Mayor John called the Council meeting to order at 7:00 p.m. in the Council Chambers. PRESENT: Hunt,
Conlin, John, Johnston, DeLapp, City Attorney Filla, City Engineer Bohrer and Administrator Kueff nor.

M/S/P Johnston/Conlin - to approve the April 16, 1996 Claims #4647 through #4679 and additional
Claims #4680 through #4705 for 1st Qtr. 1996 Fire Comp, as presented. (Motion passed 5-0).
4. PUBLIC INFORMATIONAL:
A. Arbor Day Proclamation
MAYOR JOHN PROCLAIMED APRIL 26, 1996 AS ARBOR DAY AND MAY, 1996 ARBOR MONTH IN
THE CITY OF LAKE ELMO
Residents that had brought their Christmas trees in can redeem one free seedling at the City Hall on
Arbor Day or during the first week in May.
B. D.A. R.E. Program (Deputy Osterman and Sergeant Swanson)
Deputy Osterman, D.A.R.E. Officer, reported the Lake Elmo Elementary's 5th graders were visited by an
Army National Guard Helicopter, and the students toured the chopper and were instructed on information
and equipment used. The students were instructed on the dangers of drug abuse and reasons why they
should remain drug free. The D.A.R.E. Graduation at the Lake Elmo Elementary School is on May 17,
1996 from Noon to 2:00 p.m..
C. Charitable Gambling License: Lake Elmo Jaycees
The Lake Elmo Jaycees are requesting that the City endorse their Charitable Gambling operation for the
next licensing period 1996-1998. A draft resolution for Council approval and a list of donations made
during the current license period were provided. The Council acknowledged the significant donations by
the Lake Elmo Jaycees and suggested the list of Charitable Gambling donations be published in the
Newsletter.
M/S/P Johnston/Conlin - to adopt Resolution No. 96-6, A Resolution approving the issuance of a
charitable gambling license by the State of Minnesota to the Lake Elmo Jaycees. (Motion passed 5-0).
D. Biological Inventory Group -Tom Skalbeck
Tom Skalbeck, 8879 Jane Road N., and Lisa Burban, an Urban Forester, 9612 57th Street, submitted a
strategy for Lake Elmo's Natural Resources:An Ecosystem -Based Plan. Council member Conlin
responded that establishing such a group would be redundant because the new Open Space Ordinance
does provide for this type of inventory done by the developer on a development site basis for Planning
Commission and Council review. Conlin requested an outline of what the committee would be doing and
the cost and benefit to the City. Once this information has been obtained this item can be presented to
the Council as an agenda item by the City staff for Council authorization.

5. UNFINISHED BUSINESS:
A. Alternate Maintenance Site (continued from last meeting)
The City received a letter from Joe Rogers, dated April 16, 1996, indicating his willingness to enter into
further negotiations with the City regarding the cost of purchasing his property of 16.5 acres on Highway
5 since he heard that land cost has become an issue in the maintenance site discussion.
The Council received a copy of a letter from Joe Lux, Washington County Public Works Dept., requested
by Jim Blackford, evaluating the access to CSAH 6; Stillwater Blvd.) for the proposed Lake Elmo City
Maintenance Facility at Joe Rogers' Property.
The City received a follow-up letter, dated April 15,1996, from Joe Lux, Washington County Public Works
Dept., clarifying the County's position on access to CSAH 6 between TH5 and the railroad bridge. The
County was asked to evaluate the access to the property on behalf of the property owner, Joe Rogers.
Whether this location is suitable for use by the City for construction of a maintenance facility is a City
question with many factors, none of which were considered in our access study. Their study was
intended to say only that if the City were to determine that this location was the proper location for the
proposed maintenance facility safe access could be provided. Their analysis considered only the
relatively small traffic generating capacity of the maintenance facility and any other use would require a
reevaluation.
The Concerned Citizens felt the proposed facility on the Berschen site would destroy the rural residential
character of the area and decrease property values. They presented an alternative of the Joe Rogers'
property because it was flat, had room for expansion and is not in a residential neighborhood.
M/S/P Conlin/DeLapp - that the alternate maintenance site proposed on the Joe Rogers' property
proposed by the Concerned Citizens be considered on a future siting process contingent upon the
outcome of the vote on the Berschen's site. (Motion passed 3-2:Hunt, Johnston).
B. Resolution 96-7 Amending the Future Land Use Map of the 1990 Lake Elmo Comprehensive Plan
This item was tabled at the March 19, 1996 Council meeting so that a full Council was present when the
issue was voted upon. The MPCA has officially given the City until April 29 to vacate Fire Station #2.
This is a one month extension from the March 31,1996 deadline.
On a split vote, the Planning Commission recommended denial of the Comprehensive Plan and Rezoning
siting site distance as one of the reasons opposing this site.
Jim Blackford submitted a list of questions for the Council to consider on the maintenance facility location.
Onno VanDemmeltraadt submitted a memo on sight distances for the maintenance building on the
Berschen site. The Council received a copy of a letter that was put in Jan Berschen's mailbox by a
neighbor.
M/S/P Hunt/Johnston - to acknowledge the presentations this evening and adopt Resolution No. 96-7
amending the Future Land Use Map of the Lake Elmo Comprehensive Plan based on the Findings in the
Planning Review, of CPA/96-8 dated March 11, 1996; conditioned upon approval of the Met Council and
favorable determination by the appellate court on lawsuit Involving this case. (Motion passed 4-
1:Conlin:With this site the City is compromising itself by not having a compost site. The Planning
Commission denied the rezoning in March, and there is strong opposition from the neighborhood).

C. Ordinance 8132 amending the Zoning District Map from Rural Residential to Public Facility
M/S/P Hunt/John - to adopt Ordinance 8132 amending the Lake Elmo Zoning Code based on the findings
in the Planning Review, Case No. ZAM/96-1 dated February 20, 1996; conditioned upon favorable
determination by the Metropolitan Council on the Future Land Use Map amendment, a favorable
determination by the appellate court in the matter of the lawsuit concerning this matter, and successful
closing on the property with the Berschens. (Motion passed 4-1:Conlin).
Administrator Kueffner pointed out the residents proposed changes to the Public Facility Zoning
Ordinance and these changes warranted review by the Planning Commission for a recommendation to
the City Council.
M/S/P Hunt/DeLapp - that the Planning Commission be directed to review the Public Facility Zoning
District with respect to its possible lack of similarities to other zoning districts in terms of standards
including citizen's information from the April 2 meeting be submitted to the Planning Commission in this
matter. (Motion passed 5-0).
D. Assessment Policy
The Council reviewed and approved the draft public improvement and assessment policy which had been
reviewed by the City Engineer and City Attorney.

B.7....project if sixty .... Page 4. DELETE Item D.3.) and publish a summary. (Motion passed 5-0).
E. Agricultural Zoning District Uses
Administrator Kueffner reviewed uses allowed in the Agricultural zoning district and based on discussions
between the Ag Use Committee and property owners in the City that would like to either expand the
existing use of their property (Armstrong, Hammes, Emerson, Springborn and Hansen) or be permitted to
relocate an existing business. Four of these property owners own parcels of land along 1-94 freeway and
would be given a reasonable use of their land for an Interim period of time through the transitional zoning
she has proposed. Attorney Filla explained that reasonable use is not necessarily the most profitable use
of land. The City's position is that anybody who owns property currently has reasonable use of their land
under the City's development regulations.
Council member Johnston indicated if somebody wants to put up a commercial, industrial or business
application of land, they should be looking at zoning that parcel to that kind of use and not making it fit in
an Ag zoning when it is not an agricultural use. Council members indicated they did not want to change
the uses in the Ag Zoning District nor allow transition zoning or reinstate Alternate Ag Zoning.
M/S/P Conlin/Johnston - that the City not consider any changes to the permitted uses or uses permitted
by CUP in the Ag zoning district to be expanded. (Motion passed 5-0).
M/S/P Conlin/Johnston - to direct the Planning Commission to take action on the Armstrong application.
(Motion passed 5-0).
F. Clean-up Day
Administrator Kueffnor reported that the City of Oakdale does not limit clean-up day to their own
residents. Lake Elmo residents are welcome to use the Oakdale clean-up date of April 27, 1996. Both
West Lakeland Township and Baytown Township have their clean-up day at the Washington County

Fairgrounds. Kueffner will look into the possibility of working with a waste hauler for a clean-up day to be
held at the Washington County Fairgrounds.
M/S/P DeLapp/Conlin - to direct the City Administrator to look into the possibility of using the Washington
County Fairgrounds as an alternative site for Clean -Up Day. (Motion passed 5-0).
6. CITY ENGINEER'S REPORT:
A. Road Utility
Mayor John had suggested that the feasibility of establishing a transportation utility be studied. In Larry
Bohrer's report dated April 12,1996, it first must be determined if the City has the authority in law to
establish a transportation utility or if additional legislation is necessary. Once the City's authority has
been established, then the mechanics of determining the fee structure can be discussed.
The Council suggested the staff send an inquiry and express our interest and support in aid of legislation.
Suggestions were made to draft a 10 year plan for street reconstruction, insert in newsletter notification in
advance which roads need to be fixed, and send a letter to property owners to be assessed so they can
prepare for payment in advance. The Council will look at options and come back with recommendations.
This item will be brought back when appropriate for discussion.
B. Assessment Hearing for County Road 13 Reconstruction
If the City wishes to assess any portion of the City's share for reconstruction, then an improvement
hearing is necessary to assess property owners along County Road 13 a portion of the reconstruction
costs for the project. Larry Bohrer suggested that he bring to the Council on May 7th two alternatives,
minimum City participation assessment and maximum City participation assessment and see how the
rates vary. The Council could then give instructions on how to present the improvement at the hearing of
May 21 st.
M/S/P Hunt/DeLapp - to direct Larry Bohrer to prepare the minimum City participation assessment and
maximum City participation assessment proposal for reconstruction of County Road 13 to be presented
at the May 7th Council meeting for discussion. (Motion passed 5-0).
7. PARKS/MAINTENANCE:
A. Request for approval of summer help
Park Supervisor, Mike Bouthilet, asked for Council approval of re -hiring Bill Leary at $6 per hour to assist
him in the Parks. Mr. Leary would start April 22 and work through September, weather permitting.
Money was budgeted for summer part-time park worker to cover this expense.
M/S/P DeLapp/Johnston - to approve the hiring of Bill Leary at $6 per hour for work in the Parks
Department under the supervision of Mike Bouthilet from April 22 through September, 1996. (Motion
passed 5-0).
8. PLANNING, LAND USE & ZONING:
A. Ordinance 8133, Excavating and Grading
As directed by the City Council, the grading and excavating ordinance has been modified to reflect the
recommendations made by the Council and City Attorney. These included: 1) A grading permit shall be
issued for moving 50 cubic yards of material., 2) A public hearing is required for the moving of 400 cubic
yards of material, and 3) Grading permits which require administrative review may be approved by the
City Administrator upon recommendation of the City Planner and City Engineer.

M/S/P Hunt/DeLapp - to adopt Ordinance 8133, as amended, (Page 4, Item 11. Insert "letter of credit" in
place of "bond") An Ordinance adding Section 502.050 Excavating and Grading to the 1979 Lake Elmo
Municipal Code. (Motion passed 5-0).
B. PR96-11 Site and Plan Review - River Valley Church
This is a site and plan review for modifications to a previously approved plan for River Valley Christian
Church. The Planning Commission approved the plan at their April 8,1996 meeting with the (7)
conditions presented in the City Planner's review dated April 16, 1996. The Council received a letter from
Don Rolf, The Architectural network Inc. addressing the conditions of approval dated April 16, 1996.
M/S/P Hunt/Conlin - to approve Case No. PR/96-11 Site and Plan Review for the River Valley Church as
conditioned in the City Planner's review dated April 16, 1996 and amended by adding Condition #8. A
maximum sign height of 6 feet with a maximum face of 32 sq.ft. as recommended by the City Planner.
(Motion passed 5-0).
C. Request for Fence between Torre Pines Armstrong common lot line
The City received a request from Thomas Armstrong for a fence along the common lot line of his property
and Torre Pines and a letter from Attorney Filla explaining the procedures the City should follow and the
Statutes that govern this request. The City Attorney suggested the Council set a date for an on -site visit
to the property.
M/S/P Johnston/DeLapp - to set May 1, 1996 at 7:00 p.m. to meet at the entrance of Torre Pines to view
the common border of Torre Pines and the Armstrong Property to determine if a fence is appropriate and
if so what kind of fence. (Motion passed 5-0).
D. Comp. Plan/Open Space Development Update (Continued)
Administrator Kueffner reported the City Planner has recommended that the Council direct the Planning
Commission to hold a public hearing on May 8, 1996 on the Open Space Development Ordinance,
Comprehensive Plan Amendment, and review the moratorium to decide whether to allow it to terminate or
extend it for a length of time. Larry Bohrer agreed with the statements made by the City Planner on her
cover letter, that there are three major issues that have not been resolved yet; the overall densities,
minimum lot size, and septic system issue.
M/S/P Hunt/John - that the City publish the public hearing notice for a special Planning Commission
meeting for May 8, 1996 at 7 p.m. for a public hearing on the Comprehensive Plan Amendment and
adoption of the Agriculture/Open Space Preservation and Development Overlay District Ordinance and
review of the Development Moratorium. (Motion passed 5-0).
9. CITY ATTORNEY'S REPORT:
Attorney Filla reported we have received an agreement signed by Sue Sampson which will require the
City's signature and then this lawsuit has been resolved.
10. CITY COUNCIL REPORTS:
Councilman Hunt reported that at the March MAC meeting they have developed a system for requesting
work to be done. A Work Information Request will be drafted which will be filled out by the MAC Chair
and submitted to the City Administrator for distribution to the staff.

11. CITY ADMINISTRATOR'S REPORT:
A. Effective Meeting Procedure Class
Joan Kastern provided a brochure on an effective meeting procedure class. Her charge would be $300
plus travel expenses.
M/S/P DeLapp/Johnston - to authorize the City Administrator to approve a seminar for two Saturdays in
June and the Council was asked to write down June dates when available and submit to the
administrator. (Motion passed 5-0).
M/S/P DeLapp/Hunt - to adjourn the council meeting at 10:55 p.m. (Motion passed 5-0).

A Strategy for Lake Elmo's Natural Resources:
An Ecosystem -Based Plan
INTRODUCTION: Lake Elmo can serve as a model for other communities by initiating an innovative
natural resource management strategy. This strategy will incorporate social, economic, and
environmental components to establish an ecosystem -based approach to planning and management.
ISSUES:
* Citizens are concerned about development in and around Lake Elmo. Can Lake Elmo's small-
town, rural character be maintained with the current level of development pressures?
* Lake Elmo's current and future development has a direct influence on development activities
throughout Washington County.
* Currently there is a lack of available data biological resources, hence a critical information
component is lacking for the planning process.
* Without a comprehensive development plan, land owners are uncertain about the role their
property may have in current and future development.
OPPORTUNITIES:
* The combination of aware citizens, innovative municipal leadership, involved natural resource
managers will allow development to occur while preserving and maintaining ecological integrity.
* A biological inventory will provide a resource for Lake Elmo citizen action that reflects the
natural character of Washington County, and provides an additional resource to make effective
land use management decisions.
ACTIONS/STEPS:
Step 1: Meet with Ann Pung-Terwedo, City Planner to discuss Lake Elmo'snatural resources.
Step 2: Gain approval for a natural resource management strategy.
Step 3: Promote the strategy:
1. Write an article for the Lake Elmo Newsletter
2. Organize an informational workshop open to all Lake Elmo citizens
3. Identify natural resource inventory volunteers
Step 4: Natural resource inventory:
1. Train volunteers on natural resource inventory techniques and plant identification,
and form data collection teams
2. Select inventory sites
3. Collect data for each site at three times (spring, early summer, late summer)
4. Analyze and compile data
Step 5: Organize an informational meeting for Lake Elmo citizens on natural resource inventory results.
Why Pursue an Ecosystem -based Natural Resources Management Strategy? /
By examining our natural resources, we can develop an organized way to give priority to natural systems
planning within the context of overall community planning. Recognizing that development will continue
to occur, we must design strategies that allow for development, yet also maintain and expand the natural
resources inherent within the city as well as surrounding communities. Ultimately, Lake Elmo will
become a community that is sustainable and in balance within the ecosystem.
Proposed Natural Resources Inventory Procedure:
Using existing aerial photographs, determine approximate acreage of forest, prairie, wet meadow cover
and agricultural land. Select between 40 and 50 sites within the forest, prairie and wet meadow areas to
gather data and information on the following:
L Tree identification (nearest neighbor tree analysis)
2. Shrub identification (2 meter plots of shrub species and stem counts)
3. Herbaceous plant identification (1 meter plot of species and percent cover)
4. Litter layer analysis (duff and humus estimates)
5. Site photos
6. List of animal signs
7. List of animals sighted
Identify and train volunteers to collect date and information at two sites per workday. Collect data for
each site at three times (spring, early summer and late summer), to assure all relevant information has
been collected.
Data and information will be analyzed to determine a profile of the natural resources of Lake Elmo. We
hope to identify areas of special significance, construct lists of plants and animals in their natural
habitats, and ultimately map natural corridors linking plant and animal communities.

Dated April 15, 1996 Conditions of approval.
1) The easement issues must be clarified by the submission of the certificate of survey.
Response - Drawings submitted and approved by city planner.
2) Permission from NSP for the construction of the parking lot in the NSP easement.
Response - See attached letter dated 04-15-96 from NSP.
3) An access permit from Washington County must be submitted.
Response - See attached permit.
4) A sign plan must be submitted which meet the requirements of the code or as recommended by
the city planner.
Response - A plan and elevation have been submitted to the city planner. The city planner
has comments which need to be discussed with Pastor Dan Dennison. Unfortunately The City
Planner and Pastor Dan are both currently on vacation and cannot be reached.
We request the City Council approve the site plan review at this time with a contingency that the
sign issue is resolved.
5) The grading and erosion control plan must be revised an approved by the city engineer.
Response - The city engineer has contacted Pioneer Engineering to relay concerns which
are currently being addressed.
6) The city planner shall review and approve the planting schedule in order to determine the
extent of the trees removed along highway 36. The intent of this review is to insure that the tree
buffer will not be greatly impacted.
Response - We are waiting comments from the city planner.

I had a phone conversation today with Dan Rolf, Architectural Network, Inc., who have been
retained by River Valley Christian Church, and are revisiting a project that NSP responded to
on November 8, 1969. The church is considering purchasing land under and adjacent to the
above referenced transmission lines. I am enclosing a copy of NSP's Transmission
Encroachment Policy for your review.
As you can see, the allowable encroachments have not changed since 1989. Structures,
permanent or temporary, and tall growing trees are not allowed to encroach the easement.
Any grade changes under and around lines or structures need to be approved by NSP
transmission engineers. If vehicles are allowed to park next to line structures, guard rail
barricades, 6 inches in diameter, filled with concrete must be installed a minimum of 5 feet
from the foundation of our structures.
