LAKE ELMO CITY COUNCIL MINUTES
MAY 16, 1995
Mayor John called the meeting to order at 7:00 p.m. in the council chambers. PRESENT: Hunt, Conlin,
John, Johnston, DeLapp, City Engineer Bohrer, City Planner Terwedo, City Attorney Filla and
Administrator Kueffner.

4. PUBLIC INFORMATIONAL:
A. D.A.R.E. Culmination Program, Lake Elmo Elementary School:Deputies Caroon & Osterman
Washington County Deputies Mark Caroon and Larry Osterman gave a summary of the D.A. R.E.
Program and extended an invitation to the Council to attend the D.A.R.E. Graduation held at the Lake
Elmo Elementary School on Friday, May 19, 1995 at 12:00 Noon.
B. Minnesota Pollution Control Agency regarding SW1
Nile R. Fellows, MPCA Project Mgr, and Gregg Rocheford, MPCA Staff Hydrogeologist gave an update
regarding the Lake Jane landfill. The MPCA has a $2.2 million plan to place a cap over the contaminated
fill site and a new methane gas extraction system. Currently, the Public Works Dept., Fire Station No. 2
and compost site are on the 110 acre landfill site. The fire station #2 and the compost site will have to be
relocated, but the maintenance building was said to be approx. 150' horizontally away from the fill area
and is not proposed to be relocated by the MPCA.
Administrator Kueffner has stated in the past that the city should not have to pay for a new station. She
was not convinced that the fill area is far enough away from the maintenance building and voiced her
concern of the health, safety, and welfare of the employees there. Councilman DeLapp was concerned
about the aesthetics of the proposed project since the property is between a residential neighborhood and
a park. He suggested planting a few thousand shrubs in the area. Council member Johnston inquired if
the methane could be transformed into usable energy. Nile Fellows said there was not enough energy for
such a project. The project is still pending agreements with Ramsey and Washington Counties.

C. Elementary School #834 Bond Referendum Election
Dr. David Wettergren, Superintendent of Schools, addressed $20,740,000 Elementary Bond Referendum
coming up for a vote on Tuesday, May 23, 1995.
S. OLD BUSINESS:
A. Proposed Ordinance regulating City Council meetings
The City attorney has reviewed the proposed ordinance regulating City Council meetings and a final draft
was attached for council consideration.
M/S/P Johnston/Conlin - to adopt Ordinance 8113, as amended, amending Section 203.010 relating to
City Council meetings. (Motion passed 5-0).
B. Lake Rule Signs (Postponed until the June 6, 1995 council meeting)
C. 1-94 Minor Comp Plan Amendment
The City Council and Planning Commission have discussed and considered a Comprehensive Plan
Amendment for a parcel of land located along Hudson Blvd. (1-94 Frontage Road) between County Road
19 and County Road 17. This amendment would change the land use designation from Residential
Estates to Limited Business.
The City Planner reviewed the proposed amendment and felt it may be premature at this time to change
the land use designation before the whole area has been studied. At their May 8, 1995 meeting, the
Planning Commission recommended tabling action on amending the land use designation until the 1-94
Corridor Study is done by the City Planner. (Motion passed 5-0).
M/S/P Hunt/Conlin - to continue consideration of a Comprehensive Plan Amendment for a 120 acre
parcel of property between County Road 19 and County Road 17 along 1-94 based on the
recommendation of the Planner and Planning Commission. (Motion passed 5-0).
D. Olson Lake Estates Pond
The Recommendation and Managers Preferred Option 3 for the Olson Lake Estates Pond Outlet System
seemed to receive favorable comments from residents that petitioned for a hearing with the Board of Soil
and Water Resources. The consensus of the petitioners was they would prefer to see this project
proceed this year rather than going through with the hearing, delaying the Plan Amendment process and
the construction of this alternative. After receiving a letter which included a request for consideration of
environmental issues as part of the design process from Barb Walsh, Bruce Sandstrom indicated that all
persons petitioning for the hearing, except for the City, had submitted written letters of withdrawal of the
petition. The financing of the project has not been resolved. Lake Elmo stated they were opposed to the
ad valorem tax to the entire VBWD and preferring reasonable assessments only to the Oakdale
contributors.
M/S/P John/Hunt - to withdraw a petition for a hearing with BOWSR to discuss the revised watershed
plan for Valley Branch Watershed District. (Motion passed 5-0).
E. Design Team
The Design Team has selected Lake Elmo for a visit this fall. A date has to be set for the visit and a
committee set up to coordinate different aspects of the visit (housing, food, facilities, etc.).

M/S/P Conlin/Johnston - to designate Ann Terwedo as coordinator of the Design Team visit and to
develop an outline of issues for the City Council before we proceed to form committees. (Motion passed
5-0).
M/S/P Conlin/DeLapp - to direct the coordinator to call a meeting of all interested persons to begin setting
up committees. (Motion passed 5-0).
6. PLANNING/LAND USE & ZONING:
A. Purchase of a computer for City Planner
The City received a quote from Up Time Computer Services based on Dave Bouthilet, representative of
this company, putting the specs together for this computer after discussions with the County, Planner and
Council Member Lee Hunt.
M/S/P John/Hunt - to authorize the purchase of the computer package by Up Time Computer in the
amount of $4,119.42 and to purchase the HP1200C printer from Ameri-Data for $1,040.50; subject to the
City Planner's approval. (Motion passed 5-0).
B. Continuation:Width of Driveways
At the May 8, 1995 meeting, the Planning Commission recommended no change to the driveway
standard ordinance and that driveways be dealt with in the future, by staff, on an individual basis.
City Planner Terwedo provided a draft ordinance stating the width of driveways in any zoning district shall
provide adequate egress and ingress to the site for the safety of residents, and provide access for
emergency vehicles. Driveways shall be included on all site plans for new residential and commercial
development for review by the Building Official and City Planner. Terwedo explained that in rural areas,
flexibility must be given due to the topography of the site, age of house and other environmental issues
which play an important role in site planning.
Attorney Filla stated the ordinance should be specific as possible and subject to reasonable interpretation
to be enforceable.
M/S/P Hunt/Conlin - to direct the city attorney, building official, planner meet prior to the next meeting
review proposed ordinance and draft ordinance acceptable to them for the June 6, 1995 Council meeting.
(Motion passed 5-0).
C. Planner's Report: Preparation of 1-94 Corridor Study
The Metropolitan Council has given the City until January 1, 1996 to prepare a land use plan for the 1-94
Corridor. This plan will provide the policy direction for future development of the area and help define
where municipal urban services will be provided to serve that development.
City Planner Terwedo stated it is extremely important that the study begin as soon as possible if the city
needs to have this plan done by the end of the year. Terwedo asked for council approval to prepare a
scope of work, timeline, and budget for the 1-94 Corridor Study. The Planning Commission will then
review and comment on the scope of work before it is presented for council review and approval.

D. Mayor John's letter to Jane Harper, Washington County
M/S/P Hunt/Del-app - to direct the City Administrator to write a letter to Jane Harper, Washington County
stating the Lake Elmo City Council fully endorses comments made in Mayor John's letter dated May 5,
1995 concerning comments on the Washington County's Comprehensive Plan. (Motion passed 5-0).
7. CITY ENGINEER'S REPORT:
A. Presentation of Feasibility Study Section 33 Sewer/Water
Larry Bohrer presented a feasibility report on the Sanitary Sewer & Water Services for SE 1/4 of Section
33 along with upgrading the system to provide for potential expansion of the Municipal Urban Service
Area for an additional 280 acres.

Service Area for an additional 280 acres, and this report transmitted to Northland Company for their
Information and depending upon their favorable response to direct the staff to call a public hearing for
consideration of the extension of sanitary sewer/water for the June 6, 1995 or June 20, 1995 council
meeting. (Motion passed 5-0).
Attorney Filla had discussed the feasibility report with Larry Bohrer and concluded that for public
improvement projects the city adopt a resolution accepting the feasibility report and calling a public
hearing as opposed to a motion. A copy of the feasibility report will be sent with the public hearing notice
to the property owners.
M/S/P John/Johnston - to adopt Resolution 95-39 accepting the feasibility report providing sanitary sewer
and water services for the SE 1/4 of Section 33 along with upgrading the system to provide for potential
{ expansion of the Municipal Urban Service Area for an additional 280 acres and calling a public hearing for
June 6, 1995 or June 20, 1995 depending upon the timely response from Northland Company. (Motion
passed 5-0).
B. 36th/37th Street Drainage
Larry Bohrer provided a letter to the Council, dated May 15, 1995, explaining there has been an ongoing
drainage problem in the 36th Street, 37th Street and Irwin Avenue area. There is no overland outlet for
the water. In the spring, ponded water will flood the basements and septic systems of the Boche house
on 37th Street and the Strege house on 36th Street.
On Friday May 5, Bohrer met with the neighborhood residents to discuss the problem and possible
solutions. There are three separate problems.
The first problem, that there is no outlet to the area, is addressed by the construction of a new culvert
running from the VBWD manhole in the intersection of 36th Street and Irwin Avenue to the ditch on the
north side of 36thStreet. This solution was approved by the VBWD and is included as a project in our
1995 overlays. The cost of this work was bid at $3,500.
The second problem area is the high spot across Ray Boche's yard which prevents flow between the
culverts. This high spot occurs over this drainfield and may have been caused by fill being placed over
the field when it was built in 1975. It is not feasible to grade his proper to drain because of the shallow
drainfield lines. Two solutions are possible:
A. Construct a storm sewer pipe from the low point on 37th Street to the Valley Branch manhole north
of 37th Street. Estimated cost of this improvement is $10,000.

B. Replace Mr. Boche's drainfield with a mound and grade his and Mr. Strege's yards to drain.
If the City wishes to correct this problem, Bohrer recommends solution A since it involves no work on
private property.
The third problem involves water flow easterly over Irwin Avenue causing gravel to wash on Mr. Strege's
property. The solution to this problem is to excavate a shallow ditch on the west side of Irwin Avenue and
construct a second culvert in the VBWD manhole at 36th Street and Irwin Avenue. The estimated cost of
this improvement is approximately $1,000.
The Council felt the project needs to be done, but questioned who pays. They asked the City Engineer to
come up with cost cutting suggestions (estimates based on using concrete pipe but may be able to use
plastic pipe) for the next Council meeting under OLD BUSINESS if we hear from the VBWD.
M/S/P Hunt/DeLapp - to direct the staff to contact VBWD to solicit their financial participation in this
project because it is the residents', in that area, belief the problem was made worse since the
construction of Project 1007. (Motion passed 5-0).
C. Signs on 33rd Street and 15thStreet Gravel
Larry Bohrer had not checked on these items and will accomplish both of these items this week. Mayor
John and Dan Olinger met with the homeowner involved and looked at the problem and discussed the
suitability of the Bob Cat for the job.
8. PARKS SUPERVISOR'S REPORT:
A. Tablyn Park Playground Equipment Proposals
At the May 15, 1995 meeting, the Parks Commission recommended the City accept the proposal
submitted by Gametime, for purchase of playground equipment for Tablyn Park, in the amount of $13,000
with the option to change some of the components if Parks Supervisor, Mike Bouthilet, feels that it is
necessary.
M/S/P DeLapp/Conlin - to authorize staff to purchase and install the playground equipment for Tablyn
Park from Gametime in the amount of $13,000 as recommended by the Parks Commission. (Motion
passed 5-0).
B. Summer Parks Workers
The Summer Park Workers' position was advertised, posted, and applicants interviewed by the Parks
Supervisor.
M/S/P Conlin/Hunt - to approve hiring Kevin Day and Danny Olinger as Summer Park Workers at $6/1-1r.
with termination being end of September depending on monetary budget. (Motion passed 5-0).
9. CITY ATTORNEY'S REPORT:
At the last meeting the council decided not to acquire a right-of-way easement for Lake Elmo Heights 3rd
Addition. Upon further review, if the City wants to insure itself of control on that issue, you would want to
consider something differently. The Cities have the authority to acquire land or easements in other
communities if it is done for public purpose. Cities have the authority to extend utilities into another
community only if the host community consents. The statute in the case law that interprets that particular
statute have dealt primarily with gas, water, sewer and telephone and electric. If that were to occur in this
case on the border, it would have to be with the City's consent as part of a joint improvement project and
would have to be consistent with our road specifications. If you wanted to insure that a property owner

will not be conveying land for that purpose, either by title or by easement, then the City should request
( the developer to convey an exclusive role in a public facility easement to Lake Elmo. In the future if the
circumstances come up, you will have to be contacted. In order for anyone to acquire the land for that
purpose, you will have to consent to this before the project is started. This may put the city in a more
difficult position if Oakdale comes to you with something in hand.
Discussion followed on the proposed easement:
Council member DeLapp felt the only difference whether we accept the easement now on lots 9 & 10 is
that the property owners of lot 9 & 10 will not be compensated if the road does go in. If we took the
easements, the implication would be we've done it so that we could put that road in. Filla answered if you
obtain exclusive easement rights, they also need our consent on the easement.
Administrator Kueffner stated the objection would be on environmental issues and she would rather have
the city have control over that than the Property owner. Compensation is not an issue.
Council member Conlin indicated that if the city acquires the easement, the implication is there we are
planning for a road. If the property owners did sell it to Oakdale, they would have to come to us and ask
for the improvements. Implication is better The landowner would be the first stop rather than the city be
there and saying we really don't want you to do that because of the wetlands.
Attorney Filla felt dealing with this is more of a political decision as opposed to a legal decision. If the city
acquires an exclusive easement, they would simply be taking the property owner out of the equation.
Instead of three parties, there are two parties.
Council member Johnston thought creating an easement is the first step down the slippery slope to being
forced to take action
Councilman Hunt did not change his mind on the way he voted.
Mayor John recognized the council's concerns, but by accepting the easement would strengthen the city's
position. The will of the council was the motion prevailed.
10. CITY COUNCIL REPORTS:
Mayor John reported that on May 10, he chaired the Area Elected Officers meeting for School District
622 held at the Lake Elmo City Hall and reviewed the major points covered. The next meeting would-be
held at Woodbury on September 13,1995 at 4:30 p.m.
Council member Conlin reported that REAPP has officially disbanded in April and would like to present
funds to the City for parks at the June 6th meeting. A fax was received from Terrence Merritt inviting the
city to the third in a series of forums sponsored by the Minnesota Municipal Board and opportunity to
discuss concurrent detachment and annexation initiated by property owners held at the Metropolitan
Council Building on May 24, 1995 from 2:30 p.m. to 4:00 p.m.
Councilman Hunt reported the Ag Use Committee will meet on Wednesday at 4:30 and Thursday at 6:30
p.m.
11. CITY ADMINISTRATOR'S REPORT:

How can the district cut the operating budget
AND open a new school?
Through the state education funding formula, District 834 receives $3,150 for each student attend-
ing its schools. These dollars "follow the student," and will be spent regardless of where the student
is located. Therefore, if a new elementary school is opened, these dollars will go with the addition-
al students enrolled there and will cover the cost of teachers, administration, support staff and mate-
rials. However, the addition of another school will increase building maintenance and operating
costs, paid out of the general fund, by an estimated $202,500 (90,000 square feet @ $2.25).
Money from the operating fund cannot be used for constructing new schools and money
from the building construction fund cannot be used for general operating costs. It is this sep-
aration of funds that leads to a situation such as the one faced by District 834:
• the need for additional space to accommodate a growing number of students

• the need to cut $1.4 million from the operating budget
due to a freeze on education funding (the $3,150 per student noted above) by the state

In the face of continuing enrollment growth, if no new space for elementary students is available,
the School Board will be forced to consider the following alternatives to stretch the space that
currently exists:

Since we do not have time to discuss every point presented, it
may seem that decisions are preconceived. However, background
information is provided for the City Council on each agenda item in
advance from City Staff and appointed Commissions; and decisions are
based on this information and past experiences. In addition, some
items may also have been discussed at previous Council meetings.
If you are aware of information that hasn't been discussed,

Dear Mayor and City Council:
As you are aware, there has been an ongoing drainage problem in the 36th Street, 37th Street and
Irwin Avenue area. The problem stems from the fact that there is no overland outlet for the
water. In the spring, and during heavy rains, ponded water will flood the basements and septic
systems of the Boche house on 37th Street, and the Strege house on 36th Street.
On Friday, May 5 we met with the neighborhood residents to discuss the problem and possible
solutions. It appears that there are 3 separate problems which need attention.
The first problem, that there is -no outlet to the area, is addressed by the construction of a new
culvert. This culvert would run from the Valley Branch Watershed District's manhole in the
intersection of 36th Street and Irwin Avenue to the ditch on the north side of 36th Street. Some
minor ditching is also necessary along 36th street. This solution was approved by the VBWD
and is included as a project in our 1995 overlays, The cost of this work was bid at $3,500.
The second problem area was noted by Mr. Boche on his property. Water will drain from the
culvert crossing 37th Street to the new culvert on 36th Street only after ponding on his property.
There is a high spot across his yard which prevents flow between the culverts. This high spot
occurs over his drainfield, and may have been caused by fill being placed over the field when it
was built in 1975. In any event, water stands on his property up to 1.2' depth. It is not feasible
to grade his property to drain because of the shallow drainfield lines. Two solutions are possible:
A. Construct a storm sewer pipe from the low point on 37th Street to the Valley
Branch manhole north of 37th Street. Estimated cost of this improvement is
$10,000.
B. Replace Mr. Boche's drainfield with a mound, and grade Mr. Boche's and Mr.
Strege's yards to drain.
If the City wishes to correct this problem, we recommend solution A, since it involves no work
on private property.

The third problem involves water flowing easterly over Irwin Avenue causing gravel to wash on
Mr. Strege's property. This occurs during heavy rains and during the spring snow melt. The
solution to this problem is to excavate a shallow ditch on the west side of Irwin Avenue and
construct a second culvert in the VBWD manhole at 36th Street and Irwin Avenue. The
estimated cost of this improvement is approximately $1,000.

How can the district cut the operating budget

Through the state education funding formula, District 834 receives $3,150 for each student attend-
ing its schools. These dollars "follow the student," and will be spent regardless of where the student
is located. Therefore, if a new elementary school is opened, these dollars will go with the addition-
al students enrolled there and will cover the cost of teachers, administration, support staff and mate-
rials. However, the addition of another school will increase building maintenance and operating
costs, paid out of the general fund, by an estimated $202,500 (90,000 square feet @ $2.25).
Money from the operating fund cannot be used for constructing new schools and money
from the building construction fund cannot be used for general operating costs. It is this sep-
aration of funds that leads to a situation such as the one faced by District 834:

Mayor's Report May 16. 1995
On May 10, I chaired the Area Elected Officers meeting for School District
622, held at the Lake Elmo City Hall.
Major points covered:
The work on the new North St, Paul High School was progressing well and to
schedule.
The North St. Paul City Council did not like the financing contingencies
implicit in new ice arena plan to be located in Oakdale. These would tend to
delay the project, so that the North St. Paul Council had decided to build its
own independent arena. They had built the first one, and North St. Paul had
benefited. Oakdale could do the same, and North St. Paul would provide
advisory assistance to the building of a second arena in the Tartan High area.
Maplewood: Dayton's and Mervyn's were going to be located in Maplewood
Mall, the construction work at Hwy. 36, 11th Street and White Bear Avenue
junction was progressing following purchase and relocation of some of the
homes. This will be the site of a new Cub Food store and a Home Depot. The
trail system around Wicklander Pond was being finished - it would join in
with the Munger Trail.
Oakdale: The Redevelopment Ordinance for the upgrade of local businesses
had been passed, A tree ordinance had been created to enable Oakdale to
become a Tree City. They were closing on the golf course agreement, and
developing a bike and walking trail along Stillwater Boulevard, A Super
America filling station would be located on the North side of Helmo Avenue
and 10th Street..
Washington County: Concern was expressed over the need for home owners
to ensure that their garbage haulers were using the NRG plant in Cottage
Grove rather than hauling the trash out of state. The system was very
efficient in that only 8% of garbage currently delivered to the site had to be
landfilled. But the viability of the Washington County contract depended on
using the NRG .facility to the fullest extent, as the costs charge to the county
were on a dump or pay basis. Consequently, if less material is delivered than
contracted, the cost per ton to the County would escalate.
Woodbury:
School District 622: Ground breaking for the new K-8 School in Oakdale will
be June Sth at 4 p.m. Design discussions for the new collaborative school in
School District 916 would be held at Lakeview College,
Landfall: The mobile home Park was being reorganized under HRA funding,
to convert the 50' wide lots into double size lots. Two public hearings had
been held on the subject to date and most issues had been resolved. They
had discussed garbage disposal and had selected Wildwood Sanitation as a
single hauler. They took their garbage to the Newport NRG site.
The next meeting would be held at Woodbury on September 13 at 4.30 p.m.
