Approval of Park Shelter Workers
M/S/P Johnston/Del-app - to approve the December 6, 1995 City Council agenda as amended. (Motion
passed 4-0).
2. MINUTES: November21, 1995
M/S/P Johnston/Del-app - to approve the November 21, 1995 City Council minutes as amended. (Motion
passed 4-0).
3. CLAIMS
An additional handout of claims #4309 through #4329 were received.
M/S/P Johnston/Conlin - to approve the December 6, 1995 claims #4269 through #4329 as presented.
(Motion passed 4-0).
4. PUBLIC INFORMATIONAL:
A. Public Inquiries - None
B. Steve Starke:Metropolitan Council - Discussion of "NutraLime"
Steve Starke, Metropolitan Council, presented a video on "NutraLime" and "N-Viro Soil" and explained
these products are permitted by the MPCA and Dept. of Agriculture. The Council voiced their concern on
lack of notification when NutraLime is going to be spread on land within the City and requested the City
be notified at least thirty days before the land spreading occurs so that the residents in the area can be
notified.
M/S/P Conlin/John - to direct the staff to work with Steve Stake in notifying the city of property involved in
NutraLime application including identification of hauler, and submit a list of adjacent property owners to
Mr. Stake so they can notify the property owners within a month of the date of NutraLime application.
(Motion passed 4-0).
C. Resolution No. 95-56 Adopting 1996 City Budget and Levy Taxes
Council member Conlin stated she received a call from a resident concerned about the city appropriating
funds for charitable organizations. If people want to make charitable contributions, it should be done by
their own choice to charities of their own choice. DeLapp was not comfortable in paying $11;300 for
charities that he might contribute through United Way contributions, personal contributions or Washington
County.
M/S/P DeLapp/Conlin - to accept the 1996 City Budget which includes the old figures of 1995 for
contributions ($1,000 Community Volunteer, $300 Family Violence, $2,200 Youth Service Bureau).
(Motion passed 3-1:John: We have a budget we agree in total. We should not suddenly reduce it by
$7,800 and then find we're short that money that we could find a use for)
M/S/P Johnston/Del-app - to adopt Resolution 95-56, as amended, approving the 1995 Tax Levy,
Collectible in 1996. (Motion passed 4-0).

D. Snowmobile Complaints
Three of the flowering crabs planted on Highway 5 through a grant the City received have been
completely sheared off. There is a path where the riders weave between the trees. The property along
Highway 5, from east of the bank all the way through town is already rutted. There is a path from County
Road 17 through the school property up to Highway 5.
M/S/P John/DeLapp - to direct the staff to contact the Stillwater Snowlords emphasizing the seriousness
with which the council views the activities of snowmobiles in the City and that the City is considering
banning snowmobiles unless the behavior of snowmobiles in the city improves and request notices be
posted of the snowmobile ordinance and trails in locations the snowmobilers go to. (Motion passed 4-0).
Bohrer stated he will contact the school about his concern on snowmobiles driving over their drainfield
and ask they mark or fence off the drainfields at the Lake Elmo Elementary School and Oak -Land Jr.

E. Recommendation from Solid Waste Advisory Committee on Christmas Tree Pickup
Administrator Kueffner reported the Solid Waste Committee recommended that the City will collect
Christmas trees on January 6 with a blizzard day of January 13. Residents are asked to bring their trees
to the public works building to be chipped and shredded. In return for bringing them in, participating
residents will receive a coupon for a tree seedling that can be redeemed this coming Earth Day/Arbor
Day. Anyone that has a compost sticker can drop the tree off otherwise there is a $1 or $2 charge. Each
tree costs 47 cents which comes in a bag with a message, City logo, and instructions on planting.
M/S/P Conlin/John - to approve the Christmas Tree pickup program for January 6, 1996 in conjunction
with the seedling give away project. (Motion passed 4-0).
Caring and Sharing Hands: Maroney is willing to pick up warm clothes; jackets, hats, mittens in a plastic
bag placed beside the curbside recycling on Wednesday, December 20 and Thursday, December 21.
The material will be picked up and brought to the Parks Building and Mike Bouthilet and other volunteers
will take them to Caring and Sharing Hands in Minneapolis.
The Solid Waste Advisory Committee was informed the City made approximately $8,500 on the Compost
site. The committee supported the purchase of the additional 5 acres the council is considering for a
compost site.

6. PLANNING, LAND USE AND ZONING:
A. Public Hearing: Case W95-34 -Variance to front yard setback
Applicants: Robert and Victoria Seifert, 9692 57th Street N.
Mayor John opened up the public hearing at 8:30 p.m. in the Council chambers. The Public Hearing
notice was published in the November 24, 1995 Stillwater Gazette and the adjoining property owners
were notified.
Robert and Victoria Seifert are requesting a 12' variance on Lot 5 Block 1, Rolling Hills Estates (approx. 3
acres), in order to accommodate 2200 sq.ft. walkout rambler in the area designated by the developer,
Chuck Nelson, Nelson Properties. The variance requested is to move their home 12' in a southerly
direction (to the front of the property) toward the street. Due to the setbacks required in the RE zoning,
they are unable to fit their home in the designated pie shaped area as indicated by the developer. The
following hardship was given by the applicants: (1) the shape of the area designed for a home on this 3
acre parcel makes it impossible to fit a home after including all the required setbacks. (2) The literal

interpretation of the ordinance deprive them of the rights commonly enjoyed by other properties In the
same district. The right to build a home on a lot that was advertised as a lot conducive to a walkout
rambler that must be a minimum of 1800 sq.ft. on the main level.
John Urban, 9612 57th Street, voiced his support as an adjoining neighbor to the requested variance.
A letter was submitted by Len & Bobbie Juran, 9784 57th St. N., indicating they have reviewed the
surveys provided them from the Hy -Land Surveying Company and do not have any objections to the
proposed positioning of the building and supports the variance request.
M/S/P Conlin/Johnston - to grant a variance for a front yard setback to Robert & Victoria Seifert, 9692
57thSt. N., based on Findings 1,2,3 (as amended: The special circumstances of the limitations of the
buildable land area was not a result of the action of the applicant or the City of Lake Elmo), and 5,6,
excluding Findings 4, listed in the City Planner's request for Council action dated December 5, 1996, and
there were no comments received against the variance request, there was a letter and verbal support
from adjoining neighbors and the council would not waive the fees for the variance request. (Motion
passed 3-1:DeLapp)
B. Special Ordinance 8128 declaring a Residential Development Moratorium
The City is presently working on open space (cluster) policies as part of a comprehensive plan
amendment and zoning overlay regulations. In order for the City to properly develop the new land use
policies and regulations, a six month moratorium on development is proposed. At their November 27,
1995 meeting, the Planning Commission held a public hearing and recommend the moratorium. The
Commission added two points to the ordinance. The first is to permit the subdivision of large lot parcels
(10 acres or more) and minor lot line adjustment.
The Council received copies of letters that were submitted to the PZ at the Public Hearing on November
27, 1995.
M/S/P Conlin/Johnston - to adopt Ordinance No. 8128, as amended (Delete:F..... unless said term is
shortened or extended by action of the City Council), An Ordinance relating to a Development Moratorium
on Residentially Zoned Property based upon the recommendation of the Planning Commission. (Motion
passed 4-0).
Planner Terwedo explained the City has to make some long range decisions regarding the open space
(cluster) land use policies and regulations She asked they come to a consensus of four issues. The
Council agreed the city does see open space developments (clustering) as a viable option as long as
there is some definite legal protection of the open lot as a result of the cluster. The Council felt it was
important that the city should provide life -cycle housing, but how and where had to be resolved.
The Council will hold a workshop on December 12, City Hall, 6-8 p.m. to consider Issue No. 2, Discuss
the type and location of Open Space Developments in the City.
C. Alternate Ag/Agricultural Zoning: Permitted Uses Discussion
The purpose of the Alternate Ag Zoning District Committee meetings was to receive comments from
property owners on what uses they felt should be permitted in the Agricultural Zoning District. The
committee was directed to come back to the council with recommendations and findings, but as of this
date, no recommendations have been submitted.
Tom P. Armstrong explained the legislature did not repeal the annexation law and February deadline will
be here shortly. He wished the Alternate Ag Committee would have come up with something more
concrete, but they didn't, The issue has to be addressed now and basically it is an issue of open space.
We want to retain our rural atmosphere of our farm. In order to do that, we have to get away from the

traditional agriculture and use very low intensity commercial operation on a limited area of the farm. We
would like you to direct the planner to investigate the issues.
M/S/P John/Conlin - to table until January 2, 1996 Council meeting in order to put together the Alternate
Ag Committee minutes to continue discussion with Councilman Hunt and Commissioner Helwig's input.
(Motion passed 3-1:DeLapp- Would like to see the planner define issues. Open space needs to be
clarified. This is taking too long of a time).
D. Ordinance 8127 "Temporary Parking Permits"
The Council reviewed a draft ordinance at their last meeting and made some minor changes and asked
the staff to bring back the revised ordinance for consideration. Social events have been added to the
ordinance.
M/S/P Johnston/Conlin - to adopt Ordinance 8127 amending Section 1002.040 and adding Section
1002.050 to the Lake Elmo Municipal Code relating to Temporary Parking Permits. (Motion passed 4-0).
E. Approval for Map Services
Planner Terwedo explained in preparation of the Comprehensive Plan Amendment for the open space
(clustering) policies and ordinance preparation, there are overlay maps which will be needed to provide a
development framework for the areas in the City identified. Insight Mapping prepared a quote for
services to develop a restrictive soils map along with a map depicting prime agricultural lands. This
mapping will assist the City in making decisions on the future of these areas. The City must also
purchase the soils information from Washington County in order to prepare the map.

7. PARKS/MAINTENANCE DEPARTMENT:
8. CITY ENGINEER'S REPORT:
A. Final Payment for 1993 MSA Project
Larry Bohrer reported in his memo dated December 1, 1995 that the work performed by Tower asphalt on
the 1993 MSA Improvements (Jamaca Avenue and Lake Jane Trail) is complete and ready for final
acceptance.
M/S/P Johnston/DeLapp - to approve Compensating Change Order No. 4 in the amount of $48,507.95.
(This figures shows that the final cost was lower than the original bid). (Motion passed 4-0).
M/S/P to approve the Final Payment in the amount of $40,885.70. (Motion passed 4-0).
B. Change Order #1 for 1995 Overlay Project and Partial Payment No. 2
Larry Bohrer reported in his memo dated December 1, 1995 that at the beginning of the 1995 Overlay
Project, Marilyn Kennedy advised them of a drainage concern near 9051 Jane Road. It was determined
that a short storm sewer installation was necessary to convey drainage from the north end of Jane Road
northerly in the Jamaca Avenue Blvd. to a ponding area in FoxFire Estates. This item was discussed at
LAKE ELMO CITY COUCNIL MINUTES DECEMBER 5, 1995
the assessment hearing as one of the non -assessed City sharing drainage improvements. The
Contractor was directed to add this work to the contract.
Bohrer recommend approval of Change Order No. 1 and Partial Payment No. 2 for work completed in
October. Since the work is substantially complete, Bohrer recommended reducing the retainage to
$5,000.
M/S/P John/Johnston - to approve Change Order No.1 in the amount of $6,040.00. (Motion passed 4-0)
M/S/P John/Johnston - to approve Partial Payment No. 2 in the amount of $11,176.11 for work completed
in October. (Motion passed 4-0).
C. 1996 MSA Maintenance Allotment
Bohrer reported that the 1996 Municipal State Aid Allotment for the City is estimated at $149,762.
Bohrer recommended for 1996 the City requests the minimum maintenance at $14,295 (minimum
maintenance request is $1,600 per mile of MSA street in the city which amounts to $14,295.) The
remainder of the allotment should remain in the City's construction account for the next significant
reconstruction project.
M/S/P Conlin/Johnston - to direct the City Engineer to inform the Commissioner of Transportation that for
1996, Lake Elmo requests the minimum maintenance of $14,295 for State Aid streets. (Motion passed 4-
0).
9. CITY ATTORNEY'S REPORT:
10. UNFINISHED BUSINESS:
M/S/P John/DeLapp - to direct the City attorney to draft a purchase agreement which may be used in the
city's dealings with Mr. and Mrs. Berschens for property (approx. 15 acres) on Julep and 45th Street for a
new public works and compost facility; contingent upon satisfaction of completion of rezoning from Rural
Residential (RRI to Public Facility (PF). (Motion passed 4-0).
The Council will address the purchase agreement at the council workshop in December 12, 1995, 8-8:30
p.m.
11. CITY COUNCIL REPORTS:
12. CITY ADMINISTRATOR'S REPORT:
A. Application for 1-day off -site gambling license: Maplewood/Oakdale Lions at the Lake Elmo Inn
The Maplewood -Oakdale Lions have requested that the State of Minnesota issue a one -day (February 5,
1996) Off -Site Gambling License. The Lions desire to sell raffles and tipboards at a location within the
Lake Elmo Inn located at 3442 Lake Elmo Avenue.
M/S/P DeLapp/John - to adopt Resolution No. 95-57 approving the issuance of a charitable gambling
license by the State of Minnesota to the Maplewood -Oakdale Lions. (Motion passed 4-0).
B. 1996 Intoxicating and Non -Intoxicating Liquor Licenses
Renewal of the 1996 Liquor Licenses were submitted for the city's approval. Certificates of insurance
and fees have been paid. Approval by the Washington County Sheriff's Dept. has been received.

M/S/P DeLapp/Johnston - to grant the following 1996 Liquor and Beer Licenses: a Club On -Sale Liquor
( Licenses to the Veterans of Foreign Wars Post 5725, On -Sale and On -Sale Sunday intoxicating Liquor
License to 3M Club of St. Paul (Operators of Tartan Park), On -Sale Intoxicating Liquor, Off -Sale
Intoxicating Liquor, and On -Sale Sunday intoxicating Liquor License to the Twin Point Tavern and Lake
Elmo Inn; and Off -Sale Non -Intoxicating malt liquor license to the Brooks Superette. (Motion passed 4-
0).
C. Volunteer Appreciation Party
The VFW Hall has been reserved for the Volunteer Appreciation Party on Friday, January 26, 1996,
M/S/P Johnston/DeLapp - to invite all the Minnesota Design Team volunteers and hire a cater for the
Volunteer Appreciation Party. (Motion passed 4-0).
D. Washington County Communications Plan
The City received a letter from Sheriff Frank regarding the County's Communication Plan as it relates to
the development of a region wide 800 MHz Trunk Radio Network. Sheriff Frank sates t his letter that he
would like to put together "a committee comprised of people from all types of government agencies
