LAKE ELMO CITY COUNCIL MINUTES
DECEMBER 6, 1994
Mayor John called the council meeting to order at 7:04 p.m. in the council chambers.
PRESENT: Mottaz, Conlin, John, Johnston, Johnson, City Engineer Bohrer, City
Planners Farnham and Smyser, City Attorney Filla and Administrator Kueffner.
1. AGENDA
5D. Jamaca Avenue Signs, 8A. Update on Dan Burgess

amended. (Motion passed 5-0).
2. MINUTES: November 15, 1994
M/S/P Conlin/Johnston - to approve the November 15, 1994 city council minutes as
amended. (Motion passed 5-0).

M/S/P Johnston/Johnson - to approve the November 29, 1994 city council minutes as
amended. (Motion passed 5-0).
3. CLAIMS (explanation of Claim #3236 from 11-15-94)
M/S/P Johnston/Conlin - to approve the December 6, 1994 claims #3241 through
#3316 as presented. (Motion passed 5-0).
4. PUBLIC INQUIRIES:
Mayor John stated the council was in receipt of a letter from Otto Mayer, 9295 Lake
Jane Trail N., indicating concerns on the Lake Jane Trail Project.
Mary Press, 519 Cimarron, requested help with the NHD Writ/Eviction she received
today.
Council member Conlin circulated a petition by Donna Hickey for installation of a traffic
signal on Greenway and 10th Street because of the traffic congestion when Tartan
High School starts and ends.

5. UNFINISHED BUSINESS:
A. Resolution No. 94-31, Approving the 1994 Tax Levy, Collectible in 1995
M/S/P John/Conlin - to adopt Resolution No. 94-31, Approving the 1994 Tax Levy,
Collectible in 1995. (Motion passed 5-0).
B. Martin Colon Comprehensive Plan Amendment (Continuation)
Don Niles, Attorney for Martin Colon, appreciated city council action by motion on their
request of June, 1994. Niles stated the development proposal for a travel plaza is
consistent with Judge Doyscher's order in 1991 requiring the city to reconsider Mr.
Colon's plan under the 1979 comprehensive plan. Under the 1990 comp plan, we
believe that it is appropriate and largely consistent with the goals and policies of that
plan.
Julie Farnham, city planner, presented a report, dated December 1, 1994, indicating
that the staff concludes that the proposed travel plaza, and requested Highway
Business land use and zoning, is inconsistent with the City's long-range plans for
limited business uses in this area. Further, staff does not believe any compelling
arguments have been presented to prompt the city to change its policy and allow more
intense uses along 1-94. Such a change would be a significant shift in current policy
which clearly states a desire for low -impact commercial uses in unsewered areas along
1-94.
City Engineer, Larry Bohrer, provided a letter dated December 2, 1994 indicating he
has received additional information on anticipated noise levels and proposed design of
a sewage treatment system for the proposed travel plaza. This information is reviewed
at the time of Site Plan Review, and it is premature to review design features of a
proposed development before the future land use issues have been determined.
Although the city's current regulations may not allow this particular type of
development, Attorney Filla pointed out the city does not discourage development. In
this part of the city it has taken property that is zoned RR, including the applicant's
property, and placed it in a limited business classification on the Future Land Use Map
which would facilitate a much more intense and profitable type of use. The city has
never determined that this proposal is in compliance with the 1979 plan. The city has
determined that Judge Doyscher's order does not require us to review this application
under the 1979 plan.
M/S/P John/Johnston -to deny the request of Martin Colon to amend the
comprehensive plan based on the following reasons: (Motion passed 4- 1: Mottaz: Feels
very strongly that this city is obligated by Judge Doyscher's order to consider Mr.
Colon's proposal under our original 1979 comprehensive plan).

1. The applicants have not shown that it would necessarily be in the city's best interest
to amend our comprehensive plan to allow this rezoning.
2. For the reasons expressed in the city planner's report dated December 1, 1994
which is incorporated herein.
3. The current comprehensive plan, inspite of the claims that have been indicated that
we have not reviewed this on an annual basis, there is an indication that we do so. Our
comprehensive plan continually comes up for discussion and for potential amendments
where appropriate. Consistently, as far as the 1-94 corridor has been concerned, that
has been referred to LB area and we have always maintained that consistent stance.
4. The planned uses that we have for this corridor are entirely appropriate. We don't
have a sewer system in the area, it is outside the MUSA and so our LB is geared
entirely to having a low impact, low intensity use which is different from what is being
proposed. Recognizing even though the design submitted is considered to be
appropriate for an unsewered area.
5. Recommended by Planning Commission for this proposal to be denied.
M/S/P John/Conlin - to deny this application to rezone the area because it is
inconsistent with the Comprehensive Plan. (Motion passed 4-1:Mottaz).
C. Arabian Hills: Trees
Attorney Filla reported that as part of the documents for Arabian Hills preliminary plat,
the landscape plan, which is not dated, was submitted to the city as part of the contract
documents for this plat. The resolution approving the final plat does not indicate
landscape requirements, but does include subject to terms of development contract
incorporating development plans submitted by the developer. The landscaping plan
has an annotation that standards will be 6 trees per acre on this site and generally
indicates where they should be located. That requirement seems to have been
imposed, because in the same time that this was being reviewed, the city was
considering the RE regulations and that particular landscaping standard was one that
appeared in those regulations. If this matter needs to be pursued, the party that we
would pursue would be against the developer. Apparently, some of the parcels in
Arabian Hills were sold before the private covenants were placed on the property;
therefore, not subject to those covenants requiring planting of trees. A meeting
between Chuck Nelson, his engineer, Doug Pepin resident of Arabian Hills, City
Attorney and Administrator will be scheduled.

D. Update on the Jamaca Street Signs
Administrator Kueffner reported she will be getting a letter from Washington County
indicating that all of the communities involved are going along with the changing from
"Jamaca Avenue" to "Jamaica Avenue". When this letter from Washington County is
received, a resolution will be submitted for council review.
6. PLANNING/LAND USE & ZONING:
A. Minor Subdivision: Walsh/Masanz, Lot 6, The Forest
M/S/P Johnston/Johnson - to adopt Resolution No. 94-32, A Resolution granting a
Minor Subdivision to Victor and Jean Masanz and Louis Walsh. (Motion passed 5-0).
B. PUBLIC HEARING: MicroSota Variances & Site Plan Review
The public hearing notice was published in the November 25, 1994 Stillwater Gazette
and adjacent property owners were notified.
Attorney Filla explained one of the reasons this matter was tabled was because at the
last meeting Council member Johnson asked the question regarding other variances
that need to be dealt with on the site as part of the overall application. In the early 70's
an addition was placed on the building. At that time whatever the city's regulations
were, any encroachments that were caused by the addition or by the existing building,
were effectively grandfathered in. If they existed on the site since the first addition was
placed on this property, and we have over the years inspected the site and issued other
kinds of permits, the city is not now in a position to require the applicant to go back and
eliminate those encroachments. We would now be stopped from requiring that we
enforce those provisions of our code. One of the purposes of the inventory of
encroachments was to simply identify them on the record, approve them, and by doing
that, it places the property in a legal conforming use category. This may indirectly solve
a future title problem on the property.
M/S/P John/Conlin - to resolve that from earlier construction in the early 1970's, there is
no legal reason for denying those variances at this point. The city recognizes the
following variances exist on the site: lot size, front setback from property line, maximum
area to be covered by impervious surface, parking lot setback from street right-of-way
and parking lot setback from residential zone, and the adoption of one acre for two
drainfields and grants variances necessary to facilitate them. (Motion passed 5-0).
Mayor John opened up the public hearing at 8:16 p.m, in the council chambers
There was no one to speak against the variance request.
Bill Wacker, 3603 Laverne Avenue N., stated he didn't have a problem with the
application.

M/S/P Mottaz/Johnson - to grant a variance to allow expansion of a nonconforming
building to be altered; contingent upon the consolidation of the property into one lot and
grant a setback variance of 5 feet to allow the building addition to result in a 45 foot
building setback rather than a 50' rear setback as required in the GB zoning district
based upon the unique circumstances of the property as described in the staff report
and further to approve the site and building plan contingent upon the following
conditions: (a.) any access issues are to be resolved with Washington County, (b.) the
City Engineer is satisfied that the septic system maintenance program is adequate, and
(c.) the landscaping in the back yard does not encroach into the public alley right of
way. (Motion passed 5-0).
Council member Johnson asked what happens in the future when you have a non-
conforming use where there are reasons the city wouldn't want to expand.
Filla didn't see the council's first motion as being legal precedent dealing with other
nonconforming uses in the future. Presumably, the other non -conforming uses that we
would deal with in the future, would involve circumstances that we have not been aware
of and have effectively chosen not to enforce your regulations. If there are all kinds of
non- conforming uses out there the city intends to allow to expand, then Filla suggests
we take a look at our nonconforming use regulations and see if they are reasonable as
they are applied to the Old Village and decide if we want to change them.
7. CITY ENGINEER'S REPORT:
A. Derrick Land Co.: Revised Proposal for Lots 2,3, & 4, DeMontreville
Highlands 3rd Addition
The Council received a letter, dated December 2, 1994, from Larry Bohrer on the
recent past actions of Derrick Land Company in DeMontreville Highland 3rd Addition.
Roger Derrick presented Derrick Company's new proposal to qualify Lots 2, 3 and 4,
Block 3, Demontreville Highlands 3rd Addition as suitable for septic system purposes.
Filla had looked at the agreement which does allow this type of construction to occur if
it is acceptable to the city and subject to the city's input
M/S/P Mottaz/Conlin - to allow recommendation for Lots 3 & 4 (The excavation
alternative was an option in the original stipulation agreement. If successful, the
resulting system would be a more conventional system with a much lower height of fill
and would more closely conform to moderate lot grades. The success of the
excavation alternative cannot be predicted because it depends on finding an underlying
soil layer that is not saturated and will have perk rates faster than 60 mpi. Recommend
allowing Derrick to attempt the excavation method). Upon completion, it is determined
that the lots do not perk, the lot would be leveled off to 979 level smoothed and sealed.

For Lot 2, because of the intense interest on the part of the neighbors, the city will invite
neighbors for their input before a decision is made. (Motion passed 4-1:Johnson: the
neighbors should be advised of what the city is considering on all 3 lots. )
The City will notify Roger Derrick of the meeting which will be held after the first of the
year.
B. Woodbury Comprehensive Sewer Amendment- Informational
Larry Bohrer reported he is currently reviewing Woodbury's comprehensive sanitary
sewer plan update. A meeting to discuss this plan is scheduled for Friday, December 9,
1994 at 1:30 p.m. at the Metropolitan Wastewater Services. Bohrer will be attending
this meeting to review inaccuracies within the report, preserve Lake Elmo's existing
capacity in the WONE, reiterate Lake Elmo's intention to resubmit a new
comprehensive plan adding MUSA services along 1-94 and to support a central
Washington County interceptor to serve Cottage Grove, Woodbury and Lake Elmo. He
will report back to the Council after this meeting.
C. South Washington Watershed District L.G.U. for Wetland Conservation
Act
Larry Bohrer reported the South Washington Watershed District has now been formed
to replace the Cottage Grove Ravine Water Management Organization. The State of
Minnesota has also recently enacted the Wetland Conservation Act. According to the
Act, a Local Government Unit (LGU) must be designated to rule on requests to approve
permits which would alter or impact wetlands. A municipality may act as the LGU or it
can request the watershed district to perform that function. Bohrer has been contacted
by the South Washington Watershed District as to what Lake Elmo would like to do for
that portion of the City.
M/S/P Johnston/Conlin - that the staff be directed to inform South Washington
Watershed District and the Board of Water and Soil Resources that Lake Elmo intends
to act as the Local Government Unit for the purpose of administering the provisions of
the Wetland Conservation Act for that portion of the City within the South Washington
Watershed District. (Motion passed 5-0).
D. Proposed 1995 Overlay Projects
Bohrer reported we have reviewed city streets for patching and overlay needs with Dan
Olinger. Depending on available funds, he anticipates work on the streets stated in his
letter on 1995 Overlay Projects, dated December 2, 1994.
M/S/P Conlin/John - to authorize the City Engineer to prepare a feasibility report for the
1995 overlays. Cost of the Feasibility report shall not exceed $5,000. (Motion passed
5-0).

8. CITY ATTORNEY'S REPORT:
Attorney Filla reported he appeared in Washington County District Court three weeks
ago, Thursday, on the Burgess matter. The purpose of the appearance was to argue a
motion that was made by the defense attorney to dismiss the complaint because the
city was selectively enforcing its regulations. In response to that motion, the defense
attorney cited about 6 or 7 circumstances in the city that he felt represented businesses
in residential zones that the city was aware of and was doing nothing about. We
argued against that. The Judge gave us a week to submit briefs. The briefs were
submitted and we are awaiting a decision from Judge Albertson on that issue.
9. CITY COUNCIL REPORTS:
Mayor John reported he attended the Washington County's Surveyor's Open House on
their Geographic Information System.
Council member Conlin reported she attended a special meeting of the Cable
Commission. This was to advise them that Ramsey/Washington Suburban Cable
Commission had been served with Summons and a Complaint on behalf of the former
Executive Director of Suburban Community Channels. Administrator Kueffner reported
she has been working with Mike Sather, White Bear Lake and there is a meeting
scheduled for January 5, 1995 at 7 p.m.

10. CITY ADMINISTRATOR'S REPORT:
A. (1) 1995 Intoxicating and Non -intoxicating Liquor Licenses
M/S/P Johnson/Johnston - to grant a Club On -Sale Liquor License to the Veterans of
Foreign Wars Post 5725. (Motion passed 5-0).
M/S/P Johnson/Johnston - to grant an On -Sale and On -Sale Sunday intoxicating liquor
license to 3M Club of St. Paul. (Operators of Tartan Park). (Motion passed 5-0).
M/S/P Johnson/Johnston - to grant an On -Sale intoxicating liquor, Off -Sale intoxicating
liquor, and On -sale Sunday intoxicating liquor licenses to the Twin Point Tavern and
Lake Elmo Inn. (Motion passed 5-0).
M/S/P Johnson/Johnston - to grant an Off -Sale non -intoxicating malt liquor license to
the Brooks Superette. (Motion passed 5-0).

M/S/P Conlin/John - to adopt Resolution No. 94-30 approving the application from
Guardian Angels Church for the issuance of a Temporary On -Sale Intoxicating Liquor
License for December 31, 1994. (Motion passed 5-0).
B. Set time and Place for Volunteers Appreciation Dinner
M/S/P Johnston/Conlin - to set Friday, January 13, 1995 for the Volunteers
Appreciation Party. (Motion passed 5-0).

SUBJECT: Claim #3236 from 11-15-94
DATE: December 6, 1994
Background Information December 15, 1994:
Council requested an explanation of Claim #3236 in the amount of $139.82 in favor of Lampert
Lumber at its November 15, 1994, meeting.
When a representative of Lampert came into pick up the permit he had a check in the amount
of $2500 from Lampert's Minneapolis office. Apparently when the check was picked up the
final cost of the permit (for the expansion approved a few meetings ago) had not been finalized.
The result was that the permit totaled $2360.18, a difference of $139.82 which should be
refunded.
Action Requested by City Council:
I believe that the Council only asked for an explanation of the claim, it was not removed from
the claims list so no action is necessary.

On November 30,1 attended the Washington County Surveyor's Office Open House. 1 had a
very stimulating demonstration of the power of their GIs (Geographic Information system)
software installation.
Washington County is bringing all map information onto a central data base using land
survey information to produce intelligent and up to date maps.
Although the whole of Washington County is not yet entered into the data base, the Cities of
Stillwater, Bayport, Oak Park heights, Woodbury, Lake Elmo and Baytown and West
Lakeland townships are already in the system. This means that we can get accurate 1 in 100
and 1 in 200 digital maps of any subdivision in the City of Lake Elmo. The data base is updated
monthly, and is based on the parcel Geocode information supplied to the Washington
County Tax Assessor's office. So any change recorded in a plat is automatically updated and
the updated maps are available the following month. Thus maps issued in January 1995,
would incorporate all changes up to November 301994.
It is anticipated that the data base would be accessible by wire sometime in 1995 or 1996 to
customers with the right equipment, software and trained operators. This could include Lake
Elmo, but I do not think it would be justifiable at this time, as the accurate maps are
comparatively cheap.
One additional impressive feature is the ability to overlay an aerial view of a site with the
related plot plan to the same 1 in 200 scale. This enables the record to be readily compared
with site conditions so that anomalies become more obvious.
The system is a very useful planning tool which will become more important as the City
changes es with development. 1 commend the Washington County Surveyor's Office for
establishing this project some years ago. I know that Dakota County has not yet embarked on
this project, and it will depend on City funding to make it happen in the future,. We can be
thankful that the future is already here, in Lake Elmo and Washington County.
Since we do not have time to discuss every point presented, it may seem that decisions
are preconceived. However, background information is provided for the City Council on each
agenda item in advance from City Staff and appointed Commissions; and decisions are based
on this information and past experiences. In addition, some items may also have been
discussed at previous Council meetings.
If you are aware of information that hasn't been discussed, please fill out a "Request to

Comments that are pertinent are appreciated. Items requiring excessive time may be
