Mayor John called the meeting to order at 7:05 p.m. in the council chambers.

3. CLAIMS

4. PUBLIC INFORMATIONAL:
1. Washington County Attorney, Dick Arney regarding County -wide Curfew
Ordinance
Washington County Attorney, Dick Arney gave a brief background and his reasons for
the necessity of a proposed curfew ordinance. According to Arney, the proposed
ordinance is absolutely constitutional and assured everyone that his office would stand
behind this ordinance to the Supreme Court if necessary. Similar ordinances have

been adopted by Hennepin and Dakota Counties and Ramsey County is expected to do
the same. Meredith Majors, Washington County Prosecutor for Juveniles, informed the
Council that in the last year her office had received 2,900 referrals. Sgt. Gary Swanson
pledged their (Washington County Sheriff's Dept.) support of the proposed ordinance,
Lake Elmo has a curfew ordinance that became effective February 23, 1995. Lake
Elmo's ordinance is identical to Oakdale and Woodbury's ordinance.
The Council approved the County's proposed ordinance. A public hearing to receive
comments on the proposed ordinance will be held on May 16, 1995.
M/S/P Hunt/John - to direct the staff to draft a resolution supporting the Juvenile Curfew
Ordinance as proposed by the Washington County Attorney's Office. (Motion passed
5-0).
(2) COPS FAST Budget Information
The Council received COPS FAST budget information which shows over three years
what the additional deputy will cost the city. After the third year we will pay the entire.
cost. The already dedicated vehicle will have. its usage increased by the third deputy.

program and direct the Mayor to sign the agreement. (Motion passed 5-0).
5. OLD BUSINESS:
A. Resolution No. 95-35 amending Resolution No. 94-33 approving minor -
subdivision for Howard Michels
On December 20, 1994, the Council adopted Resolution 94-33 approving a minor
subdivision requested by Howard Michels. The resolution was recorded before it was
determined that there was an error in the legal description provided by Folz, Freeman,
Dupay & Associates, Inc. The correct legal description appears on the contract for
deed that has been recorded with the County and the City needs to correct its
resolution.
M/S/P Hunt/Johnston - to adopt Resolution No. 95-35 amending Resolution No. 94-33,
adopted by the Lake Elmo City Council on December 20, 1994 granting a minor
subdivision to Howard Michels. (Motion passed 5-0).

B. Ordinance 8110 amending Future Land Use Map of 1990 Comprehensive Plan
In October of 1994, the Council approved, conditionally, a Comprehensive Plan
amendment to the Future Land Use Map allowing the Howard Michels property to be
designated RED. In the letter from the Metropolitan Council, dated April 7, 1995, it
states that because this, is a minor amendment (no system impact), the City can put the
amendment into effect immediately. The Met. Council does retain the right to a 60 day
comment period.
M/S/P Johnston/DeLapp - to adopt Ordinance 8110 amending the Future Land Use
Map of the Lake Elmo Comprehensive Plan changing the future land use designation of
the Howard Michels' property, as described from Rural Ag Density (RAD) to Residential
Estate Density (RED), based on the favorable recommendation of the Metropolitan
Council in it's April 7, 1995 letter. (Motion passed 5-0).
C. Appointments to Planning Commission (resignation from Planning Commission)
The City received a letter of resignation from the Planning Commission from Susan
Dunn due to the increased travel required of her job. Four applications were received
in response to our advertisement for Planning Commission members. Roger Colombo
asked that his previous application be reconsidered. Susan Koch and Steve Skelton
attended the meeting indicating their reasons for serving on the Commission. The
following vote by paper ballot was taken:
M/S/P John/Johnston - to accept the resignation of Susan Dunn from the Planning
Commission, and direct the staff to send a letter of appreciation to Ms. Dunn for her
service on the Planning Commission. (Motion passed 5-0).
M/S/P Conlin/Hunt - to appoint Roger Colombo, 11988 21 st St. N., as a full voting
member of the Planning Commission to serve out the term of Lonny Thomas that will
expire on December 31, 1995. (Motion passed 5-0).
M/S/P Conlin/Johnston - to appoint Susan Koch, 7990 DeMontreville Trail N., as the
first alternate to the Planning Commission. (Motion passed 5-0).
M/S/P Conlin/DeLapp - to appoint Steven Skelton, 9251 9th St. N., as the second
alternate to the Planning Commission. (Motion passed 5-0).
The council acknowledged the application for the Planning Commission from Thomas
P. Armstrong, and he will be considered in the future when there is a vacancy.
M/S/P HunUDeLapp - to contact Thomas P. Armstrong and ask if he is interested in
serving on the Parks Commission. (Motion passed 5-0).

D. Appointments to Parks Commission
The first and second alternate position on the Parks Commission are vacant. The City
received two applications for these positions; Robert Schumacher and Steve Skelton.
Mr. Skelton explained his first choice is to serve on the Planning Commission with his
second choice being the Parks Commission.
M/S/P Hunt/Johnston - to appoint Robert Schumacher, 9155 28th St. N., as the first
alternate to the Parks Commission. (Motion passed 5-0).
At this time Mr. Armstrong appeared at the meeting and agreed to sere on the Parks
Commission when asked by the council.
M/S/P Johnston/Hunt - to appoint Thomas P. Armstrong, 8280 15th Street N., as the
second alternate to the Parks Commission. (Motion passed 5-0).
E. Resolution calling for convocation of parties with land use interests along 1-94
Corridor
Councilman DeLapp proposed this resolution at the April 4th Council meeting, and it
was tabled for review and comment by the entire Council. Several Council members
supported what is proposed in theory, but wanted an 1-94 corridor study done first
before they decided what uses should be designated for the Corridor. Councilman Hunt
suggested tabling this item until May 16, ask the Planner to review this idea, and come
back with a recommendation to the Council as to whether or not to proceed with this
plan.
M/S/P Hunt/Johnston - to table until the May 16, 1995 Council meeting in order for the
planner to review the resolution and talk to Councilman DeLapp on what the intent was
behind it and return back with a recommendation on whether to proceed. (Motion
passed 5-0).
F. Water Surface Use Ordinance
M/S/P John/Johnston - to bring back the Water Surface Use Ordinance. (Motion
passed 5-0).
Administrator Kueffner asked to table this item because she would have the revised
ordinance ready for the May 2nd meeting.
The Council received a letter from Lake Jane residents indicating their concern about
the recent increase in noise pollution (jet skis and airplane) on Lake Jane during the
summertime.

city council meeting. (Motion passed 5-0).
6. PLANNING/LAND USE & ZONING:
A. Resolution No. 95-36 declaring adequacy of petition and ordering preparation of
report for sanitary sewer and water within MUSA
The City received a petition for Sanitary Sewer and Water Improvements for the SE 1/4
of Section from the Northland Land Company (parent company of United Properties).
The Northland Land Company is willing to reimburse the City for its actual expenses
incurred in connection with said updated feasibility report, provided the costs thereof do
not exceed $5,000.
M/S/P John/Johnston - to adopt Resolution No. 95-36 declaring the adequacy of
petition from the Northland Land Company and ordering the preparation of report for a
cost not to exceed $5,000. (Motion passed 5-0).
7. CITY ENGINEER'S REPORT:
A. Review of Transportation Portion of County's Comprehensive Plan
Larry Bohrer reviewed the transportation segment of the draft Washington County
Comprehensive Plan and specifically looked for impacts on the City. Bohrer
commented on the System Deficiencies, Jurisdictional Changes, Realignments and
New Alignments, Transit System Concept Plan, 1995-1999 Capital Improvements
Program and Access Spacing Guidelines of the Plan. The Council made the following
comments:
(1) the proposed new connection from Inwood Avenue to Highway 5 would cause the
displacement of a home, come close, if not through, the Animal Inn Cemetery and enter
into the new Howard Michels subdivision. There would be a significant change in grade
and this new connection would be very expensive,
(2) the Plan doesn't take into consideration the full impact of the new St. Croix Bridge
on Highway 5 and Manning Avenue to the South,
(3) clarify the design standards for minor arterials in other jurisdictions,
(4) there are inconsistencies in the transit portion of the plan in that the TH36 wide
right-of-way will be preserved for future LRT, but then stops at the St. Croix River. No
provisions seem to be made beyond that point.
(5) request more detail on intent of 10th street right-of-way acquisition from Inwood to
Manning. The city would be against an extension.
(6) should Hudson Blvd. remain under state jurisdiction or transferred to local
jurisdiction.
At the May 2, 1995 meeting, the Council will discuss these comments, summarized by
the City Engineer, to be passed on to the County.

M/S/P Hunt/John - to direct the City Administrator to send a letter to Washington
County stating Inwood Avenue by 27th Street is in dangerous condition and should be
corrected immediately and upgraded by 1996, if not in 1995. (Motion passed 5-0).
Council member Conlin explained it has been brought to their attention during Board of
Review that 15th Street is in such bad shape that one needs a 4-wheel drive to get into
their homes. The gravel is off the road and into the ditches making it difficult for the
homeowners to cut the ditches. Larry Bohrer will offer his assistance to Dan Olinger on
what can be done to resolve the problem.
8. CITY ATTORNEY'S REPORT:
A. Junker Landfill Update
Attorney Filla reported the estimated clean-up cost is $20 million with Lake Elmo's
share being $3,300 if the allocation is on a volume basis. For that amount of money it's
hard to justify not to participate in this agreement as opposed to incurring legal fees
that would be greater. Filla suggested executing the Junker Landfill agreement and
submit the $5,000 payment subject to the following conditions as adopted by the City
Council as shown below:
M/S/P Hunt/Conlin - to authorize the Mayor to execute the Junker Landfill agreement
and submit $5,000 payment subject to:
1. Verification that costs will be allocated on a volumetric basis,
2. Verification that estimated volume of Junker Landfill site is approx. 4.5 million cubic
yards,
3. Verification that Lake Elmo's contribution to the Junker Landfill is approximately
1,500 cubic yards. (Motion passed 5-0).
9. CITY COUNCIL REPORTS:
Mayor John announced that Tornado Awareness Week is April 24 through 28, 1995
and their will be a tornado drill Thursday, April 27, 1995 when sirens will sound at 1:45
p.m. and 6:55 p.m. When the sirens sound, residents should tune into a local
broadcast channel to hear information regarding the tornado drill. Do not call 9-1-1.
An interview party representing the Minnesota Design Team will meet on April 19, 6:30
p.m. at City Hall.
Dr. Wettergren, Ind. School Dist. #834, will attend the May 16, 1995 City Council
meeting to explain the school bond referendum.

Councilman Hunt reported that the Agriculture Zone committee will hold workshops on
Monday, April 24, at 6:00 p.m. and Tuesday, April 25, at 4:30 p.m. to discuss uses in
Ag zone.
Councilman DeLapp pointed out the City ordinance states an accessory building is
required to have a maximum roof height of fourteen feet. A resident would like to
house a motor home, but this is not possible when accessory buildings are required to
conform with the architecture of the principle building. DeLapp suggested that
restrictive heights on accessory buildings be studied by the Planning commission and
the new planner.
10. CITY ADMINISTRATOR'S REPORT:
A. Recommendation from Solid Waste Advisory Committee
Recycled Product Procurement:
The Solid Waste Advisory Committee recommended that the Recycled Product
Procurement Administrative Policy adopted by the City of Oakdale be adopted by Lake
Elmo.
M/S/P John/Hunt - to direct the staff to prepare an Administrative Policy 95-01 for
Recycled Product Procurement as amended (change date) for the May 2, 1995 council
meeting. (Motion passed 5-0).
Compost Stickers:
The Solid Waste Advisory Committee recommended that 1996 compost stickers be
numbered. They felt there was no accountability now, and numbering the tickets will
resolve that problem. The difference in the cost of the stickers is 4 cents per sticker --
from 16 cents to 20 cents each which would amount to approximately $64 per year.
M/S/P Conlin/John - to direct the staff to have the compost stickers for 1996 numbered.
(Motion passed 4-1:Hunt:He didn't feel there have been problems that would warrant
this increase).
Sharing and Caring Hands:
The Solid Waste Advisory Committee recommended that the City incorporate into this
fall recycling schedule, and make a yearly program the pick up of mittens, jackets,
blankets, hats, etc. much as the city did last year and donated to Sharing and caring
Hands. The Committee further recommended that the recipient of the goods be
reviewed each year.
M/S/P Conlin/DeLapp - to accept the recommendation of the Solid Waste Committee
for an annual pick up of jackets, mittens, gloves, blankets, and other warm clothing
donated to Sharing and Caring Hands, and that the Committee coordinates this effort
including a recommendation of the yearly recipient of the collected goods. (Motion
passed 5-0).

B. Recommendation from Heritage Preservation Commission
The Council received the April 3, 1995 minutes of the Heritage Preservation
Commission. The Commission has asked that the Council adopt Sections 230 and 330
so it can proceed with soliciting Certified Local Government status for the City. The
Planning Commission has not acted on the ordinance until the planner was hired and
then would set up a workshop with the two commissions (and the planner) and create
an ordinance for the Old Village area. This was tabled until February, but the planner
did not come on board as soon as anticipated, and the Planning Commission has not
yet made a formal recommendation from its public hearing although it was discussed at
the February 27, 1995 meeting.
The Heritage Preservation Commission also requested the attendance of the City
Planner at it's April meeting. Administrator Kueffner suggested the planner go to the
June meeting and that meeting be held jointly with the Planning Commission as the
planning Commission has recommended:
Council member Conlin commented that she would not accept the ordinance until the
Heritage Preservation Commission agreed to hold joint meetings and acted on the
ordinance so we can become efficient with our staff.
M/S/P John/Hunt - to table until the City Planner is involved to review Sections 230 and
330. (Motion passed 5-0).
C. Cimarron Golf Course - On -Site non -intoxicating malt liquor license
M/S/P Johnston/Conlin - to grant an On -Sale Non -Intoxicating Malt Liquor License to
Cimarron Golf Course Pro Shop (G. C. Properties, Inc.). (Motion passed 5-0).
M/S/P Conlin/Johnston - to adjourn the council meeting at 10:45 p.m. (Motion passed
5-0).

SUBJECT: Noise Pollution on Lake Jane
We have become concerned about the recent increase in noise pollution on Lake
Jane during the summertime. We used to enjoy sitting by an open window
during the summer to feel the fresh breezes and hear the birds singing. But quite
a few times last summer the noise pollution got so bad that we had to shut our
windows.
In the past, the motorboat traffic and noise have been kept under control due to
the small size of the lake. But two recent phenomena have changed that:
1) Jet Skis ^
These produce louder noise than a motorboat and the sound is more
irritating because the frequency changes constantly as the machine goes in
and out of the water. (We've been told that many Jet Ski owners modify
their machines. which makes them even louder.) Also, since these are
smaller than a motorboat, more of them can fit on the lake at one time.
2) Airplane
Last summer our lake became an airport runway for one of the resident's
ultralights - this was so loud that it could inhibit conversation.
We would like the city council to address these two phenomena to ensure that
Lake Jane residents can still enjoy the outdoors during the summer.

PROCLAMATION
WHEREAS: Minnesota's forest treasures were a significant attraction to early
settlers because of their usefulness and the beautiful
environment they provided; and
WHEREAS: Trees are an increasingly vital resource today in Minnesota and
Lake Elmo, enriching our lives by purifying air and water, helping
conserve soil and energy, creating jobs through a large forest
products industry, serving as recreational settings, providing
habitat for wildlife of all kinds, and making Lake Elmo more
livable; and
WHEREAS: Human activities such as construction damage and pollution, as
well as disease and insects, threaten our trees, creating the
need for concerted action to ensure the future of urban and rural
forests in our city, state, country, and world; and
WHEREAS: Lake Elmo is blessed with exceptional natural resources of
forests, lakes, tree farms, parks and beautiful natural wetlands,
all providing a high quality of life for its citizens and visitors; and
WHEREAS: Each year on the last Friday in April -- Arbor Day -- the people of
Minnesota pay special attention to the wonderful treasure that
our trees represent and dedicate themselves to the continued
health of our state's stock of trees.
NOW, THEREFORE, I Wyn John, Mayor of the City of Lake Elmo, do hereby proclaim
April 28, 1995
Arbor Day
and
May, 1995
Arbor Month
in the City of Lake Elmo, Minnesota
Further, I urge all citizens to become more aware of the importance of trees to their well
being, to participate in tree planting programs that will ensure a green Minnesota and a
green Lake Elmo in decades to come, and to plant, nurture, protect, and wisely use
Minnesota's great treasure of trees.
