PRESENT: Hunt, Conlin, John, Johnston, DeLapp, City Attorney Filla, City Planner Terwedo and Administrator Kueffner. 1. AGENDA ADDAC. B. Council liaison to Lake Elmo Jaycees At the last council meeting, Rand Wagner, a Jaycee member, asked if there was interest in designating a Council liaison to the Lake Elmo Jaycees. M/S/P Conlin/Johnston - to appoint Council member Lee Hunt as council liaison to the Lake Elmo Jaycees for 1996. (Motion passed 5-0). C. Appointments to the Maintenance Advisory Committee Bill Wacker reported that all the members now on the Maintenance Advisory Committee are interested in continuing to serve on the Committee. LAKE ELMO CITY COUNCIL MINUTES JANUARY 16, 1996 3 M/S/P Conlin/DeLapp - to appoint Bill Wacker, Dick Johnson, Rick Gustafson, Fran Pott, and Bud Talcott to the Maintenance Advisory Committee and as liaison to the Maintenance Dept., Dan Olinger; Parks Department, Mike Bouthilet; Fire Department, Chief Dick Sachs. (Motion passed 5-0). 5. CONSENT AGENDA: None 6. PLANNING,LAND USE AND ZONING: A. SUB 96-1, Minor Subdivision Lot Line Adjustment, Sovereign/Larson 4545 Olson Lake Trail (tabled from 1-2-96 meeting) This agenda item was deleted and will be placed on the January 22, 1996 Planning Commission agenda. B. Livable Communities Act/Lake Elmo Housing Goals The City Staff and the Planning Commission recommended that the City adopt the housing goals as presented. Councilman DeLapp submitted his concerns in a memo dated January 14, 1996. DeLapp added that he takes goals and bench marks very seriously and is concerned on what the net result of adding 2,000 dwelling units will be to the City and what is the City committing themselves to. M/S/P Hunt/Conlin - to adopt the proposed draft for Housing Goals Agreement, Metropolitan Livable Communities Act as recommended by the Planning Commission in its meeting of 1-8-96. (Motion passed 4-1:DeLapp:See concerns listed in his memo dated January 14, 1996 which will be made part of the minutes.). C. Recommendation from Planning Commission on site selection process for new public works/compost facility. Planner Terwedo reported the Planning Commission held a public hearing on a rezoning of the Berschen site for the maintenance garage/compost site at their January 8, 1996 meeting. Approximately 50 neighbors and concerned citizens attended the meeting. There was an overwhelming sentiment that the residents did not want the public facilities located in their neighborhood. In particular, they fear the compost site will generate bad odors, fungus/algae into their air and water and disrupt the rural/residential character of their area. The citizens felt that the City did not study the option in enough detail. The Planning Commission's recommendation is for the Council to consider reevaluation of the various options for the maintenance garage/compost site due to the public comments made at the hearing. Jim McLeod, Chair of Planning Commission, didn't think that the Commission's position was the City Council had not studied alternate sites. The issue before them was strictly a rezoning matter and the public hearing was left open. The Planning Commission believed there was not enough public awareness of selection of sites prior to a decision being made. Based on public protest to a compost site, the Council considered looking at eliminating a compost site in connection with the maintenance garage. The Council felt a composting site would have been a nice addition to the community, but expressed their wish that plans for the composting facility be abandoned. M/S/P Hunt/Conlin - that the City Council drop the compost site from the requirements for the new maintenance facility. (Motion passed 5-0). LAKE ELMO CITY COUNCIL MINUTES JANUARY 16, 1996 Planner Terwedo suggested the Council and the Planning Commission set up a workshop to go through the definition and objectives of the site for a maintenance garage. Council member Conlin suggested looking at additional sites, such as, the airport advisory area, which was initially suggested by Wichser and Herreid, and also the Brookman property closer to City Hall. Councilman Hunt suggested the City move the Fire Dept. building to the Maintenance facility which would allow us to operate off of one site for an indefinite period of time so we can go through the site selection process. Hunt would like the MAC to get more involved with what the City needs for a good functioning maintenance facility which was acknowledged by Bill Wacker, Chair of MAC. M/S/P Hunt/Conlin - to schedule a workshop at a date agreed upon with the Council, Planning Commission, Public Works Dir, Fire Chief, and appropriate staff to discuss a decision analysis of the three sites already selected as possibilities for the new maintenance facility and discuss the same site selection process for any potential areas that may be brought up at that time. (Motion passed 5-0). M/S/P Hunt/Conlin - to schedule a workshop for analyzing the maintenance facility sites for January 23, 1996 at 7 p.m. (Motion passed 5-0). The Council requested the Planning Commission postpone the continuation of the public hearing for the rezoning of the Berschen property from January 22, 1996 to the February 12, 1996 Planning Commission meeting. D. Multiple Residential Dwellings in City - Zoning questions Planner Terwedo explained it has come to the City's attention that there may be a potential zoning and licensing issue with a home day care facility at 9442 Stillwater Blvd. The entire home is presently being used as two separate licensed day care facilities. Terwedo pointed out there are two issues of concern, the first is the home has been used as a duplex in a single family zoning district. There are no records of when this home was converted from a single family use to a duplex use. The second issue of concern is the two day care licenses serving two single family residential uses on one property. Under the Minn. Stat. S462.357 Subd 7, a licensed day care facility serving 12 or fewer children shall be considered a permitted use in the single family residential zone. Under Minn. Stat. 462.357, a licensed day care facility serving from 13-16 persons shall be considered a permitted use in the multifamily residential zone. The day care has been located at this site for four years. The council received a letter from Attorney Fills, dated October 27, 1995, regarding Day Care Licensing Regulations, City Zoning Regulations. Filla indicated the City needs to decide whether or not there is any reason why this property needs to be treated as a multi -family use. Is there something that the City has done in the past that would legitimize the conversion from single family dwelling to multiple. If not, we have a structure in the single family zone with a multiple family use, whether its day care or whether its two individual families which is not permissible. The State regulation requires the County and the State to check into local zoning before they issue licenses. Washington County has told him that in this particular case they did not check with the City. The County was told it was a duplex and that is why they issued the licenses as they did. If a use is not permitted within the zone, it is illegal and needs to be terminated. If there is some reason why the City has allowed that to continue or issued permits to allow improvements be made and money spent, then a court would conclude even though regulations do not allow multiple family use in that zone, because of the City's involvement and expenditure of money and reliance on that, the City is precluded from applying that regulation to these people. Tammy Malmquist, 9442 Stillwater Blvd., explained it is a duplex and each dwelling has its own address. Washington County licensed a day care to each individual address. It was a duplex since 1961 and was advertised as a duplex (9442 and 9449) when they bought it. The county rented it from the previous owners as a group facility for physically and mentally challenged adults. LAKE ELMO CITY COUNCIL MINUTES JANUARY 16, 1996 5 Councilman Hunt indicated the City has to determine if this is a legal duplex. If there are other duplexes in the City operating in a single family zone, the staff needs to investigate those also. M/S/P Johnston/Conlin - to direct the staff to review the background on the conversion of this home at 9442 Stillwater Blvd. from a single family use to a duplex and to prepare a letter to the Attorney General requesting an interpretation of Minn. Stat. 462.257 Subd. 7 and Subd. 8. (Motion passed 5-0). E. Schwartz variance request (tabled form December, 1995) Staff request for extension until February 6, 1996 Planner Terwedo reported the staff has reviewed the lot sizes, land uses, and buildings on the north end of Lake Elmo in the "Old Village". This was a direction in response to a variance request by the Schwartz family on 32nd St. Staff intends to photograph the north end of Lake Elmo from the lake and review the general size and character of structures on the lots shown on the map provided. The Council did not want to see this dragged out, but wanted the information available so they could take action on the Schwartz request at the February 6, 1996 meeting. M/S/P Hunt/Johnston - to continue Case No. W95-31 (Schwartz variance) until February 6, 1996 so staff has time to complete the study on the lots on the north side of Lake Elmo. (Motion passed 5-0). F. VAA looking for soccer field sites Planner Terwedo reported the St. Croix Valley Soccer Assoc. is looking for soccer field sites, and she will be meeting with their representative. G. Standards and uses in Ag District Planner Terwedo reported standards and uses have been established for the Ag District and will be presented in ordinance form at the February 6, 1996 Council meeting. H. Setting dates for PZ/CC residential workshop M/S/P Hunt/Johnston - to schedule a joint City Council/Planning Commission workshop on Open Space Development: Density Issues for Tuesday, January 30, 1996, 6 p.m., and reschedule the City Council workshop from Saturday, February 3 to February 10, 1996, 8 a.m.-Noon, at a site selected by the City Planner. (Motion passed 5-0). 7. PARKS/MAINTENANCE DEPARTMENT: A. Response to "Adopt -A -Park' Program The following residents and/or organizations have signed up to Adopt -A -Park in Lake Elmo. Mike Bouthilet, Parks Supv., is working on a "work plan" for these volunteers and the work plan will be presented to the Council when it is finalized. (Motion passed 5-0). LAKE ELMO CITY COUNCIL MINUTES JANUARY 16, 1996 8. CITY ENGINEER'S REPORT: A. Drainage problems on Lake Jane Trail/Jane Road, post-1984 reconstruction of 45th, Julep and 47th Street During the public hearing for the rezoning of the Berschen property for a public works site, concerns were brought up on an existing drainage problem on Lake Jane Trail/Jane Road. M/S/P John/Johnston - to direct the City engineer to investigate the drainage problems on Lake Jane Trail/Jane Road, post- 1984 reconstruction of 45th, Julep and 47th Streets and to come back with a recommendation to alleviate the problem. (Motion passed 5-0). 9. CITY ATTORNEY'S REPORT: Attorney Filla reported the "Notices of Claims" served on the City were forwarded to the League of Minnesota Cities. These "Notices of Claims" are on behalf of residents claiming damages from flooding and/or excessive flows and volumes of water on properties within the Browns Creek Watershed. Lake Elmo has a very small portion of land within this Watershed. 10. UNFINISHED BUSINESS: None 11. CITY COUNCIL REPORTS Council member Conlin attended the Ramsey/Washington Counties Suburban Cable Commission meeting on January 11, 1996 and provided a memo on Franchise Renewal Process:Oakdale Advertising Policy and asked that this memo be copied to the Council. This policy regulating advertisement in its publications, on its government access channel, and on the signage located at City ballfields may be something Lake Elmo might consider. Council member DeLapp furnished an update on the Stillwater Bridge Design Committee which has rejected red and approved blue-green as the color of the bridge. Councilman Hunt gave an update on the Joint Meeting with the MAC and City Council on January 8, 1996. The role of the MAC was discussed and Mayor John passed out a list he had prepared of 8 areas MAC should be addressing. It was suggested that a Report from MAC be added as a monthly council agenda item. Bud Talcott will be meeting with the Finance Director and other Council members to go over the EXCEL spread sheet he developed. Council member Johnston asked if the Council could receive a copy of the minutes of the December 16, 1995 meeting between the Mayor, City Administrator and Fire Department. The Council requested that an offer be extended to the Planning Commission to attend the Sensible Land Use Coalition Meeting on January 31 from 7:30 a.m, to Noon. 12. CITY ADMINISTRATOR'S REPORT: A. Board of Review The City received a memo from Scott Hover, Washington County Assessor, regarding the 1996 Local Board of Review. Lake Elmo has been tentatively scheduled for April 11, 1996 from 4 to 6 p.m. and April 30th at 6:30 p.m. M/S/P Delapp/Hunt - to confirm the 1996 Local Board of Review for April 11, from 4 to 6 p.m. and April 30, at 6:30 p.m. as recommended by the Washington County Assessor, and direct the City Administrator to advise the County Assessor. (Motion passed 5-0). LAKE ELMO CITY COUNCIL MINUTES JANUARY 16, 1996 B. Participation in "Project for Sharing of Major Equipment" The City received a memo from County Administrator, Jim Schug, outlining a proposal to hire an intern to establish a plan for the cooperative sharing of equipment by the County and participating municipalities within the County. In order to participate in this program, the City will have to contribute $750 to help cover the cost of the intern. Administrator Kueffner strongly recommended the City's participation because it might take some of the pressure off staff that has been trying to find a way to share services, or cut costs in the Fire Dept. and Maintenance Supt. M/S/P DeLapp/Hunt - to participate in Washington County's proposed project for sharing equipment and to authorize the expenditure of $750 to join this effort. (Motion passed 5-0). M/S/P Johnston/Hunt - to direct the staff to volunteer Rita Conlin to serve on the Steering Committee at the same time the City indicates our participation in the Project for Sharing of Major Equipment" program. (Motion passed 5-0). C. Forum on Social Outcomes for our Community Entering the 21st Century The City received a memo from Jim Schug, Washington County Administrator regarding the report, Social Outcomes for our Community Entering the 21st Century, produced by the Wilder Foundation under the sponsorship of Greater St. Paul Tomorrow. Council members John and Hunt indicated they would be interested in attending the community forum on Thursday, January 25. D. Law Enforcement Contract for 1996 The Council received a copy of the 1996 Law Enforcement Contract with Washington County. The contract is estimated to be $128,818.89, which is approximately $2,600 over than what the City budgeted for in 1996. Administrator Kueffner reported there was more than enough money carried over from 1995 to cover this difference. The City thought we would have our COPS FAST grant in 1995, (and our third deputy) and we budgeted for that third deputy in 1995, but he did not come on board until 1996. M/S/P Hunt/Johnston - to approve the 1996 Law Enforcement Contract, as amended (Page 4, Item 7. Attorney Filla will talk to the County Attorney about this sentence), and direct the Mayor and Administrator to sign said contract. (Motion passed 5-0). E. Vehicle for Animal Control Officer Mike Smith, Lake Elmo's Animal Control Officer, notified the City that the City of North St. Paul will no longer be providing a vehicle for him to use for animal control activities in that City and Lake Elmo. The vehicle being used was in need of major repairs, and It was their choice to pay Mike Smith for use of his own vehicle rather than purchase a new one. They will be paying Mike $175 per month. Our contract with North St. Paul for vehicle use was $168 per month. Mike Smith has proposed that same agreement with the City for this vehicle ($168 per month) and will provide his own insurance. M/S/P DeLapp/Hunt - to table this item until Administrator Kueffner can check on this agreement with North St. Paul. (Motion passed 5-0). M/S/P DeLapp/Hunt - to adjourn the council meeting at 9:35 p.m. and convene the EXECUTIVE SESSION to discuss a potentially dangerous dog/dog bite. (Motion passed 5-0).
