meeting with Pine Springs and Grant Township
M/S/P Johnston/Johnson - to schedule a joint workshop with Pine Springs, Grant
Township on Tuesday, July 26, 1994, 7 p.m., City Hall to discuss Highway 36. (Motion
passed 5-0).
7. CITY ENGINEER'S REPORT: None
8. CITY ATTORNEY'S REPORT:
The jury trial for Dan Burgess has been continued to September 26, 1994.
9. CITY COUNCIL REPORTS:
Mayor John announced he's been invited to attend a meeting with Governor Tommy
Thompson and Governor Arne Carlson on July 25 for the signing of the St. Croix River
Valley Tourism Alliance Articles of Incorporation.
The City Administrator and himself met with a representative from the Minnesota
Design Team which has worked with a number of cities and townships to review what
they felt was needed within their community. In order to get these people involved
requires an application the city has to prepare. If the City is selected there is a cost of
$3,000.
M/S/P Johnson/John - to apply for the Minnesota Design Team to come and visit the
City next Spring (3-day basis) at a cost of $3,000 if the City should proceed. (Motion
passed 5-0).

Mayor John attended the Assoc. of Minnesota Municipalities for Urban Strategies Task
Force breakfast where they discussed development issues and addressed affordable
housing.
Council member Conlin reported that at the Thursday Cable Committee Meeting they
discussed renewing a joint powers agreement between members of the Ramsey -
Washington Cable Commission and Meredith Cable. Conlin felt the commission and
staff from all cities should be involved and requested that Administrator Kueffner be
added to the committee. Administrator Kueffner did receive an invitation to participate.
10. CITY ADMINISTRATOR'S REPORT:
A. Set time and date for Budget Workshop
The Council set the following timetable for Budget Workshops: Tuesday, August 2,
1994, 6 :00 p.m. (before council meeting); Tuesday, August 9, 1994. 7:00 p.m. The
remainder of the budget workshops will be set after the Finance Director informs them
of the timetable.
B. Planning Commission's response to Tuesday's meetings
Administrator Kueffner reported if the PZ changed their meetings from Mondays to
Tuesdays they would loose a member which was not the intent of the change. The PZ
wanted to think about reducing the size of the commission and may ask the Council to
amend the ordinance for the PZ to receive their packets 4 working days before the
meeting.
C. Special Meeting on Junker Sanitary Landfill
Administrator Kueffner reported the city has been put-on notice by the EPA with a
request for information for the Junker Sanitary Landfill in Hudson, Wisconsin. Because
Junker Sanitation has hauled for the City, a response document has to be completed.
The Legislative committee of the Stillwater Area Chamber of Commerce has called a
special meeting, Wednesday, 1-3 p.m., County Board Room, with the EPA from
Chicago, and local MPCA to discuss this issue and how the cities are going to
approach it. Kueffner asked the Council for permission for Attorney Filla to attend to
help prepare a response.
M/S/P Mottaz/John - to authorize the city administrator to take Attorney Filla to the
special meeting on the Junker Sanitary Landfill, County Board Room, on Wednesday
from 1-3 p.m. (Motion passed 5-0).
M/S/P Mottaz/Johnson - to adjourn the council meeting at 10:35 p.m. (Motion passed 5-
0).

I respectfully request that the Lake Elmo City Council ask the WCPW Dept.
to address the Council and interested residents on what is now proposed for the
road known as County 10,
A recent newspaper article stated that Washington County Public Works
Dept. went before Oakdale to discuss the project before the bid process and I
sincerely hope that the same courtesy is given to the City of Lake Elmo,
especially since the road bed and traffic would be entirely in the City of Lake
Elmo
Many prob;ems relating to the proposed loth Street project were raised to the
County by Met Council. in February 1994., To my knowledge none of the
issues have been addressed, let alone resolved.
I sincerely hope that the Lake Elmo City Council will request a review of this
proposed project, with any and all design changes ,before the WCPW Dept.
sWxts advertising for project bids.the end of July or the first of August.

I received a copy of the referenced letter concerning the 10th Street project. Let me
provide you with information that this letter requests,
Our Design Coordinator was at a recent Oakdale City Council meeting only to answer
possible questions from the Oakdale Council, On the Oakdale Council agenda that night
were agreements for the 10th Street projects west of Helmo Avenue. Specifically,
agreements were approved for construction and maintenance costs for the traffic signals
at Helmo and the 1-694 ramps, and for construction costs and maintenance of the bikepath
which will be built from Hadley Avenue to Helmo Avenue. The 10th Street project has not
changed in scope from our discussions and your approvals.
Met Council comments on the EAW and Corps of Engineers permit have been addressed.
For example, the storm sewer plan was revised in the vicinity of Armstrong Lake so that
no storm water is outletted directly into the lake. We have also permits from all the
regulatory agencies involved in this project.
We do plan on updating the Council as pertinent information evolves. I have talked to your
City Administrator about providing detour information and a project schedule for your
August City newsletter. We will be opening bids on July 25th and know more after a
contractor has been awarded the project. We will also invite the City to our pre -
construction conference.
We appreciate your support and cooperation on this important project, Please feel free to
contact me if you would like us to provide more information or attend one of your
meetings.

Dear Mary,
The intent of this letter is to request a change in the variance request that the Council will be
considering on Tuesday, July 19, 1994. After further review and discussions pertaining to the
original request, a decision has been made that it would be in the best interest of all parties if this
lot could be developed on district property. The attached site plan shows this revision.
A variance from the hard surface requirement is still requested. District staff will be at the
meeting Tuesday to answer questions from the Council.
