Mayor John called the council meeting to order at 7:10 p.m. in the city council chambers.

4. PUBLIC INQUIRIES:
Mary Siedow, 2796 Inwood Avenue N., stated at the 26th Street entrance the water is coming down and
damaging his property and suggested putting a couple of drainage culverts under the road to divert the
water from running onto his property. Larry Bohrer explained that the platted drainage way, that is on the
north side of Mr. Siedow's property, takes drainage from not only a portion of Lake Elmo Hts. 2nd
addition, but also a portion of Lake Elmo Hts. 3rd addition and the westerly Inwood Avenue ditch. A
suggestion was made if perhaps a portion of the water could be intercepted in the Inwood Avenue ditch
and diverted to the east side that would diminish the amount of flow that goes along that drainage way.
Bohrer felt installing a culvert appeared to be feasible from an engineering standpoint, and it would be a
good solution, if permissible, incorporated with the new design of Inwood Avenue.
Bohrer indicated that Lake Elmo Heights 3rd Addition has met our storm water requirements.

M/S/P Hunt/John - to direct the city engineer to work with Washington County in the design of Inwood
Avenue to see if a portion of the water could be diverted from the west side to the east side of Inwood
Avenue probably through a 15" culvert which costs would be included in the County's project for
reconstruction of Inwood Avenue. (Motion passed 5-0).
Request from Ed Abbott for fireworks display:
Ed Abbott, 3600 Kelvin Avenue N, requested permission for a onetime use of fireworks on his property of
28 acres, Saturday, September 9th, by a pyrotechnic who is licensed by the State. Attorney Filla
explained the city does have the authority to regulate the use of fireworks, and if the city chooses, it could
allow this to occur in the city if there is a licensing procedure for it. Currently, the city code does not allow
a display of fireworks within the city. The ordinance would have to be changed to allow this use to occur
and it is not the kind of activity you could grant a variance to and waive the provisions of the city code.
Discussion occurred and Mr. Abbott was informed that the city's regulations do not allow the use of
fireworks on his property. The Council decided it was too short of a time schedule to change the code
allowing this type of use on September 9th, but Mr. Abbott did get the procedure started for the Council to
discuss the appropriateness of changing the code allowing fireworks.

5. CITY ENGINEER'S REPORT:
A. Update on visit to Upper 33rd St. regarding 1995 Overlay
Larry Bohrer reported he and the Mayor met with the Markgrafs and Dunns out on the site of the 33rd St.
proposed paving project. There were two issues discussed; the paving of the westerly gravel portion of
the road itself and the proposed construction of a turnaround. At the conclusion of the meeting, it was
generally agreed that the residents, Markgrafs and Dunns, would accept the paving of the gravel portion
of the road up to the westerly end of the Markgraf's driveway, but eliminate the T-turnaround. Also, the
reflective signage needs to be upgraded by Public Works because of deterioration. Bohrer added that
even though paving stops some 30-40' short of where the barricade is now, Public Works will need to
plow all the way to keep the fire lane open.
M/S/P Johnston/DeLapp - to approve the modification agreed upon on Upper 33rd St.; that is, to pave the
gravel portion of the road up to the westerly end of the Markgraf's driveway and to eliminate the T-
turnaround (Motion passed 5-0).
B. Hill Trail N./Hill Trail Court Drainage Problems
Larry Bohrer was asked by the City Administrator to review the drainage patterns in the area with the
Council because of certain requests of property owners. He reported there are two affected property
owners, Furseth and Brown, with high water problems. The Public Works Dept. has pumped that wetland
occasionally when the water has reached high levels. Before the mid 1980's, there were two catch
basins and a pipe at the intersection at Hill Trail Court and Hill Trail. This would intercept some of the
street drainage from these two streets and direct it to Lake DeMontreville. In the mid 80's, the owner of
the property, Castle Design, wanted to try to develop this parcel of property and discovered a storm
sewer out across their property without the benefit of an easement to discharge water across that lot. It
was requested and granted that the water discharged be stopped; therefore, the two catch basins were
fitted with a steel plate over the grate and paved over so they could no longer accept water and transfer
water across property. The Furseths and Browns believe that by closing off the catch basins it has
contributed to the high water problems in the wetland. Bohrer agreed that closing of the catch basins
may contribute to the high water, but certainly doesn't cause the problem. This water problem was
identified in a report identifying various flooding concerns done by the previous engineer in 1978. The
residents, Furseth and Brown, have asked if the city would investigate reopening of that drainage facility.
Bohrer asked if the city would like him to make contact with the new owners, the Taylors, to see if there
would be an objection to reopening those catch basins..

Mayor John stated he was contacted by Brenda Taylor this afternoon and they would not be adverse to
entering into negotiations with the city on an easement for reopening of the catch basins.
M/S/P John/DeLapp - to approach the Taylors to find out what is involved in reopening the catch basins
and obtaining an easement on the Taylor property to transfer water across their lot into Lake
DeMontreville and approach VBWD on what their reaction would be to this proposal. (Motion passed 5-
0).
C. Request for time extension for overlay project - T.A. Schifsky
Larry Bohrer reported in his letter dated September 1, 1995 that TKDA received a letter from T.A.
Schifsky and Sons requesting an extension of contract completion date from the specified September 1,
1995 to September 15, 1995. T.A. Schifsky cited delay due to wet weather as the justification.
The contract was awarded on May 2, 1995 and the specified completion date is September 1, 1995. The
contract provided that liquidated damages will be charged at $400 per calendar day for each day the work
is not completed. Bohrer pointed out that the work consists primarily of blacktopping, but also contains
more drainage improvements which must be completed prior to the paving. As of this date, all the
drainage work is completed, but none of the paving work has started.
One of the reasons TKDA set September 1, 1995 as the completion date is so that they would have
approximately two weeks to calculate the costs for preparation of assessments If they do not have the
final costs, they must assess based on estimates which is undesirable. Bohrer would like to report final
costs to the Council on September 19 and call the assessment hearing for October 17.
Attorney Filla recommended that the city not grant an extension and waive the claim of recovering
damages at this time. Filla thought it was hard for the city to react because we do not know if rain has
delayed the project in Lake Elmo because Schifsky hasn't given the City any documentation to support
this. It is appropriate to request documentation as to why T.A. Schifsky hasn't been able to do this work
in Lake Elmo within the allotted time.
M/S/P John/Hunt - to send a letter to T.A. Schifsky stating that the City rejects the requested extension of
the contract completion date from the specified September 1,1995 to September 15, 1995 as requested
by David W. Schifsky, CEO, letter dated August 30, 1995 to Larry Bohrer and the City requests
documentation submitted as to why this 1995 Overlay Project is late. (Motion passed 5-0).
4B. VBWD & Barr Engineering re:Olson Lake Estates Pond
Larry Bohrer has received a letter from Randy Peterson outlining the anticipated project schedule for
rerouting the discharge from Olson Lake Estates Pond to bypass Olson Lake. The contract work could
start the first part of October. Laying of pipe work could be completed, but road restoration on Lake Jane
Trail would not have a chance of being completed by winter. The project would go through the winter with
a gravel road surface on Lake Jane Trail. The advantage to this is that water would be diverted from
Olson Lake Pond as soon as possible. The disadvantage is Lake Jane Trail would have a temporary
gravel surface and with a spring thaw would become non passable. An alternative would be to wait and
begin project early in the spring. As soon as the pipe work is completed, the road work would be
completed. This would minimize the inconvenience of the public.
If work began this fall, blacktopping Lake Jane Trail couldn't be completed, leaving the road as gravel
throughout the winter. Since the pipe will be placed beneath the road, portions will be excavated. During
the spring thaw, residents would be driving through mud. Offered the choice of beginning the project this
fall or in the spring, the Council favored spring construction.

Larry Bohrer has discussed with Randy Peterson, the concern on when laying the pipe along Lake Jane
Trail there is a single T-watermain where 81 homes in the affected landfill area, are relying on this main
for water and cannot be taken out of service.
M/S/P Hunt/Conlin - to direct the City to send a letter to VBWD voicing its opinion that this project bid be
let this Fall, and the project should start in the Spring with reason being the risk of closing down Lake
Jane Trail, which is a main thorough fare, is too high should there be an early melt and the road becomes
non -passable. (Motion passed 5-0).
Gordon Moosbrugger, VBWD Board Manager, stated the pond level has subsided and the plug does not
need to be pulled yet, but during the spring thaw it might be necessary to pull the plug. The VBWD
adopted a motion to direct Zetterberg to negotiate an extension of an easement across Mr. Winkel's
property back into the lake until January 31,1996 or construction, whichever is first. At a public meeting
on July 31, President Zetterberg said that allowing the pond to permanently flow into Olson Lake was not
an option since the DNR probably would not grant a long-term permit. Council member Johnston stated
her disappointment with the Board of Managers, as a whole, in the granting of the permit extension when
it was said at the hearing that no such extension would be requested or granted.
C. St. Croix Valley Youth Bureau - Request for Funding
M/S/P John/DeLapp - to postpone discussion until Mr. Weiler, St. Croix Valley Youth Bureau can attend
meeting. (Motion passed 5-0).
6. PLANNING/LAND USE & ZONING:
A. Case #SUB/95-19 Torre Pines Final Plat
Preliminary Plat approval for the subdivision of a 78.43 acre parcel of property into 24 single family lots,
Torre Pines, was approved by the City Council on July 18, 1995 and a list of conditions were included.
The Planning Commission approved the final plat at their meeting on August 28, 1995.
Planner Terwedo reported the Final Plat, as presented, reflects the preliminary plat for Torre Pines which
the city approved. As discussed in the staff report for the final plat presented to the PZ at their meeting
of August 28th, the site was Inspected for oak wilt. No signs of the disease were found.
The Council received a letter from Larry Bohrer, dated September 1,1996 stating he has reviewed the
final plat of Torre Pines as prepared by Midwest Land Surveyors and Civil Engineers, Inc. and the plat is
in accordance with the approved preliminary plat.
M/S/P DeLapp/Hunt - to adopt Resolution No. 95-44 approving the Final Plat for Torre Pines as amended
and entering into a developers agreement conditioned on the following:
1. The applicant meets the conditions set forth by the Valley Branch Watershed District in its letter dated
June 12, 1995.
2. The applicant meets the conditions as set forth by the City Engineer in his letter dated June 12, 1995
3. The access permit from Washington County shall be submitted to the City.
4. A detailed analysis of the trees one each site shall be submitted to the City Planner in order to
determine if additional landscaping will be required. Responsibility to comply with the ordinance rests
with the developer,
5. A detailed plan for the entrance island and boulevard landscaping for the development shall be
reviewed and approved by the City Planner.

6. The in -lieu -cash park land dedication shall be submitted to the City before the final plat is signed.
7. All city code requirements and comments made by the City Engineer regarding storm water detention
facilities, grading erosion control measures and road construction shall be completed.
8. The developer enters into a Development Agreement with the City subject to approval by the City
Attorney before site grading begins. (Motion passed 5-0).
B. Case #SUB/95-22 Final Plat Beaut Crest
Preliminary Plat approval for the subdivision of a 35.27 acre parcel of property into 16 single family lots,
Beaut Crest, was approved by the City Council on August 1, 1995. The Planning Commission approved
the final plat at their August 14, 1995 meeting.
Planner Terwedo reported the Final Plat, as presented, reflects the preliminary plat for Beaut Crest which
the city approved last month. As discussed in the staff report and the DRAFT Planning Commission
minutes, the final plat was approved based on the original plan. That plan was presented to the Planning
Commission on June 26, 1995. The plan indicated the north cul-de-sac extending to the west end of the
subdivision. The final plat indicates a typical tree boulevard detail which is consistent with the landscape
ordinance.
The Council received a letter from Larry Bohrer, dated September 1, 1995 stating he has reviewed the
final plat of Beaut Crest Estates as prepared by Midwest Land Surveyors and Civil Engineers, Inc.
received in his office on August 28, 1995. The plat is in accordance with the approved preliminary plat.
In particular, the east -west street, known as 35th Street North, is platted to the west subdivision line and
is provided with a permanent roadway easement for a turn -around also at the west end. If the property to
the west develops and it is determined that access should be provided from 35th Street, this cul-de-sac
will be removed and the street extended.
Ed Forliti presented a revised plat showing future road extension of 35th Street N. He had talked to Larry
Bohrer who said he didn't have a problem with stopping the cul-de-sac as long as there is an right-of-way
easement for a future road. The person that develops the property to the west would pay for the road
extension. The council voiced concern in that the developer make sure homeowners know there is a
potential of a road going through and easements are recorded with the plat.
M/S/P Hunt/DeLapp - to accept the revised final plat of Beaut Crest, as presented by Ed Forliti, allowing a
cul-de-sac to end at the start of lots 1 and 6 providing the developer agrees to convey in writing to
purchasers that this road is scheduled to be a through road and post a sign at the end of the cul-de-sac
with wording "Future Road Extension". (Motion passed 5-0).
Attorney Filla explained this would be treated like any other improved roadway; that is; dedicated to public
use but not be owned by the City. If the road is ever vacated, the underlining fee ownership reverts to
adjoining property owners. Filla cautioned the developer that a revised drawing of the final plat showing a
through street has to be submitted and no permits can be drawn until the developer's contact is signed.
M/S/P Johnston/John - to adopt Resolution No. 95-45 approving the Final Plat for Beaut Crest, as
amended, and entering into a developer's agreement conditioned on the following:
1. The applicant meets the conditions set forth by the Valley Branch Watershed District in its letter dated
July 18, 1995.
2. The applicant meets the conditions as set forth by the City Engineer in his letter dated July 6, 1995.
3. The in -lieu -cash park land dedication shall be submitted to the City before the final plat is signed.

4. All City code requirements and comments made by the City Engineer regarding storm water detention
facilities, grading, erosion control measures and road construction shall be completed.
5. Additional landscaping shall be provided along Highway 5. Landscaping on Individual lots will be the
responsibility of the developer to comply with landscape ordinance.
6. The developer enters into a Development Agreement with the City subject to approval by the City
Attorney before site grading begins. (Motion passed 5-0).
C. PUBLIC HEARING: Case #SUB/95-27 Variance to reduce the size of a substandard lot from 8.18
acres to 8.03 acres for the purpose of allowing a Minor Subdivision to correct an error of construction on
a building. Applicant: Robert Taverns, 10174 Stillwater Lane N.
Mayor John opened the public hearing at 9:10 p.m. in the council chambers. The public hearing notice
was published in the August 23, 1995 Stillwater Gazette Extra and affected property owners were
notified.
Planner Terwedo reported that in 1994 a garage was built, unintentionally, on a neighbor's property. In
order to correct the situation, the neighbor agreed to sell that portion of land (7.250 sq.ft.) in which the
garage was located plus additional land so the garage would meet the 10 ft. setback requirement as
required by the zoning code. On June 20, 1995, two options for this minor lot adjustment were presented
to the Council. Option 1 indicated a straight, 290 ft. side property line and Option 2 indicated 341 ft. side
property line which was not straight. The Council preferred Option 1. The Planning Commission
approved the proposal at their regular meeting on August 14, 1995 based on the findings of fact that the
granting of this variance would not be detrimental to the public welfare or adverse to the area, there are
unusual circumstances which have caused this problem of the location of the garage, this is a minimum
transfer of land which will accomplish the ownership of the land that the garage is presently located, and
the other affected property owner is in full support of this minor subdivision.
There was no one to speak against the variances.
Mayor John closed the public hearing at 9:12 p.m.
M/S/P DeLapp/Johnston - to approve the variance request to reduce the size of a substandard lot
(Section 301.090F) from 8.18 acres to 8.03 acres by Robert Taverna, 10174 Stillwater Lane N. based on
the findings stated in the staff report and adopt Resolution No. 95-46 approving a Minor Subdivision, as
presented, to correct an error of construction of a building. (Motion passed 5-0).
D. MN Design Team Update
Planner Terwedo updated the council with a tentative schedule of the Minnesota Design Team Visit on
September 28-30, 1995.
E. Draft Housing Goals, Metropolitan Council - Informational
Planner Terwedo attended a planner's forum on the Livable Communities Act and received draft housing
goals for Lake Elmo. The housing density for single-family detached was determined by using aerial -
photos and includes only existing housing. Lake Elmo's existing density is actually 1.1 unit per acre,

4D. Discussion on newly revised Joint Cooperative agreement for the reorganization of the
Ramsey/Washington Suburban Cable Commission.
The commission, which serves 12 local communities, is currently composed of two representatives with
equal votes from each area served, with a total committee membership of 24. The new "Joint Powers"
agreement will reduce committee size to 12 members and restructure voting procedures to give large
communities more proportional representation than they currently experience. Under the new plan for a
measure to pass, three larger cities and four smaller communities must agree, effectively requiring a two-
thirds representational majority from cable subscribers.
Tom Creighton, attorney for the cable commission, stated his belief that the streamlined committee will be
more efficient than the previous one which he believes was simply too big to get things done. The City
Administrator and Council expressed their hope this reorganization would help get rid of some of the
negative elements this commission has been faced with in the past few years and this new group be
more effective than before.
M/S/P Hunt/John - to direct the city to sign the Joint Powers Agreement for the Ramsey/Washington
County Cable Commission and all paperwork be done before the organizational meeting of Thursday,
September 14, 1995. (Motion passed 5-0).
M/S/P DeLapp/Johnston - to appoint Karen Wandmacher as the Lake Elmo representative to the new
cable commission and council member Rita Conlin as the alternate representative. (Motion passed 5-0).
7. CITY ATTORNEY'S REPORT:
A. SW1 Update
Attorney Filla reported he has conveyed the Council's decision to the County Attorney and to the PCA's
attorney. His understanding is the County is not interested in binding arbitration. If there are going to be
any changes in the current status of negotiations, Lake Elmo will have to make a decision and move
forward to get the negotiations moving. The city has received a letter from the PCA asking us to respond
to an information request.
The Council set up a workshop for September 12, 1995, 5 p.m. to discuss negotiation strategy on the
Washington County Landfill.
8. CITY COUNCIL REPORTS:
Mayor John reported the next Elected Officials meeting for School District #622 will be held on
September 13, 1994.
Councilman Hunt asked the Council to think about holding a joint meeting on October 23 or November 27
between the MAC and the City Council to discuss the original MAC charter.
The Council suggested the following newsletter articles: closing of the compost site and responsibility of
Suburban Cable Commission.

playground equipment for Tablyn Park with labor costs to be taken out of the summer help budget.

SUBJErT: County State Aid Highway (CSAH 13) Safety and Pavement Project
This memo is to let you know what took place at the Lake Elmo City Council Workshop
meeting on Tuesday, September 5, 1995. We thank you for working with us on this
project by giving us your suggestions, ideas, and concerns. It is important to us that
everyone has an opportunity to be heard.
At the meeting, the City Council gave us a design concept that we can proceed with to
develop preliminary plans, which is shown on the attached "typical sections". The
proposed road will consist of a 40 foot wide rural section south of 27th Street, and a 44
foot wide urban section north of 27th Street. Right turn lanes and left turn bypass lanes
will be constructed in the rural section and right turn lanes in the urban section at all street
intersections. The new roadway centerline north of 27th Street will be located
approximately 5 feet west of the existing roadway to balance yard impacts.
The major concerns expressed at the meeting were the speed of vehicles and parking on
the road north of 27th Street. The 44 foot wide urban section would allow parking on
both sides of the road. However, we understand the City Council plans to ban parking
north of 27th Street. The speed of vehicles traveling on the road is also a concern to the
community. The construction of the urban section will enhance the residential appearance
and may help slow down drivers, and we will also review other strategies that can be used
to help reduce speed.
What is going to happen next? We will proceed with our design and prepare preliminary
plans based on the decision made at this Council workshop and public input to date. An
Open House will be held this fall so that you can review the preliminary plans. We will
notify you by mail of the Open House date. After the Open House we will bring the
preliminary plans to the City Council. The attached "CSAH 13 Process" shows the
project scheduling. We hope to have the project under construction next spring.
