Present: John, Johnston, Hunt, Del-app. Absent: Conlin. Also present: City Planner Ann Pung-Terwedo, City Administrator Kueffner, City Engineer Larry Bohrer, City Attorney Jerry Filla. 1. AGENDA ADD: Discussion of VBWD public hearing re: Olson Lake Estates Pond Outlet Project - Wyn John; Discussion of Cluster Concept re: Direction - City Planner Terwedo; Met. CLAIMS M/S/P Johnston/Hunt - to approve the August 1, 1995 Claims #3938 through #3968 as presented. (Motion passed 4-0.) 4. PUBLIC INFORMATIONAL/INQUIRIES: A-1. Public Inquiries: Mary Siedow, 2796 Inwood Ave., informed the Council that due to recent heavy rains the Lake Elmo Hts. 3rd Addition construction of 26th St. has caused washout damage through his yard, and he is concerned that the storm pond near his house, (north of 27th St.) cannot hold all the storm water. Mr. Siedow presented pictures. City Engineer Bohrer reported he met with the developer last week, made sure the erosion controls were put, more strongly, back in place, and the wash basins for 26th St. should be in this week which will correct the problem. Mr. Bohrer explained to Mr. Siedow that he will take the developer out to Mr. Siedow's property tomorrow, and believes the developer will restore Mr. Siedow's property. Mr. Siedow expressed his satisfaction and thanks. A-2. Mayor John explained that the Tri-Lakes Association's 40th Anniversary Celebration was held July 22-23, and that there was a concern that the water ski show would have undesirable impact on Lake Jane. Mayor John expressed that in his opinion the water ski show had no more impact than someone having a party with their own jet ski's, ect., and commended the Association for impacting only a small portion of the lake. LAKE ELMO CITY COUNCIL MINUTES AUGUST 1, 1995 PAGE 2 A-3. Mayor John reported the VBWD public hearing on the Olson Lake Estates Pond Outlet Project was very well attended by residents of Lake Elmo. The City Council directed staff to send a letter to the VBWD stating the City was against an ad valorem Tax over every household in the watershed district. The VBWD will meet again on August 10, a regularly scheduled meeting, to vote on the project. 4. B. WASHINGTON COUNTY PUBLIC WORKS - CR 13 (Inwood) Project. The City Council and public received copies of an outline of the project, provided by Washington County. The County held an open house, in July, for the affected residents, to gather input. Washington County Representatives for the street project - Chris Thornton, Design Coordinator, and Don Theisen, Deputy Director, presented the issues, alternatives, cost share by the City, and proposed improvements for County Road 13/Inwood Ave. The County's preferred alternative is a 40' rural section south of 27th Street, and a 44' urban section north of 27th Street. A separated bike path was discussed, as well as providing extra parking as requested by residents at the open house, and turn lanes/by-pass lanes. A separated bike path would require extra grading and surfacing. The project will use State aid funds (gas -tax) and is based on the Minnesota standards required. The proposed cost share of the City would be $11,400 on the low end, and $46,000 on the high end. The total cost of the project will be approx. $600,000, even on the high end the proposed cost share of the City is only 5%. Dan Novak, 8520 Ironwood Tr., asked how long a turn lane is? Ms. Thornton answered 300 feet. Mr. Novak asked the distance from Stillwater Blvd. to Ironwood Tr.? The answer was 750 feet. Mr. Novak asked if the small wetland at the SW corner of Stillwater Blvd. and Inwood Ave. would be replaced. Mr. Theisen stated it would be investigated in the process. Mr. Novak stated the width of the road is unacceptable and proposed a 32 foot wide road improvement. The County representatives advised the Council that because turn lanes would then have to be made longer (to allow for the gradual line), the 32 foot width would not be a consistent width the entire length of the street, therefore less than half the road would be 32 feet anyway. Mr. Novak stated he doesn't see the need for turn lanes. Paul Eberhard, representing The Eberhard's at 2298 Inwood Ave., stated he was initially concerned about the right-of-way coming right up to the farm house door step, but that the County took that into consideration and is okay with it. However, he stated he does have a concern about speeding. Mr. Eberhard stated he is against a separated bike path, unless it is constructed on the Park Reserve side of the road. Ms. Thornton and Mr. Theisen asked the City Council for concept approval tonight, so that they may proceed with designing the formal plans and mitigation, right-of-way, and impact needs. The County is targeting 1996 to begin construction. The council deliberated the concept proposal, future development plans of the City, and the necessity of the width proposed by the County. The council discussed the improvements and width to Jamaca Ave. (MSA standards). It was recognized that a 32' wide street has a 4' shoulder LAKE ELMO CITY COUNCIL MINUTES AUGUST 1, 1995 PAGE 3 (for bike path), however, the urban section requires curb and gutter which will take up 1-1/2 feet of the 4' shoulder, leaving only 2-1/2 feet for a bike path. There was no consensus of the council, and due to the late hour, the following motion was made: M/S/P DeLapp/Hunt - to hold a workshop meeting on Tuesday, August 22 at 5:00 p.m., and requested the City Engineer prepare width standards and Trail plans, and information regarding Jamaca Avenue upgrade. The council also directed the public be notified of the workshop. Motion passed 4-0. City Engineer Bohrer explained that he has a schedule conflict, but will submit the information necessary, in writing, in advance. Mayor John asked Mr. Theisen if the County still proposes to extend Co. Rd. 13 to Hwy 5? Mr. Theisen stated that idea was removed from the Comp. Plan. 5. UNFINISHED BUSINESS: None 6. PLANNING/LAND USE & ZONING: A. Heins Nursery - Consideration of re -locating nursery to Herzfeld Property (SW Corner of Co. Rd. 15 & 30th St.) The council received copies of a letter, dated July 5, 1995, prepared by Dennis Heins, President - Heins Nursery, a location map, and a concept sketch of the site and site plan. City Planner Pung-Terwedo explained the Herzfeld's own approximately 100 acres, which is zoned RR (Rural Residential). In order to make the project feasible, 40 acres would need to be subdivided and rezoned Agricultural, and 10 acres subdivided for the existing farmstead to be consistent with RR zoning. The proposal is consistent with RAD as outlined in the Comprehensive Plan as well as the policies of the Comp. Plan. The City Planner recommended the City Council make the decision tonight to recommend this property remain zoned RR, or technically approve the concept and recommend The Herzfeld's apply for rezoning and Mr. Heins apply for a Conditional Use Permit Dennis Heins explained to the council that he is proposing to move his operation from its present location on 1-94 in Woodbury, to Lake Elmo. The office and storage building will cover 5 acres of the 40 acre site, the remaining property will be expensive nursery stock production. No retail sales, only possibly Christmas Tree sales. The office and storage building will be tucked down in a natural wooded area, far back from 30th St. or Manning, with access from Manning Ave. Mr. Heins was asked about fertilizers and petroleum use, and answered that he uses a slow release fertilizer, and will use farm type fuel storage tanks which must comply with State & County regulations. The Council discussed that this concept is currently a permitted use by C.U.P. in the Agricultural Zoning Code, and may be more desirable than residential uses due to the proximity of the Lake Elmo Airport. LAKE ELMO CITY COUNCIL MINUTES AUGUST 1, 1995 PAGE 4 M/SIP DeLapp/Hunt - That after ordinary consideration of the proposal presented by the Heins Nursery to locate their operation in Lake Elmo, the Council recommends they apply to rezone 40 acres (of the Herzfeld property) and apply for a Conditional Use Permit. Motion passed 4-0. City Engineer Bohrer added that Mr. Heins be aware that 30th Street is deteriorating, is an MSA designated street, and is being considered for reconstruction in the near future, therefore there could be some assessments. City Attorney Filla added to Mr. Heins that it is very important that the City understand exactly what is going to be done on the five acre parcel so that the City can judge whether this is agricultural or nursery or some other agri-business, in order to know how to proceed with it. A detailed written description of what exactly is intended (not necessarily a concept plan) should be supplied. B. CASE NO. SUB/95-22 Consideration of Preliminary Plat known as "Beaut Crest Estates". Applicant: Dean Beutel [The City received an application from Dean Beutel for subdivision and preliminary plat review for 35.27 acre parcel of property located in the northwest corner of Hwy 5 and Jamaca Ave. N. Half of the property is in the RE - Residential Estates Zoning District, and half is in the R-1 (1.5 acre lots) Zoning District. The proposed plat is 16 lots ranging in size from 1.50 acres to 4.14 acres. At its June 26 meeting, the Planning Commission held a public hearing for consideration of the plat, and a revised plat was presented at the public hearing. The revision to plat included re- configuration of Lot 6, Block 2 (to meet the lot ratio standard), and the redesign of the east -west street (labeled "A") to meet the cul-de-sac ordinance, therefore, no variances were required for this plat. The commission recommended approval of the revised plat at its July 10 meeting. The council received copies of the preliminary plat and all relevant supporting data, City Engineers report with recommendations and updated City Planner Staff report with recommendations.] City Planner Pung-Terwedo reviewed the staff report and conditions for approval. Rod Halverson, Midwest Land Surveyors, addressed the Winter's concern about drainage, and the developer will meet all the City drainage standards. Mr. Olson explained that Outlot A is a tiny sliver of land created by a discrepancy in legal descriptions between the Primoli property and the VanScyoc property, therefore, it (outlot) will be conveyed to one of the property owners to correct a non -conforming property line. The City Engineer added they will work very carefully with the drainage near the Winter's as it is very flat and even a foot could make a difference, and that drinking water will be coming from the water main off of Jamaca Ave. City Engineer Bohrer brought up a concern that the property to the west may be better served if the cul-de-sac of "Street A" were allowed to be temporary, as presented on the original preliminary plat, due to the fact that 36th and 37th Street are low duty, 22' wide roads, and it could be detrimental to the entire neighborhood. The code recommends perpetuating through streets wherever possible. LAKE ELMO CITY COUNCIL MINUTES AUGUST 1, 1995 PAGE 5 The council deliberated the newly adopted cul-de-sac code, and the confusion of whether or not either proposal meets the new code due to the two different density zones, which creates an unusual circumstance. The original preliminary plat submitted was placed on the board next to the revised plan for comparison and review. Mr. Beutel asked if the property to the west could be served from Hwy 5, and City Engineer Bohrer replied highly unlikely. M/S/P Hunt/Johnston - to approve the original preliminary plat, dated June 9, 1995, of Beaut Crest Estates, (with the revision to Lot 6, Blk 2, to comply with the code), and grant a variance to the maximum length of a temporary cul-de-sac based on the unusual circumstance for the northern most street which runs east and west (labeled Street A), with the following conditions: 1 The wetland delineation shall be reviewed and approved by the Valley Branch Watershed District. 2. The stormwater detention facilities shall be reviewed and approved by the Valley Branch Watershed District and City Engineer. 3. A detailed landscape plan shall be submitted and approved by the City as regulated by the landscape ordinance before final plat approval. Additional landscaping shall be provided along State Highway 5. This shall be approved by the City Planner. 4. The park dedication in -lieu fee shall be established before final plat approval. 6. All comments from the City Engineer in his letter, dated July 6 and July 10, 1995, shall be completed before final plat approval. (Motion passed 4-0.) C. CASE NO. SUBIV/95-23 Consideration of Preliminary Plat known as "Eagle Point Creek Estates". Applicant: Jon Whitcomb [The City received an application from Jon Whitcomb for the subdivision of a 33.24 acre parcel of property, owned by Howard Michels, and located north of Stillwater Blvd., east of the NSP Power Lines, South of the Railroad Tracks. The property is in the RE - Residential Estates Zoning District. The proposed plat is 16 lots, ranging in size from .143 acres to 8.93 acres, with a variance consideration to the lot length to width ratio on Lot 6. At its June 26 meeting, the Planning Commission held a public hearing for consideration of the plat, and discussed the lot ratio of Lot 6 needing a variance to the standard. The Planning Commission recommended approval with variance to the lot ratio of Lot 6, at its July 10 meeting. The council received copies of the preliminary plant with relevant data, a revised City Planner Staff report, City Engineer's report with recommendation.] City Planner Terwedo reviewed preliminary plat, staff report and findings. Tim Freeman, Folz, Freeman & Dupay Surveying, ran down the issues as he sees them: Mr. Freeman does not believe Lot 6 requires a variance according to his interpretation of the ratio standard, however, he configured the lot for the best use of the land. Lots 1 & 2 will share a driveway, although a neighbor is concerned about safety and want two separate drives, however, he has followed the County's recommendation. According to the DNR the permit for the bridge is transferable to the new property owner, and all that's needed is the deck and an inspection. The Amoco letter, which requests a "Warning!" sign (with specific language) mark all of the plans will be complied with, and finally, Mr. Freeman stated he has no problem with any of the conditions recommended by the Planner and Engineer. LAKE ELMO CITY COUNCIL MINUTES AUGUST 1, 1995 PAGE 6 City Engineer Bohrer stated he has received a grading plan, dated July 27, 1995, from the developer, and handed out an updated staff report, dated August 1, 1995, to the council recommending the grading and erosion control plan is acceptable. M/SIP Hunt/Johnston - to approve Case No. Sub/95-23 as presented, and grant a variance from the Lot Ratio Standard for Lot 6, based on the findings: 1. The granting of this variance will not be detrimental to the public welfare. 2. Due to the unusual layout of the land such as the creek area and slopes, the granting of this variance is reasonable, and with the following conditions: 1. The wetland delineation and bridge proposal plans and an as -built plan for the portion which has already been constructed shall be reviewed and approved by the Valley Branch Watershed District. 2. The permit from the DNR regarding the bridge shall be submitted to the City before final plat approval. 3. The stormwater detention facilities shall be reviewed and approved by the Valley Branch watershed District and the City Engineer. 4. A detailed landscape plan shall be submitted and approved by the City as regulated by the landscape ordinance before final plat approval. Additional landscaping shall be provided along Stillwater Blvd. 5. The park dedication in -lieu fee shall be established before final plat approval. 6. All comments from the City Engineer in his letter dated July 6, 1995, shall be completed. 7. The setback requirements for the homes and septic systems shall conform to the shoreland regulations. 8. An access permit from Washington County shall be submitted to the City before final plat approval. 9. No construction permits shall be issued for the project until all property to be added to the existing properties in Beu-Haven has been transferred and recorded with the County. Motion passed 4-0. D. PUBLIC HEARING: Case No. W95-25 A variance to the sign ordinance for placement of a projecting sign. Applicant: John Schiltz/Lake Elmo Inn John Schiltz, Lake Elmo Inn applied to the City for a variance to the sign ordinance. The public hearing notice was published in the July 20, 1995, Stillwater Gazette, and all residents within 350 feet were notified. The request proposes a 4.5 sq. ft. projecting sign placed 12 feet above the re- located entrance to the Lake Elmo Inn. The face of the entrance structure, where the sign will project from, is 32 inches to the edge of the curb. The sign ordinance requires that projecting signs be setback 2 feet (24 inches) from the curb line. The sign width is 22 inches, and a sign bracket (unspecified width) will be necessary to hold the sign. Washington County found it unacceptable to project a sign into the street area, however, accepted the idea of the sign being flush with the street or curb (letter from Joe Lux, dated July 24, 1995). The bracket and sign will not protrude into the street area. The finished sign was shown to the council. Mayor John opened the public hearing at 10:15 p.m. A letter, dated July 21, 1995, from Dave Herreid, 3476 Lake Elmo Ave., stating support for the variance and sign, was read into the record. Kathy Weeks, 3647 Lake Elmo Ave., asked if the existing projecting sign on the sidewalk level would be removed. Mr. Schiltz replied yes it will be removed and not replaced in that location, as this sign will be its replacement. LAKE ELMO CITY COUNCIL MINUTES AUGUST 1, 1995 PAGE 7 Mayor John closed the public hearing at 10:17 p.m. M/S/P Johnston/John - to approve Case No. V/95-25, with the condition that no additional signage is allowed, and the sign shall not project into the County road right-of-way. Motion passed 4-0. A sign permit will be required. E. CLUSTER CONCEPT: A cluster development concept was presented at the joint meeting of the Planning Commission and City Council on June 19, 1995. Since that meeting, City Planner Pung-Terwedo has been looking into the concept of clustering and presented a video on clustering to the Planning Commission. City Planner Pung-Terwedo addressed a memo to the council, dated August 1, 1995, and asked for Council direction on the clustering concept before proceeding further. A map was presented showing agricultural and residentially undeveloped land at this time, and the city planner stated she is receiving more inquiries of development options from farmland owners. Planner Pung-Terwedo recommended the council create goals and policies for cluster development in the form of a Comp. Plan amendment and establish a cluster ordinance to implement those goals and policies. Planner Pung-Terwedo stated she met with a planner at Met. Council, and discovered the cluster concept is such a new idea, even at the Met. Council level, they would be willing to help the city with the comp. plan amendment and establish regulations to allow for cluster housing. Planner Pung-Terwedo asked for direction, for staff and Planning Commission, on how the council wants to proceed with the cluster idea. The consensus of the City Council was to set up several joint workshops with the Planning Commission, receive more information from staff, learn more about cluster planning, with the objective of getting a consensus of the council and commission on clustering. The first workshop will be held Tuesday, August 22 at 7:00 p.m. in the City Council Chambers. 7. CITY ENGINEER'S REPORT: A. 36th & 37th Street drainage: Cost split with property owners. At the last council meeting, City Planner Larry Bohrer reported the out of pocket expenses for materials for the 36th and 37th St. drainage project were estimated at $5,000, with the city crew providing equipment and labor. The instruction was to contact the two property owners, the Strege's and the Boche's, to inquire if they would share the cost of the project with the City - approximately $1666 each. Mr. Bohrer contacted the owners and received a positive response from both. Mr. Bohrer added that he had suggested, to the owners, the possibility of reducing the material cost by the owners taking the responsibility of seeding the drainage ways rather than using, the significant amount of, sod. The owners are thinking about this suggestion. LAKE ELMO CITY COUNCIL MINUTES AUGUST 1, 1995 PAGE 8 M/S/P Hunt/Johnston - to order the project as presented by the City Engineer and direct the City Engineer and staff to construct the street drainage project for 36th and 37th Street with the agreed upon materials cost share with the two property owners, with the option that the two property owners have the opportunity to use grass seed instead of sod. Motion passed 4-0. 8. CITY PLANNER'S REPORT A. MN Design Team Visit. City Planner Pung-Terwedo reported the Steering Committee for the Design Team visit has been assembled and met for the first time on Monday, July 31 in the Council Chambers, with Design Team representatives Arthur Merhoff and Tim Mcllway. The committee reviewed the schedule for the weekend visit, and will meet again on August 7 to discuss facilities, group gatherings, food, publicity, etc. The committee will meet again with Team representatives on August 14. The council received a list of the steering committee members, and Floyd Olson was added. About 6 more host families are needed, if anyone knows of anyone that could put up Team members for the weekend. All meetings are open to the public. B. 1-94 Corridor Study. City Planner Pung-Terwedo reported the 1-94 Task Team is assembled, and the council received a list of the task team members. The task team has not met yet, due to other immediate planning issues the City's been dealing with, and the mapping for the area is not quite ready yet. However, it is expected they will meet within the next two weeks. A questionnaire has been prepared and distributed to all the property owners within the 1-94 Study Area, and responses are being received. The council felt that the committee members should be recognized, however, are not official committees of the council, and all meetings are open to the public. 9. CITY ATTORNEY'S REPORT: The City has filed a counter claim against Hammes Sand & Gravel, and they have twelve days left to respond to that claim. 10. CITY COUNCIL REPORTS: Councilman DeLapp reported he participated in a recent bus trip through Polk, Pierce, and St. Croix Counties with a number of Metropolitan Council members. At a meeting in Hudson the City Council and public officials of Wisconsin discussed concerns about development in western Wisconsin outside of Met Council's jurisdiction. Council member Johnston asked the City Administrator and City Planner when the council will receive a report on their visit to Overland Park Kansas? Administrator Kueffner replied that at the next City Council meeting a report will be given. LAKE ELMO CITY COUNCIL MINUTES AUGUST 1, 1995 PAGE 9 11. CITY ADMINISTRATOR'S REPORT: A. Assessment Policy - City Administrator Kueffner stated she did not have a chance to get to the assessment policy. This agenda item was tabled. B. Other - City Administrator Kueffner reminded the council that the City had been approached, earlier this year, by Roadway Express to present a proposal for locating their facilities in Lake Elmo, and the council declined the offer. Administrator Kueffner reported that Roadway went to Mahtomedi, however, may not get approval, and will have an incredible impact on Long Lake. Administrator Kueffner expressed the Roadway proposal would be low impact and would generate a lot of tax dollars. Administrator Kueffner recommended the council look at the Roadway proposal. The council discussed impacting the 1-94 corridor at this time with a proposal such as this, and sending mixed signals to Roadway Corp. Since the council directed the City Planner to study the 1-94 corridor, It was the consensus of the City Council to direct City Planner Pung-Terwedo to review the proposal, and only if she finds the proposal consistent with the concept of the 1-94 study should it be presented to the council.
