Mayor John called the council meeting to order at 7:05 p.m. in the council chambers. PRESENT: Hunt, John,
Conlin, Johnston, DeLapp, City Engineer Bohrer, City Attorney Filla, City Planner Terwedo and Administrator
Kueffner.
1. AGENDA

4. PUBLIC INFORMATIONAL:
A. Update on Kunz Oil Clean-up - Highway 5 and County Road 15
The Council received a copy of a letter, dated March 27, 1996, from the MPCA. City Planner Terwedo explained
to the City Council that Kunz Oil gas station at the intersection of Hwy 5 and Co. Rd. 15 has been sold to Cenex,
and the letter from MPCA addresses that site. The system building for recovering contamination of the site has
been removed as it has served its purpose, and the MPCA indicated findings and recommendations for continued
monitoring of the site, in their letter. The bond which the City is holding will be released to the bank it came from.
B. Letter of intent to submit an application for a Comprehensive Plan Amendment
and Rezoning (from RED to PF) on Ziertman property located on Hwy 36 & Keats Ave.
The Council received a letter of intent from the Lakewood Evangelical Free Church indicating its intent to
purchase property owned by the Ziertmans at the southeast corner of Hwy 36 and Keats Ave., to construct a new
facility. Mr. Charles Palmer, Church Chairman, introduced supporting members from the congregation. There
are 200 members in the congregation and as the Church cannot expand on its current site, it intends to relocate
the entire church to the new property. The parcel is approximately 100 acres and it intends to keep a lot of green
space for recreational activities. Ken Larson, 8200 Hidden Bay Tr., outlined the ministry statement of the church,
and stated the building committee is working with BWBR architects for design of the church. No concept plan
was presented. The Council thanked the group, and indicated they cannot make an indication of
recommendation tonight.

C. Maintenance Building Update
City Planner Terwedo updated the public and Council on the development of the Maintenance Building. Monday,
May 20, the Maintenance Advisory Committee met with the Council and discussed the existing City facilities.
There was discussion of moving the Parks Dept. to the existing Public Works Facility with the Fire Dept.,
Lakeview Ambulance relocating to the Parks Building. Then focus turned to the development of the proposed new
facility. The issues of the garage structure and future equipment was discussed, and Councilman DeLapp will
develop several alternative concept plans for review by the MAC and Council. There will be another Joint meeting
with the Council and the MAC on June 3, and the City will move forward on design and development of the
facility.
5. UNFINISHED BUSINESS:
A. Armstrong: Conditional Use Permit Amendment
City Planner Terwedo advised the City Council of the Planning Commission action at their April 22, 1996,
meeting. City Attorney Filla read the resolution to the council. Administrator Kueffner handed out copies of a
resolution to the Council. The Council made the following motion:
M/S/P Conlin/John - to adopt Resolution No. 96-9 denying the request of Thomas G. Armstrong, Thomas P.
Armstrong, and Jodi Armstrong for an amendment to an existing Conditional Use Permit. (Motion passed 4-0-1;
abstain: DeLapp - he was not on the Council at the time the application came in.)
Tom P. Armstrong was recognized by Mayor John. Mr. Armstrong read a prepared statement to the Council
(labeled for reference as Exhibit A). Mr. Armstrong stated his concern of being a legal non -conforming use. The
Council discussed differences in opinion of open space preservation. Mr. Armstrong indicated they will use every
legal means available to preserve their farm. Tom G. Armstrong was recognized by Mayor John and indicated
the Armstrong family will pursue this issue.
B. Armstrong: Request for fence along common lot line with "Torre Pines"
The Council received a cover sheet prepared by City Administrator Kueffner with background information
regarding this issue, and a copy of a letter, dated February 16, 1996, prepared by City Attorney Jerry Filla,
accompanied by a copy of MN Statute Chapter 344 Partition Fences.
Mayor John recognized Tom Armstrong. Tom G. Armstrong stated, to the City Council, he may have to look into
raising cattle on his property, therefore, requests a 48 inch high, 4 strand barbed wire fence. Mike Black,
representing Royal Oaks Realty and James Meehan, advised the City Council that they do not need a fence and
do not want a fence, and that Mr. Armstrong has not shown proof of his intent to have cattle; none of the property
has been fenced. Mr. Black stated that if a fence must be constructed on the common property line their
preference is a 48 inch high woven wire fence because barbed wire is not compatible with residential dwelling,
and requested the City Council define the construction of the fence. To be a fair process, Mr. Black indicated they
would require bids for construction of the fence, an escrow of Armstrong's portion, Mr. Meehan's portion and
Royal Oaks portion. Mr. Black stated they will only accept a certified survey of the property line, and requests the
notice of claim be removed from the property. Mr. Armstrong stated he would construct the West half section of
the fence and take care of that half of the fence, and would do the survey. Mr. Black stated he will follow the City
Council's direction, but wanted it made clear that any work done by the Armstrong's before Royal Oaks contacts
them will not be reimbursed by Royal Oaks or the Meehan's, and he is not agreeing to any decisions made by Mr.
Armstrong tonight.
The Council discussed their options and was not comfortable with barbed wire. Mr. Armstrong stated woven wire
would prohibit small animals from moving freely. Mr. Black requested the City Council table this issue, before
passing a motion, until he has time to consult with his firm's attorney regarding type of fence, section of fence,
and date.

MIS/P Hunt/Conlin - that the City Council acting as fence viewers finds that a fence is required for the refereed
property, a fence shall be constructed, the fence shall be constructed on the common property line, the property
line will be surveyed by a certified surveyor, the fence shall be constructed of poles and four (4) strands of wire -
the two bottom strands being non -barbed wire, the top two strands of barbed wire, that Mr. Meehan and Royal
Oaks Realty will have their choice of which section - East or West section of fence line they choose to fence and
they will notify Mr. Armstrong within 10 days from May 22, 1996, the fence will be constructed by November 1,
1996, unless an extension is requested at least 2 weeks prior to Nov. 1, 1996, the fence will be 48 inches high.
(Motion passed 5-0.)
City Attorney Fiila indicated, when asked by Council, that the notice of claim is a private matter between the two
property owners.
C. Clean-up Day
City Administrator Kueffner stated she met with Vasco Garbage Hauling, who proposed to hold Clean-up day for
the City. Administrator Kueffner contacted the Lake Elmo Baptist Church for use of their parking lot area for
clean-up day. Dates available are June 15 or June 22. Administrator Kueffner stated a cost estimate was
provided comparable to Oakdale Clean-up Day. Administrator Kueffner proposed a sticker sale of $10.00 to
defer the cost. Limiting tires was suggested. Dan Olinger suggested a deputy be on duty for traffic control.
Clean-up day will be held from 8:00 a.m. to Noon.
M/S/P John/Johnston - to hold Clean-up Day from 8 to Noon, on June 15 or 22, at Lake Elmo Baptist Church, at
a cost of $10 per Lake Elmo Resident, only, and permit a Washington County Deputy to be on duty for traffic
control, and staff to decide limit on tires and any appliances. (Motion passed 5-0.)
Council member Conlin wanted to be assured the charge from Vasco will be based on a per dumpster cost and
not an hourly or daily cost, and that notice be in the Newsletter, and for it to be broadcast on cable as well to
notify the public.
D. Effective Meeting Procedures
MIS/P Hunt/Conlin - to call a special meeting of the City Council, and all City Commissions and Committees for
Saturday, July 13, 1996, and Saturday, August 10, 1996, from 9:00 a.m. until noon for a workshop on Effective
Meeting Procedures, and authorize staff to enter into an agreement with Jean Kastner. (Motion passed 5-0.)
Council member Johnston cannot make the dates, therefore, the sessions will be video taped.
E. Set Date for Council/Solid Waste Advisory Committee Joint Meeting
M/S/P Johnston/Conlin - to call a joint meeting of the City Council and the Solid Waste Advisory Committee for
June 6, 1996, at 6:00 p.m. to discuss Organized Collection, and that discussion of Composting be included on
that meeting agenda. (Motion passed 5-0.)
6. CITY ENGINEER'S REPORT:
A. CSAH 13 Discussion on Assessments to benefiting property owners; call public hearing
City Engineer Larry Bohrer was previously directed to prepare a sample assessment roll based upon strict
application of the newly adopted assessment policy. The new assessment policy did not define "Front" or the
"Front of the Lot" for assessment purposes. The City Code's definition of "front" states to use the short side of
the lot. Administrator Kueffner explained that was not the intent of the policy; the intent was to not split
assessments on corner lots --that a corner lot pays one assessment and that would be on the "address" side of
the Lot. .

M/S/P Hunt/Johnston - to approve the amendment to the Lake Elmo assessment policy to include a definition of
"front of lot". (Motion passed 5-0.)
Larry Bohrer explained the assessment policy states the abutting property shall be assessed based on zoning
category, and the Council will set the appropriate rate for each zoning category. These rates shall be equal
throughout the City independent of project scope. It does not appear there will be another street reconstruction
project in the City this year. The assessment rates for overlay projects can be different than those for
reconstruction projects. The Council adopted the following rates for 1996 Reconstruction Projects: R-1 - $1,000
per lot, RE - $1200 per lot, and RR - $1400 per lot.

M/S/P Hunt/Johnston - to approve the assessment rate for 1996 reconstruction projects as outlined in the City
Engineer's memo dated May 17, 1996. (Motion passed 5-0.)
The County has reminded the City that the final cost ($37,043.43) is still subject to some variation due to final
construction cost. The City has applied for qualification for use of Municipal State Aid (MSA) funds for its share.
The estimated MSA funds available for this project is $15,537.00.
Financing Plan: Amount Assessed $17,400.00
MSA FUND $15,537.00
Infrastructure Repair Fund $ 4,106.45
The assessment rates and financing plan were acceptable to the Council and an Improvement Hearing was
called for June 18,1996.
M/S/P Hunt/DeLapp - to direct the staff to call a CSAH 13 (Inwood Avenue) Improvement Hearing for June 18,
1996. (Motion passed 5-0.)
B. Update on CSAH 13 Construction Schedule
City Engineer Bohrer advised the Council that Arnt Construction proposes to start construction on CSAH13 the
second week in June, at the North end and work towards the south. Arnt will bring in sand as they dig sections
as to not leave huge drop-offs. The construction will extend past Labor Day, however, the first layer of
bituminous will be laid by the beginning of the school year. The road will be closed to through traffic - which
means area residents only, and will be enforced 9 need be. The work schedule is proposed to be 10 hours per
day, Monday through Friday. The Council directed Mr. Bohrer to investigate the "stake" placement, as some
stakes look as though they are too far into the Regional Park and Eberhard's property.
C. Update on Valley Branch Project
City Engineer Bohrer reported progress has been made with the contractor as far as complying with the
specifications in the contract. Street grading and restoration follow the pipe laying unit so that the pipe laying
doesn't get more than 300' in advance before they start restoring the road. The restoration begins at the east end
on Wednesday of this week. Bohrer has insisted that the project be patrolled by contractors personnel twice a day
on weekends. Dan Olinger has a list of after hour contact names and telephone numbers. Density depths were
taken, but he has not received results. Jeff Stanway, 8455 Lake Jane Trail, voiced his concern on public safety
and traffic maintenance. In the contract there is a sentence that states in all cases the contractor shall provide
and maintain vehicle access to all homes, Stanway asked why that is not being enforced. Attorney Filla advised
this is a project between VBWD and the contractor constructed within a City street, but the primary responsible

party is the VSWD. The City of Lake Elmo will take the concerns into account and talk to the appropriate people.
It would not be inappropriate for Mr. Stanway to also address his concerns to the VBWD and their consultants.
D. Other- Bidding Schedule for Section 33 Utilities
M/S/P Johnston/Hunt - the City Council will meet at 6:00 p.m. on June 7 to review bids for Section 33. (Motion
passed 5-0.)
M/S/P Hunt/John - to postpone Section 33 utility bid opening to Friday, June 7, at 10:00 a.m. (Motion passed 5-
0.)
M/S/P Hunt/Conlin - to move agenda item 7A - C. to follow 8G. (Motion passed 5-0.)
7. PLANNING/LAND USE & ZONING:
A. Case No. ZAT/96-12: Zoning Text Amendment - Ordinance adding Light Manufacturing as a
Conditional Use in Limited Business and redefining "Use Determination"
City Planner Terwedo reviewed the background of this amendment and advised the Council that a public hearing
was held by the Planning Commission and recommendation of approval of the amendment was unanimous by
the commission. Mayor John recommended such facilities be limited as to the number of employees per facility.
City Attorney Filla suggested some verbiage be amended.
M/S/P Johnston/Hunt - to table this item to allow staff to review wording and number of people allowed in such
facilities, to the June 4th meeting. (Motion passed 5-0.)
B. Public Hearing: Case No. SUBN/96-14: Minor Subdivision of a 76 acre parcel into a 12 acre
parcel and a 64 acre parcel, with variance to lot ratio. Property located at 6193 and 5275 Keats
Ave. N. Applicants: George Dege and Joe Magill
Mayor John opened the public hearing at 10:05 p.m. and asked for public comment. In absence of comments,
Mayor John closed the public hearing at 10:06 p.m.
M/S/P Conlin/Hunt - to approve Case No. Sub/W96-9 as presented by Resolution No. 96-10, with the condition
that the 24 acre parcel cannot be subdivided, based on findings 1 - 6 in the staff report. (Motion passed 5-0.)
M/S/P John/Del-app - to direct staff to instruct the Planning Commission to review the 4:1 lot ratio requirement in
the RR zoning district. (Motion passed 5-0.)
C. Case No. ZAM/96-15 Zoning Map Amendment - Rezone a 12 acre parcel from AG (Agricultural) to
RR (Rural Residential) on property located at 5193 Keats Ave. N. Applicants: George Dege and
Joe Magill.
City Planner Terwedo recommended approval of the request to rezone the 12 acre parcel of land which will be
combined with the existing 12 acres. The map amendment is consistent with the policies in the comprehensive
Plan. The Future Land Use Map does Identify this land as RAD, Rural Agricultural Density (1 unit per 10 acres).
The 64 acre parcel of land will remain as Agricultural. The majority of land uses adjacent to these parcels are 10
acres and are consistent with the Future Land Use Map.
M/S/P Johnston/Del-app - to approve Case No. ZAM/96-15, a zoning amendment to rezone a 12 acre parcel of
land from Agricultural (AG) to Rural Residential (RR) by Ordinance No. 8134. (Motion passed 5-0.)

D. Case No. CPA/96-16 Resolution approving a Comprehensive Plan Amendment establishing
goals, policies and objectives for AOP (Agricultural/Open Space)
The Council received a copy of a staff report prepared by City Planner Terwedo, the Comp. Plan Amendment, a
resolution, copies of the May 13 Planning Commission minutes, and written comments from Planning
Commission Chair Jim McLeod, Mayor John, Council Member Conlin, Brian Herzfeld, Robert Engstrom, and Judy
Screaton. City Planner Terwedo advised the Council that the Lake Elmo Planning Commission held a public
hearing on May 8 and continued to May 13 where they recommended the City Council adopt the Comp. Plan
Amendment as amended. City Planner Terwedo explained discussion and amendments by the Planning
Commission and that the density issue was discussed at length. City Planner Terwedo explained that she has
been working with the Met. Council staff on this amendment and they have been very supportive and helpful.
The Council thanked the City Planner, staff, and Planning Commission for all their hard work, and thanked
Council member Karen Johnston for her attendance and work, as Council liaison.
The Council discussed outlots - that they not be created, what is purpose of cluster concept, and that the different
density zones be labeled as the City does now, i.e., OP-1, OP-2, etc. The Council discussed densities and
density bonuses. Attorney Filla advised the Council that the base density should allow at least what property
owners have now by their current zoning, but probably quite a bit more because we are asking for a 50% open
space. Compare the Ag., RR, and R1 densities which people currently have to what they will end up with, such
as Ag. property can go from 4 units per 40 to at least 10 per 40, so people are being compensated for the open
space.
M/S/P Hunt/Del-app - to amend policy 12 and 14 of the Comp. Plan Amend, to reflect a common base density will
be applied on all Open Space Development areas. Additional densities would be provided in recognition of
development proposals which aim to preserve historical structures, provide for public trails/foot paths, and other
amenities deemed desirable. The density shall not be less than 6 units per 20 acres nor more than 10 units per
20 with density bonuses. (Motion passed 5-0.)
M/S/P Hunt/Johnston - to advise staff to update any maps or figures or tables affected by the amendments made
to the Comp. Plan tonight. (Motion passed 5-0.)
M/S/P DeLapp/Johnston - to adopt resolution 96-11 adding text and amending the future land use map of the
1990 Lake Elmo Comprehensive Plan relating to Agriculture/Open Space. (Motion passed 5-0.)
E. Case No. ZAT/96-17 Zoning Ordinance adopting Agricultural/Open Space (AOP) zoning district
The Council received copies of the AOP ordinance and minutes of the May 13 Planning Commission meeting.
City Planner Terwedo advised the council that the Planning Commission held a public hearing on May 8 and
continued to May 13 where they recommended the City Council adopt the Agricultural/Open Space Development
Ordinance as amended. City Planner Terwedo reviewed her staff report which outlined the amendments
suggested by the commission, and recommended a couple more changes.
M/S/ DeLapp/Johnston - to adopt Ordinance 8135 establishing and regulating the use of property located within
the Agricultural/Open Space Preservation District, subject to approval by Met. Council of the Comp. Plan
changes.
The Council struggled with the issue of how to figure a density bonus for preserving historic structures. Jack
Buxell suggested the density bonus over 6 units per 20 as follows:. 2 units per 20 for clustering, 1 unit per 20 for
pathways, 1 unit per 20 for perhaps aerobic septic systems, and 1 unit per every 2500 sq.ft. of historic structures
preserved.
The Council discussed amendments to several pages of the ordinance. City Attorney Filla suggested the
l ordinance be tabled to the next meeting for council to see the final draft, because the density section needs some
significant re -writing to agree with the amendment made tonight to the Comp. Plan's density section.

MIS/P Johnston/Conlin - to table the motion, to adopt Ordinance 8136 establishing and regulating the use of
property located within the Agricultural/Open Space Preservation District, subject to approval by Met. Council of
the Comp. Plan changes, to the next Council meeting, June 4. (Motion passed 5-0.)
F. Moratorium Recommendation from Planning Commission
M/S/P Johnston/DeLapp - to extend the Residential Moratorium until such time as the Comprehensive Plan
Amendment is approved by Met. Council or until the City Council adopts an ordinance rescinding the moratorium,
but in no case shall the moratorium extend longer than two months. (Motion passed 5-0.)
8. PARKS/MAINTENANCE:
A. Amendment to City's Purchasing Policy
In May, 1996, the Council directed the staff to amend the City's purchasing policy to conform to state law.
Accordingly, the mower that was just bid did not require a sealed bid. Mike Bouthilet, Parks Supervisor, has
requested that all bids be rejected.
M/S/P John/Johnston - to approve the amendment to the City's Purchasing Policy to reflect conformance with
State Law. (Motion passed 5-0.)
B. Reject Bids for Mower for Parks Department
M/S/P John/Del-app - to reject all bids received for a mower, per the recommendation of the Parks Supervisor.
(Motion passed 5-0.)
C. Review Mower quotes for Parks Department (and receive recommendation from MAC)
M/S/P John/Conlin - to table the purchase of a mower for the Parks Dept. (Motion passed 5-0.)

Steve Delapp questioned the commiment of Lakeview Hospital to use the parks building and the
Parks Department needs. Mike Bouthilet stated that the Parks Department close to Reid, VFW,
Lions, and Tablyn is efficient but so is being closer to the parks in the TRI-Lake Area.
Dick Johnson questioned the costs to upgrade the building. Lake view Hospital will be upgrading
the building.
Ann Pung-Terwedo reviewed the plan for the existing maintenance building and how the building
may be modified to accommodate the Fire Department and Parks.
Mike Bouthilet stated the Jayceess may be interested in the parks building.
Ann Pung-Terwedo reviewed the cold storage building and the future uses of that based on the
Public Works Department and Parks.
Dick Johnson stated that the city needs a second civil service siren.
Dick Johnson questioned the compost site. Karen Johnson reminded him that this is separate is-
sue.
Rita Conlin asked about the CIP for new equipment. Dan Olinger stated that the Public Works
Department will need a new truck and snowplow within 5-10 years. Since 1984, the department
has added a fourth snowplowing route and the parks department became its own department.
Performance of contracting services vs. City service was discussed.
Bill Wacker stated he has experienced good vs. bad contractors vs. staff.
Rita Conlin questioned the cost sharing effort at Washington County. Could Lake Elmo share
with the County?
Bill Wacker felt that the building should be built for 15-20 years. What are the future needs of the
facility?
Steve Delapp questioned whether or not the building inspectors car should go in the building.
Karen Johnston questioned the deep bays as shown on the plan Lee hunt adde that there may be
possibility that some of the items could be pulled out of the building.
Dan reviewed what the existing cold storage areas will be used for.
Steve Delapp had concerns regarding the proposal as outlined. Mr Delapp will meet with Dan
Olinger before the next meeting and three alternative scenarios will be developed for discussion.
Mayor John asked if the building should accommodate meetings. Karen Johnston stated that the
city may need the space. Ann Terwedo stated that the building committee did not like a meeting
room.
Rita Conlin questioned the future needs for cold storage. Additional storage should go on the
north side of the building.
The next joint meeting with the MAC and Council will be June 4, 1996.
