The plan was introduced with a graph showing how the county's Population had grown over the past ten years, and how it was expected to grow. This identified the need to plan for a 63,000 population growth over the next ten years. Presentations covered land use, parks and transportation followed by a long period of public comment. Responses were requested to be sent in by October 15, and I would encourage everyone who attended this, or the later session on September 29 to send in their comments. Because I was preoccupied with assembling the photograhic record of the Lake Olson algae bloom problem, I regret. I forgot to go to the Met Council breakfast on September 26. I did follow up, however, and talked to Chuck. Ballantine who was very pleased with the wide ranging discussion that took place - from annexation to mass transit, Gray Cloud Island Park to the new Metro Airport site. No doubt my other council colleagues who DII) attend can give a better report. MEMO Date: 10/18/94 To: Mary Kueffner - Lake Elmo City Administrator CC: Mayor City Council From: Lee Hunt 8810 55th St. No. Subject: Heritage Preservation Commission Meeting of 10/3/94 After following up on comments made by Councilperson Jess Mottaz at the Oct. 4th City Council meeting concerning a meeting of the Heritage Preservation Commission I have come to the conclusion that there was no prior notice given for that meeting, or an agenda published. As I am sure you are aware, the Heritage Preservation Commission, as a formal commission of the City, is governed by the provisions of the open meeting law. An agenda should have been prepared, and notice given. If it was an emergency meeting there are provisions for notice, but it appears the meeting was not an emergency. Also, if I am not mistaken, even if there was not a quorum present, they are an official body of the City, and any meeting of it's members when official business is discussed must follow the provisions of the open meeting law. If there was a meeting of the Heritage Preservation Commission that occurred that was in violation of the open meeting law, even if it was inadvertent, the City does need to take some action on this, as the lack of action would indicate that the City finds violations of the open meeting law to be not important. I would suggest that the Council direct the staff to investigate and determine if a violation occurred, if this is an isolated instance, or if other violations of the open meeting law have occurred. If a violation is determined, the City Attorney should then recommend any disciplinary action. I feel that it is important to investigate this matter completely, as there is currently an accusation by David Johnson that that an illegal meeting occurred. To quote David Johnson's complaint "This points to a secret meeting at some time after Feb. 25, `93 (perhaps 3/19/93 as Councilman Jess Mottaz suggests was the date of an illegal telephone pole conducted by Mary Kueffner)...". lam sure that if the City does not fully investigate this matter a further complaint will be filed by David Johnson demanding investigation of this incident. Ov -7L' # 11 4 October 3, 1994 To: Mayor and City Council From: Mary Kueffner Re: Section 32/33 Negotiations with Oakdale Mayor John and I have met with the Oakdale staff a couple of times (at council direction) to try and resolve the Section 32/33 boundary issue. Attached is a list of conditions the Oakdale Mayor and City Administrator have proposed in response to our request for additional sewer capacity. Oakdale's City Engineer has analyzed its excess capacity to be approximately 10,000 gallons per day. Oakdale did not feel that Lake Elmo was giving enough (we offered nothing), and came up with the attached list of conditions for which they would consider giving us the excess 10,000 gallons per day. I believe No. 1 is a given. We want to try to settle all annexation issues with the City of Oakdale with respect to Section 32 and 33. Number 2, we told Oakdale, might have to read something to the effect that we would not oppose the issues, but asked that they include similar language for any Comp. Plan amendment that Lake Elmo may submit to the Met. Council. Number 3 is similar to 2. We may not want to support the legislation, but should we agree not to oppose it? Number 4 refers to the property west of the Don Bishop property. This seemed to be an important issue with Oakdale staff as they feel it important that Helmo Avenue go through to Stillwater Blvd. Agreeing to Number 5 could possibly put us in another Olson Lake Estates situation, and we are not sure that the City of Lake Elmo has any intention of mitigating wetlands for development in any other city. Number 6 brought up the discussion of the reneging on the agreement that we now have for water in the Lake Jane Advisory area. Number 7 was a definite "No". Lake Elmo will agree to settle all annexation issues with the City of Oakdale with respect to Section 32 and 33. 2. Lake Elmo will support Oakdale in its development of the golf course, including all peripheral issues such as the EAW, Comprehensive Plan/MUSA extension, Washington County CTAP proposal, etc. Lake Elmo will support Oakdale in its special tax increment legislation, should it be introduced. Lake Elmo will require the developer south of Stillwater Boulevard to provide the right-of-way for Helmo Avenue and allow the City (Oakdale) to construct the roadway. 5. Lake Elmo agrees to work with Oakdale in developing an area -wide wetland mitigation program as a development incentive. 6. Lake Elmo will allow Oakdale to sell water to the area that Lake Elmo is bringing into the MUSA as well as the 3M property (sewer also) along Highway 5. Lake Elmo will drop resistance to the Olson Lake Estates discharge and allow the system to function as initially permitted by the Watershed. Since the City Council does not have time to discuss every point presented, it may appear that decisions are preconceived. However, staff provides background information to the City Council on each agenda item in advance; and decisions are based on this information and experiences. In addition, some items may have been discussed at previous council meetings. If you are aware of information that has not been discussed, please fill out a 'Request to Appear Before the City Council" form; or, if you came late, raise your hand to be recognized.
